government within five days of realizing that you have a problem, with a particular part in a car, you've got to initiate a recall action. at least say, look, there's a recall. we don't know the remedy. we are looking into it. general motors don't that. in fact, it took years, more than a decade before the recall was ultimately announced so today the department of transportation is fine general mottoers or general motors agreed to pay a fine of $35 million. that's a record with the national transportation safety administration. not people might be saying $35 million seems like a slap on the wrist. that's the limit allowed by the federal government and fines levied by ntsa. they'll hold a press conference saying $35 million fine that general motors agreed to pay and more importantly, general motors is giving them full access to its internal investigation. remember when mary barra in front of me believes of congress

heat and winds. the most dangerous fire in san marcos with officials reporting today 10% contained. almost 30,000 people have been evacuated since wednesday. two men who ignored evacuation orders talked about a harrowing night this morning on "today." >> it hit a brush pile in the field near me, skipped by home and got the two next door and i thought this was it and then the fire truck showed up. >> wow. jennifer bjorklund joins us. one 10% contained. >> reporter: that's where we're standing at the fire you can see the path of destruction it's left behind so far. when we say 10% containment, they're firm containment lines. those are fire breaks dug in where they know the fire will likely not jump. the rest of the perimeter of this fire may not be an active

flame. in fact, most of it is not but it's area that they have not dug in and made sure that the fire won't spread so that's what they're looking at as far as containment goes. it's still very smoky and very dangerous but the good news this morning is the weather is about to turn. it is noticeably cooler today. the winds are calm. and they're hoping for that nice, cool ocean air to come in and bring a little bit of moisture and relief to the firefighters who are on the lines here, tamron. >> all right. thank you very much for the update there. we'll keep our audience up to date on the containment of the fire where you are. developing now, we are awaiting a decision in the case of marissa alexander, the woman from florida who wants a new stand your ground hearing to prove she fired a warning shot at her estranged husband in self defense. she was convicted in 2012 of three counts of aggravated assault with a deadly weapon and sentenced to 20 years in prison and the conviction thrown out on

appeal. the previous request for immunity rnd the state's stand your ground law was rejected but the attorney says they have new evidence showing today to prove she should be able to use this defense. as it stands now, she's free on bond awaiting a new trial on charges of firing a gun at her husband. now, joining me live now on the phone, florida times union newspaper reporter larry hannan who was at the hearing this morning. larry, first the evidence, the new information her toernls say they have. what do we know? >> tamron, the new evidence is basically the claim that rico gray, her estranged husband, child changed the story and originally backed his father and since told people that, in fact, what he testified to is not true. the judge james daniel did not issue a ruling today. the hearing ended ten minutes ago and what daniel says he needs more time to consider whether alexander's getting a new hearing or not. >> does it sound, from the legal experts, the new evidence, the child's testimony changing is

that significant enough to fall in the way of marissa alexander's side here? >> there's several different issues here to make it difficult. one is the judge daniels clearly concerned of established a precedent, second stand your ground hearing and said several times in the hearing specifically he feared if he allowed a second hearing that every defendant would start demanding second, third, fourth stand your ground hearings and the court system would be bogged down. in response, alexander's lawyers insist it's a unique issue. the original trial, original conviction was tlounl out but the prosecution arguing that there's nothing new here and nothing that was introduced really changes the result of the first stand your ground hearing. >> what is the time line we are looking at from the judge? >> judge daniel said he'll give both sides to the end of the month to file written arguments to supplement what they said

today. he wants the hearing june 10th and likely decide probably the first week of june whether there's a hearing or not. >> as i pointed out, marissa alexander is out on bond awaiting this. she has talked very little through the media regarding this situation, particularly since she's been released from prison and is her support base still strong in florida at this point? >> oh yeah. no doubt about it. rallies for her. quite a few people in the courtroom today, you know, state legislature passed a new warning shot bill which is basically inspired by alexander because a lot of people do feel like the 20-year sentence she got was excessive and ironically she may face 60 years convicted again. >> that's something we discussed with you because of the state law and explain that to the audience how she could face 60 years because of florida law. >> she was originally convicted of three separate counts of ing a ra investigated assault and sentenced to three separate

