prisoner ready to be on his own? the plans for his release from army care. and on a lighter side, she's back, rosie returns to "the view" for season 18. break out the beanie babies and the koosh balls, this is "way too early." ♪ hey, everybody, good morning, i'm thomas roberts. it is friday, july 11th, welcome to "way too early," the show that doesn't have a prop budget. mom, and my sister if you're watching, it's time to order. let's get down to business here and our lead story, john boehner going forward with his lawsuit against president obama. the suit hinges on the president's action delaying the employer mandate of the aca in 2013. speaker boehner says the president effectively created his own law by doing it without a vote from congress. it's the latest pressure placed on the president. he shot back yesterday from texas.

republican senators introduced a plan to deport undocumented immigrants more quickly, modifying a 2008 law that some say has ham strung efforts. but for all the political moves, the surge of immigrants impacting states as far away as nebraska. and the problems that propel them to america in the first place show no signs of slowing down. stephanie gosk reports from guatema guatemala. >> every day just before dawn, central american immigrants pile into rickety wooden boats like this one. the owner didn't want to show his face, but he did show us the points where the boats leave. coyotes charge $7,000 per person, he tells me. the illegal journey to the u.s. begins here. on the street, we see a negotiation taking place. four hondurans, two of them only teenagers strike a deal with the man in the white hat. our producer overheard the conversation. this is a trip for men, he told

them, with no guarantees, we leave on saturday. i spoke with the guatemalan soldier on duty. he told me there are few immigrants and definitely no coyotes. >> well, relations are growing more strained with one of the united states' closest allies. over reports the cia turned a german intelligence officer. and as andrea mitchell reports, set up an awkward phone call between the leaders of the two countries. >> white house officials claimed the cia didn't warn president obama that an american agent had been caught by the germans more than a week ago. so when the president called merkel asking for help against vladimir putin, he didn't know to apologize. in other words, mr. obama was blind sided by his own spies. >> that was andrea mitchell reporting for us. the latest developments reignite tensions from earlier in the year when it was revealed the u.s. was taping the cell phone

conversations. a photo emerged that appears to show sergeant bowe bergdahl smiling with a taliban commander. this was posted on a twitter account. bergdahl appears to be thin and pale. the pentagon said bergdahl likely had no choice but than to pose for this picture. it emerged the same day as advisers told lawmakers that president obama was right to free five members of the taliban in exchange for bergdahl. an army source telling nbc news that bowe bergdahl is now close to completing his reintegration. he could soon be transferred from ft. sam houston in texas. and the military is determining how he disappeared in 2009. meanwhile, john kerry landed in afghanistan this morning. he's there to meet with president hamid karzai. and the candidates in afghanistan's disputed presidential election. now we turn our attention to

the middle east where overnight, at least two rockets were fired into israel. and it comes hours just after president obama stepped in to try and help end the escalating crisis. he called israeli prime minister benjamin netanyahu offering to broker a cease-fire possibly similar to the one negotiated during the 2012 conflict. president obama says he's concerned about the ongoing violence between israel and hamas, but also told netanyahu he supported israeli air strikes, which israel says are in response to rocket attacks. israel has not reported any casualties yet, but the anguish is growing in gaza where it is a much different story. palestinian officials say more than seven dozen people have been killed so far in israel's offensive, including 25 children and 15 women. well, back here at home, the man accused of murdering six people in suburban houston is set to be arraigned today in texas. prosecutors say that ronald lee haskell pretended to be a delivery man before killing four kids and their parents at their

houston-area home. he was once married to the female victim's sister and was apparently looking for her at the time of the shooting. the wounded, a 15-year-old girl survived able to call police alert enough to tip them off to what he looked like who was then captured. the alleged gunman created this standoff in a cul-de-sac. he was finally pinned in between two sheriffs vehicles. now, he had been jailed in the past for domestic violence and assault. same-sex couples are now saying "i do" in parts of colorado. county clerks began issuing marriage licenses after a state judge wednesday ruled that the state's marriage ban for gay couples was unconstitutional. that judge stayed his ruling to allow for appeals. but a district court judge refused to stop the clerk from issuing licenses and denver quickly followed suit. issuing marriage licenses to 17 same-sex couples. and this is samantha getman and victoria quintana.

pueblo county is expected to issue licenses to same-sex couples later today. marriage equality currently exists in 19 states plus washington, d.c. all right. let's shift gears and talk about business for a friday. wall street closed in red yesterday. however, things could have been a little bit worse considering investors' initial response to trouble at one of portugal's main banks. we're going to check in now jeff cutmore. how are we going to close out? >> it all revolves around the spirit of the bank in portugal and questions surrounding the viability of the holding company. today, though, a very different tone. it seems the markets are prepared to look beyond this narrow banking issue in portugal, and we have very much the market's higher here in europe. and looks as though you're going to get a rebound in the united states, as well. and i have to say to you, it was

an 180-point round trip. and people started to look into the detail of this story, they said it really isn't going to do serious damage to european banks as a whole. and it's certainly not a systemic crisis. i think already traders were starting to step back from selling over this sort of risk aversion panic that we initially saw. so you'll probably get a better day on the u.s. markets today. one story that i think it's worth looking at here. the ftc suing amazon. this is over apps that children have been using. this whole story of app purchasing, apple settled and said, look, we're going to set aside $32 million to pay back those parents whose children have used these apps inappropriately. amazon is pushing back at this stage. looks like this one's going to run a bit further.

clayton kershaw on the mound, san diego's chase headley. and with that, kershaw's pitching streak ends at 41 scoreless innings. the two-time cy young award winner. cincinnati, things get heated after reds' pitcher chapman throws a pair of fastballs up and in near the head of chicago batter. chapman would strike him out and eventually get out of the inning, but not before back and forth between him and the chicago dugout that clears the benches on this one. the umpires get things under control before any punches are thrown. the cubs go on to win this one, 6-4 after 12. we've got to show you this, one player takes the term head first a little bit too literally here. on the slide, check it out, his dive into third. he goes face first, chin's scraping across the ground until i think his feet got there first over his head. straight into the back. poor guy, though.
