powers unite. hi, good morning. i'm thomas roberts. it's wednesday, january 15th. and we start with this, the potential reach of the national security agency into our personal lives just got a little bit larger. "the new york times" reporting the nsa has used surveillance technology to infiltrate roughly 100,000 computers worldwide. now, the software, which utilizes a secret channel of radio waves can transmit data, even if the computers are not logged in to the internet. the nsa calls this digital pathway a "active defense" against foreign cyber attacks. so far, there is no evidence the nsa has used this technology here at home. now, the agency is not commenting on the extent of this program but says it does not compare to similar ones used by the chinese government. now, on friday, president obama is expected to announce several changes to the nsa. among the recommendations the president is considering, a revision of how the government uses software flaws to assist surveillance and prevent cyber attacks. two students are in the hospital this morning after

another school shooting. this happened yesterday at a middle school in roswell, new mexico. authorities say a 12-year-old boy opened fire in the gym with a sawed-off shotgun. the suspect shot an 11-year-old boy and a 13-year-old girl. officials say there is information that suggests he warned several students not to attend class. the entire incident lasted ten seconds. >> i just seen him run in there and then shoot, and then the guy was on the ground and he was covering his face crying. >> at this hour, the boy is in critical condition after two surgeries, the girl listed in stable condition. parents and police are praising the courageous teacher who officials say convinced the shooter to put down his weapon. >> it's one thing for an armed state police officer to enter a school and do his or her job, it's another thing for a teacher or staff member to intervene in a situation like this. >> all right, so, the families, the suspect's family, that is, expected to release a statement later today. the school will reopen tomorrow.

governor chris christie is calling for a longer school day, pension reform and an answer to crime, but that wish list was overshadowed by the persisting george washington bridge scandal. >> thank you. >> now, as you see there, christie entered the capitol to a standing ovation that carried on even after he had taken the podium. he quickly addressed the controversy head on. >> now, without a doubt, we will cooperate with all appropriate inquiries to ensure that this breach of trust does not happen again. but i also want to assure the people of new jersey today that what has occurred does not define us or our state. this administration and this legislature will not allow the work that needs to be done to improve the people's lives in new jersey to be delayed for any reason. >> but it remains to be seen how

much christie can get done in the scandal's wake. democrats dismissed much of the governor's address as talking points, accusing him of playing bait and switch with public pensions. they also released a web video calling the scandal an embarrassment. meanwhile, the "wall street journal" has photos of governor christie with david wildstein, the port authority official who authorized the bridge closures during one of the days of the closures. now, christie has said he had not had contact with wildstein in a long time. wildstein's there in the red tie. another official involved, bill baroni, was reportedly on hand as well. both have stepped down. in a sign that the scandal extends beyond the garden state, senator jay rockefeller says his transportation committee is "ready to pounce," indicating there could be hearings in washington. and senator carl levin said "you have to not have a nose if you don't smell something." today's twitter question is chris christie-related. we want to know, what didn't the governor say during the state of the state address that you really wanted to hear? tweet me your best, most

creative answers using #waytooearly. we are going to put the best answers on the air later in the show. keep it clean. 1.3 million americans waiting for congress to restore their unemployment benefits are going to have to wait a little bit longer. yesterday the senate dismissed motions on two different proposals, one to extend benefits by 11 months and another offering a 3-month extension, but they ended with no immediate plans to restart negotiations. yesterday, president obama commented on the gridlock in washington, vowing to push forward if congress proves to be unwilling. >> i've got a pen and i've got a phone, and i can use that pen to sign executive orders and take executive actions and administrative actions that move the ball forward. >> now, the earliest the lawmakers could possibly restart the talks will be after next week's senate recess, but for now, the upper chamber's focus shifts to the $1.1 trillion spending bill. later today the bill is expected to pass through the house, and the senate hopes to pass it by the end of this week.

israel's defense minister is apologizing for some harsh comments about secretary of state john kerry. that official, mosha yallon blasted kerry's efforts to broker a middle east peace deal. he said sec kerry "operates from an incomprehensible obsession and a sense of messiahism and he can't teach me anything about the conflict with the palestinians." he went on to say "the only thing that might save us is if john kerry wins the nobel prize and leaves us be." the remarks triggered a tough response from the white house and state department as well, which called them offensive and inappropriate. the defense minister later issued a statement saying he apologized if the secretary was offended. the husband of a pregnant and brain-dead woman is suing the hospital that is keeping her ali alive. erick munoz filed an emergency motion to take his wife, marlise, off life support. he says his wife made it very clear she did not want to be kept alive in that state.

