this battle sunday near aleppo, we're learning he could be from the same minnesota town as douglas macarthur mccain. another major development, the u.s. launched new air strikes against isis in northern iraq yesterday. those strikes came on the same day the mother of american journalist sotlov is threatening to kill issued an emotional plea to the leader of isis. >> i ask you to please release my child. as a mother, i ask your justice to be merciful and not punish my son for matters he has no control over. i want what every mother wants, to lives to see her children's children. i plead with you to grant me this. >> nbc news foreign correspondent joins us live,

aman, this second american, the state department officially says it's investigating, we're waiting to hear, but the number of americans believed to be fighting with isis is around 70 to 100, is what we're hearing? >> that's correct. in fact, again, we still don't know all the details and circumstances surrounding the second american's deaths, there are some anecdotal reports that he may have died in that same fight where that other american, douglas macarthur mccain was believed to be killed in fighting with other syrian rebels at the time. but it does give you a sense that this is a growing threat to american officials. 70 to 100 is going to be a primary concern for u.s. officials, not only those fighting, but already that there have been americans engaged in the fight. a video that was put out by the group showed -- not only for

u.s. officials that it's the americans that could pose a threat if they were to return to the u.s., but also european passport holders and we know that they are in larger numbers fighting in the battle field than americans. they could pose a major problem for the u.s. if they come back. because they could controversial so easily on their european passports. >> what about the new air strikes in iraq? >> they are con greg greating in and around various cities, particularly in the northern part of iraq, isis in the past couple of days has tried to spread out, making it very difficult for the u.s. to travel where they are gathered in large groups, keep in mind, they have large military vehicle that is have taken from the iraqi military. the u.s. is trying to soften targets in and around the area of the mosul dam. they're trying to solidify the area in and around the dam

because of it's strategic importance and it's certainly going to give -- as the isi sirks fighters spread out, there's concern that -- >> lastly, this emotional plea from steven sotlov's mother that was released yesterday, you feel for her, you understand certainly her pain, has there been any reaction from isis or any affiliation regarding this plea from her? >> it's a very sad situation tamron, you're right, it's very emotional, but no indication whatsoever that isis even has responded to the tape and more importantly is going to heed the calls of that mother. that's certainly a very troubling point. when you put this this context of what isis has been doing in the last several months, they have been killing all kinds of people, they are a very barbaric

organization. this plea from sotlov's mother was a very emotional plea. but to see isis responding to some sort of political gesture, trading something of strategic value for the group as opposed to simply appealing to them on a humanitarian level. >> aman, now to a massive cyber attack on u.s. banks, including jp morgan chase, the nation's largest bank. some suspect that russian hackers are behind this attack, that is leading to speculation on what this is -- let's bring in nbc news justice correspondent pete williams, he joins us live. so pete, is there any indication that this has something to do with those -- >> we know roughly when it took place, earlier this month, a couple of weeks ago, it targeted jp morgan and as many as four

other banks. then it starts to get sketchy, it's not clear exactly where this came from, there's some indication officials say it came from russia, but it could have been eastern europe as well. if it came from russia, some are speculating that perhaps it was in retaliation for u.s. sanctions. but one official says if the goal was to show the u.s. it was retaliation, why carry out what's, you know, an unnoticed attack at the time. usually if you want to get attention, you do what you call this denial of service attacks, where you get lots of computers to dial in at once, and you shut the website down, this is not that kind of thing. and finally, what were they after? they seem to have targeted as one official said gigabits of data, customer and employee data of at least one of these banks, but the banks jp morgan says they have seen no sign of fraudulent activity. were they trying to get

intelligence, were they trying to learn about future financial transactions? all of this is yet to be answered. >> all of this advice you repeated when we discussed the last major hacking of accounts, experts say this boils down to changing your password and other information? >> right, i mean this is a little like saying brush your teeth every day. >> yeah, it is. >> but we don't even know whether they stole pass words to credit cards or credit card numbers, account numbers, you know, the officials always say it's a good idea, the experts always say it's a good idea to regularly change your password, although i suspect few of us actually do. but the banks do say if customers notice strange activity on their accounts, they should definitely call the bank. >> we're talking again about the cyber hacking situation. those two powerful storms churning across the pacific and atlantic oceans, generating dangerous conditions on both

coast this is morning. in fact in southern california, waves as tall as 25 feet from tropical storm marie are tending life guards scrambling to save lives, but person was killed and first responders conducted they say 130 rescues in the last two days from san diego to santa barbara. the east coast is being hammered as well, with life threatening surf and rip currents generated by hurricane cristobal. that storm is blamed for at least seven deaths including those of two teenaged swimmers in new jersey and maryland. our meteorologist from our nbc station in new york joins me now with more. and steve, obviously you've been tracking this along with the team throughout the weekend. >> yeah, the good news tamron is that both storms are moving away from the united states. we're not going to see any direct hits, but we are seeing very rough seas from these storm systems. so we'll begin in southern california, where we do have a high surf advisory in effect.

