his parents sounded thele a larm about the mental state. the officers did not reperceive him to be a danger, and by law did not have the grounds the put him on psychiatric hold. he had post eded a number of disturbing youtube videos and he expressed anger towards a neighbor who asked not to be identified. >> he said he was going the shoot up everybody, and kill himself. >> and jennifer bjorklund is in santa barbara with the very latest. first, start with the memorial that is going to be taking place later today, and what can you tell me? >> tamron, the memorial is set for 4:00 pacific, and that is 7:00 eastern, and sit at harder stadium. they want as many students to come as possible. they have cancelled the classes for the day, and calling it a day of mourning and reflection. they are asking all of the faculty to come in to talk with students and in case they are need needed and just to be there to be together, and to talk through it. this horrible thing that happened friday night this

horrible thing that they are dealing with here on campus. >> and jennifer, for the investigation, itself, are we expecting more details from the authorities regarding the incident where this young man was questioned, and just some of the events that led up to this shooting and the stabbing. as you well know many of them are calling them the red flags that may have been ignored. >> yes, and tamron, there is much has been made of the manifesto, and of the video that was posted on youtube, but remember, that none of those things was available to the deputies that made what is called a welfare check on april 30th. what happened is that there were some youtube videos posted that seemed angry. family was concerned, and the therapist was concerned, and they called authorities to do a welfare check. and when those officers showed up, deputies showed up at elliot rodgers' door on april 30th, he

was able to convince him, and i spoke with the sheriff personally earlier this weekend and he said that they were able to be convinced that he was just, just a little bit depressed and it was a misunderstanding, and it was fine and everything was fine and he was able to hold it together for 57 minutes that they were visiting with him, and he writes about that incident in the manifesto saying that here he had seven deputies at the door asking him questions and he was panicked that they would come into the house and find his guns. they didn't, and he had no grounds to, tamron. >> and lastly, the investigators are looking at at least one of the stores where rodgers legally purchased a gun, and what are you telling me about that? >> well, that is a store in burbank and they served the search warrants and confirmed that they have served the search warrant warrants at the burbank gun shop, and he had leelly obtain ed them and three of them purchased at different places, and we know that as well legally. and what they are looking at with the warrant, we can surmise, because they want to make sure that all of the

paperwork was in order, and yes, since he had never been committed to an institution, and he had no mental illness on record, he was able to legally purchase the firearms and the ammunition. he had 400 unused rounds in the car with him when that rampage ended his life came to an end friday. >> thank you, jennifer. and let me bring in a professor from the university of santa barbara. thank you for ginning me. >> thank you. >> and let's start with the five to seven minutes that the suspect was able to hold it together april 309 when the authorities went to question him after the parents expressed concern. i want to note that you did not treat elliot rodgers and we are just learning from his manifesto and from the family, the details of the mental health, but we know that according to his account, he was able to hold it together five to the seven minutes and cover up the true

feelings. >> this is not unusual. i want to be clear that my position at the university has nothing to do with psychiatry or psychology, rather i am speaking on behalf of the mental wellness center here in santa barbara where i'm a volunteer and on the board. it is not unusual for mental health clients to be able to hold it together under that sort of circumstance. one of the biggest problems that we have is that many of the people who have or who are suffering from the symptoms of the mental health disorder are often in denial or have a lack of insight regarding their state. therefore, they are not likely to reach out and get the help they need, and that is one of the problems. we know that early intervention can in fact make a positive difference in terms of treatment. >> in this case, professor, we

know that elliot rodgers' family according to the manifesto, they made numerous attempts to get him psychiatric illness but he was resistant, and he was prescribed a number of drugs, and refused to take them, and there was an attempt to do the intervention by the family, albeit a resistance from this young man, and a struggle that had taken place apparently in the family for years, and what is the advice that you would offer to the parent, and maybe not in the severe situation, but dealing with the someone who is unable or resistant at this point to vive the help. >> my heart goes out to all of the families including elliot rodger's family, and the situation is a parent's worst nightmare. again, it is not unusual for a young person who is struggling with the symptoms of mental health disorder to resist treatment and to be in denial, because there is such a lack of insight. as well, many of the medications