now, the hospital says it cannot do that, citing that a texas law prohibiting hospitals from withdrawing or withholding life-sustaining treatment from a pregnant patient. the hospital can detect a fetal heartbeat, but it does not know how healthy or viable the fetus is. but mr. munoz argues the law does not apply to his wife's case since she is dead and not a patient. marlise munoz was 14 weeks pregnant when she was found unconscious in november. doctors believe she suffered a pulmonary embolism. it is being called a big win for supporters of marriage equality. a federal judge yesterday ruling oklahoma's ban on marriage equality as unconstitutional. same-sex couples won't be able to say "i do" right away, though. the decision was stayed pending appeals. now, the judge says the ban went against the equal protection clause of the 14th amendment. republican governor mary fallon said she is disappointed, since the ban was approved by voters nine years ago. now, utah's ban on marriage equality was also ruled

unconstitutional, you'll recall, last month. now we move on to the business headlines of the day, and wall street will look to build off the momentum that we witnessed in yesterday's closing. all three indices posted gains. in fact, yesterday was the market's strongest performance of the year. look at the dow jones, up by 115 points there. cnbc's geoff cutmore is live in london for us. geoff, this was a good day yesterday, but we have been off to a slow start for 2014. >> yeah, it's been a little slow and steady, but markets seem to be improving, which has got some people in the internet space a little bit riled up about a net neutrality story here. so, let's get on to that. a federal court ruling that service providers can do deals with who they like for content. the fcc was hoping that they could prevent some of these major commercial tie-ups, so it means that some of the bigger, richer businesses like netflix can do exclusive deals here. the regulators and consumer

advocates are concerned that this may ultimately cost consumers a whole lot more when these large commercial entities push up prices for their services. moving on, fascinating story if you're a bit of a car nut, like i am. the f-150 -- this is the ford pickup -- is going to get an aluminum body. i think you folks say aluminum. whichever way you cut it, it's a very light metal, it's going on the bodies of these cars, and ford says it will help cut down costs on fuel because they're going to shed, what, 700 pounds by putting this new chassis or this new body on the chassis. my question is, though, this is still a 3 1/2-liter v-6 you're running in this car at face model. that's still a bit of a gas guzzler. thomas, back to you. >> aluminum? is that how you say it? >> aluminum. >> oh, that. i thought we were talking about alimony payments or something like that.

anyway, let's move on, because now we've got -- and full disclosure here, the weather channel is part of the information family -- but we've got sam champion, al roker, jim cantore, all tweeting up firestorms about the fact that the weather channel has now been dropped for 20 million directv customers, and it doesn't seem like they've got a compromise in the works any time soon. >> yeah. i mean, 20 million viewers on directv will now lose access to the weather channel. directv saying, look, this is not just about money in the distribution deal, this is also about the fact that the weather channel runs a lot of reality tv. oh, yeah, right. when it comes down to it, this is about hard dollars and cents here. and for the time being, directv and the weather channel cannot find a compromise on the distribution terms. directv say you're not going to miss the weather because they have weathernation, which will put the story out there instead. back to you. >> you know what we say about the weather channel here, make it rain up in here. it's all about the money, right? all right, anyway, still ahead on "way too early" -- that made

fans of the heat. they're from both parties. because we all know, nothing brings people together like the miami heat. this group has now won twice, but it's gone to the finals three times. and sometimes it feels like they're still fighting for a little respect. i can relate to that. >> all right, so, to sports now. at a time when the nfl wants us talking about its final four, there's an update to the $765 million concussion settlement reached with the union last year. a federal judge is asking for more information on whether the settlement is enough to cover 20,000 retired players. the league came to the agreement with retired players before the season, hoping to avoid individual lawsuits with the more than 4,500 players who filed lawsuits, saying that football caused brain injury. the nfl has said the settlement was an effort to do the right thing. critics say the $765 million is a small price to pay, considering the league's annual revenue of more than $9 billion.

proponents argue the settlement benefits those players who need immediate financial assistance in dealing with their injuries. the nfl has yet to comment on that delay. all right, so, a couple big finishes last night in college basketball. we start with unbeaten number three wisconsin hosting indiana. the game with just under 3 minutes to play. indiana's yogi ferrell drills the three-pointer to give the hoosiers the lead. final seconds, indiana up three, wisconsin misses the three, but they get the ball back for another shot. air ball. indiana runs out the clock. did you see that? a lot of air. gave wisconsin their first loss of the season, 75-72. to arkansas, the razorbacks hosting number 13 kentucky. final seconds of regulation when the wildcats' andrew harrison drains that three-pointer to tie things up, send this one into overtime, but it was arkansas's turn in o.t. >> final 7 seconds. >> got to drive it, brad. you've got to drive it.
