arraignment met boy a crowd. he is charged on nine counts including murder in the first degree, possessing weapons of mass destruction and reckless endangerment. after today, he was marched past the cameras and the district attorney spoke to reporters. >> the families in this matter of corporal brian dixon and trooper alex douglas and the pennsylvania state police have suffered an unimaginable loss of unspeakable proportions. they will never be the same, but today we find some comfort as a community that we are taking these next steps towards justice. in brooming grove and nice to see you under these circumstances. a lot of people waiting a long time for this.

>> good morning, peter. they touched on some and that included first-degree murder and homicide and attempted homicide of a law enforcement officer and possession of weapons of mass destruction among many other charges. the arraignment was brief. this was the first appearance in court. prosecutors indicate they do plan to seek the death penalty and they stress this is an ongoing investigation. there still a lot of is to dot and ts to cross. they are working to build the best case to achieve justice both for the families of the troopers and the community as well. >> we are getting a lot of details about how things went down in terms of the capture of eric frein. what more do we know about that? >> this was the best possible out come taken into custody with no shots fired or nobody injured

or killed. this was a routine sweep of the area. not a tip or a call from someone in the community, but this routine search. they came across him and he was outside this hangar and he surrendered meekly. they are saying he got down on his knees and following the commands of law enforcement. he had weapons and they are not going into too much detail. you have seen the images of him being led in and out of court. on his face, he appears to be injured. hoe has swelling in his nose and scratching. they said that happened in his time in the woods and did not happen during the arrest. they say it looks like he managed to survive for so long by going from abandoned house to abandoned structure and finding food along the way. >> the wilderness taking its toll on eric frein. we appreciate it.

ron allen was outside the room where eric frein was arranged this morning. he spoke to locals about what his capture means to that community. >> what do you feel? >> relief that the manhunt is over and threats are over. >> you felt threatened? >> everyone felt threatened. everyone has been concerned. the children were not playing on the playgrounds for the first few weeks after. everyone feels relief and feels safer. >> when you looked at frein, what did you think? >> i don't know. we as a community and a mission work towards not making it happen again. >> the special agent in charge of the field office of the atf and brought in as search for frein.

i appreciate you taking the time tonight. congratulations and as we congratulate you on the end of the ordeal for law enforcement officials, we want to get a sense of the next steps as we look forward in and we will go methodically through the evidence and just taken into custody. to try to develop leads. >> at least two weapons were in his possession. is there anything else you have collected? grenades found in the woods and soiled diapers over the course? how did he survive for so long? >> he has been out here for several weeks. one of the primary things we would like to find out is did he have assistance from anyone in the public? we don't believe that to be the case, but we want to leave no

stone unturned. we will go through the evidence recovered prior to yesterday's event as well as the items recovered after frein's arrest. >> investigators had a chance to interview him yet, but are there details about what he communicated. some suggest he might have been hiding underground or even of a motive. >> he was interviewed by investigators. i can't get into the specifics of what was stated in the interview. i can assure you that law enforcement is confident. we have our man and that this alleged cop killer will be brought to justice. searching for the person they believe responsible for killing

one of their own. >> it has been tremendous for me and the first couple of days after this event. we had a team of our personnel and we started working with our partners from the state police and the fbi and a number of other agencies that all came together. i have to tell you that checking your ego at the door, that's what happened and it took that collaboration to ultimately wind up with freezing rain's arrest. >> i'm sorry to interrupt, i was going to say there was significance to the patrol car to the handcuffs and the car belonged to the state trooper brian dixon who was killed seven weeks ago. we look at his picture on our screen right now, can you tell

us about your thoughts what it meant to do that symbolically. to use his handcuffs in this arrest. >> absolutely. i don't think there can be anything more fitting than to have corporal dixon's cuffs being used to be placed on mr. frein and transporting him in his police cruiser back to this police barracks where it started. for myself personally, it's gratifying that atf in some way can bring a sense of closure to the families of douglas and dixon. i fully and this cowardly but dangerous game is finally over. we feel pretty good on it. >> several searching for eric

frein. we appreciate your time. >> both parties have brought in the guns to close the deal. governor chris christie will be hitting 19 states -- that's not a typo -- in the run up to tuesday's election. we caught up with him and asked about the dust up with the protester back in new jersey. take a listen. >> i am who i am. my view has always been that and i told you at the public events, you girl give it, you are getting it back. if you don't give respect, i'm going to take you out on it. that's the way it goes. i don't calculate these politically. this is who i am. most people understand that. someone stands up and yelling and screaming it's not appropriate and i won't sit there. >> chris christie is confident and defiant as ever. casey hunt from colorado. were you struck and surprised by christie's response? >> would you have been?