that we have simply the side effects are unpleasant enough that people are unlikely to follow their treatment routine. furthermore, there is a lack of coordination with the mental health services that are provided. b better coordination certainly would have helped in this situation. the parents were put in an untenable situation to where they were the ones who were probably trying to coordinate and make sense of what was going on. >> professor, thank you very much. >> without the support. >> and without the support. >> yes, thank you, and we greatly appreciate your time and insight. >> you are welcome. >> and developing now an important ruling by the supreme court to decide whether florida can solely rely on the i.q. score to determine if someone is eligible for the death penalty.

u.s. supreme court justice correspondent pete williams joining us from outside of the supreme court. >> the answer is no, the supreme court said no, the test score is not enough. if someone falls in the borderline range of someone who is intellectually disabled. it was 2002 when the supreme court said it is unconscionable to execute somebody who is mentally retarded is how they termed it, but florida and other states decided it would be a hard cutoff, 70 or below on the i.q. test meant they could, and below, no. and today, dividing 5-4, the supreme court said that it is not reflective of how the i.q. test works. justice kennedy who wrote the opinion said that the officials who design and interpret the tests at best, the iq is a moving score over the years, and the iq test, the person could be 70 points higher or lower, and

meaning that the defendant in this case, freddie lee hall who kidnapped an raped and murdered a 21-year-old pregnant newly wed, his i.q. could have been as low as 66 or as high as 76. so the court said that in the few states that had a hard cutoff on the i.q. tests, and if the person falls within that range, they must be allowed to present additional evidence of the intellectual disability, and he concludes by saying that the death penalty is the gravest sentence that the society can impose, and a person imposing that sanction must have a fair opportunity to show that the constitution prohibits the execution, and this is going to affect florida and a few other states, and it is hard to tell how the other states are applying the rule, and some have it, but they have not carried out the death penalty in years and in some states the test has not been processed through the courts yet, so it is probably a handful of states like florida that have this standard. >> all right. pete williams live for us

outside of the supreme court court. thank you, pete, for the information. we are following developing news on the kidnapped schoolgirls in nigerian. they say that cameroon has deployed 1,000 troops to the border with nigeria, and this is after the defense chief said that the military know where the girls are, but will not attempt a rescue out of fear that it could get the girls killed. >> the good news for the girls is that we know where they are, but we cannot tell you, okay. we cannot come to tell you mi military secrets here, but leave us alone, and we are working to get the girls back. >> where are they held? will we tell? is. >> no. >> so nobody should ask the mill tashgs because we know what we are doing. we can't go to get the girls to kill them in the name of getting them back. >> and the nbc news correspondent jim miklaszewski

joining us, and mik, the military defense there saying that we know what we are doing, but it is not the right time to go in, and get the girls, but we know that u.s. personnel is there in a minor role. do we know if the surveillance information locating the girls came from the u.s.? >> well, you know, first of all, the clip that you played the nigerian defense chief sounding a little defensive there. and they are under an awful lot of pressure, because according to the military experts, it is one of the most poorly run, led, functional militaries in the world actually, and no match in many cases for bow ckocoe -- bo harm, and so i can tell you that there was no information from

the drones that have been flying over nigeria for a week and a half, and u.s. military officials saying that they don't have any idea. the surveillance drones have found no clues whatsoever about the whereabouts of the girls. the most encouraging things perhaps about what the defense e chief had to say is leave us alone we will bring the girls back suggests that they may be in negotiations with bocko hara of some sort of swap, and there may be a release of some of the schoolgirl hostages, but at this point, it is a slight glimmer of hope. and everybody agrees with the defense chief after all that a military operation according to the u.s. military officials is pretty much out of the question, because of the size that is of the group, the 276 girls perhaps split up in different groups would require according to the

