to do it now he's going to do it. earlier president obama said he would announce executive action on immigration tomorrow. >> tomorrow night i'm going to be announcing, here from the white house, some steps that i could take to start fixing our broken immigration system. everybody agrees that our immigration system is broken. unfortunately washington has allowed the problem to fester for too long. so i will be laying out the things i can do with my lawful authority as president to make the system work better even as i fin continue to work with congress to encourage them to get a bipartisan comprehensive bill to solve the entire problem. >> we will have full konk here on msnbc. then on friday, president will hold a rally in las vegas with harry reed. who told reporters he wants the

pl president to do everything he can on immigration. >> when the president decides to do his executive action he should go big, as big as he can, and there's precedent for him going back to eisenhower administration to do something just like this. >> so the bulk of what the president is going to do, he's expecting up to 5 million undocumented immigrants to stay and work in united states illegal. boehner had this to say. >> well, what does that mean? john boehner i think is making it clear he will use all options to stop president obama on this action. >> this is the wrong way to govern. this is what the american people

said they didn't want on election day. so all the options are on the table, we're having discussions with our members and no decisions has been made how we will fight this if we proceeds. >> but the funding bill will have that strict language. >> all options are on the table. we're going to have conversations with our members and when we have a decision we'll let you know. >> you said the government shutdown should be off the table. that it is not good for the party or the country. >> our goal here is to stop the president from violating his own oath of office and violating the constitution, it's not to shut down the government. >> sounds to me like a government shutdown is on the table, over immigration. many house republicans are already using the threat. fleming told the associated press this.

so what does that mean? democrats are already returning fire on offense. harry reed had no problem calling out republicans on the radical threat. >> it remains to be seen whether republican leaders, boning here and in the senate and in the house will stand up to their own caucus members who are threatening to shut down the government if president obama does this or that. namely, last 24 hours has been on immigration. immigration should not prevent senator mcconnell and boehner from working with me to fund a government. >> give republicans a big win in the midterms and they immediately over step their bounds. that's how i think liberals are viewing this. these guys will do anything to trash the president. that's still a-number one on the list, even if it means hurting

space. what a wonderful time to protect millions of american families. >> the right wing as we read in our lead in, some congressional members are saying this is amnesty. what is your response to that? >> well, look, the president is going to act within the powers granted him by the congress of the united states. let's remember all presidents have used discretion when it comes to certain groups of people. matter of fact, ronald reagan in 1986 helped passed thamnesty bi. when he saw million and half children and spouses specifically excluded from the 1986, he said i don't care if that is express will of the united states i'm going to protect them. and in 1991 they fixed the '86 legislation and included the

very people reagan and bush protected. that's what the president is doing now. we have given the republicans many chances. i think they should stop crying and whining and stop legislating. they have the majority and today we can pass a bill and the president won't have to take a single action if they will simply allow the house of representatives to vote its will. >> okay the latest poll shows this. 48% americans disapprove of the president acting alone on immigration and 38% approve. what do you think. >> first of all, the american people have not been explained what is executive action and what the implications are for tens of it millions of american families across the nation. i think once the president has the opportunity to explain it, those numbers will go up. plus remember this takes kour courage.

it took courage for president truman in 1948 to desegregate the armed forces of the united states. we think of the courage we have in our heart that he showed the courage. that is the same exact way this decision of the president is going to be seen. >> and finally congressman, the conservatives are threatening another government shutdown, the last one costed us $24 billion. is this worth a government shutdown. is this worth the risk? do you think the republicans will do it. >> we shut down the government october 20, 2013, how did we avoid another one? the republicans sent their best man, paul rand and the democrats sent senator murray and they both figured out the budget. i voted for the ryan budget so

did most democrats and mostp republicans. there's a way to figure it out if you let men and women do the will of the american people and allow a vote. the only problem is mr. boehner and the republican party are trapped in a small group in their own party that don't want to do it. here's what united republicans being against obama. they would rather put their party interest ahead of what is good for the american people. >> so your advice is to go ahead and move on this. >> we need to stop political partisan consideration and do what is fair and just. future of our children is at stake. justice and equality is at stake. let's move forward. it takes courage and i know the president has it. >> good to have you with us. i appreciate your time. thanks so much. >> thank you. >> you bet.

