into thin air. more than five days now, and still more questions than answers on what happened to that missing malaysian jetliner. authorities admit they don't know which way the plane was going when it vanished with 239 people on board. the malaysian military now says its radar has tracked the plane as it doubled back over the malaysian mainland and a small island in the strait of malaca. officials say mechanical failure, pilot error, sabotage or terrorism are all still causes of the disappearance. >> the authorities in malaysia and the united states and other countries are pulling all that's possible to see whether tourism played any role in the disappearance of the aircraft. this really is quite disturbing. malaysia airlines says its focus is to care for the passengers' families who are still desperately waiting for answers. they're providing them with meals, lodging, and medical

support at no cost. "we have 115 family members in kuala lumpur. something that is expected to have rippling affects across the nation. alex sig about 3,400 votes in a special congressional election. both parties poured more than $11 million into the race. the gop going into november's midterms. at the center of the election was the affordable care act. his democratic opponent did not. on tuesday the administration revealed 4.2 million americans had signed up for health plans. open enrollment ends march 31st. brand new poll numbers out this morning. how rough the midterms could be for democrats. according to the nbc news-wall street journal poll president obama's approval rating stands at 41%. that's done nearly ten points from a year ago.

his numbers are bleeding over. one-third of americans say their numbers this november will be based on opposition to president obama's policies. those numbers aren't good for anyone. >> no, they're not. especially for the democrats or the president. this is a bad poll for them. however, we need to put it in perspective. at the same time in his presidency, president bush's numbers were even lower. 37% approval rating. what really stands out here for president obama is how many democrats appear to have turned on him. 20% of democrats disapproving of the president of their party. that's a record high for president obama. now, taking a look at some of the other results from our overnight poll. who should control congress? republicans now have a very slight 1% edge on that machine, but it's all split when you take into account the margin of error. what about congress? our polls are showing over and over people are really frustrated with washington.

the cia's search may well have violated the separation of powers, principles embodied in the united states constitution. feinstein's charge that the cia hacked secure computers the senate was using, tried to hide the smoking gun of brennan's own policies. brennan oversaw the cia secret prisons and the controversial investigations of terrorism suspects under george w. bush. yet, the council on foreign relations, brennan denies he has interfered with the senate investigation. >> if it is proved that the cia did do this, would you feel that you had to step down some. >> if i did something wrong, i will go to the president, and i will explain to him exactly what i did and what the findings were, and he is the one who can ask me to stay or to go. >> brennan's counter charge in this letter to the senate obtained by nbc says the senate staff improperly took documents from the cia. brennan wrote, "it is imperative to learn whether a breach or

"the senate says it was only trying to safeguard proof of cia abuses, fearing the cia would destroy the evidence." >> cia's brennan says the president has great confidence in him. had might make you grateful for the security cameras out there. thanks to eight surveillance cameras in a las vegas puppy store there's immediate evidence of a january incident involving two people, one said to be the owner, sneaking in and setting it on fire. the video clearly shows one suspect dousing the store with gasoline and even the puppies' cages before setting it ablaze. luckily the sprinklers saved all the 27 puppies and preserved the video for prosecutors. now to the latest in sports this morning. the player at the heart of miami dolphins bullying scandal jonathan martin, he is getting a fresh start. he has been traded the san francisco 49ers. he tweeted he feels blessed and it also reunionitis him with jim harbough. four more teams are

good morning. the u.s. attorney's office in manhattan has reportedly opened a criminal probe with the recall of nearly 1.6 million cars worldwide. reuters says prosecutors are examining whether gm is liable for not properly disclosing problems with some of its cars, which have been linked to 13 deaths and prompted a recall last month. in other news, president obama is expected to order a rule change thursday requiring employers to pay overtime to more salaried workers. currently companies don't have to pay overtime to employees who make more than $24,000 a year or about $455 a week. lastly, starbucks will now let customers leave tips with et cetera global payment app. you can give a tip of between 50 cents and $2.
