good morning everyone. i'm tamron hall. this is "newsnation." developing news on the friday morning. president obama is about to leave washington for las vegas for this afternoon he will officially sign the sweeping executive action he announced last night. air force one is taking off right now. we also just learned the president will travel to chicago. the chicago area next tuesday to promote his immigration plan. now as the president explained last night it will allow as many as 5 million undocumented immigrants to apply to stay in this country. >> if you have been in america for more than five years, if you have children who are american citizens or legal residents, if you register, pass a criminal background check, and you're willing to pay your fair share of taxes, you'll be able to apply to stay in this country temporarily without a fear of deportation. you can come out of the shadow.

it does not grant citizenship or offer the same benefits citizen receiv receive. >> outside the white house immigration supporters marched during the president's speech carrying signs thanking him. a couple of hours ago john boehner issued a warning to the president. >> for this action the president has choicen to deliberately sabotage any chance of enacting bipartisan reforms that he claims to seek. we're working with our members and looking at the options that are available to us. but i will say to you the house will affect that. >> senator lindsey graham is warning his fellow republicans, quote, if you over react it becomes about us. not about president obama. senator graham was a member of the bipartisan gang of eight responsible for the immigration

reform bill that passed the senate last year. joining me live now jose diaz-balart host of the rundown. it's great to see you. let's start with the reaction. your reaction to speaker boeh r boehner's threat. we heard it from other republicans saying there will be consequences to the president's actions. but we heard very little as it relates to options that the republican party plans to offer up. >> yeah. i mean, that's a very good question, tamron. and the speaker and the incoming senate majority leader have said they want the next congress to be given the chance to deal with issues like immigration without the pressure of unilateral action by the president. and that's what they're saying about the in coming congress. the fact of the matter is that for 2013 and 2014, the senate passed a bipartisan bill that was sent over to the house. and for those two years, the house said they were going to be dealing with immigration reform.

they actually got members of congress both republicans and democrats a small group of them to physically work on drafting potential language on immigration reform. so it's not just clouds and smoke and mirrors. we're talking about work being done to deal with the broken immigration system that all sides agree is a reality. it's broken. yet, when push came to shove, there was nothing done in the house. even though there were good faith efforts underway by democrats and republicans to get some bipartisan work done in the house on immigration reform. so the president now announced he was going to do it. he said he was going to do it before the election decided to delay it and now he doesn't. >> let's highlight lindsey graham's reaction. i want to contrast the reaction saying don't overreach with potential presidential candidate

rick perry he's saying the lawsuit is likely. when you look at governor perry's comments compared to what he said when he was running for president. he got booed not allowing the students in the state of texas to attend college to people not being compassionate. his change of tune compared to someone like lindsay grey graha points to a divide within the republican party. >> no doubt about it, tamron. there's been divided internal politics on both parties. let's remember that the president decided to delay this act that he announced last night until after the elections. what senators in the democratic party that were facing the tough re-election campaigns asked him to delay this exact thing until after the elections. most of those senators lost anyway. >> yeah. and most of those senators lost

yesterday, is your family or you impacted potentially at all by this? >> yes. we are actually very impacted by what obama said last night. it's very confusing. i mean, i'm happy because my parents will benefit from this, yet i'm sad that i won't benefit to it due to the fact i have a criminal record. i was charged with criminal impersonation for wanting to work to save up for daca. and i think it's something that it's not fair. i think he should take a little more in consideration people like me and maybe think about it and perhaps let us have that permit he's giving to parents of

u.s. citizens and childs. >> because you feel there are others like you while it's potentially great news for a million people including your own parents who have been in the country for many years and may be able to stay longer. there are people like you who worked hard. you were trying to raise money so you could stay in this country. now you have the felony charge against you. what, if anything, have you heard from advocates that can be done to help you? >> so far i haven't really heard much. i mean, we did file the lawsuit, which will -- if we win will it will clean our record. if that happens, we'll be eligible for what obama is now giving. so, i mean, i think if that happens question apply for it and we'll qualify. >> so right now the news is