that's where we're seeing seas of roughly 10 to 15 feet with these storm systems and we also will see very high chances of dangerous rip currents with the tropical storm marie. so with that said, here's what's happening right now. there's tropical storm marie right there, you can see it moving away from the united states, producing winds of roughly 45 miles an hour and located about 800 miles south and west of los angeles. here are the latest stats. right now winds of 45 miles an hour, moving toward the northwest at 15, but again, it is moving away from the west coast and over the next couple of days it will continue to drift off to the west and continue to weaken. now in the meantime, back on the east coast, we're also dealing with a high surf advisory, brooklyn and queens, southampton and nantucket, where we will see seas of eight to ten feet, all

thanks to hurricane cristobal. once these storms get into these mid latitudes, they really start to pick up speed. right now this thing is starting to cook. it's producing winds of 35 miles an hour. so it's barely a category 1 hurricane. but it's moving at 36 miles an hour so that's pretty fast for these testimosystems. as we go into the holiday weekend, high pressure is going to build downing and it's going to bring the northeast and this storm system will continue to weaken and move away. so good news there. >> thank you so much, steve, for joining us, and the texas dad accuse ed of murdering the drun driver who killed his children is free this morning and says nobody is a winner in this case. >> a lot of weight lifted off my back. i'm still destroyed, i'm missing my sons, always and forever. >> now prosecutors are defending their decision to try him for murder, with little physical evidence. we'll have the latest.

nbc's janice shanlian has more on the case, and what the father had to say as he left the courtroom. >> david and his wife broke down in tears after a jury found him not guilty of shooting the drunk driver who killed their 11 and 12-year-old sons. >> i've got a lot of weight lifted off my back, but i still miss my sons, always and forever. >> reporter: from the start, there was little physical evidence, no gun or witness to the shooting along a rural road. the truck had run out of gas and the boys were helping their dad push it. but prosecutors argued that he had a parent's motive, after

watching his children die. his attorney says investigators never looked for other possible suspects. >> they made up their mind on the scene that night and they never considered any other potential leads. >> despite sympathy on social media, prosecutors defended the decision to try him for murder. >> we believe that he commit this crime and we know that -- >> his family left court without comment. the realization after the verdict, no one won. >> there's a loss for everybody, not only did i lose my two children, i pray for my family, i pray for the family that god gives them the comfort and the strength to move forward, they lost a son too. >> a free man, but never free of the greatest of all losses. his children. >> and joining me now, associated press criminal reporter juan lozano who's been

covering the case. juan, let's first talk about the mood of that courtroom, when that verdict came down. what can you tell me? i know that this is a small community, and everyone knew, it seems, about this case. >> yes, the courtroom had been packed with the majority was with the relatives, but there are also relatives of the victim. and once the verdict was read, mr. baraha's relatives cheered a bit. mr. banda's family members were crying afterwards. so there was a lot of emotion in the courtroom when the not guilty verdict was read. >> when mr. baraha talked after leaving court, he talked about losing his children, and the other family losing their loved one, expressing that there is no victory here with this verdict. >> yes, i think that he

expressed that and also the district attorney expressed that. i think both sides, while they can't agree on who killed mr. banda, i agree that there were no winners in this case. two families ended up losing three skons, so it was a tragic situation for everyone involved. >> let's talk about this case, the prosecutor defending their decision to go forward, despite having -- there's no physical evidence here. there are no witnesses. you have a dash cam from the police car that shows mr. baraha attempting cpr, but little else do you know about that night? >> a circumstantial evidence case, certainly motive was not in dispute. but that doesn't proof murder. and in the end, the defense was able to persuade jurors that there was insufficient evidence to convict this man. but surely we wonder, in that

jury room what held sway, the emotion or the evidence? juan just described the scene in the courtroom. there were days apparently where supporters of the defendant outnumbered supporters of the victim to the point where the judge had to ask some of them to leave to make room. jurors are human. everyone feels awful about this story and i'm sure they did too. >> but the prosecution, it's responsibility is to look at the facts, look at the case they have before them. and what do you believe was the overriding or most important piece of evidence that they were hoping would secure a guilty verdict here? >> they tried their best to link the dwefendant to the crime. so the fact that there's an empty holster in his home, that there's ammunition that may match the crime. that there was a witness who discussed seeing the defendant go back to the car, although in the end, that witness did not get the prosecution's case forward. it's not that they lacked evidence, it's just that the defense did a really capable job of telling the jury, look, they just haven't met their burden.