this is sort of a chris christie we have come to know. this is his attitude. i asked if he would continue to behave this way if he got elected president. he said i am not yet doing any anything like that. it worked for me and i what i haved that way as governor. i will say he was subdued in the campaign that i saw him at. i have seen him more up front and brash than he was yesterday. it's possible that they made a calculation that he needed to be calmer on the trail. at the same time the substance of it, no change. >> let's speak about the race itself. you caught up with mark udall yesterday. get a sense of the race there. take a listen. >> our focus now is on the effort and we will win this race because we will have more votes. we have shown it in 2008 and

2010 and 2012. people look at the numbers and lock at the turn out and tracking way beyond what we saw in 2010 with the mailing of ballo ballots. i'm optimistic. >> get out the vote. as you know, they pulled out the upset. the question now is can mark udall do the same on tuesday? >> absolutely. democrats say they are further along as you heard him say in the turn out than they were in 2010. polls had shown he was losing to ken buck the republican just as polls now show that udall is behind gardner. a couple of things for republicans, this is potentially a big deal. they need to show they can win if they win the pedestrian in 2016. on the flip side, this would be a huge loss for democrats if they are losing in colorado, there is no hope to hang on to the senate. >> on the road. if it's a friday, i guess it's colorado. nice visit with you. thank you.

>> nice to see you, peter. >> for more on what to watch for, we want to bring in nbc news. mark murray and political editor with our viewer's guide. we will try to break it down for folks and play it out sort of the same way tuesday night will play out. we want to talk about the expectations and look at key races as the polls close tuesday. we will begin with north carolina. that closes earliest at about 7:30 eastern time. what will you be looking for there? >> this is the race where everyone thinks that democrats have the slight advantage. most polls have shown democratic senator kay hang in with a slight lead over republican challenger tom tillis. a couple of polls have been showing a tight race and a tightening race. democrats are hoping that hang in is able to win. we will be watching early on as if the decision desk and people end up saying it is too early to call, but with an advantage to kay hang in.

you know this is going to be probably good news for democrats and they have to cross their fingers that they get better news in iowa and colorado to be able to hold on to the senate. peter, all of a sudden if we hear that this race is too close to call, a coin flip, that's not good for democrats. this is one of the red states they need to be able to hold on. >> this is what they think they should have in the bag. let's go west out to kansas. the polls close at 9:00 eastern time. could we know early if republicans are showing up for pat roberts in a big way. >> how greg orman is faring in key counties. remember in a lot of mid-terms, this is such a reliably conservative state, if you were not an interested voter or democratic leaning, there is not a lot of motivation. you know that the republican is going to win. greg has created an alternative

for the voters. it's the urban areas around wichita or lawrence. if you are seeing a lot of turn out there or in the southwestern counties where there is a bigger hispanic population. this is a really tricky race to look at just the big turn out numbers. the incumbent governor is on the ballot and not that many are excited about him. they may be committing the ballot. it's hard to get an early indication. >> orman is making no indication about exactly who he would caucus with. also to iowa, east of kansas. the polls and the hawk eye state close an hour later. 9:00 central and 10:00 eastern. there is a lot of early voting there. what do you expect out of iowa? >> you mentioned the early voting. that has been a big issue in iowa. it always is. republicans last week were leading in early voting and absentee ballots.

it's unusual. they were timeouting that as a huge victory. the balance has tipped as republicans expected towards democrats. what democrats are saying are republicans are cannibalizing their voters who would normally come on election day and getting the people to come early. our early voters are people who didn't vote in 2010, but reactivating them and getting them motivated. we will look at the biggest key counties in iowa. how they compare. if democrat numbers look more like 2012, that is great news. and the opposite for republicans. >> we're swing way out northwest to alaska. this is what guarantees us a late night. they close at 1:00 eastern time. i know you and i rest of us will keep a close eye on what happens there. any good sense of what we should expect? >> peter, there is absolutely no sense at all.

