missouri. ferguson is cleaning up after another night of protest and unrest. had a small group of break away looters. they were met last not by police, tear gas, some of the things we saw earlier in the week. they were met by citizens who blocked them from entering some stores and looting any further. the latest anger surrounds the decision by police to release surveillance video. the video shows michael brown shoving a store clerk and stealing a box of cigars from a convenient store minutes before he was shot and killed. you're seeing the video there. the officer darren wilson. brown's family calls it a character assassination. we're expecting more in just moments. we have the live picture. that's inside where the press conference is going to be happeni happening. we have a picture as well from the outside. we saw people gathering a short while ago.

people were standing outside but everybody waiting for more information about exactly what happened between officer wilson and mike brown that could have led to this young man being shot several times. we still don't know how many but being shot. that's the information we're not getting yet. we do have several people standing by with me. we'll bring this to you live as soon as it happens. the key question why there's so much unrest and lack of trust between the community an police department is we don't know the details. they can't give us everything but some key details we do have which is why.

what -- i'll go with my fellows i do have. lisa is not ready yet. that key question will go to that officer's state of mind whether or not he thought mike brown was a robbery suspect. >> one of the things troubling about where this case is remember, for example, start with the police car. if we believe the officers account as told to us by the police he reached into the car. that itself was a crime scene and he drove that car away. there are multiple witnesses who have come forward telling their story. they have not yet given their stories to the police department. we know that the further you get away from an event there's more the possibility that the memory becomes fuzzy. people can change their stories. i think that this entire investigation has been compromised at too greatly from where the original events were. as this goes on, as we see the

civil disobedience, we're moving further and further away from the events of that night. >> how did this story change yesterday when that surveillance video came out? and the fact we're hearing he's a robbery suspect. >> it changed in a number of ways. you saw the police chief say that the second press conference that the officer did not suspect him of robbery when he interacted with mr. brown. by the police chief's own account the video that he released has nothing to do with the interaction and the loss of life of mike brown, number one. number two, i think the anger, we saw thursday night it was much more peaceful in terms of the change in police tactics of the protesters. i think by yesterday we saw anger and rage coming back again in terms of the release of that video. >> to your point about the

video, the chief's story keeps changing. we still actually, i don't have a clear picture and ai've been watching closely. he said it had nothing to do with him stopping him but when he got closer he saw cigars and he thought maybe. >> yeah. it's changed three times. they are not saying this but the ferguson police department is kind of stepping into the background now and letting the professionals, frankly, take over this thing. the state investigators and even more so the federal investigators because it's pretty clear that the ferguson police department just isn't equipped to handle a controversy like this. you saw the police chief gave a kind of halting performance where he kept stopping. could hardly speak. it's time to turn this over to the people who know what they are doing. >> the fbi and the justice

department have interviewed those witnesses long before the local authorities have. at least there is a record of those eyewitness testimony. >> they are investigating as well. we're standing by. you're seeing the live picture on the right of your screen. we're expecting the governor and the captain who is in charge, the highway patrol captain to step to that podium. you're seeing video on your left of what was taking place last night. there were people looting once again. according to our producers on the ground, it was small number of looters last night. nothing like we saw in prooefev nights. what you saw last night was the community, young black men stepping in front of some of those store fronts and refusing to let the looters in, protecting businesses themselves because in a large part police officers stepped back last night. there wasn't a lot of tear gas. there wasn't a lot of riot gear. of course, there was some of that out there but nothing like what we saw earlier.

