and a thriller as the major league playoffs get under way. good wednesday morning, everyone, i'm angie goff. it is here. the first confirmed ebola diagnosis in the u.s. a man is critically ill at a dallas hospital after visiting liberia. and now the scramble to figure out if he infected others. nbc's jay gray is in dallas for us this morning. >> reporter: this morning the first patient diagnosed in the u.s. with the deadly ebola virus continues to receive treatment from a team of experts inside this dallas hospital. >> our staff is trained and prepared to take care of patients with a variety of infectious diseases including ebola virus disease. >> reporter: they will have help from the centers for disease control. a medical team has been rushed to texas to assist in the treatment and track down and monitor the handful of people the patient had had contact with after flying from west africa on september 19th to visit his family in dallas. >> the bottom line here is that

i have no doubt that we will control this importation or this case of ebola so that it does not spread widely in this country. >> reporter: ebola is not an airborne virus. instead it's transmitted by direct contact with blood or other bodily fluids from someone infected and already exhibiting symptoms of the disease. more than 6500 people have been diagnosed with ebola in africa. more than 3,000 there have died. >> it's a severe disease which has a high case fatality rate even with the best of care. but there are core tried-and-try public health interventions that stop it. >> reporter: a procedure that for the first time has been used on an ebola patient diagnosed on american soil. doctors here will not discuss their treatment protocol including any experimental drugs that the patient may receive during his stay here. that is the latest live in

dallas. i'm jay gray. angie, back to you. >> jay, thanks. accused white house fence jumper omar gonzalez will face a judge later today. now, at a previous hearing the judge ruled that he'd be held without bail, but that could be revisited. meanwhile, the secret service is under fire. the agency's director was questioned by lawmakers yesterday. at the same time, a new report says the secret service allowed an armed security contractor who had a criminal record into an elevator with the president on a recent trip to atlanta. nbc's tracie potts is live from washington. and tracie, there on the hill, lawmakers, they don't seem the least bit satisfied with that hearing. are we going to see more backlash today? >> reporter: well, we certainly could, angie. good morning, everyone. and the interesting thing about that is it's equal. democrats, republicans seem equally outraged about this. and now we're getting new information that three days before the president -- before his family, i should say, experienced that fence jumper, the president himself was at risk.

>> i want to thank dr. freeden and everybody here at the center -- >> reporter: a new "washington post" report said when president was at the cdc in atlanta, a security contractor with a criminal record and a gun was standing right next to him in the elevator and that the man was never screened. >> don't let somebody get close to the president. >> i will make sure that it znlt happen again. >> reporter: this comes after a new report that the white house fence jumper was stopped by an off-duty officer who just happened to be nearby. director julia pierson admits agents did not follow protocol. >> i don't sense from you, director pierson, a sense of outrage about that. >> i wish to god you -- you protected the white house like you're protecting your reputation here today. >> reporter: omar gonzalez is in court today facing three counts for jumping the fence and making it all the way into the east room of the white house. initially the secret service said he was stopped just inside the door. >> were you lying to the american people, or were you misled by your own agents about where the intruder was tackled?

>> the secret service is conducting an ongoing investigation. >> tremendous restraint is not what we're looking for. the message should be overwhelming force. >> americans know that the next attempt to take the white house may not be by a crazed solo knife-wielding veteran with ptsd. it could well be a planned attack from a terrorist organization. >> reporter: and there's another concern, too, that agents, the rank-and-file, may be afraid to speak up to their superiors. director pierson tells congress that is unacceptable. we'll continue to follow it today. angie. >> tracie potts live from capitol hill, thank you. the mayor of los angeles suburb was shot to death following an argument with his wife. according to officials, the mayor of bell gardens reportedly got into an argument with his wife. his 19-year-old son tried to intervene. and after allegedly punching his son, officials say his wife got

