drugeon. we'll give you more when we get more information. carlesha freeland-gaither was abducted. she's back home after being found alive. she was dramatically rescued by the police from the car of her alleged kidnapping in parking lot in maryland. this all unfolded after a tip led atf suspects to the suspect. he has been feed as delvin barnes. according to police he has a long criminal record is in custody and will now face federal charges. this morning on "today," philadelphia price commissioner charles ramsey said the surveillance video of the abduction was instrumental to the investigation. >> we put stuff on youtube as fast as we get it. we have a very, very good success rate. we have a great relationship with the media in philadelphia. it was picked up even nationally

and it really helped us out and probably saved the woman's life. had she remained much longer, don't know what the outcome would have been. >> our reporter is in maryland where carlesha was found. >> reporter: hey, tamron. car nisha spent several hours in the hospital. she was found to be in good condition and she was leased to her parents and she went home to pennsylvania. the horrifying ordeal for this young woman ended here in this parking lot in maryland. police say they tracked down the suspect's vehicle and found him and the victim inside. overnight carlesha and her family made it home back to philadelphia just hours after the shocking news friends and family had been playing for. >> carlesha freeland has been rescued. her abductor has been arrested. >> reporter: her mother was overjoyed. >> thank you for being there for us. i'm taking my baby home. thank you. thank you so much.

>> reporter: police say the manhunt that spread across five states finally ended in jessup maryland, over 100 miles way from where the crime began. authorities say a tip led them to a vehicle in a shopping center parking lot. when the suspect tried to drive off with the kidnapped 22-year-old inside, police surrounded the car. >> when the subject existed the vehicle, he was app hended and that's when miss freeland was recovered. >> reporter: the suspect in custody identified as 37-year-old delvin barnes had six prior violent felony warrants out for his arrest including another kidnapping. police do not believe barnes as prior to his abduction. >> he's a vicious predator and hopefully he'll be off the streets for the rest of his life. >> reporter: the search began after the surveillance video.

there was the suspect buying groceries and using carlesha's atm 75 miles from where she was taken. last night friends, family, and neighbors turned out to light candles, a sign of gratitude and relief. >> i'm glad. you know, i'm don't know what else to say. i'm just happy. >> reporter: today giving carlesha's family everything to celebrate. the suspect is in police custody. he won't immediately return to pennsylvania. he's wanted on another kidnapping and attempted murder charge in virginia. tamron? >> all right, rehema. john boehner made his first appearance since the republican route. the speaker will hold a news conference this afternoon as he and the rest of the government and democratic leadership in congress get ready to meet with president obama on friday. now speaker boehner and the presumed new senate majority

leader mitch mcconnell co-wrote a wall street op-ed entitled now we can get congress going. they laid out a plan reforming the tax code, the construction of the keystone pipeline, supporting charter schools, and, quote, renewing our commitment to repeal obamacare. and back at the white house, the news conference yesterday afternoon, both president obama and senator mcconnell pledged to work together to break the washington gridlock and get things done, but they also crossed swords. >> i think that the best way if folks are serious about getting immigration reform done is go ahead and passing the bill and getting it to my desk and then the executive actions that i take go away. >> what t president is choosing to do a lot of things unilate l unilaterally would be a big mistake. it's like waving a red flag in

front of a bull saying if you guys don't what i want, i'm going to do it on my own. nbc's chris jansing reporting live. what do we know, chris, regarding this meeting on friday? what are you hearing will the tone and will the president assert himself regarding executive action as he did yesterday? >> you know, listening to the sound bytes it sounds like the honeymoon is over before it started but they do have this meeting tomorrow. both sides say they do want to find areas of common ground. it's in both of their interests. let's look at the president first. he's already being called the lame duck. his staff knows he's only got a couple of months to set the tone for the next two years. they're important to his legacy. they're important to getting things done for the american people. on the republican side they're no longer going to have the excuse and point the finger at harry reid and the democrats in the senate. they're going to show the congress.

