why he claims it is an abuse of power to actually charge him. for the land of the free and the home of the brave this woman is on a star-spangled mission. how she's lending her voice to a patriotic new record. this is "way too early." ♪ what so proudly we hailed -- good morning, everybody. hope you had a great weekend. i'm thomas roberts. it is monday, august 18th. welcome to "way too early," the show also on a mission for the undercaffeinated and the news hungry. right down to it. we have a lot of news to cover this monday morning. we begin in ferguson where violence returned to the streets more than a week after an unarmed plaque teen shot to death by an officer and just hours ago democratic governor jay nixon ordered the national guard to the city to, quote, help restore peace and order. for the second night in a row a curfew was in place and police and demonstrators were involved in some very heated clashes on

the streets there. hours before the curfew went into effect police fired tear gas at hundreds of protesters. ron johnson says the protests spiraled out of control and police had no other choice. >> molotov cocktails were thrown. there were shootings, looting, vandalism and other acts of violence that clearly appear not to have been spontaneous, but premeditated criminal acts designed to damage property, hurt people and provoke a response. >> also the other big news, a preliminary autopsy conduct the on behalf of michael brown's family shows the 18-year-old was shot at least six times including twice in his head, some bullets entered and exited brown several times. the aups found no gunpowder on brown's body which could indicate he was not shot from close range. he was shot after a struggle. officials have identified darren

wilson, a six-year police veteran as the officer who shot him. more than 100 people gathered for a rally to support him and collect donations for wilson and his family. ferguson police are facing strong criticism for releasing surveillance video before the shooting that they say shows brown pushing a store clerk and stealing a box of cigars. critics say the video was an attempt to tarnish brown and only fuel anger in the community. meanwhile, the governor saying he is outraged that the initial police response to protesters and press was so aggressive but new video emerges that shows an officer threatening a local radio reporter. >> get down. >> get down. out of here. get down. >> but amid the rises tensions the community of ferguson came together to church service and rally for brown's family.

the reverend al sharpton was among those giving passionate speeches. >> there's a difference between calling for peace and calling for quiet. peace means that we have equal protection under the law. quiet means just shut up and silenc silence. we are not going to shut up. there's a difference between an activist. don't loot in michael's name. we are not looters. we are liberators. >> developing news out of iraq where kurdish forces are celebrating a key victory overnight against islamic state militants and nbc news say they regained control of the dam. militants seized control of it less than two weeks ago, the largest dam that provides

electricity in northern iraq. the strikes destroyed several militant vehicles and a checkpoint. president obama notified congress about the new air strikes and said regaining control of the dam would protect iraqis civilians and americans serving overseas. despite the gains, islamic state militants there, one says he fears we are in more danger. >> before 9/11 there were single threat streams coming in, pretty serious, obviously they got in and conducted the attacks on 9/11 and now you have multiple organizations all al qaeda-minded trying to accomplish the same thing so isil said they want to take the people who have western passports. they're flooding into this country, thousands of individuals now signing up with isil to fight their jihad in syria and iraq have western

passports. that's what's so dangerous about this. >> what's happening in texas, the governor there, rick perry says an indictment issued him for abusing power is itself an abuse of power. he says in a statement in part, we don't set a political differences with indictments in this country. it is outrageous that some would use partisan political theatrics to rip away at the very fabric of our state's constitution." perry is accused of making good on/threat to veto millions of dollars for a state agency that investigates public corruption. the agency is run by democrat rosemary lehmberg who refused to resi resign. >> i did what every governor has done for decades which is make a decision on whether or not it was in the proper use of state money to go to that agency and i vetoed it. i stood up for the rule of law in the state of texas. if i had to do it again i would make exactly the same decision.

>> perry has found some unlikely backers on twitter. among them msnbc contributor david axelrod who tweeted the indictment seems pretty sketchy. we have an update on a story we told you friday about new texas national guardsmen on the mexico border. the associated press initially reported these troops of the guard they were part of the 1,000 that were called up last month by the governor to address the surge of undocumented immigrants crossing the border. the ap corrected it saying the texas national guard they're actually part of the counterdrug task force and the troops that perry ordered in july will arrive within the next few weeks. we'll let you know when they begin their official duties. ntsb is investigating the cause of a fatal freight train collision in arkansas that killed two crew members and injured two others. happened about 90 miles northwest of memphis when two union parker trains crashed into one another and caught fire. nearby residents awoke early sunday to the sound of an

explosion and 500 evacuated for several hours as a precaution. one train was carrying diesel fuel and the other had a load of alcohol. shifting our attention to monday business news where investors will keep a close eye on fresh housing data and volatility in ukraine for impact on the global economy, cnbc's geoff cutmore joining us with more. good morning, geoff. >> good morning to you. market indicators are positive right now. europe has got a head of steam up so the market should open in good shape. but we'll keep an eye on this housing data. it's housing sentiment number then later on we get housing starts and a look at joust how strong the strength is in this market. there are some economists who are wondering if it, in fact, is weak housing holding back the recovery so quite a lot to talk about in terms of what the housing data will tell us. i also want to talk about auto sales here. because, you know, some companies have gone early on labor day sales, ford, we

understand from automotive news started its labor day sales and gm has had to do the same basically they're doing chevy labor day deals and if you look around at the dealerships you can probably get zero financing for some years to come, or deferrals or a combination of both here and there are indications even as though the economy is picking up the average price for autos is off about 375 bucks this time around so there are some deals to be had if you are canny and you are good at talking to those salesmen. i always seem to number when it comes to the extras but you know how tough that -- what is it they say, that the last person who talks is the one who pays the most. >> we always love the good labor day deal especially when it comes to zero percent financing. testify us in on sprint and how they're trying to capture market share with a better deal. how aggressive are they being for their customers?

>> this is really good news, you know, if you are looking to get a new mobile deal at the moment, they're talking $50 or at least that is the suggestion that we're seeing at the moment that when they come out with this new pricing arrangement, it could be a $50 all you can eat in terms of data and talk and texting so that would be significantly disruptive for the mobile market at the moment because i reckon that's at least 30 bucks cheaper than t-mobile are doing it at the moment so i think you're in for a little bit of a pricing war kicked off by sprint which says, hey, good news for all of us paying more for everything it seems every day. back to new competition, it all helps. geoff, thank you. we got this great read that is out from slate's joseph stern who reports on why your favorite song as a team stay with you forever. in recent years psychologists and neuroscientists confirm these songs hold