an important part of the story that tells the full picture is the community has gotten angry at some of the others in the community and saying we're not going to let this stand. let me bring you back in. the story, the back and forth. will it go to mike brown's state of mind. if we get somewhere down the line in trial and officer wilson's defense wants to go to mike brown's state of mind meaning he was a robbery suspect. he saw a police officer and a police officer said something to him so he automatically thought that officer was there to pick him up for what he had just done. maybe he was a little more aggressive. is that an argument we'll see? >> possibly. even to flip the script, even if we accept everything that they have said. the narrative from the police department is true. witnesses have not said the

officer warned him. even if we accept it was him in the convenient store and he did shoplift and assault the man. does that mean he's waived all his rights to justice and he deserves to be shot dead. the police department's, with that backdrop, the police department's tone deafness has been incredible. now that they are in this phase where they are demonizing the deceased, a teenager who is dead while his parents are attempting to grieve, that only makes the situation more incendiary. i think it makes matters so much worse. it might be time for the police chief to step down. >> a couple minutes behind schedule. expecting the press conference at the top of the hour. governor nixon and captain johnson when they step out you'll hear it here live. it's time to let the

professionals step in. the former head of the naacp said maybe it's time for chief jackson to step away, take a leave. he's not protecting this community. it's almost like he's putting the community in further danger by everything he says. is it possible that this is a city of 22,000 people, this is a small police force who is probably never dealt with this kind of crowd control and not properly trained, not just to use the equipment but just trained when you see someone throw a rock that doesn't mean shoot them. trained to how to read people and judge what they are up to. is that part of the problem we're seeing is this is a little department not equipped to handle this. >> this is not just ferguson, missouri. how many thousands of local police departments around the country. you can imagine the variation of good versus bad training, if any training to deal with these situations. think about the summer and how

many unarmed black men and women have been killed at the hands of the police. the usa today story from earlier has roughly a two a week from a particular period of time over the last several years. >> those are with the ones we know about. >> i want to make sure we should be focusing on ferguson but this has ramifications beyond ferguson. >> what are we doing here? we're all a part of the problem. i'll take responsibility as well as being part of the problem but in the past week it seems like we have done almost everything but mourn an 18-year-old kid who was shot and killed because it seems like every time around and i'm told our lisa bloom is with us now and up and ready to go as well. we'll bring her into the conversation. again, lisa, i'm speaking here, this is very personal in a lot of ways because this is a black community and this is my community and i deal a lot an work a lot with young black men. the young black man shot and

killed on the streets of ferguson has almost his mourning took a backseat to rioting, looting and police video. how do we get back on track? i know you have a book out talking about just these types of cases but how do we get back on track to what we really need to be talking about and from everything else in a lot of ways just a distraction. >> bless you for the important work that you do with young black men. i call upon everyone not to leave this to the black community which is only about 12% of the population of the united states. this is an american civil rights issue. i've been a civil rights attorney practicing since 1986. i represent young black men in cases like this every day. this is up to all of us. this is an american issue. we need to all stand together and understand that there are too many shootings of unarmed, young black men in america. four in the last month.

one right here in my town of los angeles. i'm speaking at a rally tomorrow at noon downtown los angeles. sorry, 3:00 p.m. downtown los angeles at the police headquarters. this is a national issue. this is an issue for everyone of every color. this is intolerable. we cannot have unarmed young people shot dead in our streets. in the case of mike brown, laying there for 30 to 40 minutes minimum. there's a report in the new york times today that a nurse was begging the police to let her go out and render cpr to mike brown as he lay there dying. she was denied the opportunity to do that. that is appalling. that is the center of this case. yes, we're all interested in the community's reaction and the police reaction and even what mike brown was doing in the moments before, but the central issue is why he was shot. how he was shot? how he was allowed to lay there and die and how this is happening all across america over and over again. >> all right. lisa, thank you so much for

that. we always appreciate your passion. i know you're staying with us. we'll continue our conversation. we saw a little movement on the television screen there on the right side of your screen as we're waiting for the captain, the highway patrol captain, ron johnson who has been getting a lot of credit and being hailed a hero for calming things down in the community and the way he did it was to come out in solidarity with the community versus a police versus the community dynamic that we saw play out for several days leading up to the day he took charge. we'll hear from captain ron johnson and governor nixon. he's been getting a lot of criticism for the way he's performed. you're sighing over there already. the governor who has been in that community for the past several days but some of the criticism being a little late, being tone deaf in some of the things he's done. is this who the community, is this who the state, is this who

the country needs to be saying right now is a governor jay nixon or like you said leave it to the professionals? i know he's the governor but it seems some are better equipped to handle the situation better than others. >> whether it's better equipped or have a better sense of what the community needs. we did see him appoint ron johnson to take charge of this which seemed to calm the situation a bit. this is not such a surprise. he's a very conservative democrat. about ten years ago opposed the desegregation program where they bus children into different schools. he's never been seen as a friend of the black community there. there was a black state senator who could not contain her frustration on twitter and used a very harsh language against him. i think they're not surprised that they haven't seen him take a real leadership role on this.

