november 25th. we've been covering the latest in the breaking news in the las% eight hours. in the protests from overnight in ferguson, missouri and protests across our country it's been a very fluid night in ferguson, missouri for the violence that erupted there and for parts of the country and the city in ferguson, missouri especially with the unrest that happened right after the moments that the county prosecutor announced a grand jury did not indict officer darren wilson, that's the white police officer who shot and killed michael brown an unarmed black teen in august. this is one of the results of the protest. a dozen businesses up in flames including a drugstore and a pizza place. protesters also set fires to numerous vehicles including at least two police cars. other police vehicles are damaged after being vandalized. some demonstrators smashed windows and looting was reported at several stores in the area. president obama addressed the nation late last night urging demonstrators to show restraint

but his speech came as the violence began to unfold creating surreal images on tv as you see the split screens there with the president speaking and the violence happening on the other side. police officers used smoke and tear gas to break up some of the protests. officials say 29 protesters were arrested. no lives were lost police say the unrest will have a long term impact on the community of ferguson. our community has got to take some responsibility for what happened tonight. for what happened tonight as far as tearing our community apart. this cannot happen. we talk about peaceful protests. that did not happen tonight. we definitely have done something here that will impact our community for a long time and affect our region. that's not how we create change. change is created through our voice and not through destruction of our community. >> so the county police chief said he personally heard at least 150 shots fired overnight.

the frequent gunfire forced report towers step back including msnbc's own chris hayes. >> we're hearing some more what sounds like gunfire nearby. [ gunshot ] that's gunfire. all right. just a hail of gunfire justqmpm. yeah? okay. we're being told to fall back. i'll throw to you in the studio. we'll try to get on the phone. >> okay. so out of precautionary measures they moved and returned to tv a short time later. chris hayes and his crew were not jurisdiction. >> reporter: thomas we're here in ferguson where we're just a few blocks away from where michael brown was shot and killed in august and chaos erupted overnight have word there would be no indictment

against ferguson police officer darren wilson. they said this was the worse night yet, worse than anything they saw in august. his officers heard 150 rounds randomly being fired off by different protesters, demonstrators on the street. looting, buildings on fire, a police car torched, other cars lit on fire. at least 25 buildings on fire and some of them are still on fire this morning. there was so much gunfire flying through the air there were flight restrictions. five flights were diverted. those restrictions lifted at 5:00 a.m. a news conference at 1:30 in the morning to assess what went wrong. law enforcement saying they did not see a lot of peaceful protests in the administrates overnight. back to you. we'll check back later in the show with you. we want to take a deeper look at the grand jury's decision not to indict officer darren wilson in michael brown's death.

the grand jury was made up of six white men and three white women along with one black man and two black women. county prosecutor bob mcculloch says reliable eyewitnesses testified brown charged at wilson before he was shot. there were multiple witnesses that changed their stories or gave conflicting accounts. >> i'm ever mindful that this decision will not be accepted by some. and may cause disappointment for others. but all decisions in the criminal justice system must be determined by the physical and scientific evidence and the credible testimony corroborated by that evidence not in response to public outcry or for political exped ency. >> mcculloch didn't mention brown was unarmed but singled out to the media saying they contributed to the unrest after the shooting. these are photos of officer wilson after his altercation

with brown. he testified brown hit him when he first approached the teen about a robbery. the officer said he would warn brown he would shoot if he did not get back. at which time brown grabbed wilson's gun and twisted around. wilson said brown looked like a demon and drew his gun out of fear and another punch could knock him out. wilson's attorney released a statement which said law enforcement personnel must frequently make split second and difficult decisions. officer wilson followed the law. michael brown's mother screamed and cried when she learned officer wilson would not be indicted. the brown family said we're disappointed the killer of our child will not face the consequence of his actions. join us. join with us in our campaign to ensure every police officers working the streets in this country wears a body camera. we respectfully ask that you please keep your protests peaceful. answering violence with violence is not the appropriate reaction.

