i'm thomas roberts, welcome to "way too early." the show that has moves like elaine from "seinfeld." great to have you with us. let's get to it. we're going to have more on politics in a moment. first, breaking news out of south africa this morning. olympic runner oscar pistorius has been sentenced to five years in the 2013 killing of his girlfriend reeva steenkamp. he was found guilty last month of culpable homicide. his legal team told reporters this morning they expect him to spend ten months behind bars with the remaining time served under house arrest. obviously, a developing story and we'll wait to see if we hear anything from oscar pistorius himself. president obama has cast his vote in this year's midterms. monday he was in illinois for early voting. in a radio interview with al sharpton he spoke about the limits of his own ability to

help democrats keep their seats. >> a lot of the states that are contested this time are states that i didn't win. and so some of the candidates there -- it is difficult for them to have me in the state because the republicans will use that to try to fan republican turn out. the bottom line is these are all folks who vote with me, they have supported my agenda in congress, they are on the right side of minimum wage, they are on the right side of fair pay, they are on the right side of rebuilding our uninfrastructure, they are on the right side of early childhood education. so this isn't about my feelings being hurt. these are folks who are strong allies and supporters of me, and i will tell them, i said, you know what, you do what you need to do to win. i will be responsible for making sure that our voters turn out.

>> so president obama also made life more complicated for those same democrats earlier this month while talking about his economic agenda. >> i'm not on the ballot this fall. michelle is pretty happy about that. but make no mistake, these policies are on the ballot. every single one of them. >> meanwhile democrats around the country are trying to fire wall their excampaigns from the president. here's an ad in georgia. >> have you seen this picture? it's the one david perdue used to try to attack me in the campaign. it was taken at an event honoring president bush, who i worked for as ceo of his points of light foundation. >> she used another image earlier this year and because he's endorsed her republican opponent, the bush camp asked

her team to stop says she's disregarded his wishes. but they are staying alive in the latest wave of polls. allison grimes who saw money dry up is down just one point to republican senator mitch mcconnell in the blue grass poll of kentucky. as we look at new hampshire, senator jeanne shaheen is hanging on to a lead over brown. kay hagan is also up three over republican thom tillis in north carolina. and greg orman is dead locked with incumbent pat roberts. president obama presenting another change of heart on the issue of marriage quality. in an interview, the president says he believes the constitution allows gay and lesbian couples to be married. he says, ultimately i think the equal protection clause does guarantee same-sex marriage in all 50 states.

appears to complete a full shift, a full evolution on his views on his issue. when he first ran for president in 2008, you'll recall then senator obama believed marriage should be between a man and a woman adding i'm not in favor of gay marriage. still he said he did support civil unions. in 2010 president obama said his views were evolving. within a few months he ordered the justice department to stop defending the marriage act which prohibited the federal recognition of same-sex marriage. and then six months before the 2012 presidential election, president obama announced he was in favor of marriage equality but believed it should be worked out on the state level. days after vice president joe biden announced his support for marriage equality while on "meet the press" which forced the president's hand on that issue. a republican candidate for congress in south carolina is catching heat for a facebook post that criticizes gay

couples. anthony culler is running against james clyburn. in the post he says, quote, same-sex couples that seek to destroy our way of life and the institution of marriage are not cute and cuddly, but rather for those that are old enough to remember the movie "gremlins" that will only destroy our way of life. these people are bullies and their hateful nature is easier to see and hear. he's since defended those comments calling his critics bigo bigots. a libertarian is urging him to drop out of the race and is running as a write-in candidate. alabama state house speaker mike hubbard has been arrested on 23 counts of felony corruption. the grand jury indictment accuses the republican of using his office to benefit his own business and soliciting help from former governor bob riley.