military sources an invasion force to pull off, and the likelihood for success would be very low, and it could actually threaten the lives of the girls themselves, tamron. >> and quickly, mik, back to the deal swap that may be in the works with some 50 girls in exchange for 100 boko haram p z prisoners and the bbc is saying that deal fell apart, but if it were to take place, it seems that the world would be concerned that the girls now that they were taken killed some 500 people, and seems to shrug off what the global response has been in outrage to the actions. >> well, the global response to this is all steeped in the welfare of those girls. look, it is terrible they are in custody, but everybody that we have talked to who is very well versed in these kinds of operations feets -- feels that with the first sound of a helicopter or the first shots fired at any one of the many

afghanistan on two narrow missions after 2014. given that the bilateral security agreement is reached. both of the afghan presidential candidates recently reiterated their intentions to sign the agreement despite opposition by hamid karzai and the president as you know made a surprise visit to afghanistan yesterday and had a brief 20-minute phone conversation with karzai. he will announce the numbers and the u.s. role in a combat mission ending in 2014, and also developing surrounding the v.a. scandal, lawmakers are now calling for the justice department to open up a full criminal investigation. right now the v.a.'s inspector general is investigating alleged wait time cover-ups at centers across the kun tcountry. he is working with one branch of

the justice department. meantime, house republicans are e expected to introduce a bill this week to give the veterans an option to go outside of the veteran's edadministration if ty cannot get an appointment within 30 days. and the president touched on that scandal in the surprise visit to afghanistan that i mentioned. >> we will stay strong by taking care of our wounded warriors and veterans, because helping the wounded warriors and vets heal is not just a promise, but it is a sacred obligation. >> and joining me now is richard blumenthal who is a senator and wants to get involved. the president is going to be making an announcement that the bilateral security agreement is doing to be signed, some 9,800 force forces will remain in afghanistan beginning 2014, but the president will be announcing the next steps of winding down what is referred to as the forgotten war in what is caught up in the v.a. scandal are those who need treatment after having

served in afghanistan. >> i strongly support the president's goal of withdraw in the troops, winding down if wars the long nest the history as soon as possible. even earlier at the end of 2014 if it is possible, but the announcement also highlights that we are going to have to deal with the invisible wounds of war, post-traumatic stress and traumatic brain injury which affects tens of thousands and maybe one-third to half of all of the returning troops, and not just those who are going to be returning in the next six months, but who have been through the wars and earlier wars. and so our obligation, the president is absolutely right, it is a sacred obligation has to be fulfill and we have to do better, because the deback disability claims and the kinds of the times required for our vets to see doctors is absolutely intolerable, and unacceptable, and it needs to be better management, and more

resources to deal with those delays and the accountability. >> and the president said that accountability will happen once the inspector general report is complete here, but you want the department of justice to get involved. what do you point to as the urgent evidence of the need to have the d.o.j. involved here? >> well, the evidence is that there have been forging of documents, falsifying of records, destruction of the certain kinds of data, and secretwaiting lists, and in effect, cooking the books and covering it up in violation of the federal criminal laws, and it needs to be investigated by the department of justice, because they are the only department who has the resources and the expertise the do a prompt and effective investigation, and it has to be done before august which is when the inspector general of the v.a. says that he is going to be done. there have to be findings and recommendations even before then, because we owe it to the veterans, and only the

department of justice has the numbers of agents beyond the 165 that the i.g. and the v.a. has, but only the department of justice can convene a grand jury and only the department of justice can bring a cred canable outside presence to investigate, and restore the trust and the credibility, and those are the reasons that i called on general shinseki to request that the department of justice be involved from the very outset right after we learned about the potential violations of the criminal laws that are not proven, and we are not rushing to judgment. we are not drawing conclusions, but the reason for the investigation is to make sure that we get to the bottom and impose accountability. that is the key goal, accountability. >> and let me ask you, lastly here, regarding the shooting and that in california where there is a memorial today, and they are expecting thousands of people and many who attended the college in santa barbara to