i will bring in vice chair of the democrat party and chair of republican party. good to have you with us tonight. i appreciate you being part of the mix tonight. what is your response to the possibility of a government shutdown from a conservative is it worth that risk? >> i'm not sure we will have a government shutdown and i certainly wouldn't like to see a government shutdown but i would like to see an executive action that is legal and doesn't exceed his authority. in january he stood before congress and declared that if the congress doesn't do what he wants he will do it himself because he has a pen and cellphone. well i have a pen and cellphone doesn't give me authority to pass whatever laws i want. >> so you think the president is over-extending his legal boundaries here? >> i don't know what the president is going to say

tomorrow so i can't say that for sure but it sounds like he might and i hope he doesn't bl and how will the president's announce. go over in florida which has a hot bed of immigration issues. >> it's a very positive thing in florida. i think most of us will be celebrating. i certainly want to remind the viewers and my friend, that reagan did this, and bush did this, and certainly the republicans weren't saying that it was illegal or outside the boundaries of the constitution. president's have used their pen many times and sadly, he wouldn't have to do this if they would just call a vote. if boehner would call a vote. it already passed in a bipartisan fashion in the senate and all we need is a vote on a bill that is already there. but boehner is more worried about his party and him keeping his job then the job he's there to do which is legislate.

republicans done something on immigration when they have power in the house what is the hold up. >> i think the hold up is lack of trust with the president. he said he would work with them and then not lead with them. he made it kpleclear he doesn'tt to sit with the republican leadership in the house. they just don't trust him to deal fairly with them. >> do you think that the majority of floridians want the president to do this? >> i don't think so they want the president to act without the congress. i think we have a constitution that has executive branch, legislative branch and both branches have to work together and that's something washington really needs to learn how to do. >> i agree with that. but unfortunately republicans have shown they have no intention of working with the president and the president has held off on doing this executive action because they had the

opportunity to vote and they still do by the way. they still can vote on it and then all of this is mute. >> let me make it clear, just because -- if the congress decides not to act on skmg the constitution says the president can do it on his own, that's not how this works. if congress decides not to do something that is congress, the president can't just go do it by himself that's not how this works. >> mr. diaz, you can react to what has been reported that there will be some 5 million people that will be given work permits, not citizenship but work permits, do you think that is exceeding his constitutional authority? >> probably not. i don't suspect that exceeds his authority. now if he decides to give them some sort of legalized status or do something like that, then that would exceed his authority under the constitution.

it makes me feel very good about the future of our company. ♪ welcome back to "the ed show." ferguson, missouri remains on edge today. residents are waiting for a decision on whether or not police officer darren wilson will be indicted. the nine-member grand jury is considering a range of potential charges. he shot and killed unarmed teen in august. the shooting led to months of protest. the governor has called the national guard ahead of the decision. >> the choices we make in troubled times are the true expression of our humanity. >> many people are afraid additional police and national guard police could trigger the

same kind of violence sparked in august the day after michael brown was killed. school was closed for six days. this time educator are planning online courses. >> waiting and wondering continues in ferguson right now. >> it's like a panic attack or something. i've never witnessed anything like this in my lifetime. >> more than 100 days after michael brown was shot and killed this fractured community doesn't know if officer will face charges as they prepare for a decision from the grand jury in the case, businesses look like they are bracing for a storm. can't hide the concern here. >> feels very, very stressful. >> teachers at many area schools are giving students extra homework just in case they are closed down and parents are making sure they are ready. >> we've done water. we've tried to make sure that our gas is filled up.

blankets in the car. you never know if they will block our streets and we're going to be stranded so we're trying to do as much as we can. >> protesters and police and governor cleared the way for national guard to move in supporting police in ferguson like they did in august. plus an additional 400 troops be stationed at 45 location as cross the area away from protesters and working 12-hour shifts to keep the peace. >> i think there's too much hype like preparing for war, not preparing for peace, i don't condone is that. >> this is about 100% of people being safe and 1 hundred% of the people with the right to speak. >> the grand jury has yet to say a word. >> jay gray reporting from missouri. prosecutors are still hearing evidence in the case. charges range from first to second degree murder to involuntary manslaughter, self-defense or no charges at

all. missouri congressmen joining me now and national reporter. good to have you with us. congressmen is it necessary what the governor did to bring forth the presence of the national guard? what do you have think of that decision? what it the right thing to do? >> i have some ambivalency on it because while the national guard stationed all up and down the streets of ferguson it makes an intimidating statement to the protesters. on the other hand i know the governor is trying to make sure if things get out of control that they may be able to restore order quickly. i think, you know, we cannot have ferguson looking like some ira iraqi village that is under attack. that will infuriate the