you list the things they say they're going to do. u thing it's important to point out the things that i're going to do. the president has said repeatedly by the end of the year, he's going to take some action on that. that was never going to go away. when you talk to the republicans and they say they're going to vote on repealing obamacare, the ten new senators who were elected, who are republicans all advertise that they were going to come here and push to repeal obamacare. you know, joanni ernest, the on who was going to castrate hogs, she said she had a gun and she was going to take aim at obamacare. i think those things while they may cause tension with some of the new members both sides have a vested interest in seeing how things go forward. let's see what the tone is tomorrow. i think there is an openness that may be born out of necessity on both sides that they want to see where the areas of common ground are. i just want to say one thing,

tamara, web the last couple of years in congress are the least productionive. it does not behoove mitch mccome to do it. >> john ernest was on. he said he's eager to hear from the public but the president is ready to use his veto pen in necessary. it was referred to as numb. it was said he was unrepenitent. the tedline on the "today" show was a mixed med with the president on how aggressive was he going to be. the goals he wants to accomplish in the next few years. >> i'm talking with senior and white house officials, that's the bansing act, right? that's politics, he's not going to abandon his base and immigration like he's been forceful on. on the other hand there's going to have to be give and take on both sides and i talked to

democrats who wish he had been perhaps a little more admitting of just how much of a shellacking that they took in the midterms. having said that, i think there is a sense here that there are some things on the president's side that he wants to do that they can get done, a plan to fix crumb bling roads and bridges. again, those issues are out there of common ground. i think tomorrow's going to be a really important meeting in setting that tone to see if they can move forward. >> thank you very much. let me bring in congressman elijah cummings. first off, i've got ask you -- thank you, first of all, for joining us and congratulations on your tenth term there. congressman, what do you make of the notion there are mixed messages. someone made it clear the president is not going to abandon his base. it was noted in his comments yesterday. he heard those who voted and he also heard those who did not. the largest group who did not show up, minorities, young people, women, the young people who supported the president and

who don't want to see obamacare repeal and want to see immigration reforms. will the president protect the base and his agenda? >> yeah. i think it's going to be balancing act. i didn't necessarily see it as mixed messaging, by the way. on the one hand as he said throughout that press conference, he's going out there every day and trying to make life better for american citizens, period. and where he can work with the republicans, he will. and i thought mitch mcconnell's tone was a good tone. and i think he's opened the door for that dialogue. you know, we need to be concerned. just listening to the list of the items that boehner and mcconnell have set as their priorities, you know, when you talk about corporate tax reform, that's all well and good, but the american people are worried about the tax pie ler. they're worried about that

individual who's struggling for a job or who has not seen their pay raised in years. and so basically what we've got to be about the business of doing is doing what the american people have said. basically what they're saying in this election as i interpret it, as the government we want you to share in the governing and we want all of you to come together to make our lives better. that's what it's got to be all about. >> let me go down the line. here you have this op-ed from mitch mcconnell and john barren. first up, obamacare. how does that play out? >> it doesn't play out very well. they might reconsider that. but i uchbs they've got to let the foges who are new to the senate and congress, that's all well and good. but, again, that's going nowhere fast because we know that obama care is here to stay and the president has said it and made it clear that there may be some tweaking that needs to be done. all well and good.

>> i guess what i'm asking you is with that op-ed to your point as you said and the president said, he's not going to veto his own law. does that then equate to gridlock? will we see another dozen or so votes regarding health care, which, again, equate a log jam in the house, for example? >> i think that mitch mcconnell is too wise a politician to do what we've done over in the house, to vote over and over and over again on the affordable care act. i think what will happen is they'll get their vote and then we'll move on. i think -- i just believe that we've got to do those things that are practical. this blame game thing, they're tired of it. my constituents are totally tired. >> absolutely. let me ask you about immigration reform. you have the president before tuesday and the latino voters who are tired of hearing about immigration reform but in the news conferences yesterday, mitch mcconnell said it's like

waving a red flag in front of the bull if the president decides to go it alone. >> i heard those comments. and if i were mitch mcconnell and the president i would say, look, we've got a bill through the senate that is a good bill and it's a bill that we can start with. let's sit down. let's get that done and get it through. that's what i would do. i mean that's something that the senate has already agreed on and we can get that done now. so this thing -- you know, i dare you and redlining and i'm going redline you, don't cross this line, we've got to get away from that. the american public is saying get together and make our lives better and that's what it's got to be about. >> you do think it's important to redline in some areas? again, there's a redline in health care. >> you have to remember we have millions of people who have health insurance, people who have pre-existing conditions who now are able to get conditions. that's not going anywhere.

