the man who was up against clay aiken, competing with him for a house seat died yesterday. one day before he was reportedly planning to concede that race. kelly o'donnell has the latest from raleigh, north carolina. >> reporter: good afternoon, this was already supposed to be a very big day in this congressional race. no one could have foreseen the tragic circumstances that would now cast a shadow over the north carolina second congressional district. officials had planned to do a canvas today going county by county to do the official vote tally necessary because the race between clay aiken, the former american idol star turned candidate and keith chrisco was so close, fewer than 400 votes behind them. there was a possibility that the results could change when they counted absentee ballots that had a bit more time to come in. what we know now is that the canvas goes forward and they

will officiate the results. the death of keith crisco, doesn't affect the process. what will happen is they will look at the vote tally and certify that. if he had been able to pull ahead, the democratic party would choose a candidate. i'm told by a source close to crisco he was prepared to concede because they looked carefully at the number and did not believe there were enough balance lots to change the results. when all of the official counting is done it's expected clay saken will be certified as the winner of the democratic primary and that is just the long general election campaign. renee elmerz is the republican congress woman and this is consider the a conservative district. it will be a tough race for a democrat. elmers and aiken put out statements for the crisco family offering their condolences and

campaign season will be on hold for some time to allow his family to leave. draw mattic events in a campaign that was already notable nationally for a seat that is considered to be safe for republicans but now certainly one to watch. >> kelly o'donnell in north carolina. what impact do you think this will have on clay aiken's candidacy? he has to go on to a tough general race against his republican opposition. obviously the results were in even though it was a close lead. does this delegitimatize things in a way? >> i don't think so. they were ready to concede, 400 vote differential. i suspect that that was probably going to fan out. they'll count the votes either way. how this manages aiken's kman going forward, look, it is very, very difficult race for him regardless of name recognition, very solidly conservative district. romney won by 57% of the vote. and you know, look, there is a

certain desperation too. you see the charges from elmers saying he's a celebrity. that's fine -- >> does he have any chance against renee elmers? >> i don't think so. i'm -- i think her campaign has been embarrassing in a number of levels saying he shares san francisco values, we know what that is code for. >> right. >> but i don't think they eastern need to go that dirty but it's embarrassing that they do. >> it seems like aiken has been handling this with clags and blacked out his website and put a statement up as we just heard taking a pause there. you see the website there. he's doing all he can to be a gentleman about this. it's a tough situation for everything. let's take a second to look at new hampshire, you've been up there doing reporting and covering this scott brown race. brown is having trouble on medicaid expansion in particular, which i find interesting. take a look at what thing he said on that.

conversation last night, there are a couple. when you heard shelly sterling speculate as to whether he has dementia or early onset of something. in watching that interview, you do sort of ask yourself exactly what his capacity is. and to the extent that he is perhaps diminished in some way, that could potentially have some -- i don't want to say sympathy but there could be an impact on the way the other nba owners in particular look at this situation and say this is a guy who isn't really -- maybe fully aware of the words coming out of his mouth. >> could also set a procedural precedent how to take a team away from someone. do you think with both sterlings saying they will fight to hold onto the team that we'll see a legal battle? >> if you listen to what donald sterling, he did say that he would not get a bunch of lawyers to fight the nba if the owners

try to take the team away. shelly is giving another story, saying she is prepared to fight. but donald seems to be willing to accept whatever judgment is passed down on him. if that's the case, that's going to put shelly in a tough situation. if donald doesn't fight it, shelly doesn't have a lot of standing to fight this. she's not the controlling owner listed in the ownership agreement with the nba. if donald decides to sell the time, that's what's going to happen. i know i believe quite strongly that the nba will get the 3/4 votes from the owners they need. >> the nba commissioner issued an apology to magic johnson on sterling's behalf. i feel compelled to apologize and he continues to be dragged into the situation and degraded by such a malicious and personal attack. why does sterling keep dragging magic johnson into this? >> that's the second time now in under two week adam silver had

the fight to bring back our girls is going high tech. the u.s. is adding more resources to the hunt for 276 school girls kidnapped in nigeria, including manned surveillance flights over the country and satellite photography. and we've just learned that two high ranking u.s. officials are in nigeria right now. commander general david rodriguez and sara sewell and sending ten advisers and another seven from u.s. africom and fbi is sending kidnapping experience. o this say this illustrates just how organized this group is and just how much of a threat they pose to the region. it's a lot to go up against and

