something done yesterday. the gop-led house voted to bring a lawsuit against president obama. and they might not be the e-mails that everybody's been looking for. however, the gop released some e-mails from lois lerner they say expose her bias while performing her job at the irs. and then, what in the world did justin bieber say to actor orlando bloom that reportedly started an in-person altercation now being fueled by the biebs on instagram? this is "way too early"! >> hey, everybody. good morning. i'm thomas roberts. it's thursday, july 31st. can you believe that? whoa! july is almost over. welcome to "way too early," the show that is totally #teambloom. okay, so, let's get to this, because a lot to talk about this morning. and just before congress leaves for recess, relations are even more strained in washington. the house has approved a lawsuit

against president obama in a party-line vote. this lawsuit centering on the president's executive actions, which republicans say he has used to circumvent congress. speaker john boehner spoke on the house members' take in light of the lawsuit at hand. >> the oath only refers to the constitution, and our obligation to defend it. i said that with moments like this in mind, i said that knowing there would be times when we would have to do things we didn't come here to do. we didn't plan to do and things that require us to consider interests greater than our own interests. no member of this body needs to be reminded of what the constitution states about the president's obligation to faithfully execute the laws of our nation. are you willing to let any president choose what laws to execute and what laws to change? are you willing to let anyone tear apart what our founders have built? >> so, house leader nancy pelosi

blasted this move, and president obama riffed on what will go down as one of the least productive congresses in our history. >> this lawsuit, you don't sue somebody unless you want to prove that they are wrong. this is about the road to impeachment. and if it is not, the speaker can say one simple sentence -- impeachment is off the table. that's what i had to say in 2007. that's what speaker boehner should be saying now. >> they have announced that they're going to sue me for taking executive actions to help people. so, you know, they're mad because i'm doing my job. and by the way, i've told them, i said, i'd be happy to do it with you. so, the only reason i'm doing it

middle east, where israel is reinforcing its ranks, despite some of the obama administration's strongest criticism yet over fallout from its ongoing war with hamas. overnight, israel announced plans to call up another 16,000 reserves, bringing the total number to roughly 86,000. this move follows a violent day of clashes that saw at least 15 palestinians killed during shelling at a u.n. school serving as a shelter. israel says it did not target the school and was responding to hamas attacks. without specifically blaming israel, the white house condemned the deadly attack. it is the sixth time a u.n. school was struck. a u.n. spokesman says israel was told 17 times the school was serving as a shelter. >> we will soon have a situation where tens of thousands of people, if they continue to leave their homes in the streets of gaza, without food, without water, without shelter, serious chances that communicable diseases will break out. this is beyond unrwa, i'm afraid to say. we've reached breaking point.

it's time for the parties of the conflict to accept their responsibilities to the civilians caught up in this conflict. >> a separate strike in gaza left 11 members of one family dead, including 8 women and 2 children. more than 1,360 palestinians have been killed in the conflict, according to officials there. israel, meanwhile, has lost 56 soldiers and 3 civilians. meanwhile, the state department used some colorful language to describe a fake transcript that claims president obama told israeli prime minister benjamin netanyahu to end the gaza offensive. >> now, i know you don't want to talk about the alleged transcript, but -- >> i'll talk about it. >> okay. >> because it's complete crap. >> one of the things was -- >> technical -- complete crap. yes, a technical term there. >> in it, the president is -- >> it is! >> well, a brand new poll shows that a majority of americans do not approve of how president obama is handling the crisis. 52% say they disapprove, while 39% say they approve. in just a few hours, the republican-controlled house will

vote on a pair of bills that address the growing crisis at the nation's border, and some of the more conservative members of the republican party are now backing a bill from congresswoman marsha blackburn that would stop president obama from blocking the deportations of children who enter the u.s. illegally. house speaker john boehner is hoping to pass a separate bill that calls for $659 million to address the crisis at the border. but the lawmakers who met late last night with senator ted cruz say that plan does not go far enough and are signaling opposition to the bill. >> this bill allows us to speed up asylum for foreign nationals. why would we want to do that? if the american people realize that's what this bill does, they would be livid and they'd have every right to be livid. but i do think that the speaker's bill is in big trouble based on what i heard tonight. >> meanwhile, the democratic-controlled senate moved forward with its own bill, which calls for $2.7 billion in emergency funding. senators voted 63-33 to begin debating the legislation. 31 republicans voted against it.

the possible 2016 hopeful, senator marco rubio, voted in favor of it. he says he voted yes so he could make changes to the legislation. and two democratic senators considered vulnerable this november bucked their party. senators kay hagan and mary landrieu both voted against beginning debate on the bill. new e-mails released by house republicans are not doing much help. the ex-official at the center of the irs targeting scandal, because in an e-mail exchange with a colleague back in 2012, lois lerner made a profane remark about conservatives related to a talk radio show. she also said of those on the right, "we don't need to worry about alien terrorists. it's our own crazies that will take us down." republicans say the e-mails give further proof that lerner does have a bias against conservatives. there is an unusual move in the plagiarism investigation against senator john walsh. it all started after a "new york times" story accused the montana democrat of plagiarizing on his 2007 masters thesis. the u.s. army war college says the defense department will oversee the case and make the

final decision on whether any discipline is warranted. the school's provost says the dod will take over because walsh is a member of congress and a military veteran. democrats are leaning on an unlikely source in a renewed push to crack down on gun violence. during a very emotional hearing on capitol hill, alvin daniel, a card-carrying member of the nra and a self-described constitutional conservative, told the story of his sister who was killed by her estranged husband at a mass shooting in 2012. daniel choked back the tears as he asked for stronger laws against unlicensed dealers, saying if they were on the books, the chances are very good that his sister and two other women might still be alive. >> i'm republican. i'm an avid hunter, a gun owner, and i enjoy using my guns for target practice with my family and friends. i am a strong supporter of the second amendment and an nra member. i also believe in common-sense,

business news now. stocks were mixed yesterday as investors feared a positive report on the economy could lead to the fed easing off of its tapering policies. cnbc's steve sedgwick is standing by with more on that one. steve, good morning. >> reporter: yeah, very good day to you. it's actually quite a fascinating session. stocks ended flat, despite this enormous figure we had for the second-quarter growth of gdp in the united states, a 4% increase and a better-than-expected figure for the first quarter, revised up tweerd a negative 2.1%. the point here is for most of this year, we have had to wait for this number to confirm what a lot of people thought, i.e., that a lot of the contraction in the u.s. economy in the first quarter of the year was purely down to that unbelievable weather we suffered early in 2014. now we have the real evidence, and now the economy grew at an amalgamated pace, around about 1% in the first half of the year. that led the fed to say, look, things are good, but they're not quite where we want them to be to raise rates just yet. they are going to be getting rid of the taper, though -- getting rid of the quantitative easing and the taper by october, and by
