about this, and not that so many veterans have needed to wait for a long time, but they have died in the process. >> first of all, if it is true that the v.a. official in arizona did hide the facts and the american heroes did die because of the lack of care, they should be treated like a traitor. when people are offering their way of life and indeed to protect the free world, and they are treated like dirt, it is an attitude that can countries, especially our countries should never have. most people don't even know or care when presidents and people are sent into harm's way, and young people are sent into harm h's wa harm's way, but the truth of the matter is that nobody is aware that we are losing the veterans to suicide in battle there. is something wrong with the picture, and it is not just health care and not just mental and physical care, but we treat them like dirt after they have completed the battle and in save ourg great country.

people who have served our great country. hey, if you are waiting for a do doctor, and there is to doctor there, maybe you should be screaming out loud that you need the funds and the resources in order to save a life. but if what you are doing is to cover up the fact, then you are an accessory to murder. i really think that, too, and i hope it is not true, and i really do, but if it is true, they should be made an example of, because sometimes when you find these things that are happening sim tymptomatic throut the v.a. system, but i know one thi thing, the veterans of these wars in iraq and afghanistan have been mistreated throughout this system. and the only thing that we can hear that may make some sense is that the congress, the united states congress is not providing the money and the resources to take care of these people. now, whenever anything breaks

out, we always find somebody to send the troops all over the world to continue to put them in harm's way. i just cannot figure that if we look at them as a part of the family, then we are sending out the kids some place to find enemies that we don't know and to find them in places that we don't know, and then they come home, and they are homeless, and alcoholic and suicidal and sick and they don't have access to health care? there is absolutely no moral excuse for this. so when i say traitor, everything that that word means if you love this country and some one would cover something like this this and not run to somebody to say, this should not happen in the great country arkped it is too sad and too painful to discuss, so we will see what happens, but it pained me to hear about it, because there's so many people that can't even get into the veterans

nine hours from now in huntsville, texas, the first lethal injection in the u.s. since clayton lockett's botched execution in oklahoma. and the lawyers are working for a long shot reprieve. robert campbell is on death row convicted for the rain and murder off a 20-year-old bank teller. two sets of lawyers are on the case, and one is appealing to the supreme court after a federal court denied his lawyer's request for a stay of execution last night. those papers will be filed at

noon. the argument is that the drugs used are shrouded in secrecy, and creating the potential for another death chamber debacle. and in the past hour, attorneys have lost a close vote at the texas board of pardons and paroles saying that campbell's iq was low enough to make him ineligible for the death penalty, and that information was not shared. and today, the "time's" details the state's execution history, and sit by far the most extensive. this is governor rick perry on "meet the press" last weekend defending the policy. >> for a long period of time our citizens have decided that if you kill our children, kill our police officers, for those very heinous crimes that the appropriate punishment is the death penalty. >> i'd like to bring in one of robert campbell's lawyers, jo jonathan ross. good morning. >> good morning, chris. happy to be here. >> give us what is now in the

hands of the supreme court. what do you believe is the best argument to help your client avoid lethal injection tonight? >> well, i think that the best argument is the secrecy argument. about a month and a half ago, the state of texas stopped providing the information that lawyers like myself, like my partner need in order to determine whether our client has 8th amendment rights. i liken it to my children who are teenagers now, and years ago i was able to read their e-mails and see their texts, and they didn't have a problem with that, but now that they are teenagers, they do, and they are trying to hide the information from me. but the state of texas has found themselves in a quandary, because they cannot get the drugs they use to execute the inmates from the legitimate sources. so they are now hiding how they go about trying to find that information. under the law, we can get relief if we can show that our concerns are not speculative, and the state is keeping from us the