attend the memorial, but we are back to the issue of mental health when guns and knives are involved, and we know the tragedy of newtown and people thought that things would change, and nothing has. when you woke up to the news friday or saturday and heard the information, what did you think here? >> my heart went out to the families and loved ones of those victims, more innocent victims there. are 32,000 every year of gun violence. and we thought after newtown that we would in fact accomplish a comprehensive measure to reduce gun violence and the failure to do so is shameful and disgraceful, and my hope is that we can refocus on the mental health which is part of the comprehensive measure including the background checks that we sought then, and we ought to renew the effort now to achieve. my hope is that those families will find some solace in the days ahead of the support they are receiving around the

reporters, he also indicated that the vatican is investigating three priests for crimes against children. he said there is a zero tolerance for evil of priests who abuse children. and joining me is now the founder of survivors network of those abused by priests or s.n.a.p., and what is your reaction to the pope making this announ announcement? >> well, it is really important to recognize that there is nothing meaningful in any of these statements. he's talking about three separate things that he is doing, but none of them will actually protect more children. >> but the pledge of zero tolerance in that they are investigating at a least three bishops means nothing? >> well, i mean, he does not say first of all what is he investigating the bishops for? for actually abusing the children or enabling and covering up the abuse by one of the priests? and we know that there are 24

accused priests in the united states, 39 from other countries -- so which three is he talking about now for one thi thing? >> is that what you wanted him to investigate, and we don't know to your point the details, but we know that the vatican said investigating three bishops for crimes against children, and if there is an an investigation, the assumption is that we, the journalists covering the vatican and covering the issues related to this scandal that has plagued the church for all too long would know at some point the aolgations, right? >> well, you would hope so, but the problem is that these are more lofty words, and in fact, what would make a difference is if pope francis were to actually punish some of the bishops who we know have abused children, and who have covered up sex crimes. one of them is bishop finn, right now the bishop of kansas city, and he has been criminally

prosecuted and found giuilty of endangering children in missouri, and yet, he is still the bishop, and so if pope francis were sincere, we think that some of the bishops would be punished and not nearly investigated. >> why do you believe no puni punishment at this point? >> well, we can hope for the punishment, but at this point, we have not seen any, and considering that he is talking about three when there are 50-some-bishops accused and we haven't seen any one of them in punished, and it seems like more rhetoric and it is not really action. and when the pope talking about zero tolerance, we don't see any action and if he were sincere, why wouldn't he demand that all of the bishops remove all of the sexual predators from the ministry, and post their names on the web sites like here in chicago cardinal george posted the names of those accused, and

in about two dozen other cities here in the u.s., they have done that, but globally, most of them are, most of the predators have never been publicly identified -- >> and barbara, let me ask you, because we know that the pope has been praised internationally for handling the position, and making statements that others in the past have not. who has decide in many cases to turn words into action as it relates to as he said the judgment of odirection of the church and the priority of the church, are you willing the give him the benefit of the doubt that perhaps was not deserved quite honestly in the past based on the reak shction of the leadership within the church? >> well, i think it is really important to recognize that gesture gestures and symbolic statements are maybe mean iingful when someone doesn't have power or authority, like for example his

gestures and symbolism in the middle east this weekend, but in terms of the problem of the sex crimes happening by employees in the catholic church, pope francis holds all of the power, and he is the boss, and he could immediately see action on his part. but so far, all we have seen is lofty words, and we have not seen even one predator priest removed or any demand that they be removed or be kicked out of the priesthood. we have only seen these lofty statements and if pope francis were sincere, we believe that he would take action. >> we will see if action will follow on these meetings that he has announced. thank you so much, barbara. we greatly appreciate it. right now, first lady michelle obama is keeping up the fight to keep the healthy food in public schools and end childhood obesity, and how the first lady plans to take on the republicans and the food