bittersweet. i know, you're happy for the other cases but obviously for your own case it's in a stagnant state. thank you so much for being brave enough to show your face. joining me now is attorney usa "toda usa today column nist and law school professor. you heard her story. there were people at the front of the white house yesterday celebrating the mood which is monumental in many ways. there will be many others, potentially 5 to 7 million who are not affected by this. >> right. this type of decision inevitably going to have winners and losers. one thing -- i'm not familiar with all the circumstances of her case. one thing on her side is the new applications for the new d aka

program and the expansion of the existing program is not a blanket threat to the group of people. everyone applies and adjudicated on a case by case basis. they only look at felony convictions. she has a good shot at presenting her circumstances, pleading her case, and showing at this point from the sounds of it she doesn't have a conviction yet. so there are some extenuating circumstances that could help her win her case. i think what she summed up she used the word bittersweet. it sums up what a lot of people are feeling. there great joy and jubilation. we're hearing yes we could. people are excited and yet we still have some families in the immigrant communities that are not eligible for the relief. >> how will it play out? you look at it 5 million people. we heard congressman lewis gutierrez said he would be a part of a coalition of people trying to help people understand the process. how they apply and what they're supposed to do.

many times bureaucracy gets in the way. how will you see this playing out? >> one of the reasons the immigrant rights advocates were pushing the president to go so big no matter what you start with. potential 8 million or potential 5 million. the number of people who finally qualifies tends to be much smaller. when reagan did his amnesty only about 45% of people qualified and naturalized citizens. with daca we have about 600,000 recipients. that's out of 1.2 million eligible. the reason people don't do it is sometimes $465 is not something that most undocumented immigrants have. sometime there's language barriers. there's also the risk factor. it's not a get out of jail free card. you're signing up with the government, giving them your name, parent's name. all your personal information. who knows who is going to be in the white house next. >> there's a risk. they have been living in secrecy

this long. >> and it's just for two or three years. >> that's a part of the observations you've made regarding what happens under the next administration. >> yeah, i mean, that's right. there's no guarantee about what is going to happen next. and there's no guarantee that a person who applies will get it. there's no guarantees about any of this. it's a huge deal but it's not, as you said, a get out of jail free card. >> one of the other issues regarding the legality of this. you've heard republican response already. you make the point there are 11.5 million unauthorized immigrants in this country. congress has only funded the capacity to deport 350,000 to 400,000 per year. that's under 5% of the people who could potentially be removed. and under what is established right now, you are not dealing with 95% of the problem until the president made this move. >> yeah. that's right. this is a prioritization move. that's the legal defense of it.

i think that's an accurate characterization. the idea is that the president wants to focus the capacity that congress funded which is to remove 400,000 people or some fewer. he wants to focus that on the people who it makes sense to remove. therefore, he wants to give some kind of safety to the other people so they can get out of the shadows and live their lives. because they're not going to get deported. so shouldn't they have some reassurance and safety and work permit and a driver's license and so on? so it is a prioritization move. the same way as the police prioritize people driving at 80 rather than the people driving at 56. >> that's a great way to put it. thank you so much. i want to mention to our audience you can join our immigration conversation online. we'll be answering your questions about the president's executive action. they'll be on twitter starting at 11: 30 eastern time. 15 minutes from now.

tweet your questions houusing h msnbcchat. one day after the president announced his immigration action. house republicans filed a long awaited lawsuit against the obama administration over the affordable care act. nbc news kelly o'donnell joining us live from washington, d.c., with the details on this breaking news. >> tamron, this is about the health care law not immigration. even though there's some talk about trying to challenge the president on what he announced last night. this is about the health care law. it's been a long time in the making. it was authorized by congress with a vote this past summer. what this says is that the house of representatives is suing the president for the department of health and human services and the treasury department over two specific parts of the health care law. part of it the affordable care act's employer mandate. the president delayed the implementation of that. congress is saying he did not have the ability to do that because the law was explicit that employers of larger

corporations above 50 employees had to provide health care or pay fine. there's a piece to ensure that providing health care coverage having access to be a part of the marketplace to provide the health care coverage to those who purchase it through the plans, and if they needed to have a subsidize because they were providing it at lower than market rate, the government would provide the money. congress was saying it was not appropriated or a part of the law. those are the two grounds. this is important because they're trying to challenge the president on specific things. this isn't just a big political argue. they're trying to find a place where they would have legal standing. it remains to be seen what will happen with the lawsuit going forward. it's a big step. in announcing this today speaker boehner said time after time the president has choice ton ignore the will of the american people and rewrite federal law on his own without a vote of congress. if this president can get away with making his own laws, future presidents will have the ability to as well. the house has an obligation to