he's a transformative figure in the state of politic there is and he was one of the architects of the 2010 election cycle routing them out of control of the state house for the first time in more than 130 years. he said in a statement, quote, friends, if there was any doubt that this was a political witch hunt, i think it is pretty clear right now that is exactly what it is. let's talk some business news. another banner day for apple. the tech giant beating its own expectations reporting 13% increase in profit on the same day it launched the new apple pay feature. jeff cutmore joins us live from london. good news for apple, but there are some weak spots, but many more bright ones. >> apple crushed it with these numbe numbers. record iphone sales in access of $39 million for the quarter here. they did strong iphone and macsales. it's the ipads that is the area

of weakness. there was a 13% decline in ipad sales. that's just one area where maybe they could do better, but tim cook saying they have incredibly strong demand right now for the iphone 6, which suggests that the next quarter is going to be a strong one for apple going forward. so in the round, apple doing very well for shareholders. one company running into a few head winds is staples. oh dear, how long do we have to hear these stories? the latest in a long line of retailers telling us they are investigating breaches of data as it concerns concerns in a number of their stores. right now we don't have full details on exactly how many and what the cost is going to be, but clearly staples has some issues it needs to address near. this just goes on. we had sears, home depot, you just wonder who is going to be next and why they can't be more

secure with our data. >> unfortunately, they are in good company of other trusted brands. so we'll follow that. geoff, thank you for your time. u.s. health care workers treating ebola will be following new procedures. the new rules include making sure no skin is exposed and a supervisor is present. the group doctors without borders uses similar protocols. a study in the medical journal predicts of the three people could travel from west africa each month. marco rubio is planning to introduce legislation to temporarily ban travel to the u.s. from liberia, ghana and sierra leone. and a new ebola czar ron klain will not appear at a house oversight committee on the response to ebola.

the white house is saying he's starting his job on wednesday, but other officials they are going to be there to testify. meanwhile doctors say the freelance nbc cameraman is doing well and could be home later this week. and the world health organization is praising nigeria for being free of the ebola virus. it's been 43 days since a case was diagnosed in that country. monica lewinsky is back in the headlines after joining twitter and making her first public speech ever. she addressed the forbes 30 under 30 event where most of the guests were likely too young to know the details of her back story. >> 16 years ago fresh out of college, a 22-year-old intern in the white house, and more than averagely romantic, i fell in love with my boss in a 22-year-old sort of way. it happened.

time for sports. we begin with troubling news out of the nhl. slava voynov was arrested on suspicion of domestic violence. police responded to a residence after a woman heard screaming. when officers aarrived, there was no answer. police received another call saying a woman was being treated at a nearby hospital for injuries possibly received during a domestic violence incident. officers met with the victim at the hospital. they arrested him, who was present. the hockey player will appear in court on december 1st. no charges have been filed, but his ban will continue while the league investigates the arrest. we switch gears to the nfl and the steelers hosting the texans. pittsburgh trailing 13-0 early. things turn around and score 24

hitting back at moms trying to get action figures taken off the shelves. it centers around crystal meth maker. his action figure comes with a gun, a duffel bag full of cash and a toy bag of crystal meth. that's good for the kids. the mom is asking toys r us to drop the action figures and has garnered over 6,000 figures. toys r us released a statement saying it notes the items are intended for ages 15 and up, are located in the adult action figure area of our stores. a mom petitions over breaking bad. action figures. i'm so mad i'm burning my florida mom action figure in protest. i'm surprised he's mixing it up on twitter. >> these are more collectors. >> upgrades are coming to the popular dating site tinder and

will not be free. the ceo maded announcement yesterday. he wouldn't say what the new features are, but he did drop a few hints. >> we hear all these cases where people are using tinder outside of -- but there's different ways that sort of materializes. whether it's using it to get local recommendations when traveling or trying to make friends because you came to a new city or trying to make friends period. or doing business. we hear all the time that people are cutting deals on tinder. >> the upgrade. ed service will launch early next month. no word on the pricing. the free service will be available still and the ceo says users swipe left just to make friends. 1 billion profiles a day and tinder is responsible for 15 million matches. it's pretty incredible stuff.