terms and the judge ordered them serving concurrently and serving them at the same time. since her conviction was overturned, appellate court ruled that judges can't issue sentences concurrently. they have to be consecutive and getting three 20-year sentences and is convicted again, she'll have to serve 60 years instead of 20. >> thank you very much, larry, with those details, including what marissa alexander's attorney says is new evidence. the son of her estranged husband changing his story to fit the account of what she said happened that night. thank you very much. an now to new developments involving the nearly 300 nigerian school kids held captive by boko haram. today nigerian president canceled a planned visit to the town in northeast nigeria where the girls were abducted. it would have been his first viz it there since the girls were kidnapped there now more than a

month ago. bill neely joins us live. do we know if he plans to reschedule? what's the latest there? >> reporter: no, no plans, tamron, to reschedule. pretty much the time he should have been taking off for the village we were told that he was canceling due to security concerns. as you can imagine, that's not gone down well here. social media full of criticism of the president. it's really been mishandled if you like from start to finish. first he announced that he was going to be flying in to this village, deep in boko haram-controlled territory on friday morning giving that group i suppose plenty of time to plan an ambush and then this morning it was called off because of what they called security concerns. now, for the people living in that area, that's a bit of an insult because they have been living with security nightmare for the last couple of years. many of them don't sleep in their villages in night but the

bush for fear of attack. so, president goodluck jonathan who didn't talk about this issue for three weeks has now decided not to set foot, not only in the village from where the girls were kidnapped but not set foot in the entire state since this began. it's a textbook example really of how not to deal with a crisis. he should have shown what a caring, compassionate president he really is. instead he's come across once again as rather callous and indifferent to the fate of these girls. >> and with that said, bill, is there any indication that the president or his staff or anyone within his administration, if they're attempting to beat back some of this anger or at least give the face of concern to those parents awaiting the return of their children? >> reporter: well, exactly, tamron. i mean, there was the perfect opportunity to show that this was a caring president.

even his wife has been widely criticized because she attacked the parents of the girls who were demonstrating about the lack of progress. so the couple, the first couple, are not coming across well and even if he hadn't gone to the actual village today, he could quite easily have gone to the state capital and showed his face. instead he turned his back and on the way to a paris to a security summit there called by the french involving nigeria and its neighbors and discussions about how on earth to combat boko haram. as for the search itself, tamron, it seems to be in some kind of chaos. nigeria's army just sacked its commanding officer in the area citing real concerns about his leadership. nigeria says it's got two divisions. it says there's a search going on but there's absolutely no

chilling new details are emerging in the second murder indictment against former nfl star aaron hernandez. prosecutors yesterday charged hernandez with two don'ts of first-degree murder in the 2012 deaths of two men in what police describe as a drive-by shooting. according to court documents, investigators believe hernandez did not know the victims prior to the night of the shooting and say it was a chance encounter at a boston area nightclub that triggered a series of events leading to the shooting. >> when the victim's car stopped

at a red light, waiting to turn on to harold street, the suv pulled up beside the victim's car on the right. aaron hernandez then fired a 38-caliber revolver multiple times from the driver's side of his vehicle into the passenger side of the victim's vehicle. >> meanwhile, hernandez is awaiting trial, of course, in a separate shooting death of 27-year-old olin lloyd. he's also facing first-degree murder and weapons charges in that case. joining me is maria cramer with "boston globe." hernandez's attorneys said we are not going to try this case in the media under our system of justice, aaron hernandez is innocent of these charges and he looks forward to his day in court. what else have we learned about the case against him in the double homicide? >> what is interesting about this case is this had

investigator s flumoxed at firs. they were immigrants, hard working men just out for a night on the town. they had no criminal background, no gang background. none whatsoever. just two innocent guys and could not figure out why anybody would target them and only after oden lloyd that they turned sights on aaron hernandez and had been at the club and left much earlier and not seen as a suspect initially. >> never seen as a suspect in the case. do we know if there was a witness that was flipped here regarding the allegations? how did the trail end up at aaron hernandez's door? >> it was really actually pretty much gum shoe detectivive work if you think about it. they were paying attention to what was happening in the oden lloyd case and said, wait a second. with e no e that aar we know that aaron hernandez was at that club earlier and we should look at the surveillance camera and looked at the club

