good morning, everyone, i'm tamron hall. this is news nation, developing now, the house and senate are in session right now in both chambers to complete important legislation by the end of the day when lawmakers plan to start a 5 1/2 week vacation. right now the house the taking up bills that deal with the border crisis. and final approval is expected for funds to overhaul the scandal plagued veteran's administration. all that with this congress on track to become the least productive in modern history. the house spent a good chunk of time yesterday in a heated partisan debate over whether to sue president obama. in the end, the house voted

came out swinging this morning and said republicans do not have time to -- house speaker boehner and the establishment are bending to the more conservative voters out there and what they want to hear and see. what's your reaction today as your colleagues prepare to go to vacation? >> well, my reaction is much the same as you heard from leader pelosi, the fact of the matter is, we ought to be spending our time here, getting americans back to work, getting them a livable income. and repairing the infrastructure of our country that's crumbling all around us. we need to be trying to fix this immigration system that we have in this country, that has not worked for years. and leaving little children on the border, and not coming out with punitive legislation, making it real, partisan. nobody is trying to sit down and

work with the other side, the speaker is a better person than that. i have known him for a long time. and i'm absolutely puzzled as to why he would walk away from every chance he has been given to sit down and fashion a compromise, find common ground. the fact of the matter is, nobody can have his or her way all of the time. and that's what seems to be the majority of his caucus feels that it's only a compromise when you see it their way. well, that's not the way the world functions and i really, really wish we could just come together, find some common ground, and fix our infrastructure, allow our children to get their kind of educational opportunities that they need, and really give people a livable wage, that's the kind of stuff we ought to be doing here. >> but you point out, i mean

this behavior, if that's the appropriate description, we have seen voters have seen over and over again here, when you say you are puzzled by speaker boehner's actions, i can't even imagine the words that some folks at home are saying that could be directed, quite honestly, depending on how you vote in both petarties, the botm line is what do we think is happening? meaning we the people who vote? >> i am hopeful that the voters will let their disdain be known come november 4th. the fact of the matter is, it's very clear that the president of the united states has tried time and time again to extend the olive branch to the other side, and it's been slapped away every time. he is still pleading for to us come together and to work together to get something done. but, there is an element within

the republican conference who are hell bent on impeaching this president and they're making no secret of it. that's what this lawsuit is all about. >> making no secret of it and making their voice heard yesterday. i just want to play a little of the debate that went on yesterday, some house republicans and what they said regarding this lawsuit. let's play that. >> by circumventing congress, the president's actions have marginalized the role that the american people play in create the laws that govern them. >> our constitution does not say that our president gets to write his own laws. the founders knew that was a bad idea. >> we cannot stand by and let our president shred our constitution. >> in your opinion is this the priority and not some of the other issues that we have heard republicans say are primary and most important, border security, for example. i mean the dollar figure the president is asking for, some

3$3.7 billion it appears that house republicans are wanting to provide $659 million in emergency funds through september to deal with the border crisis, that's a big difference in figures there. >> yes, it is. the president wants a permanent fix, the republicans want to just piecemeal this, enough money to go through the end of september, or as you know, the new fiscal year begins october 1. for some reason, they have calculated that this is a good note to start the election season from october. people have a vote of the nation on november 4th and why they want to crowd this kind of debate into this is beyond me, except they may see this as a

way to rev up their base. and they have calculated, as long as you can keep this immigration stuff alive, this anti-immigration, the better off they are with their base. but i would love for us to put the american people at ease. they ought to look at the surveys that are being done. that's probably why we in the congress are at our lowest survey numbers in modern history. i don't think it's in history, or even ancient history. we have never had it this way. but for some strange reason, they seem to enjoy being disliked and distrust and that to me is not a human way to do it. >> congressman clyburn, thank you very much for your time, we'll see what business is tackled today and we'll talk about it in our first read roundup what has or has not

happened in this congress. thank you for your time. developing now in the mid east where israel is now calling up another 16,000 army reservists vowing not to pull back until it has finished disarming hamas and destroying it's tunnels. the shelling of a u.n. school serving as a shelter for many women and children displaced by the fighting. that strike has drawn strong n condemnation. >> what do you think the united states would do if you had 200 million americans in bomb shelters? you had 3,000 rockets fired at you from contiguous territory by a terror organization committed to your destruction who were using their own people as human shields? >> joining me now, martin