information that would show that are concerns about these compounding pharmacies are far, clearing the bar over any kind of speculative nature, and i don't believe that the supreme court is going to stand for that, and twice in the last month, we have had district court judges who have agreed with us on the principle, and one who granted an injunction and one who wanted to the in this case, but unfortunately found that the 5th circuit case law from the previous case prevented him from doing that. >> and as you know the court of appeals ruled that texas has a right to secrecy, and even the long-time defenders of the death row inmates and looking at particularly through "the new york times" article of david dow of the university of houston e said that when you do something a lot, you get good at it. and let me play you another clip from governor perry. >> our execution is different from oklahoma, because we use one drug, but i am confident in

the way that the executions are taken care of in the state of texas are appropriate. >> and humane? >> and humane. >> and the key here is cruel and unusual punishment as it is written in the constitution, and how does this play into it? >> well, here is how it plays into it. the current batch of the pent bash toll which is what the state uses, they have just done three executions. in one of the executions, one of the inmates said that it was burning. he had a burning sensation before he died. pent b pentibarbitol has been used in oklahoma and other places where they have said that they have had a burning agent, and this is made by a pharmacy that has no fda oversight and could have incredible contamination in the

facility that they make it, and not a reputable drugmaker, but we are introducing cruel and unusual punishment into the proce process. the attorney general of texas said that this information should be made public in three opinions, but now because they have trouble with the sourcing -- >> they say it is potent and free ofcontaminants, and i want to hear your argument that the execution does not mean it is free of pain and execution. >> well, his argument is not evidence. in any case, you can discover evidence regarding whether or not in fact it is free of contaminants, and they have p potency on the face, and it is a cause for concern, and you are not supposed to be that high. and that is all of the information they have given. with the information -- yes?

>> go ahead and finish. yes, sorry. >> with the information that we are seeking, we can determine whether a proper 8th amendment claim can be brought, but to hide the information and say that you are not going to be able to determine whether or not in fact we are subjecting your client to cruel and unusual punishment smacks more of the closed societies than it does like a great state of texas. >> and supreme court does not issue stays often or light ly, and they did, you mentioned in the case of the missouri inmate just in january. there was a stay, but he has since been executed and what is the reasonable expectation in this case? do you have a hope that there is a stay? >> we have hope. obviously, you are correct that the supreme court does not get involved, and the 5th circuit's opinion in this case was devoid of any reasoning other than we are following a month ago, but i am not sure that the supreme

court would accept it, but they would like to see more reasoning. and just recently in a procurian situation, they did reverse it, and so we do have hope that the supreme court will see issues here to at least take a quick look at before allowing this execution to go through. >> jonathan ross, we are following this case closely. thank you so much, sir, for coming on the talk to us. >> thank you, chris. i appreciate the time. >> and i'd like to bring in e.j. dion, the washington post columnist, and msnbc contribu r contributor. and e.j., a huge legal question here, but a political one as well. we have a president of the united states directing the attorney general to review how states execute death row inmates and three years ago when a case was in the news, you wrote a column saying that the democrat s can not lead this fight, and only conservatives can, and i wonder if you still believe that

and are you talking largely about the religious conservatives? >> well, first of all, i'm against the death penalty, and i'm clear about, that and i would like the democrats to lead the fight, but i would also like the conservatives and particularly the religious conservatives who have shown great restraint on the penalty, because there are a lot of religious conservatives who are pro life on abortion and said that we want to be consistent on this, and they have come out against the death penalty, but in the cases that we are talking about here, i think that whether you are for or against the death penalty, there is something d disturbing about the government secrecy that is vunding something that is not a private matter. these executions are carried out in the name of the people of the states where they happen. and in oklahoma, when things went wrong with that execution, they pulled the curtain. in texas, that i they don't wan to reveal what the drugs are, and there is a cross of the ideological lines that if we have the death penalty, let's be open of what is going on and