protesters, 98% of whom are good, decent, hard-working americans who are upset at what happened to mike rchael brown a deserve the opportunity to exercise their first amendment right. >> are you concerned if there is no indictment and there is some trouble in ferguson, missouri that it could spill over to other citys in america? >> i think that is a possibility. at the congressional black caucus meeting today we were all discussing this issue and what could we do. and i think it is the belief that depending on how police in ferguson, and the national guard for that matter, hand whle what happens in ferguson could ignite

something or could maintain order to avoid any friction to the point where people are getting injuredx. the protests probably will occur around the country and i think the police in ferguson could determine what will happen around the country. >> okay. i have to follow up another question on that. if you're talking about it in the congressional black caucus, what role does it see it might have when it comes to influence to keep the peace. >> i'm not sure we have any influence. i'm glad you asked this question. understand this, i have met with a number of the young african-american leaders, this is a new group of folks. they are different than the john lewis's of the 1960s, these young people are not going to be redistricted by ministers or by members of congress or the missouri general assembly.

these folks are angry because they have seen many people in their age group shot and for no reason and the sense that they were unarmed and i think this is like the last stand like we got to stand up some place and say this is enough. and it just happens to be ferguson. and so, you know, we're not going to be able to as a black caucus be able to say let's hold it down. what we plan to do after the spring is to do massive voter legislation to change the nature of ferguson municipal government. >> sure. can you respond to what the congressman just said. are people angry? are they on edge? could this explode? >> i think since august we have been teetering on the brink of will it explode or not. the congressmen is correct these

are young protesters activated by the death of michael brown. this is not your father or grandfather civil rights movement. it is teetering between going in one direction being more radical while others say they want access to the electoral politics, to work from the inside while putting pressure on the outside. right now will there be a kbuan, that's the question as we wait for this grand jury announcement. >> what are you hearing from business owners in the area there? >> we talked about this blanket of fear and anxiety that has come across this region it is felt precisely in those businesses. from protesters, some businesses were damages and businesses were shut down for weeks at a time. so the concern about property damage is real.

the concern that their revenue stream will be cut off is very real. if it's a throw back to august those were troubling days for area businesses. >> congressmen would it be appropriate for the president of the united states to make a statement before the results of this grand jury are released? >> no, i don't think so. i don't think we ought to do that to the president of the united states. because this president has been accused of being some kind of african-american militant when he just says the word black. he can say that car is black and he's in trouble. so i don't think he ought to get involved in it. now we had a meeting scheduled over at the white house few other councilmembers and i to talk about ferguson. it was cancelled because of the immigration issue. which we understand. but the president is concerned about this. he gets reports from the

resurrect the keystone fight in van. >> this will be an early item on the agenda in the next conference and i'm confident that the bill will succeed and we'll get it to the president. >> we'll be back at the first of the year as mcconnell has said. >> all along as we have said we knew we would be in the new congress on this issue because the president has made it clear that he will veto this bill. >> we will have an opportunity with new people for a new vote next year. >> this issue will be back as soon as we get back next year. >> this is all about new republican majority manufacturing confrontation with president obama right off the bat in the legislation session. some are concerned president might use keystone as a bargaining chip.

this according to the new york times. i think it was a good move that the democrats had a vote last night. because now sereverybody is on record who wants to do something about climate change. the republicans stated policy, more oil to market and denying climate change. joining me senator from rhode island and executive director from nebraska. senator the vote last night, was it important from the standpoint of getting party people on the record about climate change, your thoughts? >> yeah i think it was an important vote. i think it's going to be another important vote in january.

both demonstrating the republicans will be ento ytowede fossil fuel energy and give president obama an opportunity to veto this measure rather be stamk stampeded. >> do you believe he would use it as a bargaining chip that he believes the country needs. >> that's not necessarily a bad thing. if the total sum of the deal is a very significant reduction in carbon and 6 million car's worth, that the keystone pipeline will produce, that somehow very considerably offset, i think that's a conversation we ought to have. our goal should be to reduce

carbon. if we got a significant carbon fee or absolute clearance on the existing plant rule. i'm willing to have the president pitch us on a reasonable deal. what i'm not willing to have him do is take something completely unrelated to climate and trade it away and send a signal to both republicans and the fossil fuel industry that is now giving him direction that he is ready to roll on this issue because they won't back down once he keeps rolling. they will keep rolling him and rolling him. >> what is your response that there might be something that would negotiate keystone. >> our families are not bargaining chips and our clean water in the aquifer are not bargaining chips. i don't think the president will allow republicans to bully him into approving the pipeline. you can't continue to play on