years ago it was a little little less clear. but i think today after the windsor decision last summer, people are hopeful that the supreme court that there are five votes to find a constitutional right to same-sex marriage. certainly what we know is that it is probably not as dangerous as once thought. five years ago people thought maybe we shouldn't ask for it yet and shouldn't ask the court to go that far. >> the last time they tried to bring this before the court, it didn't work. >> it didn't work, but they were successful in getting same-sex marriage returned to the state of california. >> you think it's time to try again rather than try to let this bubble up. >> i think that the supreme court is always reluctant to go further than they need to with a particular facts before them. so they will always look for the path of least resistance or historically that's what they do. the cases working their way up, the case in virginia, that's why it's so important, one of the

next cases that gets to the supreme court. >> it seems like whether the approach is bottom up or top down, change is happening from virginia to alaska. >> it's certainly working and arkansas, the first state in the south that is allowed same-sex marriage, virginia, there was a court ruling earlier but that court ruling was stayed. today in arkansas, if you're a same sex couple you can get married. >> the other big gay rights fight is over employment and right to fire people for sexuality, coming to the floor ironically through sports because michael sam was drafted in a state where gay individuals can be refused employment or fired. how do you think sam's draft might affect that fight in missouri? >> well, i think that moment captured on film was certainly very emotional and most players who are drafted, these are young guys and people in college. it's normal to respond emotionally. but i think that that for many americans may have been the first time that they saw an

unscripted real life gay couple, michael sam and his boyfriend. >> very sweet moment, really. >> very emotional moment. >> we've had a lot of professional athletes talking about this since it happened and the consensus seems to be everyone of every sexuality has this reaction to a draft moment. it's a common thing. >> right, this is not someone who had a long professional career. this is a young person. and you had a moment where everything in his path is suddenly changed. it's normal to share it in an emotional way. >> do you think that could change the debate on the employment laws? >> i think it will change the playing field in a lot of ways. it was senator mccaskill was the first person who said, in this -- our home state where michael sam plays college football and now professional football hopefully, that he could be fired for being gay in that state because there's no protection and state level protection and no enda -- >> this is the federal

welcome back. congress is paralyzed on raising the minimum wage nationally but states and cities across the country are doing something about it. this weekend the vermont legislature voted to raise that state's minimum wage $10.50 by 2018. the highest state minimum wage in the country. that makes vermont the seventh state this year to hike minimum wage. cities are doing even more already. seattle making the biggest move towards $15 an hour for minimum wage over the next seven years, chicago voters also supported a $15 an hour minimum wage. one city already giving this a go, ij ka, new york. joining us by skype right now, thank you for joining. your city became a certified living wage employer. tell us what that means? >> it means that we know that the minimum wage is the poverty

wage. if you work 40 hours a week and two children at the minimum wage you don't have enough money to pay for your health care, your rent, your clothing and your food. you rely on government services like medicaid, medicare or food stamps. what we decided to do, what does it cost to live in our community each week to provide those things for yourself and your family and divide that by 40 and we came up with a living wage, what it takes to actually live. we pay -- even though we're going through tough fiscal times, it's a priority to fund our employees at this living wage. >> and what kind of economic benefit do you think you'll see from doing that? >> right away, you see increase in consumer spending because folks at the lowest end of my -- i grew up -- we didn't have a lot. my mother always worked minimum wage jobs and raised four of us. when we got a financial windfall any money that comes in, goes out right away in the form of

consumer spending, buying more groceries and paying back pills and credit cards. and it broadens the success of our economics. this is why in new york state we've led every other state -- every other county in job growth for the last two years. every month that i've been mayor we have the lowest unemployment rate in all of new york state at about 4%. >> let's talk about that personal commitment a little bit more. you have this incredible background in this story of seeing your mother struggle with this. have you talked to her since this policy change? she must be proud of that? >> it was a very emotional -- we had a couple of people affected single mothers speak at the press conference and my mother saw that. and it was -- it was just nice because to know you know as a kid you don't understand why when your mother gives all of herself to a company when she

spends 60 hours a week working for them, if they don't give her a wage that allows her to pay for all of the groceries for that month, we think what's an employer for. ? that was a commitment i made to myself and mom and i was happy to fulfill that commitment. >> why should other cities and counties follow that lead? >> i think because we can't -- frankly, and municipal leaders all over know this because we can't wait for congress to do it. the best way is for the federal government to raise a minimum wage to a living wage. we know they are not going to do it because incentives are misaligned. they can get re-elected again and again by bashing each other. city and county leaders can't do that. they have to fix the problems they are facing. it is good government and good politics and it's going to broaden your municipality's economic base if you can raise what people are making it and you'll generate more consumers which is good for your community. >> new york state's governor andrew cuomo has seen a lot of