>> we're taking this press conference live as soon as it happens. it's going to happen at any minute. >> whether or not governor nixon is comfortable with the issues he should have been there on day one to say this is not a problem of the black community. this is our problem. this goes to the foundation of our criminal justice system. he needs to be there to show he has a stake in this too as we all do. i would say to anyone who still at this point is looking at this as a problem largely that relates to communities of color, it's not. when you have whole communities that mistrust the police and do not want to come forward and feel they have a line of communication with the police that puts all of us at greater danger no matter where you are or who you are. i think the governor should have been out in front of this showing that every one of those people, every one of his con

stimp w constituencies that their life matters. >> what you're seeing us and what we have been seeing over the past several hours. looks like governor jay nixon about to take the podium. we had last night after a day of peaceful protest the night before and last night was the night that we saw things kind of flare up again. it's not in some of the ways we saw in previous days this week. you did have some people step out, were looting once again. i'll stop right there. let's listen in. >> i want to first start by thanking all the elected officials and faith leaders here with us for their work over the past week. on behalf of the family of michael brown, the people of ferguson and the entire st. louis region. the tragedy shooting of michael brown one week ago today and the vents that followed left a family grieving the loss of a son, a community wracked by fear and unrest and an entire world looking for answers and justice.

over the past several days i've heard from the people of ferguson, have heard their anger about injustice and intimidation. i've seen and unheard the unspeakable sadness of a mother who won't see her son again and the anguish of parents throughout the region struggling to teach their kids to trust among so much strife. like all the world, i've also seen over the past few days tremendous acts of grace, generosity and courage. people of all races and creeds joining hands to pray for justice for the family of michael brown and last night the courage and resolve of peaceful protesters who stood up against violent instigators. volunteers coming forward even in this morning's steady rain to help their neighbors pick up the pieces. as governor i'm committed to making sure the forces of peace and justice prevail.

that is why early in the week i called on the department of justice to conduct an independent investigation of the shooting death of michael brown. an investigation that is being beefed up with additional fbi agents canvassing the area over the next several days. i want to thank general holder. we had a good discussion yesterday and i appreciate de deeply his leadership and support. that's why two days ago as we saw escalation and a need change in shift, i put the missouri state highway patrol in charge of maintaining safety and security in ferguson. i want to personally thank captain ron johnson for his outstanding leadership in helping bring calm to the streets of ferguson while maintaining the rights of citizens to maintain in peaceful protest. that balance is important. the first amendment is extremely important. in times like this people be able to speak their concerns is vitally important. as the result of those actions we begun to see progress.

on thursday night peaceful protesters of all ages, races and creeds here in ferguson and in cities and towns across the nation, 80 separate cities called in one united voice for justice to be served. last night except for a very few the folks on the streets were peaceful demonstrators. we also saw a pattern develop where after hours of peaceful protesting small groups to the to the streets with the sbents of committing crimes and endarngiendarng i endaengerring citizens. that is unacceptable. each step of the way this week i've been in touch with local leaders. i've met with them to discuss the best course forward. i share their frustration and their conviction that we cannot allow the ill will of the few to undermine the good will of the many and continue to put the people and businesses of this community in danger.

