>> good to have you with us tonight. thanks for watching, i have always been a believer in this business when you're on a story there's always new developments, you have to stay on it. if it's big and it's impactful and this one is. we have covered keystone now for several months and this weekend will mark a small victory for landowners in south dakota and those who oppose the pipeline. on sunday the permit needed to build the keystone pipe line expires. after june 29th, transcanada will need to reapply for a new permit in the state of south dako dakota. it will be opening the door for more public comments and a hearing. the pipeline's review is now in its sixth year, proponents say this is outrageous it's taken this long. those who are opposed to it say it should never be built. time is on their side.

the oil which will be extracted from canada and travel through the proposed pipe line say it is tar sands, the most dangerous to ship through pipelines because of its corrosive properties. it is dangerous. it's even a heck of a lot more difficult to clean up if it's spilled than regular crude oil. despite the truth of the negative impacts there are still people in congress and especially in the senate who don't feel the same way as those opposing it and still pushing for the pipeline. >> a critical in my view piece of infrastructure that will transport safely the cleanest barrel of oil produced in north america, contrary to popular belief. >> i've got to tell you, that sound bite right there is one for the archives. nothing could be further from the truth but it's in the record

at a committee hearing. so we play it. we're not picking on senator landrieu, it is not the cleanest oil, simply is not. one of the biggest environmental concerns about the proposed route t. will cross over the aqua fehr, which is one third of the water supply to the middle of the country when it comes to agriculture. obviously grass root groups have taken hold and have grown and numbers in sport, we have seen public protest and legal battles and have seen delays that have plagued this project. native american tribes in south dakota have taken a strong position against the pipeline, tribal leaders claim they have not been consulted on the construction of the pipeline that goes over their land. transcanada in their opinion infringed on the tribal land and water rights and didn't properly survey the route to protect cultural resources, which of course has native americans very upset. native americans from the rose

bud sioux tribe set up awe prayer camp. many native tribes all over the united states have joined together with a group called the cowboy and indian alliance. the group brought its peaceful statement and protest to washington, d.c. we were there. the ed show visited the natives in both locations. >> this encampment, it means we're here. it means the people are here and it means that no matter what anyone thinks or perceives about what we're doing here or the people, we have never left. i think that's the biggest thing what this means. it means we've never left. >> i'm asking president obama to honor our 1868 treaty. there's an article in there, the very first article, article one, called the bad man clause. any bad man entering our

territories that is bringing harm to us, we are able to turn him over to the indian commissioner here and tell him we don't want them here. they need to honor our treaties and keep the bad men and bad evilness of the tar sands pipeline from coming through our lands. >> we're suffering from environmental genocide and we have no choice, we are dying. >> we are willing to die on behalf of our children. our way of life and the water. >> our people are so passionate and ready to die. our people have come up andside we want to be on front line and willinging to give our life to stop this because they know what it's going to do to the people. >> isn't that dangerous talk? >> it is dangerous talk? >> you just said your people are willing to die for this. >> that's the sad part. i would love to see as we protest, it's not our people are willing to die to make sure it

doesn't happen. that is scarily. >> i want to be clear, i'm not prodding you to say this. >> no, i'm saying it. >> this is from your heart of where your people are. >> this is where our people are right now and they are going to stop it, with their blood. and that's sad i don't want to see any of our people hurt or people die. but people realize what this is going to do. the impact they keep talking about the problem but not talking about the impact. the impact is our people are going to die because of this. and we have people right now that are willing to die for it. >> as the fight continues, landowners and native americans and activists are keeping a close watch on any step of the legal process. property owners are waiting for a ruling from the state supreme court. the ed show has been speaking with members of nebraska, a group dedicated to stopping the construction of the keystone xl pipeline. >> the best used car salesmen you'll ever find but only have

to sell you one car. when that car is sold, they are going to be out of the country. you know, there's no -- >> already out of the country. >> there's no warranty on this used car they are going to sell us. >> they had the power to come and condemn any of our properties that were on the pipeline route. even though they don't have a permit to be in the united states, to me that is totally outrageous. and the sad part is, if you follow the pipeline route, south dakota has the same thing, montana has very lax -- they have changed their imminent domain laws in favor of pipelines and that type of thing. they have -- they have greased all of the wheels all up and down the line. they have undue influence in so many legislatures. and we're seeing the power of money in america. >> if the public service commission changes the route which they possible will could do to go around the sandhills,