the republicans terms. if i were in the white house, which i'm not, but if i were i would advise the president to reject keystone during christmas and new year's it's the right thing to do and he has all the information to make the right decision. >> they say they will bring it back. with this to say. >> we're either going to have to get to 67 or we're going to have to attach this legislation to a broader energy package or maybe an appropriations bill. >> they clearly have a strategy to get keystone built. >> i think they will do everything they can. i think you could also see them trying to attach this to the budget bill in december and have another show down december 11th when they have to make that vote. i think the president needs to get his pen out and reject the pipeline. he knows this is bad for energy policy. he knows it is bad for our

families in the heartland and for tribes. i don't quite understand why the president is just not rejecting now. we know he can't approve it, right. we know because of the supreme court and trans canada jd asouth dakota, he can't approve it, but he certainly has all the informing he needs to reject it. >> senator, you revealed carbon legislation today, would they be a model for coming to a deal on keystone. >> i don't know about coming to a deal on keystone, certainly a $40 per ton carbon fee that is 100% returned to the american people through rebates through taxes and other devices that saw that all of the money went back to the american people i think would have practically explosive effect on our economy. we would suddenly be taxing carbon pollution, which we don't

want, we would be freeing up income to corporate sector and individuals, it would explode innovation in research and green energy, which is a huge jobs growth area, a lot for republicans to like in terms of economic development and lower taxes, they got to realize they can't just keep goofing off about carbon pollution. that's just unacceptable. they know it. >> senator you're the only representative, the only senator from the united states senate that went to nebraska to meet with people on the ground. if you could come to a deal, or if the democrats come to a deal that would go along with the president giving up keystone for other issues, it doesn't change the risk that the aquifer would face if it does leak. does a deal outweigh that risk. >> it would have to be one hell of a deal because i really ad

admire jane and what she and her group has done up against very powerful and wealthy interests and they fought hard and fair and i think the president should listen to them and the solution should be to get rid of the pipeline. but if you could trade it for full on carbon fee for a solution to our carbon problem and put this fight behind us and move on and grow the economy that is something snib anybody would have to take a serious look at. >> i think if you expand tars ans which keystone would do, you are going to expand carbon pollution. so there's no deal on the table for our family's livelihood and no deal on the table that it will erase the damage it would do to people's life lvelihood a the culture on our farms and travel communities so there is

>> shoveling for a day and a half. >> some parts of our community that will receive the equipment of a whole year's worth of snowfall in three days. >> joining me today, nbc meteorologist dominicka davis. that board behind you is filled with all kinds of color and it is snow. what is the latest in buffalo tonight? >> yeah, hi. it is a little nuts. they are getting ready for round two of the second significant lake effect snowfall. it is quiet right now. they are looking at light showers, not a whole lot going on. overnight, this is going to start to ramp up once again. we are looking at a line that goes really south of buffalo. that will be this heavy snow belt where we got that 60 inches of snow. where we heard that it is a year's worth of snowfall in really just a couple of days. they will likely add to that

another foot and a half to two feet. that will start tonight. and then end by friday afternoon. all this lake effect snow will wind down. i think the big question is, the bills have a home game on sunday. will they be able to clear out that snow? i think they will. it is going to be a challenge. we're not only dealing with the lake effect snow. we're dealing with the cold. it is 15 for the high tomorrow in minneapolis. 22 in chicago. we'll have the 30s and 20s right in that snow belt where we're looking at the significant snow for tomorrow. 54 in atlanta. temperatures do start to rebound around the east coast. so we are seeing an end to this cold spell and this snow spell. hang in there. we have about at least 36 hours before we can finally say this is all done. ed? >> well, i would call it buffalo luck. that means they're probably going to get two feet.

they should prepare form. you were talking about the buffalo bills. and ralph wilson stadium there. actually going to be paying the fans to be shoveling the snow. where are you going to put it? shovel it out of your seat and put it on the next guy? >> exactly. by friday, they really could be looking at an additional two feet around there. so yeah. where do you put it? >> and of course, in that middle part of the country, and the upper midwest, we've had some really cold temperatures. it is about a month ahead of schedule, isn't it? >> a lot ahead of schedule. these are january temperatures that we're seeing in november. so yes. old man winter is certainly coming early. but it will be a quick exit by the end of the week. then actually, for the thanksgiving week ahead, we are looking at temperatures being near normal. so we'll get back into the 50s and everything. these are certainly january temperatures. and january snowfall.