stand up for the constitution. that's an argument to say this case, if it moves forward, will wind through the courts and not even be dealt with likely while president obama is still? office. so they claim it's about a larger issue. democrats say it is a way to try to make a political argument in a courtroom. and so there's going to be a lot of debate about this. it's been threat nld for a long time. today is an important step. we're learning a bit more about what the specific arguments are basically congress is saying if we write a law it must be followed. if the president changes the law on his own, even if he thinks it's good reasons it's under cutting the role of congress. it's a debate that is important for the courtroom and also important in the public square with so much going on. >> all right. thank you very much. and up next. the snowfall from buffalo's epic snowstorm has finally stopped. the situation there could get even worse. we have a live report coming up next. plus this. >> no matter what the grand jury

million people affected by the back to back epic snowstorms in new york state. preparation preparations are underway for major flooding. a year's worth of snow on the ground it could produce the equivalent of 6 inches of know and make the roofs heavier. people are risking their safety and scrambling to clear off roofs. and 30 major collapses have been reported throughout the area already. the number of deaths from the storm is up to 13 people. officials announced this morning two elderly nursing home residents died after they were evacuated over fears that that build's roof would collapse and another man was found dead in his vehicle. sa sara dallof joins me from new york. at a stand still behind you. there's no movement. >> reporter: that's correct. they're starting to dig out here. that doesn't mean that life is back to normal. take a look at the snow on

let's factor in the tweet from hillary clinton last night. she wrote thanks to potus for taking action on immigration. let's turn to permanent bipartisan reform #immigration action. words and at least a tweet from hillary clinton on this. we're talking about how some of these very topics address their factor into 2016. >> that's right, tamron. i think on immigration you saw hillary clinton who really, by the way, hasn't really weighed into political issues that fast and that forcefully since she left the state department. this was a very quick response from her. for republicans, you saw most of those 2016 contenders racing not only who could decry the president's actions the most but the loudest and on the most platforms. i think it may have the result of doing is in the republican primary republicans are going to keep moving to the right on immigration. it's what their base is asking for. whoever the eventual nominee is might want to return to the

center. hillary clinton having embraced this may have an easier go of it if she is to be the democratic nominee next year. >> the first read team puts also a good point on the conversation. it says republicans would be very different place on this issue right now and their criticism of the president's actions if they had any bill. even one that might not get presidential support to show the public but they don't have any bill. not a singular one that is border security first. nothing. >> that's right. and republicans have this issue now of the president saying last night if you don't like what i did pass a bill. the ball is definitely in their court now. i think republicans have no choice but to address this when they have the majority in the senate. you saw, by the way, some 2016 candidates including jeb bush and marco rubio saying we need to -- we need to think about addressing this legislatively. the problem for republicans is hard to imagine what that legislation looks like with a conference as divided especially on the house side as john

boehner faces. he has part of the caucus that wants to address this. is looking toward 2016 and looking toward demographics in the coming election and part of the caucus that said maybe we'll address the border. anything that seems to sound like amnesty. i'm not for it. let's factor in the lawsuit. the house republicans filing the lawsuit against the president over unilateral actions on the health care law. the timing of this actually after, as we know the president's announcement regarding immigration. >> right. and republicans have been talking about this lawsuit since the summer time. they hadn't filed it until today. they had trouble getting legal representation on that. they have a lawyer who is going to represent them. and move forward with this. this is changing the conversation away from immigration trying to change back to health care that is something that the republicans are much more united on, i think, than how to handle immigration in the long run. >> thank you very much for our political postscript. and msnbc will have live

this? >> we have a battle in the arena of brand rehabilitation. it's adrian peterson attempting to rehabilitate himself. versus roger goodell using this case and using the beaten body of a 4-year-old child to rehabilitate his own brand in the ray rice scandal of a few months back. that's what's so upsetting about this exercise. we need to separate what we may think about adrian peterson did to his child. i do not believe in hitting my children. separate that from the fact that roger goodell and the national football league are exploit ploiting this case for their purposes. that rubs me the wrong way. it trivializes child abuse and turns it into an exercise in public relations.