if there was an easy way to separate those who hurt from those who help we would, but it's hard and sometimes especially at night we can't. to protect the people and property of ferguson today, i signed an order declaring a state of emergency and the imme menation of a curfew in the impacted area of ferguson. again, this is not to silence the people of ferguson or this region or others, but to contain those who are drowning out the voice of the people with their actions. we will not allow a handful of looters to endanger the rest of this community. we still need more answers about what happened one week ago. i will continue to push for those answers and demand transparency and expediency.

if we're going to achieve justice we must first have and maintain peace. this is a test. this eyes of the world are watching. this is a test of whether a community, this community, any community, can break the cycle of fear, distrust and violence and replace them with peace, strength and ultimately justice. it will not happen in one night, but that is where we will start. tonight let that journey continue. in the morning this community will rise with the sun to renew its quest for justice. now to go through a couple of the operational choices and we'll hear from a couple of officials. this challenging time it's nice to have veterans of law

enforcement working in a coordinated fashion. >> excuse me, you need to charge that police with murder. >> yeah. >> it doesn't take that long for an investigation. >> where's the indictment? >> why is he allowed -- >> the task that we have at hand, the task which i have the task to lead is a task first of all to represent the people of the state and the people of this area, but also to make sure that we have peace and security. let us go through the decisions that have been made and the implementation of that. we'll be glad to take questions. let me first introduce the colonel of the missouri highway

state patrol. >> thank you, governor. i command 1240 troopers from jefferson city, missouri where our headquarters is at. i cannot solve this problem from jefferson city, missouri. to recognize the resources he has to put in play when problems come up. two days ago i placed captain ron johnson in command of the highway patrol operations here in ferguson, missouri. he's the most outstanding resource that i as a colonel can bring to this problem in ferguson, missouri. i think you've seen his actions over the last few days. i think you've seen what he's capable of. i'm going to turn this over to him. he's been here for 12 years. he grew up in this community. he knows this community. he can far better solve this problem from i can from jeff city. i'm going to turn the podium over to him. he will announce this plan for the curfew and how to bring peace back to this community.

>> why does it take a long investigation for a killer cop? >> please tone it down. >> good afternoon. i have been tasked to provide security for the people of this community, allow them to right to speak, allow them the right to express their feelings. as far as the investigation that's not my task or the task of the highway patrol. the gophvernor has enacted a curfew to allow us safety for the citizens of ferguson but also maintain the right of the people. it will start today. it will run from 12 midnight is when the curfew will start till 5:00 in the morning. we will enforce that curfew in an effort to provide safety and security to the area. before i go on any further there's some things that when i was out yesterday in a crowd that i was asked about. i've been promising that i will

talk, i will communicate. the things we talk about behind closed doors, i will communicate with you. there was talk about having more eye os on this investigation. this morning the fbi brought 40 agents in and went door to door to try to find other witnesses that may have been a part or saw the incident. they contacted several witnesses and they went to several homes where people weren't there. the homes they went to they left this card. they were also pass this card out to clergy and if you are a witness or you have any information you can contact your clergy. you can look on the door of your home and you'll see this card. i would ask that if you fill out this card make sure you're filling out with some valid information. let's not send a lot of cards this invalidates those that have valuable information to make sure that the proper justice is done in this case. i'll answer any questions but i

can tell you the past few days i have seen a great people stand up with a lot of pride. i've seen great people stand up and speak their voice. i've seen people show compassion toward each other, strengthen each other and that's what we're going to talk about today is the positive impact that our community is showing on this nation and we will survive this and we will make a change. >> governor, i have a question for you. >> how are you planning to enforce your curfew law? >> before we get to lengthy questions i committed to our host to make sure he had the right to speak. i want to thank personally representative, reverend, friend, tommy pearson. this is your house, the lord's house and i would ask if you would like to make comments. we'll be glad to take questions. >> thank you, governor, and all

the elected officials and the law enforcement officers who are here. the greatest st. mark family church is just that. we're a family. we view this community as our family. we wanted our place to be open to anyone who wanted to come here and have their peace and have their say. we've not restricted anyone from coming here. i want to thank the governor for coming here today. we're in this community and we want to do our part to make it a great community. we, like everybody else, want to see justice in this case. i believe what the people that have been sent here from d.c. and other places, we will see justice. in the words of amos, as i step to the side, let justice roll