and the streets and were able to see that he had not actually left the scene. he was just circling the streets after he had left the club and then witness i believe there's witness testimony that showed that he pulled up to the car and shot into the bmw where the two victims were sitting. >> do police say that there was an altercation prior to this shooting? what do we know about the night and the events that led up to it? >> it's interesting you use the word altercation. usually the district attorney's office even if they don't reveal details use that word if there was some sort of a fight, an argument or a physical fight but they said chance encounter and that would indicate that whatever happened between them was very minor. i know that the victims -- the survivors who were with the two victims told police initially they couldn't think of any serious problems inside the club, anything to lead to somebody wanting to kill them. >> maria, you broke the story

yesterday regarding the new charges against aaron hernandez. you well know that when the first charges and the oden lloyd case filed, people were stunned and started to dig into his background and now you have this double homicide. patriots washed their hands of him. i cannot imagine still the sports community not strapping their heads about the background and if the allegations are true and he's guilty of them. >> that's what i think has drawn so much attention to this case and talking about a promising athlete, talented tight end that signed a $40 million contract. he was one week away from going to training camp the night of the double homicide. everybody is just scratching their heads. why would this man throw his future away? according to the alleged actions. >> and again, according to these charges, taken three lives on two separate occasions. stunning. thank you very much. we greatly appreciate it. great reporting there. thank you. >> thank you. well, today the first lady

veterans. >> what do you say to those veterans today who said you of all people failed them. >> i came to make things better for them. >> reporter: whistle-blowers say hospitals were hiding appointments on secret lists to cover up long delays in getting treatments. >> while people cooking the books? >> i'm not aware and other than a number of isolated cases where there is evidence of that. >> reporter: former va dr. samuel foot from the va hospital in phoenix alleges that 40 veterans reportedly died while waiting for medical care. the va inspector general said in 17 cases he has not yet concluded the deaths were caused by the delays. both democrats and republicans aren't convinced. and are demanding a major shake-up at the va. you know, there's no talk on the

hill about dissolving the va. everybody realizes there's not enough money in the budget to meet all the demands and requirements that the va needs so serious lawmakers up on capitol hill are talking about alternatives, having the federal government offer veterans options in where, when and how they get their medical treatment, tamron. >> mick, what about the staffing situation? that's another part of the story. it's long wait times and may have even contributed to this wait list issue scandal. >> reporter: well, quite frankly, the va is overwhelmed. you know? back in about just before the year 2000, it was thought that the va might be dissolved because there was a fewer numbers of veterans every year and they had more in the system

and threatened to sue the nba. according to "usa today," his attorney writes in the letter sterling doesn't warrant, quote, any punishment at all for comments recorded in a conversation. nbc news reached out to the attorney and nba and neither commented after sterling reignited the controversy this week by making more incendiary remarks of race and magic johnson. sports attorney everett glen joining me now. some of the people saying i don't defend the comments of donald sterling but taped in a private conversation in his home that is what some are articulated to explain this. nevertheless, does that hold any water in the court of law? >> well, thanks for having me on the show, tamron. i think that this is what happens when there's a crash at the intersection of race and sports and money. and whether or not in an arbitration with the nba it wouldn't hold weight, i think his actions today are try to

take it or signaling he wants to take it outside of the perview of the nba to a court of law because the commissioner silver indicated their position and really didn't have any choice legally but to contest the matter. >> but looking at the challenge here with donald sterling saying he'll sue the nba and not paying the fine, what ammunition do you believe his attorneys have at this point if any? >> well, i don't know in particular, i've heard rumors that he'll push an anti-trust claim but, again, i don't think there's an injury to competition and, again, this is what happens when you get to the intersection of race and sports and money. i mean, he is pulling at straws. the nba in their own rules they actually say that the rules of evidence and that sort of thing don't apply, and so, even if the tape was recorded without his knowledge or consent, in a nba action i don't know that it