izadi as well as e.j.dionne. and what is the political calculation for a potential presidential candidate? >> well, if you look at the polling around climate change, and specifically of the voters who identify as republican or lean republican, a ma jjority o them either they don't believe that the climate change is happening or they don't believe it is a major concern. if you look -- >> so no risk, essentially? >> sorry? >> no risk sense shall for the a republican in saying what marco rubio is saying. >> true. and the reverse is true in a primary facing a huge slate of republican candidates who are trying to position themselves, and we know that the more con e ser vative voters will come out in the primaries and more activity, so it is endear yourselves to the voters. and remember that marco rubio used to be a conservative hero

and darling and now that he has pushed in immigration reform and working with the democrats, he has lost some clout. so it is not at all surprising that he has made the comments over the weekend that really conservatives by and large agree with him. >> and e.j., a second part of the argument beyond the science part of it which is the economic argument which is that you don't do some of the things, because of climate change, and it hurts our economy. many point to other industrialized countries not play big the same rules, a san diego that a m-- and is that a that can resonate? >> well what is troubling is is there are two parts of the argument. i don't understand why so many republicans have chosen to abandon the sinls on this. the science is quite overwhe overwhelming that something is going on potentially dangerous. and senator mccain had aggressive ways of dealing with the climate change as recently

as four or five years ago. they don't have to take that and say, we are for x or y liberal solution. but let's have an argument at least over what we ought to do about this. i think that in marco rubio's case, you are right, it does not hurt you in a republican primary, but there are a lot of the middle of the road voters who may not feel all that strong about the climate, but they do know what the science says, and says, why are these guys just denying the facts. why don't they accept the facts, and then have an argument over what should be done about the facts. >> well, that leads me to the n next point which is that the latest climate clashes are coming as the future of the keystone pipeline has been delayed again, and the senate voted down the energy efficiency bill, and the liberal groups have been lobbying hard gaiagai the pipeline citing environmental concerns, but it is necessarily, and i want to ask you both the question quickly, is it black and white? can you still elahe be for the pipeline and the environment? >> well, sure. you can say that the pipeline is not going to have that big of an

foundation is working hard to shore up hiv prevention, and hiv-aids prevention and what that condition can do to communities and families and providing college access, and for him to say what has magic johnson done, and what has he not done? and he was not doing it because donald sterling is watching, but because it is the right thing to do. i commend commissioner silver for doing it. but i wish that donald sterling would put a cork in it, and have a seat. >> and why would anybody let sterling do this interview or at the very least tell him bluntly, apologize and then shut up. >> i have no idea. it is very obvious that this guy has a problem keeping his mouth shut and not the mention the fact that he is a creep. he has said some deplorable things, and what i found funny about bringing magic johnson into the story is that he was deriding magic johnson for having sex with a lot of people and contracting hiv, but yet in his own tapes, released on radaronline and he said, i would

want, but it was not their choice. espn aired it, and it was michael sam's moment, and he should have the opportunity to en joy his moment the same way that heterosexual football players and basketball players and baseball players do. he celebrated with the person he loves the most and the person next to him and that happened to be the boyfriend and everybody else, they don't have much to say. at least it does not matter to at least michael sam or the boyfriend because of the tweets later on who commented about the moment. >> and this is part of what was written today, whether it is the kiss or the impact that he is going to have on missouri's anti-gay employment law as a member of the st. louis rams or how good he is for business in the nfl, sam has made a stunning debut in the most popular sports league in the country. and hogan, what kind of impact can michael sam make off of the football field? >> well, it may be more off of the football field, the impact he can make as opposed to the one on the football field.

good tuesday morning. i'm craig melvin in for tamron hall and this is "newsnation." military officials telling nbc news that the united states is now flying manned surveillance flights over nigeria to help find the nearly 300 schoolgirls abducted by the islamic extremist group boko haram, and they snatched the girls four weeks ago today, and meanwhile, the intelligence officials are pouring over the video released by boko haram yesterday that shows some of the kidnapped girls, and the parents are also desperately trying to identify their daughters in the videos. we will get the latest now from stephanie gosk in neighboring cameroon. >> craig, it is difficult to
