close vote. the vote on a procedural motion which sought to end bulk data collection missed by two votes. it split the state of kentucky, but for different reasons. rand paul voting against it because it did not do enough to curb government snooping, newly elected leader mitch mcconnell voted against it too well. he thought it went too far. sponsors like mike lee in utah said it would address the problem of government spying on citizens without cause. marco rubio argued there were no examples of abuse, calling it, quote, a theoretical threat. five people are dead after the attack on a jerusalem synagogue. three of them were rabbis with dual american citizenship. one was prominent massachusetts, another with british citizenship, an israeli policeman died as well. an outpouring of grief last night at three of their funerals. the assailants, palestinian men

who were cousins attacked with axes, cleavers and guns before being killed in a shootout. prime minister benjamin netanyahu promised a quick response. at least 12 relatives of the cousin have been taken into custody already. while hamas did not claim responsibility for the attack, the massacre some inflaming the holy city where recent violence has fueled concerns of a new interfad da. an air bag recall has gotten a whole loss worse. federal regulators are calling on japanese company takada and several automakers to extend recalls to all 50 states. a previous recall included only regions of the country with high humidity. a report of a defective bag in arizona outside the original area prompted them to extend this nationwide. the expansion will affect millions of cars made by ford, honda, crisler, mazda and bmw. more than 14 million vehicles have been recalled since 2008

because of takata-made air bags. this brings us to business news today and a look at the impact this massive air bag recall will have on affected motor companies. cnbc's steve sedgwick joins us from london. what does this mean for all those five automakers just mentioned and how important is this for people out there with these cars, to be paying attention to this and get them in to get promptly fixed? >> reporter: on the latter point as you mentioned, places like puerto rico and florida, they've already had their recall notices. nationwide, this scale is absolutely enormous. the automakers, ford, chrysler, mazda, bmw and honda as well. what is interesting is the u.s. car industry should be in a sweet spot at the moment. the auto sales are absolutely fantastic. we're back to 2007 levels and the kind of levels we saw at the first part of this century. in 2015 we're looking at 16.7 to

16.9 million cars. that's a fantastic number, way better than we've seen over the previous six years. you would think the share prices of these companies would actually be at highs given the fact we'll talk about the s andp record high in a short while. i did work on ford which closed yesterday evening at $15.50. the top of the range is over 18 bucks as well. nowhere where near the highs despite the fact that car sales has gone through the roast. gm had a whole host of recall issues, we've talked about them a lot. their shares closed yesterday at $32.27, the high for the last few weeks is $41.85. if it wasn't for these recall issues, you have to imagine they'd be trading higher. the big two, gm and ford are not rallying like the rest of the market. that brings us to the next story. 43rd record high is what we've seen from the s&p, in one year.

that's not quite the record. last year we had 45 record highs. going in one direction. one of the catalysts for that is mergers and acquisitions. the latest is acta vis is going to buy allergan for $66 billion. autos still struggling a bit. recall has to be a big part of that. >> this is really interesting, steve. nielson, the company that monitors ratings for tv is going to start measuring tv shows and online impact of what cordless viewers are doing for watching, especially the streaming services like netflix. >> this is all about sbod, another great acronym, subscription video on demand. the guys who invest millions and millions in getting big stars like kevin spacey into the shows, "house of cards," what i'm plowing through myself, they

can't monitor how many eyeballs are watching or what the viewership s. now it looks like they've got a new technique, looking at the audio component. they can monitor the audio part of the streaming and monitor a little better how many people are watching the shows. that had big, big ramifications for the advertising marnth as you and i well know. >> didn't we steel "house of cards" from the british? >> yes, you did. the executive producer on the show is michael dobbs, and he wrote this many, many years ago. there's a very good archive series, british series based on westminster. you should watch. kevin spacey is a legend, the original is perhaps, perhaps just as good. >> cool stuff to hear you're watching it right now. it's really good. i'm not going to tell you what happens. there's some good stuff. steve, thank you, much appreciated. we'll move on to the next story. model janice dickinson is coming out accusing bill cosby of sexual assault.

cosby's camp is fighting back. dickinson claims the event took place in 1982 in lake tahoe where she traveled to meet with cosby in town for a performance. she told entertainment tonight she remembers the comedian giving her a glass of wine and a pill before the alleged assault occurred. an attorney for cosby calls dickinson's claim a complete lie and points to an interview in 2002 about her book when dickinson said she refused cosby's advances. in the past cosby denied allegations made by other women and has never been criminally charged. nbc entertainment which was in development for a show with cosby isn't commenting on its plans for the future of the program. however, last night netflix announced a postponement of its upcoming comedy special "bill cosby 77." that show was shot on cosby's 77th birthday. actor and comedian tracy morgan is still recovering from a traumatic brain injury she

suffered in a car accident more than seven months ago. his lawyer says while he's been making progress, it's still unclear if he'll ever be, quote, the tracy morgan he once was. he went on to say, quote, he's still fighting and trying to live his life at the same time trying to get better, he's just not better. we're hoping and praying to get him back to where he was. the jury is out. morgan filed a negligence lawsuit against walmart who employed the truck driveer who crashed into his let me mow last june. lawyers for both sides were in court on tuesday for a scheduling conference. it was supposed to be funny. tiger woods is not laughing at this one, a parody interview in the magazine "golf digest," the title of dan jenkins' article my fake interview with tiger. asking what's the moral of the story to which a fake tiger responds don't get caught. on accusations tiger is a bad tip per, he pens him as saying i

here we go. time for sports. minnesota vikings running back adrian peter sont won't see the field this season and perhaps longer. after pleading no contest for injuring his 4-year-old son, he was sis spended without pay. peterson will remain on the commissioner's exempt list with pay. here we have nfl commissioner roger goodell saying peterson will have to undergo counseling and would return no sooner than april 15. in a statement goodell said to peterson in part, quote, you have shown no meaningful remorse for your conduct. he's really coming out quite harshly here after we watch what happened with ray rice. we want to switch topics and talk about the weather we've been watching, especially for parts of new york and this cold front that's come in.

nbc meteorologist dominica davis has the story. bim has the day off. >> epic snowfall and epic cold. it all continues. really the snowbelt, upstate new york, that's where they've been getting hammered the most with over six feet. look at this. this is what we're looking at yesterday. this is a time lapse. they had near whiteout conditions as the system moved through. again, 60 inches came through. they had to shut down highways there. that's pretty much going to continue unfortunately for the next 24 hours. it's still happening. here is a look behind us. you can see that lake-effect snow still continues. it starts to wind down tonight and tomorrow we'll really see it start to shut off and things will quiet down for the weekend. look at the cold, though, temperatures, they're not only biting this morning with windchills, so much of the east coast right now feels like it's in the single digits and the