it was a very peaceful assembly. that's what we want that to continue to be along that stretch of street. i want to commend the law enforcement for toning it down, for pulling it back and showing a human side to this community. that's what we first have to do. we first have to relate to each other and look at the way we police this community and hopefully change it for the better. we will stop there and open it up for questions. >> governor nixon. >> you first. >> i understand you have the right to set a curfew. you also have the right to take the investigation away from bob mcculla. are you going to take the

investigation away? >> our focus is on the security here making sure we get peace. as i said before there's a number of people, people of good will, people of good strength that are working extremely hard to get justice. >> do you have that authority? >> i'm not going -- as i said when i got involved in this at an operational level our focus security and we'll maintain that focus while continuing to comment and support appropriately. another question over here. >> why is he not in jail indicted? we'd be in jail. >> how do you and captain johnson, how are you all going to enforce this curfew tonight peacefully without? are you going to do tear gas or bringing back military force? how are you planning to enforce

peaceful protester, or rioting. you will still get the same answers. tonight we will enforce the cure fu. we won't enforce it with trucks, tear gas. we'll communicate. we'll talk about it's time to go home. it's time to go home. if you have not seen a hand in hand approach, last night some things were different and you saw that. you saw that. i can tell you because someone is standing in the street there's not going to be an armored truck come out. you saw people sitting in the street and they had a chance to get up. that's the way it will continue. we're going to answer one question at a time. >> were you not awear of the swat teams were being deployed last night? did you know about it? >> i did. >> you gave that order? >> yes.

yes. >> tear gas last night. >> you ordered the tear gas? >> can i answer your question? >> yes. >> let him answer the question. >> there are reports that this happened without you knowing. >> let me answer the question. last night we had several officers that were trapped on a parking lot. they tried to get out. we sent an armored vehicle to help them out. we sent two armored vehicles to help them out. we had three officers injured. one officer deployed one can of tear gas. he was there. he made that decision. i got call on the phone and i said i'm back in route. i got back out of my bed and went in route and i said make sure we're not going to use any force that's not necessary and it was one can that got out. i removed those officers out and the next thing you saw was a group of officers standing on the roadway, and yes, that happened. >> why can't they release the

picture of the officer that killed michael brown? >> that's not part of my investigation. we can't answer that. we cannot answer that. >> captain johnson would you be willing to work with the ground peace keeper so we can can communicate when all those intend to keep peace are gone and those who don't intend to keep peace will be remaining. we have a person that can be in contact. can we have a direct contact with someone so we can say all the peace keepers are out? >> yes, you can. i've seen you out on the street. i've seen you out with those gentlemen with the red bandanas on your face. i walked up to you and talked to them. some were angry. i listened. i didn't walk away. i've talked to you every night and to them every night. i will continue to do that. we will be in this together. >> will you provide for our leader, two way radio so we can

say all the peace keepers are out before any additional is taken? >> we're not using a two-way radio when i'm there on the ground you can talk with me and walk with me. >> how do you find you after curfew has ended and everyone is not gone? how do we find you to let you know that all those who intend to keep peace are gone and those who don't intend to keep peace are staying? >> we're not leaving until we get justice for mike brown. i'm not going home. i'm on the streets until we get justice for mike brown. >> we got a question. let's answer this question first. >> this is very important.