the state department has to do a supplemental review and that has to have public comment to see how the dominos are falling here. >> this activism is having an effect because you've already got it to the state supreme court. >> that's right. >> and it's another level they have to go through, which is really going to bring the environment to a big issue in 2016. >> there's no question. and the environment and energy has to be an issue of the generations before us fought about health care. energy and the environment, that's our issue our generation's issue and we'll make a difference on it. >> there's no question these groups are making a difference. republicans in congress are still pushing lies, they want this project to go through, conservatives are pushing the false information, exactly what it is, false information about job creation in energy independence. >> vifrmtal impact statement has come back and said will create no significant environmental impact and will create 42,000

jobs. the president says, we're in year six but i'm going to postpone this decision indefinitely. >> it's outrageous the way a small group of democrats refuse to even consider having a debate on this vital measure, energy security to our country. america needs the jobs. we need the energy. >> the reality is that tar sands are among the highest risk and highest carbon emitting oil in the world. the keystone xl pipeline won't help the united states move towards energy independence, only 35 permanent jobs will be created. it's a hazard to the environment and future of farming and too much of a risk to this day, i don't know how in the world i was ever in support of this. months ago i changed after i reviewed all of the facts, all of the environmental impact statements and all of the risk and what about the landowners? eminent domain is a big issue in

this country. when you own something you should have a say. cultural rights are also very important. and if there are treaties which i have not seen, but i am told, that the united states is on thin ice when it comes to treaties, with native americans and that they are not operating properly in going through the proper procedure. so there's a whole lot of facets to this story. it's easy to see why it has taken six years. but it is unfortunate to actually have united states senators stand up on the senate floor and talk about 42,000 jobs and it's a joke. i can't believe that hoefen was saying that. he comes from a state, north dakota that has plenty of oil. this country has plenty of oil. we have no shortage whatsoever. we do not have to take this risk. canada can move it to the west coast through their lands but a lot of their folks don't want that either. this is a big day because the

permitting process starts all over for south dakota. the question is, how hard is it going to be, get your cell phones out. tonight's question, can grass roots organizations stop big oil companies? text a for yes and b for no. you can always go to our blog and we'll bring you the results later on in the show. joining me tonight from south dakota, jane cleb, executive director of bold nebraska and also with us, of the rose bed tribal member. we should point out they are having a celebration there tonight on the rose bud reservation because this is a big deal, that this permit has run out. jane, you first. how hard is it going to be for trans canada to get repermitted? how much hurdles are there now because of the activism? >> it's going to be inkredsably hard. not only are landowners more educated about the risk, tribes

know this is violating their treaty rights. before they were not organized in the way that they are now. and so there's 50 conditions that transcanada was supposed to adhere for and the whole purpose of the permit was because they said american oil production was going down and our demand was going up. four years later that has actually reversed. so their project is literally falling apart around them. >> so what's the difference this time around? are we talking about hearings? are we talking about a long, drawn out processor will there be political powers that will rubber stamp this and get it through. senator thune is very much in favor of the pipeline. what about that? >> yeah, i mean there will be public hearings so the chair of the public utilities commission in south dakota is the only one left from the last time process and he is very open to landowners and tribes coming in. he wants to hear from them and made it very clear that transcanada's permit does expire because they were trying to tell the press and public it wasn't

going to. i think you'll see grass roots support and landowners coming to the table. i'm not quite sure there's going to be a lot of politicians standing there with them unfortunately. that is going to be a hurdle that we honestly don't care about. we're going to make sure our choices and route goes around the sand hills and water or that the permit doesn't get recertified at all, which is an option. >> if you could describe the momentum amongst the folks in south dakota that are against this. what's different this time around is this? >> well the momentum is continuing to grow and expand. it wasn't but a couple of months ago we first set this camp up. and we've had people here 24/7 for the last several months. we're prepared to keep going if need be. we're looking at the fuj victory with the permit expiring.