now protests they did break out across the nation last night as well in chicago there were reports of more than 200 people gathering and joining in chants. protesters shut down parts of lake shore drive along lake michigan. and in washington, d.c. about 500 protesters, mostly students gathered outside of the white house. the group held a four and a half minute moment of silence for michael brown. that was one of the requests that brown family had made. the protest was reportedly peaceful and police were not engaged. in new york city over 1,000 people gathered downtown and marched through upper manhattan. helicopters show protesters swarming the area around times square and nypd spokesman said one man was arrested for throwing what appeared to be red paint towards police officers including commissioner bill bratton. in seattle police say demonstrators got on to the interstate where highway

officials were forced to close lanes and after several hours of peaceful marching protesters began hurling bottles and rocks and "seattle times" reports police responded with pepper spray and percussion grenades. in oakland, california several hundred people blocked a major highway, interstate 580 before police were able to corral the crowd and re-open the highway several others later. before those protests broke out president obama called for calm in a primetime address and as he recognized the issue of race may play in the distrust between citizens and police. >> we are a nation built on the rule of law. and so we need to accept that this decision was the grand jury's to make. there are americans who agree with it. there are americans who are deeply disappointed, even angry. it's an understandable reaction. but i join michael's parents in asking anyone who protests this

decision to do so peacefully. we need to recognize that the situation in ferguson speaks to broader challenges that we still face as a nation. the fact is in too many parts of this country, a deep distrust exists between law enforcement and communities of color. some of this is the result of the legacy of racial discrimination in this country. and this is tragic because nobody needs good policing more than poor communities with higher crime rates. the good news is we know there are thing we can do to help. and i've instructed attorney general holder to help communities to work for better relation between communities and law enforcement much this is not an issue just for ferguson this is an issue for america. we have made enormous progress

i really don't have any hesitation in telling you i didn't see a lot of peaceful protest out there tonight. i'm disappointed out there. i'm not saying there weren't folks out there for the right reason. but unfortunately this spun out of control. and frankly what i'm seeing tonight and i've been up there all evening right in the middle of it along with captain johnson what i've seen tonight is probably much worse than the worse night we ever had in august. >> so we are continuing to follow the developments overnight in ferguson, missouri after a st. louis county grand jury chose not indict officer darren wilson in the shooting death of michael brown. in the meantime i want to look at the other big headlines making news this morning. president obama will have to find a new secretary of defense as chuck hagel has announced his resignation. it was first reported by the "new york times" and the paper

said the president and hagel mutually agreed it was time to make a change. both men spoke to reporters yesterday afternoon. >> i've known him, admired him and trusted him for nearly a decade since i was a green behind the ears freshman senator and we were both on the senate foreign relations committee. there's one thing i know about chuck is that he does not make this or any decision lightly. >> it's been the greatest privilege of my life. greatest privilege of my life to lead and most important to serve, to serve with the men and women of the defense department and support their families. i am immensely proud of what we accomplished during this time. >> while obama and hagel are close on a personal level there are a number of reports that indicate a strained relation between the former nebraska senator and the white house. the time quotes a senior administration official says the

next couple of years will demand a different five cuss. another official was more blunt saying hagel was forced to resign after the white house lost confidence in him. official said hagel wasn't up to the job. other reports said hagel was fed up with the micromanagement from the white house. hagel will remain in his current position until the new appointee is confirmed by the senate. the department of veterans affairs removed the head of the phoenix va hospital six months after being placed on administrative leave. she's now gone. the phoenix va came under widespread criticism after staff lied about wait times. 40 veterans died while waiting for care. a new hospital director will be named soon. republicans are set to take over capitol hill but doesn't necessarily mean the party has a mandate. in fact a new bloomberg politics ans is selm poll caution republicans against

overreaching. 60% say the gop shouldn't use their majority to carry out a new jends. 46% want the president to give ground to republicans, 44% want him to stop them from going too far. overall 44% are more optimistic about the future, 28% are less optimistic. shift gears let's talk sports. we begin with the ravens and the saints, monday night football and the game in the third quarter. drew brees back to nsa. he throws, intercepted. will hill taking it 44 yards the other way a touchdown by the ravens. there we have it. ravens take the lead. but the running back rushed for 182 yards and two touchdowns. new orleans is handed its third straight loss after 34-27 ravens victory. purple! anyway a double dose of monday gridiron action the bills hosted the jets in detroit because of