>> will you finish answering my question. >> my name is malik shabazz. i'm the president of black lords for justice. as you well know on thursday night that my group and thanks to you my organizers along with the new black panther party and nation of islam that we are the ones that put those men in the street and we control the flow of traffic. i shut down the avenue at 2:00 and cleared everybody out. there were no incidents on thursday night. you were there. you witnessed that. what i'm saying is tonight with the curfew being at 12 midnight

it seems to be a tight curfew line that could be a prescription for a confrontation. i don't know if it's as easy as it is asking people to leave at that time as you may believe it to be. what i'm saying is right now we're organizing and we have at least 100 or 150 men working with the various organizations i just name and the national action network to make sure that this doesn't deteriorate into a situation where everybody's tear gassed and demonstrators look bad and it turns that way. is there any way that the curfew could be pushed back some and that there are some -- there is some dialogue or some rules of engagement because i don't believe that the police could enforce the curfew without a confrontation, but i do know that the forces that are under

our command can bring this to a conclusion with the demonstrators being able to get their message out, our message and bring this to a decent conclusion. >> it took us about an hour and a half to get everybody out that wanted to get out. >> my specific question is can the time be extended some and can the burden of ending the demonstration tonight, can that be on us so that we don't have what happened last night? it was falsely reported on friday morning that it just ended by magic. it did not end by magic on thursday night. it ended because we ended it and we have the dialogue with the demonstrators. they respect me. they respect us. we can talk them and get us to leave. >> they can still loot. >> don't get in that. >> that was only because we left

it to them. >> will you meet with the peace keepers to develop a strategy? >> we will talk. i will talk with you. can i answer your question? >> yes, sir. >> those groups that he talked about that helped us on thursday night, he's absolutely correct. when i met with the governor the next day i said i do not know the name of those groups, and i said they were gentlemen in black pants and black shirts. i said they got out there and did their job. i told that to the governor. i'll tell that to the nation. those groups helped and they are a part of this. be curfew is going to stand but i ask that you still help us and get it out. we have citizens that live in homes, elderly citizens that live in homes with kids and kids are going to school. we got to have our rest. we're angry. we may not be able to get out of my home and protest and i don't want to stop that. what they're thanking me for is

we're allowing them to voice their opinion. when i walked up here today there was a motorcycle group who walked up and said you tell us what time. you tell us what time. i ask that you help us. i'm going to tell you that we can't do it. we can't do it. through the gentlemen in the crowd and everybody say captain johnson great job. you turned this around. you had the crowd gone. he said you go ahead and do it because we were out there. i said you're right. captain johnson didn't do it. you do it. service some of those young men that were helping you and i appreciate it. >> we couldn't call 911. nobody was able to respond from 3:00 a.m. to 5:00 a.m. when the citizens that you're asking to help you, we call 911. we call the local police and everybody was pushing the bucket. it's like we're chasing our tail. you're asking us to help but we

don't know how to help you. >> that's why we're going to clear the streets. we did have citizens who call and we were unable to get to them. we're in the back room talking about 911. people are calling and not getting their calls. the representative talked about where should they call. you'll see a state patrol car or county police car get there. that's why we have to clear the streets. i know you're trying but people get sick at 1:00 in the morning. people get sick at 2:00 in the morning. let's work and get this part done and see what gains we made. here is the historical context for this. we think and the author of the book on sundown towns thinks this is the case. this town might have been a sundown town meaning if you were black in an all white town you could not be there when the sun goes down and it was a threat to your safety. that's the historical context so then a week later when you hold a press conference and give us no new facts or no incident reports, no autopsy report, no indictments and you have a press conference to say there's a curfew and that historical context, i can't believe it. it defies logic and sound politics. >> is lisa bloom still with me? let me get your reaction to what we just heard. anything you might have in the way of how in the world are you supposed to go about enforcing a curfew in a community. i see bars up. maybe don't have -- we do have her. we'll get her up.

what is your reaction to what we just heard and how will they enforce this? >> first of all, governor nixoni give him about a d minus for this press conference. he has such wall up between him and the community. he's there to say what he wants to say. he doesn't answer most of the questions posed to him. he doesn't connect with this community at all. captain ron johnson is authentic, honest. he answers the questions even if he has to give answers the community doesn't like. he connects with the people in the audience. he says i remember you from last flight. thank you for what you did. i think governor nixon can learn a lot from captain johnson. as to how they will enforce it, we have to have some hope that captain johnson will exercise the skills that he's shown so far. the primary issue at this press conference that the community is screaming about is never addressed by anyone.