this is a when. it's a victory, but the war is not over. just like the u.s. soccer team, they are advancing to the next round but we haven't won it all yet. >> what about the tribal treaties with the united states? are they relevant to this day? would the united states be violating tribal treaties from decades ago if this pipe ksline were to go as scheduled as is? >> yes, the united states has been in violation of the 18451 and 1868 treaties. they are continuing to use the pipeline route and the process as it's been pursued thus far has been a gross violation of our treaties, of our land and right to clean water and right to an economic future. it wasn't but several weeks ago

that president obama was on the standing rock indian reservation which stratles north and south dakota, the stranding rock sioux tribe has been vocal about their opposition. they've sent a letter to president obama stating that if the pipeline were to be implemented, and routed as is they would take the united states to court over treaty violations. so it absolutely would impact our treaties and our children's future. >> jane, what's the political landscape look like in south dakota, rick weiland is the candidate going for that senate seat. how big an issue is this going to be? what's your sense of this? >> i don't think it is going to be a political issue to be quite honest. it hasn't risen to the level in south dakota because the politicians are going on the talking point that this is going to hip america be independent

and solve a jobs crisis, when we know this is not american oil, it's foreign tar sands going to the exports mark and threatens property rights. and that is a responsibility that we need to do. register more voters. i'm not sure it will happen this election cycle but mark my word, it will happen by 2016. you will not have a presidential candidate who supports the keystone xl pipeline or tar sands. >> since the state department's final environmental impact study, there have been some developments, it was released in january of 2014. two major tar sands mines have been canceling due to deteriorating market conditions. what do you make of that? >> well, you know, it underscores the lie that

transcanada and proponents of transcanada have been pushing over the last several years. the market has changed. this is foreign oil that's going to be pumped across american lands, refined in the gulf coast and shipped overseas, it's going to lessen america's position and standing in the world economically. and it's going to pose a huge environmental risk, domestically and overall it's not good for our economy. it's not good for our people. if trans canada wants to ship its oil overseas, then it needs to find a different route, perhaps going through canada. but as we stated in the opening piece, the people of canada don't want that either. >> it also shows the state department report is wrong. said it is inevitable tar sands will be mined and exported. because two mines have been shut

down -- it shows the state department is wrong. >> okay. finally, it's come to light within the last few weeks that keystone one needs repair all over a 98 mile stretch of pipe because of inadequate construction and failure. jane, your response to that? >> it's terrifying. landowners who have this pipeline on their ground, they do not sleep at night because they are not sure at any moment is a maximum capacity pipeline going to destroy the supply. it is unacceptable we have that risk of a pipeline going through families with that high of a failure rate of the welds. >> great to have you with us tonight. keep up the fight. this is a big victory that this permit has expired and the process starts all over for south dakota and doesn't look

rockefeller republicans. two observations about bill o'reilly. number one, he has more influence and number two, he's got kind of a love/hate relationship with talk radio. he tried competing with rush limbaugh and bombed out of a couple of years. but those two are still sniping at each other, just a week or two ago, bill o'reilly says, unlike limbaugh, i'm a fact based guy. and rush keeps calling bill o'reilly ted baxter. so there's a lot of noise going on on talk radio and blah, blah. >> is boehner taking his lead from right wing talkers to do the satisfaction dance? here's the president talking about boehner and the lawsuit that might be coming. >> we take these actions and

welcome back. greedy and careless oil companies are trashing our nation's environment. look at the facts. bp has been running ads saying that the gulf is open for business. after the 2010 deepwater horizon disaster, these ads are misleading at best. bp officially ended cleanup operations from the spill in june of 2013. but residents of the gulf coast know there is more work to be

done. this week, a 1200-pound tar mat was found floating near pensacola. the oil is still ever where. how about this? 4.6 million pounds of oil material were collected in the year 2013 alone. last month i spoke with the largest shrimp buyer in louisiana and told me the gulf is still a mess. >> bp still has these commercials saying everything is open and everything is good. it's not true. we still got three areas that remain closed from the spill. so some people thought it was doing good but it's getting less and less. if you look what happened in alaska five years after the spill when they had a complete collapse of the industry and i've got a bad feeling we looking at the same thing. there's a lot of people suffering down there. every day we've got to see it.