would be relevant. in the court maybe a different result. >> do you believe that donald sterling is simply wanting to tie this up as as long as possible when he looks at the lay of the land? he knows the nba constitution and where the other owners stand, what adam silver says he needs to get sterling removed and do you believe he's trying to run out the clock here? >> i think he is doing what anybody dwould and exercising his constitutionally protected rights but the real issue is underlying, persistent racism and what happens at the intersection of race and sports and money in america. i mean, rather than just submit because public sentiment is clearly not in his favor. he's choosing to fight. that is his right to do. >> all right. thank you so much. we'll see what happens when the owners reconvene next week. thank you. >> thank you. frightening new video of an 8-year-old girl that survived after being struck by a car. the girl riding a scooter on the

earlier this week, the school asked them for a waiver to help antoine. joining me, college sports reporter for "usa today." i left that i left that drum roll at the end and not revealing the decision from the ncaa. i want to talk about his story. you hear that and we have talked a lot about college sports and whether or not these are employee athletes and what should be the rule here. this point, i think, is something who could debate this? >> i know. the boise state coaches have said, you just want to drive there and pick him up and give him a hug. his story is even more heartbreaking. he talked about his mom dying when he was 4 from cancer. growing up on the streets of new orleans and katrina and all of these things. you hear it all and of course, you want to help. so fans and viewers just reached out and asked how they could help him, but they were not allowed. >> remarkable thing also is he wasn't going around asking for help. he kept it a secret. he was suffering in silence. >> boise state coaching state did not know how bad it was.

they said they would call him and said he was great. they were not aware until the report of how bad he was. >> the ncaa was asked for a waiver and they decided to help. >> they granted that boise state could provide immediate assistance. normally you're not allowed to help or give room and board for athletes until they are on campus. but they are able to do it. so they are paying for a hotel room and three meals a day and will pay for transportation to idaho. >> did it ever appear that the ncaa would stand its ground on the rules or was it always pretty clear? >> this was how the process works. the school became aware of it and applied for the waiver and it was granted. fans see the initial outpouring that they can't help and it would be an extra benefit that people would be helping because he's a football player. and that's the part that's

frustrating and doesn't seem to make a ton of sense to fans and just common sense in general. >> with that said, are there other students in similar situations? i can't imagine there have not been things like this when you look at the number of people without foreclosures and families who are struggling and their dream is just to get that kid to school. >> again, he wasn't publicizing this. there are a lot of kids trying to get college scholarships going through very similar things. that's what coaches and athletic directors and different people have complained about. you can't buy them a $50 meal or you can't give them a ride somewhere, pay for their parents to come see a game. it definitely has come up multiple times in the recent years. >> great reporting, we wish him the best. i'm going to have to get a jersey to support him when he finally takes the field.

thank you. time now for the news nation gut check. another caught on camera moment to show you. this one may be difficult to watch. it is difficult. a teacher allegedly grabbing a 6-year-old. the nelson family in ohio is trying to get their little boy's life back to normal after a shocking incident in a place his parents say he should feel safe. katy tur has the details. >> reporter: in this surveillance video from river dale schools in ohio, you can see the 6-year-old walking alone into a school bathroom. when he comes out his teacher who appears to be looking for the kindergartner can be seen grabbing him and pushing him against a wall. she then grabs his face and his shirt and picks him up again, jostling him, his neck appearing to snap back ward. >> i was crying. it broke my heart to see my child get harmed by a complete

stranger. >> reporter: when his parents first heard of the incident, they didn't think much of it. that was until they saw the tape. >> i was just in complete utter shock. >> ian never said anything to his parents, but another staff member reported it. the kindergarten teacher is on unpaid leave for ten days suspended until summer break. >> they should have fired her when they found out about the whole situation. >> the school says it filed reports with the sheriff, the department of education and children services. >> you don't ever want somebody's child to go through that. that's not what we're about. we'll move forward. >> reporter: he's only said a few words about the incident. >> she, um, did this to me,