fletcher. benjamin netanyahu said he won't agree to any proposal that will not allow the israeli military to finish this important task for the take of israel's security. we are determined to complete this mission with or without a cease-fire. tell us regarding this military, the number reservists numbers called up there. >> reporter: the 16,000 called up brings up the number of israelis called up to do military reserve duty in this war. up to 86,000, that is a lot of people for a small country like this. but the 16,000 called u up now are actually replacing residents going home. so there's a rotation, rather than adding to the full numbers. but either way israel is now completely prepared for a much larger ground invasion if called upon to do so but netanyahu told us in a statement, it's more of a limited goal than he said

before, which is to end, terminate fully the secret tunnel net work that hamas has built to go secretly under ground to attack israeli soldiers from the rear. about 60% want the war to end as soon as possible. but 90% say it must not end before the threat from the tunnel is eliminated. so behind the prime minister on that. meanwhile the israelis continuing to suffer along the border area, i mean spending time the last couple of days in border settlements, israeli people along the gaza border. people there are very frightened indeed, about half the people have gone to the north of the country to seek shelter from the rockets and the particular fear they have is the tunnels. they say we can live with the rockets, it's bad enough, it's

frightening, the loud outgoing artillery, the incoming rockets, but the tunnels, the idea that somebody can just suddenly pop-out of the ground, a dozen fighters pop-out of the ground near the school, near the county. everybody says we cannot live with that and that's why netanyahu says we will not agree to a cease-fire until that tunnel threat is eliminated. ayman, the investigate continues into what happened at that u.n. facility there. what's the latest from gaza? >> reporter: well, tamron, you can probably hear the fighter jets behind me. a short while ago, there were several rockets, by our count, at least half a dozen, five or six rockets that were fired in the direction of gaza. probably that's what led to the sirens going off in tel aviv, and a short while after that, now while we're just about to go on the air with you, we heard the sound, a thumping sound

believed to be that of an israeli strike targeted somewhere here in gaza. certainly hearing the sounds of drones above us, indicating that the military operation is still in full swing despite the condemnation that came through that attack at the u.n. school and also from many others regarding that attack at the market that happened yesterday. despite that international criticism, israel is still pushing ahead with its military operation and that is certainly even adding to the frustrations of ordinary palestinians and u.n. officials that we have been speaking to and it's special something that hamas is criticizing here. they say the silence of the international community and its inaction is precisely the reason why so many palestinians are being killed in what they are describing as massacres stay after day, tamron. a man sparks an ebola scare at a u.s. hospital. this has u.s. officials making

fears that the unprecedented outbreak of ebola in africa could spread to the united states triggered a major scare at a north carolina hospital. it vod a patient who had just traveled from africa. officials at the hospital were already on high alert amid new concerns the outbreak is about to get worse. now the peace corps is pulling more than 300 volunteers out of western africa and the world health organization says the number of people who have died from the outbreak has now topped 700. nbc's stephanie gosk has more from outside the charlotte

medical center where that patient arrived late tuesday. >> reporter: the cdc has asked u.s. health officials to watch out for ebola. including tells nurses that he had recently travelled to africa, they isolated him and cordoned off a section of the er. for seven hours charlotte medical center was concerned one of its patients may have ebola. it turned out to be a false alarm. cmc's infectious disease specialist says the hospital's response was the right call. >> after we learned more information, it's easier to back off than put measures into place later on down the road. >> reporter: but balancing protecting the public with trying not alarm the public is tricky. in sierra leon, they believe it's just the tip of the iceberg. >> to look behind this fence and look at the patients and you

know their chances are very small, it's horrible. >> reporter: the peace corps announced it's temporary removing 3 hung volunteers from the region while two volunteers are in a life and death struggle in liberia. >> she's sitting up and she was talking with us and she's able to move about. but she still has a long way to go. she's still very ill. >> reporter: with cases mounting, containment gets harder and harder. the big concern is air travel. direct flights out of the affected region reached 35 countries. but officials and medical experts in this country are asking americans to take a collective inhale and not panic. >> we haven't had any cases in the united states to date and i think there are the infrastructure in place in hospitals to try to prevent any potential threat to patients or health care workers. >> reporter: officials here at

trial for us in richmond. >> reporter: just a couple of hours ago i spoke to governor mcdonnell as he entered the courthouse. he thanked the countless people who supported him and his family. just seven months ago the mcdonnell's lived in virginia governme governor's mansion just blocks from here. prosecutors say mcdonnell once heralded as a possible running mate for mitt romney and his wife maureen accepted 100,000 in gifts, lav vich trip -- williams a colorful businessman is now the government's key witness and has been granted legal immunity, this was a business relationship, williams insisted in court. mooning the latest -- including a trip aboard williams private jet to williams lake front vacation home as well as use of a ferrari. as well as in cape cod,