bp ought to be ashame of themselves allowing it to happen. >> to make things worse, bp is appealing settlements of people affected by the spill. the supreme court ruled last week bp must continue to make payments while appeals are ongoing. >> on monday, it was reported bp stopped pavements to claimants who opted out of larger settlement cases. bp caused this mess in the gulf and now running away before the job is done. meanwhile there are new oil disasters every day. in colorado leaked 7500 gallons of crude into the poudre river. in north dakota, over 300 oil spills have gone unreported since january of 2012. north dakota is now planning to double the pipeline capacity in the next two years. they will jump from over 700,000 barrels a day to 1.4 million

barrels a day. there's no doubt oil companies are polluting the environment. when something happens they don't report it or weasel their way out of the cleanup. what about those folks who have been affected down in the gulf? are they ever going to be made whole? joining me tonight on the rapid response panel, brant kuhn and reese halter. we spent time with both of you back during the oil spill several years ago. mr. kuhn, let me ask you first, will the people of the gulf ever be made whole by bp? >> hell, no, ed. the sad thing is four years into had litigation, 75% of claimants have been stonewalled and denied and bp filed a motion with the court where all of these cases are proceeding requesting the right to go back and make a claim to get their money back from the people they've made payments to in the past.

>> so where does this go? i mean, they have enough money. they are just simply going to wear people down as i see it at this point. and weasel out of paying and making restitution on people that have had their livelihoods disrupted. >> well, they have. they have worn down everyone. they've worn down the judicia judiciariry and executive branch, they have the resources and capital to do so and the individual affects victims have very little ways of combatting it. >> bp has stopped the cleanup, how much oil do you think is left? what does it tell you from your expertise on this when these tar bands keep showing up in massive amounts. >> well, ed, the gulf is very sick. let's look at what the facts here. the dolphins and blue fin tunas

are referred to as doctors of the sea, they prevent diseases from becoming epidemics worldwide. the doctors in the gulf of mexico are very sick. let me give you three examples quickly of what's going on. the largest -- 60 feet long, 65 tons and earth's record deep divers at 2 miles deep. the population of between 1100 and 1600 sperm whales are the most polluted whales ever recorded on earth. the gulf's dolphins are all suffering from a number of lung diseases that are directly related to the bp deepwater horizon disaster that pumped the

equivalent of 318 olympic size swimming pools of crude petroleum and another three olympic size swimming pools of oil dispersant into the gulf and lastly, the critically endangered eastern atlantic blue fin tunas, the 3/4 of a ton sprinters of the seas that can beat a ferrari off the line are showing my colleagues signs life threatening aridge mia or heartbeat irregularities. the population of these beautiful creatures is down 80% from the 2010 bp deep water disaster. >> this is -- you're giving us sound, doctor, that we don't

hear anywhere. it's like the country is not even paying attention. the damage has been horrific. you talked about the coral reefs and damages that's been done there. brent, is the supreme court ruling payments that they must continue a step in the right direction or is bp going to be able to nail that too? >> well, you know, there are -- they may still succeed in the ability to stonewall paxts, all they have done today is release the injunction stay in payments but there are underlying issues and problems in applying the rulings affect waited to date and how to calculate a loss and pay anyone. in the meantime, as i said before, bp today as their next step at the trial court level, filed motions with the court not only to continue this stay on paying anyone but actually they filed a motion requesting the ability to go back and reclaim reimbursement of payments in the

past. it is as nine. >> is this reversible? can the earth recover? can the gulf recover from what has happened? >> sure it can recover, ed, in 100, 250 years but i want to remind the audience, three out of every four breaths of air irrespective of where you live on earth come from our oceans and our gulf and our oceans are sick, man, we've got to protect our environment or there is no economy. >> amen to that. brent coon and dr. reese halter. we'll do more on this. i think the environment is a huge issue with our politicians and country is awake to this in many respects, climate change is upon us and it it's a lot different today afar as awareness than five years ago. great to be both of you with us.