>> but there was no gunpowder residue on mr. baraha. >> it's the prosecution's job in the first instance to bring the conviction home, and you heard the da say we thought he had the right person. now no one's been convicted of this murder, but the defense did an equal job of giving joourors what they needed to come back with a not guilty verdict. >> this is the kind of county, the kind of community where people are related to one another, you know or work with an individual, this is not something that just -- it may dissolve from the national headlines, but not for them. >> mr. baraha told reporters yesterday that he's hoping to just to be able to move forward now and to start finding clo iie regard to the loss of his two

reality show cops has been killed while working on that show. 38-year-old bryce deon. was hit by a stray bullet. it happened as officers interrupted a robbery in omaha, nebraska. the suspects shot at police with what turned out to be a pellet gun and the officers returned fire. footage from to the camera crew is being reviewed as part of this investigation. dion had worked for cops for seven years. the chief of omaha police is being felt by the entire department. >> my concern right now is for the cops production crew, their co-workers, their family, my concern is with my officer who is are taking this extremely hard. i am telling you bryce is our friend. this is as if we lost one of our own. >> and joining me now from lincoln, nebraska, is reporter vaughn carson. vaughn, thank you so much for joining us.

rural area, the crews are traveling along, i assume they won't have the same training or expertise as those officers but they're facing the same dangers. >> that's one of the more nuanced aspects of this story. the omaha police chief said does he regret the decision, of course he does now, knowing what happened. but he originally allowed cops to come along with them as sort of a community outreach. he wanted the opd to be a more transparent body and that he does not regret doing. unfortunately, this turned out very awry, and he could not have predicted that, it does say something about how police units are going to respond. >> will they change some of the procedure? i know that he was wearing a bullet-proof vest, he slipped in a gap in the vest, that's according to the police department there, but do we know if there are going to be

even if it's one, that one dad gets to go home and one child's life is not ruined as a result of this kind of accident? >> well, as you said, this was the second time this has happened. the one in connecticut was kind of an amateur thing. also with an oozi. the -- for one accident, i don't see changing the entire system that we're doing, we have lots of gun ranges that do this. my problem here is it don't want to there the guy under the bus, woutz everybody realizing there could be things that have gong wrong, the stock could have broken, she could have slipped. the gun needs to be examined and the whole circumstances before we look at changing the laws nationally. it is a tragedy that this guy died. i will agree. but, you know, we have how many hundreds of children devin brro

officials in st. john the baptist parish near new orleans are monitoring the water and treating it with chlorine after test results confirm the presence of the deadly amoeba. an emergency order was issued late yesterday. however, officials stress the water is safe to drink and there are no reported injuries or illness. police in idaho are searching for an inmate who escaped from jail with part of it being caught on camera. security footage shows nicholas grove hopping over a razor wire fence and running away tuesday morning. he'd been in custody for alleged unlawful possession of a firearm by a felon. officials are searching oregon where he lives. and star player and captain of usc football team josh shaw is now admitting he made up that story about leaping out of a window to save his 7-year-old nephew drowning. it drew national attention after being posted on the team's website. after questions were raised about what really happened, shaw released a statement yesterday saying he was, quote, wrong to to tell the truth.

>> i love you have your hops earrings. >> yes. >> here you are this woman in what's seen as a male driven, not just seen as it is statistically the numbers showing male driven industry. how did you find the courage and inspiration to leap in? >> i love good beer, and i love cooking, and i started making the beer in my apartment in harlem because i love cooking with beer and i was cooking with a lot of other great beers and started experimenting. the harlem renaissance was taking off, or the second one, and i was encouraged to take the brand further and try to build a brewery in harlem. >> for those at home who may have a good idea who may, for example, be cooking up some kind of product in their home. a skin care cream. and wonder, how do you take it from a dream in the kitchen, a dream in your home into something larger, what's your advice? >> my advice is to never give up. you've got to really stay the course. you've got to take those nose and turn them into inspiration

and keep going until you find that open door. it's one door at a time for us. one beer at a time knocking on doors. continuing to just get the word out about what you're doing and sharing your passion with other people. >> financing is always a huge problem for small businesses. how did you overcome that? >> liquidation of every asset i had. when you're passionate about something you take everything you have and put it into your dream. we literally did that. and asking friends and family to pitch in. we're also doing a crowd funding campaign to raise funds for our brewery. it's just really getting the word out there, putting it out there in front of people. >> i don't like to use the word fear or afraid. but here you are putting all your cards on the table. >> every last one. >> you are cashing in all the chips. how did you fight the concern that -- and i could walk away with nothing here. >> i fought it because every time we got a really positive response from our restaurants and people that loved the beer, that kept us encouraged.

so that motivation and that inspiration from people that really believe in what we're doing and support our products, that's what fuels us. >> as a woman in this industry, did you face particular challenges or did you never focus on that? >> we faced and continue to face many, many hurdles in this business. i'm working with my partner now who is in the studio with me. we're out here every day. we leave here. we're going up to the rainbow room, taking them some samples. there are challenges but you just allow that positive feedback you get to continue to fuel those nos that you get. still a lot of open opportunities and possibilities for the brand. we focus on that more than the challenges. >> this is sugar hill with me. my colleagues and dear friends at the "today" show, hoda and kathie lee, they drink wine every day. >> you're a natural at that. >> i'm a texan. >> whoa. >> oh, that's delicious. >> thank you very much.
