>> thanks for joining us. we have break news overnight in the search for flight 370. two more pings detected underwater 33 days after the airline vanished. they're optimistic the plane's wreckage will soon be found. >> i believe we are searching in the right area but we need to visually identify aircraft wreckage before we can confirm with certainty that this is the final resting place of mh 370. let's get right to nbc's ian williams live in perth, australia. how cautious is this sense of optimism. >> good morning to you, betty. they are increasingly confident that they're looking in the right area but there are enormous challenges still to trying to find and recover any black box and aircraft wreckage that might be lying on the ocean floor which is almost three miles deep at that point.

now, detecting these two bursts of sounds tuesday which they're convinced are man made is giving them this confidence but they're trying to detect more sound and the sound is also described as getting weaker which would suggest the battery life is going in the black box if it is the black box. but if they can find more sound bursts they can pinpoint where it's coming from. that's important because they need to send down a submersible vehicle. an underwater drone to verify what's down there and that piece of equipment is very slow. it operates at a walking pace. which means the better they can pinpoint the sound the easier it will be to follow it up. but the radius is about 12 miles around the ship but they need to focus that more. >> focus and time is running out.

ian, thank you. to ukraine, reunited fears that the prospect of military action from russia is a real possibility. john kerry says russia is determined to create chaos. good morning to you. there's word that the obama administration is facing criticism of its own. >> reporter: well, they're getting criticism because some lawmakers here on capitol hill don't think they're doing enough to stop russia, to get russia to back off. we want to show you the latest pictures out of eastern ukraine because this is what the u.s. is concerned about. more violence in at least three cities. pro-russian demonstrations going on there and at one case 60 people were held hostage because those demonstrators won elections for independence. now, the u.s. thinks russia is behind all of this and is doing so to push further into eastern ukraine.

secretary of state john kerry said here on capitol hill if they push any further than the crimean border, then the u.s. is going to take action. but is that action going to be effective? so far the individual sanctions have not been. what he's say as good we may actually see sanctions against the larger russian economy if they decide to go any further into that country. >> interesting, tracie potts, thank you. dramatic new testimony moments ago from oscar pistorius who is back on the witness stand for the third day. he described the scene in the bathroom moments after shooting his girlfriend reeva steenkamp. >> i checked to see if she was breathing and she wasn't and i put my arms underneath her shoulders and i pulled her on to me and i sat there crying for some time. >> this comes after an

emotionally charged day in court yesterday. he recounted for the first time underoath how he fatally shot her. >> i thought that there was a burglar that was gaining entry into my home. the first thing that ran through my mind was that i needed to arm myself. that i needed to protect reeva and i, that i needed to get my gun. >> pistorius said he needed to get his gun and headed to the bathroom shouting at reeva who he believed was in the bedroom to get on the floor. when he heard noises inside the bathroom, he opened fire. >> before i knew it i had fired four shots at the door. my ears were ringing. i couldn't hear anything. so i shouted i kept on shouting for reeva to phone the police. >> when reeva didn't answer, he couldn't find her in the bedroom as well, pistorius said he realized what he had done. he said he put on his prosthetic legs and ran back into the

bathroom. >> at that point all i wanted to do was just look inside to see if it was reeva. i flung the door open, i threw it open and i sat over reeva and i cried. i don't know how long i was there for. she wasn't breathing. >> court will adjourn. >> very tough to listen to. joining me now is former manhattan criminal prosecutor faith jenkins. a lot of time was spent talking about when he put on his prosthetic legs, when he shot through the door. why does that matter? help us understand the time line? >> the prosecutors charged pistorius with the top count, premeditated murder. they did that based on the fact that they thought he put on his prosthetic legs before he went to the bathroom and shot through the door four times. they're saying from the time he put on his legs and went back to the bathroom that he formed the

intent to murder reeva. now we had an expert testify they don't believe he had his legs on and we're hearing testimony from pistorius. i haven't heard any other facts that support premeditation so for that top count i don't know that the prosecutors proved that thus far. >> but if you're worried about an intruder and trying to protect your girlfriend, wouldn't you want to talk toe her or hear her first before you start shooting to make sure you know where everyone is. >> that's the problem with pistorius's testimony. now we heard the full account of events. he described that yesterday and this morning. that's the problem here. now he's saying that he stood by the bathroom door. he screamed to this would be intruder and screamed back to reeva to call the police but he doesn't hear a response and then he shoots. the natural thing to do would be to wait and hear a response. now we know there wasn't an intruder. we know that it was reeva in the bathroom. wouldn't she have called out or