this is a coin toss race that heads marked and tails dan sullivan is the victor. this is a 1:00 a.m. poll closing on the east coast. that means that people like me and everyone else will be up around 5:00 or 6:00 in the morning. trying to decide this. might go on for another day and we have no idea who is ahead because the polling is so difficult. a lot of people live in alaska and places that are hard to poll. we don't know what the electorate is like. we guarantee this is a coin flip race. >> alaska goes late into the night. nice to see you and see you back in d.c. soon. thank you. >> thank you. >> officials in wichita say the real work continues for four people killed after a small plane considereded into a building in a regional airport yesterday afternoon. the burning jet fuel was so hot that parts of the building are viewed as unsafe. heavy equipment they are bringing in and the pilot of the plane as well as three people

you are watching "andrea mitchell reports." the standoff between kaci hickox remains. she was issued a court order restricting her movements. the judge ordered her to submit to active monitoring to avoid public places. the nurse was quarantined after returning from sierra leone is permitted outside for bike rides and runs, but has to stay at least three feet away from others. her boyfriend spoke about their calculated route for the bike ride they took yesterday.

compromise. you were having directive monitoring. at least once a day and checking on kaci's well being. there were restrictions as well as travel. she she can't check in with these officials. she can't go-go to a movie theater. she can ride in her car if she doesn't come around or a run is another example is something she can do. it is by no means stay in the house or you get arrested. >> you have been here and spoken to a lot of residents including becky long. she is the owner of a local pizza shop. let's listen to what she had to say. pafr ever we received phone calls of is she her and people wanting to have bunch and a

possibility she may be here. >> how are they reacting? >> it's funny. they own the pizza place called the moose shack is answering the calls because she said what she is dieing to do is get a slice of pizza at the moose shack. she has not done that. when she said that, people are on edge the same way they are around the country and looking for guidance and guidelines. they made calls and made sure it's a brock ter of how the community feels. kaci's boyfriend is talking about they are sensitive to the community and pay are part of the community and one of the things they don't want to do is unnecessarily scare people. so far from seeing their behavior up to this point, they haven't done anything particularly aggressive in the case of this town. >> how many more days left in the 21-day quarantine?

>> the national guard has been called in threatened to be cutoff by the slowly moving lava flow. residents cheered as troops arrived. the river of lava at a temperature of roughly 2,000 degrees creeping along from the kilauea volcano for weeks, destroying one home and many more in its path. residents at risk have been told to prepare to evacuate. hawaii congresswoman visited pahoa wednesday and is joining me live from honolulu. you just visited that village and took a helicopter tour of the lava flow. describe what you saw and what the folks told you. is. >> good morning and aloha, peter. it's something unlike anything i have seen before to go from first seeing the over 13-mile stretch from the vent all the

way down to the tip that is bordering these homeowners's property and walking that tip and the fingers that are extending out from the lava flow is incredible. one of the things that can be deceiving in a lot of coverage we have seen and even standing there is the tip. when you look at the force of the flow from behind and how much there is, that is where the need for vigilance and the need for preparedness and kind of why everyone in the community is holding their breath to see where this goes. >> obviously a lot of homes and potentially in its path. the question that we were thinking. do folks have lava insurance? what happens to the resident who is lose everything? >> that's something that people are concerned about. both their mortgages for those of us who have been evacuated.

looking at all the scenarios here in the past that when we have seen the lava come through and devastate a lot of homes, the insurance companies have stepped up and covered them as they cover fire. this is a nuanced situation where this is not something that happens all the time. we hope that these insurance companies and the mortgage companies will step up to the plate and understand and support these resident says as they go through this very serious and unknown out come situation. >> about 1,000 residents there specifically. infrastructurally, what's at risk? beyond the homes, what else is at stake that folks are concerned about? >> i want to commend the mayor there in hawaii. his civil defense director, they have been proactive with the infrastructure and the roads

making sure that working with the electric company and they are able to maintain power and make sure that the telephone companies continue to run. what is most at risk here as the flow goes down and these congresses pop out, this community can be cutoff and isolated. the park service that goes through volcano national park. what we are talking about is it's not a matter of if, but when this community will be cutoff and a 45 minute commute into town will turn into over two hours one way to get to a gas station or a place where you can buy groceries. this is something that is going to change people's lives and separate a community that is a very tight, beautiful little town. >> it strikes us that the hurricane hit during the primary and a lava flow as you get ready for the general election.