now to breaking news in a few hours and 2:45 eastern time president obama will announce the next steps in winding down the american presence in afghanistan beyond 2014. joining me live is nbc news senior political editor mark murray. mark, some of the details are come in, and what can can you tell us? >> well, the president wants to keep a residual force of less than 10,000 united states so soldiers in afghanistan. this would be to do two things, one counter terrorism efforts as well as training afghanistan security people. so, this is something that the administration has always wanted to have this kind of residual

force in afghanistan, but the ball is going to be in the afghanistan government's court on whether they end up sign iina bilateral security agreement. hamid karzai, the outgoing president was always iffy on signing something like that, and the united states in fact, said, well, maybe we have a zero option of having no residual forces at all, and the new candidates for afghanistan president seem to be more open to signing an agreement, and that is why the president wants to keep some residual forces slightly below 10,000. >> and transition ing ing to th first lady also making headlines today in what many publications have referred to as unusual move that she is fighting back and defending the initiative to get the healthier lunches in schools. >> well, we have not seen this type of activity from the first lady when it comes to hand-to-hand political combat since the 2012 political re-election fight, tamron, so it is sig nnificant and of course, the first lady's signature domestic goal on child

nutrition, and nutrition standards to counter childhood obesity, and the con ser va republicans are against this, because they see it as a big intrusion by the federal government, and so that the classic type of fight of the democrats versus the republicans over the size of government. >> and this is going to become the first lady's movement today, and what we will hear from her today comes after republicans wanted to allow for some schools to opt-out of these healthier guidelines. >> well, this is why we are seeing her speak out. she sees that some of the legislation is a threat to what she has been trying to do as first lady, and so she is ramping up the efforts on the domestic political side, and it is going to be interesting, tamron to see what happens after she makes a response to the republicans, and how the republican politicians respond to her. >> and mark murray, we will keep an eye on both of those events today. >> and right now, florida beachgoers are in danger of

be caught in a rip current, and in volusia county, our lifeguards, we can have as many much as 1,000 people in the summer that we rescue out of the water. >> and as i mentioned, moderate rip currents today, and what are you expecting forrer the rest of the week? >> we are expecting moderate through the week, and of course, the crowds are not like they were over the weekend, so i we will be having the water rescues, but just not as many. >> and so what are you telling the people who decide, listen, they still want to go out to enjoy a little bit of the cool water, and even with the warnings? >> well, absolutely. and volusia kocounty, we have probably some of the best beaches around, and so people flock here, and what we'd like to say is that one of the most important and basic things to remember is that if you come to the beach, always swim in front of the open lifeguard tower, and volusia beach has a app volusiabeach.org and you can open it up and lit tell you

>> the song is called "mission." recorded by a rapper who's recently become a celebrity ambassador for stand up to cancer and is helping raise money for cancer research. critics are praising the song's powerful message and lupe fiasco joins me now. this song is amazing. le personal testimony from cancer survivors that you hear in it as well. what made you decide to get involved? >> i guess my personal history is my grandmother passed away from cancer. but it was very sudden. it wasn't a drawn-out kind of battle or fight. that was few years ago. just recently had a few friends and different people in my life, specifically a professor at chicago state university named brother quasi who developed cancer last year and his reaction to it was he was going to fight it and fight it in a

very bold, aggressive, vigorous kind of manner. it was the first time i had ever seen a close friend of mine battling with cancer, battling with a disease on that level. you know, the music that i make has to be relative to what i do or who i'm around or personal, what have you. it was kind of like quasi needs a song. not only him but my grandmother. what about the guy across the street and my friend who has breast cancer and a friend of a friend who has lymphoma. it just kind of turned into this record. i didn't want it to be something sentimental or something like you sit down and be sad about but something where can you get out and go feel invigorated. >> i've talked to many cancer survivors. to your point, that is the desire to feel that they can fight, that they are not the victim of this disease, that they can win. some of the stories i pointed out in the song, you have survivors telling what they went through on your website. let me play a little bit of