we've got breaking news. we're following rick perry in the courtroom. he's facing two charges of abuse of power. and trying to force a district attorney to step down following

her dui arrest. this is the first pretrial hearing but the first one he's been required to attend. his attorneys are seeking to have the case thrown out on several technicalities. perry arrived by private entrance after his last trip drew a lot of supporters. and now a reporter with the hewn chronicle, obviously, patrick, this goes against texas in so many ways. first off, he's considered a possible presidential candidate in 2016. we understand the judge throwing out the indictment would not be on the table today. what else have we learned? >> thanks a lot for having me. so right now what's happening in court is the court is taking up this kind of technical issue of whether the special prosecutor was sworn in properly. rick perry's lawyers say hi wasn't. he may have taken an oath of office but it wasn't filed the right way.

>> i understand your latest piece is how the governor's words could be used against him in this case. what else can you tell us regarding some of the strategy here if this does proceed? >> sure. one of the other procedural/technical issues his lawyers are raising is they want the judge to order the production of grand jury transcript testimony. he's on je he's objecting to that. governor perry said something to the effect of all of those involved in this it dietment will be held responsible or held to account and in the latest court filings we've seen the special prosecutor kind of uses those words against governor perry and says that shows he may have malicious intent or it could be construed as a threat

to the people involved in the grand jury process including the jurors themselves. >> do you get the feeling behind closed doors that the perry camp feels it could have influence on his presidential plans? >> certainly. he's under indictment. i'm sure there's plenty of concern in the cycle. there's the appearance that he was to appear out of the last one. he was traveling to europe. a trip to burnish his foreign policy credentials. just a few days ago he was campaigning for governor rick scott and i believe next week he's headed to new hampshire for his second trip there this fall. so it's kind of full steam ahead for him in that way. >> all right. we'll keep an eye on this courtroom in texas and bring you any new developments. thank you greatly foryour time. we appreciate it. >> thank you. and the navy s.e.a.l. who claims to have shot and killed osama bin laden is telling his

[ male announcer ] and we do. it's how edward jones makes sense of investing. ♪ top military officials are expressing criticism. one of them is set to publicly reveal his identity as the shooter and the man who multiple reports identify as robert o'neill will reportedly discuss his role in the s.e.a.l. team 6 raid during an interview set to air next week. now, days after the interview was announced, the top commanders of the navy s.e.a.l.s issued a special letter to warfare sailors warning them of consequences for speaking out. they say we do not abide willful

or selfish disregard for our core values in return for public notoriety and financial gain, which only diminishes otherwise honorable service, courage, and sacrifice. jim miklaszewski has more. what have we learned at the pentagon? >> we have no idea what o'neill's motives are for the time being but officials do confirm to msnbc news that robert o'neill was, indeed, a navy s.e.a.l. and one of those first to burst through the door of osama bin laden's bedroom in pakistan and one of those among the first to fire shots. now, in an "esquire" article nearly a couple of years ago now, he was described anonymo anonymously as the shooter, but we're getting conflicting reports on exactly who may have fired the first shot in that raid that took down osama bin laden. as you can imagine in a classified operation like that in the telling, things get a little murked up, i guess you

could say. >> and, mick, this statement, it's very strongly worded saying that this diminishes otherwise honorable service, courage, and sacrifice of the men and women who serve. so this obviously just from the wording there alone points to how upsetting this interview even before it airs is to the top brass. >> what's interesting is robert o'neill has been on the speaking circuit for some time and it was understood that he was involved in the raid, but he was very careful not to apparently, we're told, not to get into details about that operation because much of it, of course, still remains classified. but there was another s.e.a.l., matt bissonette who's now written a book, the first one about the raid itself, revealing some of the actual details of that operation, which has not only the s.e.a.l. and the special forces community up in

arms, but at the moment, bissonette is under criminal investigation by the department of justice for perhaps revealing improperly some of the classified information in that raid. now, i can tell you that even if there was classified information reveal thad shouldn't have been, military officials here acknowledge that it would be pretty difficult to actually prosecute bissonnette. after all, he was one of those who put his own life on the line to take down osama bin laden. so it gets even murkier, and it gets a little more complicated than simply he did it and he should be prosecuted. >> sure. his father in the "daily mail" is quoted as saying people are asking if he's worry -- >> we have to be careful here. now you're talking about o'neill. bissonnette is the one who wrote the books and revealed the details. o'neill has always been very careful not to fall into that trap and avoid details of the