responded. so a couple of things here, the question is does it line-up with the prosecutor's evidence and the other thing is is it believable? right now he's going unchallenged. he's talking about the events. but when the prosecutors get up and cross examine him, they'll test his story and i'm not sure if it's going to pass the test. >> thank you. for the second time in five years, president obama will be attending a memorial service at ft. hood. the president and first lady are headed to texas to remember the victims of last week's shooting spree. mr. obama is expected to make short remarks at the ceremony before traveling to houston for a pre-planned democratic fund-raisers. three people were killed in the shooting and 16 others injured. let's get the latest in sports as we shift gears from francis rivera. good morning. >> good morning, good to see you this morning.

. time to get down to business. the national highway transportation safety administration is fining general motors $7,000 a day for failing to respond to over a third of its request for information about faulty ignition switches. the fines will continue to mount until gm responds fully. an internet virus called the heart blood bug is putting secure and incrypted cites at great risk. they're vulnerable to having hacked and having private information stolen. >> and murder by stiletto.

a jury found her guilty of killing her husband with a blue high heel. they alleged she hit him in the head 25 times with her 5 1/2 inch heels. she claims self-defense. speaking at the u.s. naval academy, former president bill clint clinton shared his thoughts on the government's use of technology and edward snowden. >> mr. snowden has been sort of an imperfect messenger from my point of view for what we need to be talking about here. but the snowden case raced questions about whether we can use technology to protect national security without destroying the the liberty which includes the the liberty which includes the right to privacy of innocent bystanders. >> mr. clinton went on to say it would be foolish not to use available technology to protect the country but it must be done in a way that keeps privacy

you know the music. time for your first look at this morning's scrambled politics. who's no practicing what they preach? apparently lawmakers. a new survey suggests they're not following their advice to hire military veterans. vets make up less than 3% of staff in congressional offices. slightly more than half of the congressional offices responded to the survey. >> louisiana congressman mcalister missed two days of votes since a video surfaced of the married republican kissing a married aid. the woman voluntarily re-signed. he released a statement apologizing for his actions. watch the sparks fly between eric holder and the texas congressman. >> what we promise to do is to provide you and your staff with -- >> sir, i read you what your department promised and it is inadequate and i realize that

that was quite testy. >> their exchanges have become legendary. >> let's get on to the clins on the. i want to talk them about a little bit. bill clinton was talking about edward snowden specifically and pretty much seemed a little sympathetic would you say calling him an imperfect messenger. what did you make of that? >> he's expressing what a lot of people believe. they don't like the way he released the information but he's probably doing everyone a favor by putting it out there and suggesting maybe we do need to reign in a little bit what the nsa and other agencies have been doing and the capabilities they have, if only because it does intrude on the privacy of perfectly innocent americans. and a lot of government officials would say they welcome the debate. they're glad they're having it. but at the same time, don't necessarily give hero status to snowden because he broke the law. >> but he also specifically said we could be designing systems that dramatically enhance

personal liberty and privacy and our national security but we have to be prepared to spend the money. is it really just about money here? >> no, it is also about the general debate of do we focus more on protecting the country or do we also try to strike a balance? that's a debate that a lot of people are eager to have. it's happening to some extent but not in any real serious and sustained way just yet on capitol hill at least. and yeah, i think to some extent it will require money but it's going to require new laws that are difficult to pass in an election year. >> all right. ed o'keefe, thanks for being with us today. >> coming up, bill karins and francis rivera are back for first buzz. we're talking about the planned death of a comic book icon. >> and what could be the most watched play date ever.

"way too early" with thomas roberts starts right now. according to a new washington post poll only one out of six americans can find ukraine on a map although two did find waldo but the exact poll found the less americans know about ukraine's location the more they want the u.s. to intervene. straight. this is america and we don't need to know where a country is to send troops there. i believe in democracy, especially when it comes to geography, the ukraine is where ever the american people say it is and according to this poll, americans say it is everywhere. all right.