look at the cold air in pittsburgh and buffalo. that's what the storm will eventually tap into. winter storm watches from northern maine to the western areas of virginia, even a couple of winter storm warnings down there in the mountains of north carolina. this is going to be a storm that will have a lot of moisture with it. but the temperatures are very questionable. so it's going to be a fine line between if you get all snow or if you stay all rain for predominant period of the storm. the mix area right along i-95, most likely starting as rain. if you're traveling really from new york city southward wednesday morning your fine as long as you're with windshield wipers. it will rain hard but not heavy snow. wednesday afternoon and wednesday evening it's going all snow through areas of new england. that's where the worst will be. here's how much snow i'm expecting. d.c., no problems on the roads. new york city, i got to be right around three. the national weather service in new york has new york city six

tonight understand that there's never an excuse for violence, particularly when there are a lot of people in goodwill out there who are willing to work on these issues. on the other hand, two are only interested on focusing on the violence and just want the problem to go away need to recognize that we do have work to do here. and we shouldn't try to paper it over.

the most significant challenge encountered in this investigation has been the 24 hour news cycle and its appetite for something, anything to talk about. following closely behind with a nonstop rumors on social media. i recognize, of course, that the lack of accurate detail surrounding the shooting frustrates the media and the general public and helps breed suspicion among those already distrustful of the system. many witnesses to the shooting of michael brown made statements inconsistent with other statements they made and also conflicting with the physical evidence. some were completely refuted by the physical evidence. as an example, before the results of the private autopsy were released, witnesses on social media during interviews with the media and even during questioning by law enforcement claimed that they saw officer wilson stand over michael brown and fire many rounds into his

back. others claimed that officer wilson shot mr. brown in the back as mr. brown was running away. however once the autopsy findings were released showing michael brown had not sustained any wound to the back of his body, no additional witnesses made such a claim. after their exhaustive review of the evidence the grand jury deliberated over two days, making their final decision. they determined that no probable cause exist to file any charge against officer wilson and returned a no true bill on each of the five indictments. >> st. louis county prosecutor bob lock announcing the grand jury's decision not to indict officer darren wilson in the shooting death of brown. flames and gunfire and a lot of anger followed that indictment. right now i want to go to you gene robinson of the "the washington post," reaction of last night's decision. i know you've been following this very closely and writing

about it since august. we've seen how the community reacted. one thing to point out, though, because when this first happened there was violence but we've had over 100 days of peaceful protests as people anticipated what was going to happen. so how do you put that into context with what we saw last night with the reaction to no indictment? >> well, first of all, i think a lot of people, certainly, including myself were not terribly surprised that there was no indictment given the way entire "4÷guprocess. it was an unusual way to present evidence to a grand jury, presenting the whole case rather than just what the prosecutor wanted the grand jury to hear. that alone should have given us not pause but should have let us known basically what was coming.

i am mystified why this was announced the way it was announced at the time it was announced with the kind of build up that was given and i wonder clearly -- to me any person would have realized there was a way to announce this decision that would have been less likely to provoke what we saw last night. >> the onus is on the prosecutor going through this to go for an indictment. >> yeah. well that's what i thought. i thought the prosecutor was there to represent the victim. the prosecutor spoke as if he were there to represent officer wilson. and one certainly has the impression that he decided very early on that he was not going to vigorously pursue an indictment and indeed did not get an indictment. prosecutors who want indictments from grand juries get them. >> one thing we can say the

brown family has reacted saying that they were disappointed but definitely asked for calm and they also asked that they encourage people to support a movement of police wearing body cameras. we'll see if that movement is picked up and i know joe has talked about that a lot on "morning joe." eugene i know we'll see you in a few seconds. this is the tuesday edition of "way too early."