five-week vacation. this congress is on track to become the least productive in modern history. joining me now live with some interesting facts and figures, nbc news political reporter carrie dan. just some of the things you guys have put together compiled to illustrate these are not just words when we say this congress has been ineffective. it's pretty incredible. >> the term do nothing congress came about in the 1940s during the truman administration. that congress passed 906 bills into public law. compare that so far to this congress, it's passed 142. so obviously a lot less, they're even on track to be even les -- last congress they passed 151 bills into public law. we have had divided government before but this is a precipitous

drop compared to recent years of what they have signed into law. >> when you look at for example, they're racing to complete action today on border crisis, we'll see what happens there, the highway funding which is you are urgent as well. the headlines today are about going after the president with the lawsuit about proceeding ahead. let's handicap first about what some of these moves may mean for republicans in the midterms. >> a point that a lot of republicans make, especially those conservative tea party republicans, it's actually better to have fewer laws being passed and becoming public law, tea party types will say, look, congress has done too much in the past, they're being overly active. that's an argument you hear from the other side. however for democrats and president obama, these are numbers you're going to hear over and over. obama came out yesterday and talking about how he has to take executive action. with numberless this low, congress does have a talking point. the tea party will say the

a suit monday claiming the county school board, school superintendent and principal of the high school are all responsible for the teenager's death. johnson's body was found rolled up in a school gym mat in january last year. the teenager is seen here in surveillance video that day. authorities call it a freak didn't. they say he fell into the mat and got stuck upside down. his family had a second autopsy done by a private pathologist which said the teenager died of blunt force trauma. they say it would be premature and inappropriate to make a public. a federal review has been going on for nine months so far, no findings have been released. joining me again, kendrick's parents, kendall and jackie johnson. thank you so much for joining us again mr. and mrs. johnson. again our thoughts are with you as we know your grieving

continues and these unanswered questions remain. but i would like to start off with your attorney first, c.b, can you tell us what's going on with this federal review, nine months now no findings, what have you been told? >> we have been told there has been at least one meeting of the grand jury and that we are currently awaiting an analysis of the video surveillance tapes that were taken from the school several months ago. >> have all of these surveillance video tapes been turned over? i know that was a lengthy process in itself. >> yes, as far as we know, it was all recorded on a hard drive on a computer system and we were advised by the u.s. attorney that it was consistent to one of the fbi's laboratories for analysis and that they should have some results from that analysis within the next few days.

>> mrs. johnson, mr. johnson, ms. johnson, i will start with you here. you decided to file this new lawsuit, why did you feel even with this federal investigation or review taking place that you needed to file this new lieutenant against the school there and the principal. >> because that's where my son was found dead, in their custody. >> and you believe that there are people in the school who have more answers than they have provided to you? >> yes. >> mr. johnson, in this lawsuit, it says, which include again the county school board, the superintendent and principal. it goes on to say that the defendants caused, encouraged or precipitated the ultimate assault upon kendrick lamar johnson, who has a result therefore died on or about january 10. can you explain to me what you were referring to in that lawsuit where you say they

caused and encouraged or precipitated your son's death? >> well, kendrick was on their premises, he was where he was supposed to be, he was doing what he was supposed to be doing. it was several things that happened at that school with kendrick and some other students and kendrick, we believe that if they would have handled that situation properly, this would have never occurred. >> do you believe that he had been bullied? or was the victim of some kind of violence at school before this incident before his death? >> yes. it was one of the students was -- had been saying to kendrick and to some of his friends that it wasn't over, you know, kendrick had came home and told us, he said that, you know,

like i said, if they would have handled the situation more thoroughly and more properly than the way they did, this probably would have never happened. >> ms. johnson, through this pain that you are enduring and dealing with every day, what keeps you going? what keeps you fighting for these answers? you say that you and your husband and your family have not received. how do you keep going. >> we keep going because it was my baby and it's my son and we know we got to keep fighting for kendrick because if we don't keep fighting for kendrick, there will be another kendrick after this if we let this die down. >> c.b., what's next here legally? >> what we intend to do with this lawsuits is to further the investigation that has yet to take place with the local sheriff's department, that we hope will be the result of the