any concerns about the impact this has on the folks's ability to vote? >> yes. this is a community that has been hit, this specific community in puna was hit and they had a tropical storm and hurricane ana and now the lava flow. it affected voters's ability to get to the polls during the hurricane and the state office of elections learned about that and they have been proactive in early walk in voting within the community. they may not have been registered to walk those in and they are opening up additional polling places on election day. should anyone be in a position where they get cutoff. >> in honolulu. aloha. thank you. the news for your wallet. the average price of gas hit $3 a gallon and should drop lower for the first time in four

i want to get a sense of your expectations right now. are the results pretty much baked in at this point? how much do closing arguments matter? >> they can matter a little bit, but people have heard so much for so long, but there is not a lot more to be said over the weekend to change people's minds. it's a question of motivation. how do you get people who are not motivated and if you are not, how do they come out in the big numbers you want. that's where the focus is in the last few days. >> i want to get specific and show a closing argument for republican tom cotton in arkansas. this is one of several elected officials trying to distance himself or themselves from washington. take a listen. >> after just a year, i had bad news. it's a lot worse than we thought. both parties put off hard decisions and keep on spending

and the debt piles up. they just don't get it. i was trained in the army as a soldier. you lead, you act and you are always accountable. if you like washington today, i am not your candidate. if you are treed make things right, i am ready to serve. >> this is a theme in the closing days. if you are in washington, this is not where i'm from. >> dan is right. all of the messaging has been done and what matters is the mobilization and getting out the vote for democrat who is have a much more uphill battle to change and increase the electorate in a mid-term year in the red states and places like arkansas where all of the natural factors are against them. if you look over the last several months, things get worse and worse for democrats. they have fallen behind in arkansas where tom cotton had a consistent lead and crisis after

crisis that has made the president look worse and prevented democrats from getting out any other message that they might like to talk about. i think there is no momentum really in either direction, but in practice that means momentum for republicans. >> let's move north to new hampshire. the former senator scott brown. neither shied away from debates. here's the new wmur poll. shaheen is pulling away and brown trying to be the first in two different states in 135 years. do you think brown is on the ropes right now? >> i think he is still the underdog in that race. i think he has been the underdog from the beginning. anybody who comes into a state brand new like he has done has an uphill fight. he has a long history in that state as an elected official and as a strategist. she knows how to run the campaigns in that state. this has been a close race. he has done good things that kept it close.

i think that republicans still think there is a possibility that he could win, but they are not bullish at all about the chances. >> i want to get a chance of the early indicators. on election night if you see scott brown is cruising, a good indication they could have a big night. what else will you be watching? >> you talked before about the states where the polls will close early like north carolina and which way the states go will tell us a lot. this is the year they noted that it doesn't seem like a wave. it seems like a minor tide. he as much as said it when he announced i am running in case there is a wave in the favor. that would put him over the top. the fact that he made it a single digit race would never come that close. if there is a surprise upset in the other direction, if we see

in north carolina that tom tillis managed to pull out and kay hang in led consistently. she is a democrat who has managed to hang on. we are the early vote. it looks good for democrats. that's something that will tell us a lot. you still a chicago bulls fan? >> i have never been a chicago bulls fan. >> you look like a sports fan. a new line of criticism that may sting for the president. not policy, but this time from his heirness. it may be all day playing. >> he's the president of the united states. >> tough reviews and this may sting more than others. >> it no doubt does. they are waiting for them to adjudicate this dispute. >> we will get them in the group

about what he was thinking when he left the bible behind. >> you knew you were breaking the law when you left that bible in the club. >> i assumed it was. it was definitely illegal and it was the risk i was willing to assume at that time. >> why? >> i was motivated by the stories of the suppression of the underground christians. >> joining us and give us a sense of the impressions. what did you take away from this interview? >> one of my biggest impressions is that he talks about the fact that the first few weeks in detention were the hardest and he didn't know if he would see his kids grow up. he was terrified about that. he had to endure nearly six months of detention, but the

other striking thing, he was held initial low in a hotel and then in a supportity center. he was alone for about 23 hours a day. i said how did you pass the time? he wrote letters. he watched north korean tv. he said a lot of it felt like propaganda images of the leader there, kim jung un. he read letters that he got from his family and it was difficult, but he was treated well. he had enough to eat. at point he said the food was too spicy and they made it less spicy. take a listen to what he had to say. >> throughout the process i was treated fairly well. i had too much to eat. >> what are did they serve? >> every meal had rice and some kind of soup. usually one or two side dishes of vegetables.