a gun and shot him several times. his wife was questioned but released late yesterday. the district attorney will decide whether to press charges. crespo and his wife were high school sweethearts and married nearly 30 years. in california, two new laws get tough on guns and bags. first, firearms. families can now ask a judge to remove guns from a relative deemed a threat. they'll also be banned from buying them. and no more using these things, those plastic bags. those are going to be phased out starting next summer. the change hits supermarkets first. every year it's estimated that californians tossed out 13 million plastic bags. in china, tension as national day which celebrates independence is honored. ♪ in beijing, it was business as usual. a flag was raised at tiananmen square. more than 100,000 were on hand. but a different scene in hong

kong as a swell of protesters gathered. pro-democracy backers surrounding the business hub there. protesters gave the government until today to meet their demands, but leaders refused to budge. growing outrage days before one of america's notorious convicted cop killers speaks to college grads in vermont. officials at godard college say it was the students who selected jamal as their commencement speaker. he will give the speech this sunday via a pre-recorded video. abu jamal is serving life in prison for killing a philadelphia police officer in 1981. he fought for years against his original death penalty sentence. in 1996 he received a bachelor of arts degree from the private liberal arts college. pennsylvania's u.s. senator pat toomey called the college's decision, quote, outrageous and users are giving the college's facebook page one-star ratings. they're calling the move disgraceful and calling on the administration to resign. the future hall of famer

welcome back. police in pennsylvania found two functional pipe bombs in the pocono mountains. they're the latest items thrown away by the man wanted in the ambush style killing of the pennsylvania trooper last month. it is the second dui arrest for 18-time gold medalist michael phelps. and now branding experts are telling nbc that it could cause sponsors to back out. phelps was arrested and charged with dui in baltimore late monday night after he was spotted driving 84 miles per hour in a 45-mile-per-hour zone. phelps apologized to his fans on twitter, saying he was, quote, deeply sorry to everyone i let down. end quote. police in arizona arrested this man nearly a month after this surveillance video. this camera on a bus captured him brutally beating the driver there. it all started when the passenger wanted to be let off naer a dry area away from pulgds and water and the driver refused. the driver did suffer a

we think attractiveness has something to do with it. and that's your morning dish of "scrambled politics." for more on the secret service security breach, i'm joined now by "chicago sun times" reporter lynn sweet. lynn, good morning to you. >> good morning. >> so the secret service story, it just seems like it keeps getting worse. and as we watch these new security breach bombshells continue to drop, the big question this morning i think a lot of lawmakers and a lot of americans have is our president in danger? >> well, i think the thing to remember is nothing happened in these other incidents. more than the fence-jumping incident, the other revelation that happened in these string of stories is that he was in the elevator in atlanta with an armed -- with a security guard who had arms -- a gun on him and his detail didn't know it. that's perhaps more serious. you know, during the testimony at the house hearing on tuesday, it did seem like there was some common-sense things that the

secret service was not doing. you know, people in washington wonder just why isn't the fence higher around the white house? so i do think the president is safe because in the end, nothing happened. but on the other hand, you can't underestimate the seriousness of these breaches. >> yeah, and lynn, when you mentioned that hearing, i want to touch on that because julia pierson who we just saw right there, julia pierson is in charge of the secret service. and you know, she's catching a lot of heat this morning because lawmakers didn't appear very satisfied with what she said. she didn't really answer the questions that they were asking her. a lot of them were yes or no, and it seems like she danced around them. is this going to hurt her job? is her job on the line? >> she's new, so perhaps not. but i think her credibility already has taken a beating before the house committee and oversight and government reform. part of what she probably didn't realize is that she needed to show more overt concern than she did. you know, i don't know her.

maybe she's a very cool and collected person, but it was clear that what lawmakers want -- both democrat and republican -- is to show some, i guess, outrage at what happened on her watch. >> yeah. with her saying she's taken responsityway from that hearing saying they just don't believe her. thank you so much, lynn sweet. and just ahead, the uproar over caffeine-infused underwear?