operation. >> right. correct. and o'neill's father was quoted in the "daily mail" saying he's not worried about the potential threat in if quote we were saying. he says that people are asking if we're worried that isis will come and get us because rob is going public. i say it will paint a big target on my front -- i'll paint a big target on my front door and say come and get us. those are strong again words from his father as well regarding his son's safety. >> that's always been one of the big concerns of the navy s.e.a.l. and special forces community who go on such operations like this, that there are -- you can only imagine. they killed osama bin laden. how many radicals are out there who would love to take on those who took down osama bin laden. but here's the important part about that and this is what the navy s.e.a.l. community emphasizes. it's not just the security of that individual s.e.a.l. it's the security of everyone around him, his family, his fellow s.e.a.l. members, those

make your holidays pop! back to the new reality in washington. as the dust settles from tuesday's republican wave president obama and mitch mcconnell have both talked about working together and getting down to business but our first rag team writes this. that may prove to be a difficult thing to do. president obama and mitch mcconnell said all the right things but there are two significant obstacles to even achieving the small stuff. immigration and health care. joining me now mark murray. mark, i'm sure you've glanced at social media and there's no shortage of people who say if they couldn't get anything done in six years, are they really going to get anything down now especially given this op-ed where mitch mcconnell and the speaker have their sights set on repealing the health care law? >> tamron, if you look at it, i

think status quo is the smart bet to make. you have parties who are in disagreement. most of their members are liberal. fewer and fewer sin terroriare . very few conservative and members of congress there and that is usually a recipe for a gridlock in devried government. that said, i moon there are some pieces of low hanging fruit where theoretically you could end up having a deal. republicans and democrats want some type of tax reform. of course, the devil's in the details there. the republicans want the keystone xl. it is possible president obama ends up relending to that if the democrats are able to get something out of it. president obama's talked about more money for fighting ebola. a new congressional authorization to combat isis. all of those things are potentially realistic but as you mentioned in the intro. if president obama goes ahead and does something on executive action when it comes to immigration, that's going to

tick off a lot of republicans. and similarly if they try to gut or hurt -- end up hurting obamacare, you're going to see the democrats angry. >> all right. mark. let me bring in maryland democratic senator ben cardin. he's a member of the senate finance committee and the committee on health care. thank you so much for your time. >> thank you so much, tamron. >> you were quoted in "the wall street journal" yesterday saying elections have consequences, there's no doubt about it. the consequence is that the republicans control the agenda and they'll be determined how it will be taken out and what will be taken up. let's talk about health care. how do you see that playing out if that is the immediate focus? >> they may try to repeal the affordable care act. it's not going to happen. they know it's not going to happen. i think they made a commitment to do it so we'll see some votes on it but it's not going to be consequential. >> we know it's not consequential but does that just

equal more gridlock and more votes and not focusing in on some of the other issues the president would like to accomplish and i'm sure you and other democrats would like to see given proper attention in the next two years? >> well, it's certainly not helpful to bring those types of issues up. but here's the challenge for the republicans. they know control both houses of congress, so when things don't get done, they can't blame the democrats. it's the republicans. the one message i heard louder than anything else on election day is the voters wanted congress to deal with the issues of this country. they do not want to see stalemate and gridlock. now the republicans have a lot more at stake in delag issues being resolved. >> but if we're look ak the message that came from the elections, i was in charge of the exit polling and you have a huge divide. as it was pointed out on the role of government. an overwhelming difference regarding the base. you have the democratic base who sees the role of government as

pivotal in some ways and then the gop base solidly believed in huge numbers in our exit polling that government is doing too much. they believe that businesses should be tackling some of those things and not the government. so how do you close what is -- you know, a gap as wide as the grand canyon here? >> no, there's no question there's a strong philosophical difference between the two parties, i acknowledge that. but quite frankly we agreed to the size of the federal budget. that's been pretty much agreed to. we should be able to pay us a budget, a longer-term budget agreement. we should be able to do tax reform because tax reform doesn't talk about the amount of revg knew. it talks about how we're going to raise that revenue and we agree that it's broken. these are issues that democrats and republicans should come together on. a long-term transportation bill. that's usually not partisan. we should be able to get that type of legislation gone. >> we'll see roy happens. perhaps your optimism will be infectious. that's what we're hoping.
