about the president's immigration executive action. right now at this moment, you are looking at a picture there. the house judiciary is getting under way on capitol hill. that committee will hear from four witnesses, only one of whom is known to support the executive order. earlier this morning they questioned jay johnson. he defended the president's move that could protect five million from deportation. >> the reality is that given our limited resources, these people are not and have not been for years priorities for removal. it's time we acknowledge that and encourage them to be held accountable. this is simple common sense. >> johnson testified that his department can't run without a short-term spending bill. this hour's hearing just getting under way. i'm going to hear from my colleague following this about both of the hearings in a moment. another big update out of washington. we are hearing an announcement

of the president's nominee that could come any days. the leading candidate we are hearing is former deputy defense secretary ashton carter. there have been a few names he is rising to the top. we know that carter was the weapons and tech-buying chief for two years and had an extensive background. degrees in physics and medieval history from yale and a doctorate in physics from oxford. detroit has been hit by power outages in a huge way. a student from state university sent this. power is out and classes have been dismissed. we will keep an eye on the situation there. the frank murphy hall of justice building have been hit as well. some without working traffic lights too. look at that back up. the conference is scheduled for 2:00 p.m. today. >> another football controversy very much in the headlines. granting a first exclusive

happening today. both led mainly by republicans. right now, the hearing of the house judiciary is getting under way at the legal question of whether they overstepped powers. earlier jay johnson was who in the hot seat testified. john boehner saying this morning that republicans are going to take action. it is just a matter of how and when. >> this is a serious breech of our constitution. it's a serious threat to our system of government. we have not made decisions about how we will proceed, but we are going to proceed. >> the great jose diaz following this story for us and telemundo and he joins me now. he defended the president's action. tell us about the legal question at stake. he said this is perfectly legal.

>> i think the big question is who will have standing to challenge that in the courts? the house of representatives could i presume do what they did on obamacare and present a lawsuit against his actions on this immigration front. who has legal standing on it? i was interested in seeing that this morning when speaker boehner spoke, he said they were not idea ready to announce anything specific as far as reaction to the president's executive action. i guess they will wait this week and a half before going on break. that would mean i guess that the new congress would have to deal with that. but meanwhile, these 5, 5.5 million people who have been living in the shadows and come out to register and have to show they haveus-born children or residents of the united states of america. go through a background check and pay taxes. that's going to be happening in short order in the next four or

five months of the 2015 new year. >> and jose, you mentioned the standing question. that is a big subject in the dl debate. one thing we heard in the earlier pursuit with the action to move the mandate date on obamacare, they are drawing on old precedent going back to the argue thamt lawmakers can have standings and suffered an injury that would allow them to sue. there is a big policy debate. a number of republicans saying the order would encourage immigration. that's something we heard a lot of. what's your take on that? >> any time there is talk of immigration reform, some republicans always say that whatever is done is going to encourage new waves of illegal immigration into the country. that's part and parcel of any discussion when it's talking about the possibility of moving forward on immigration reform. the fact of the matter is and the secretary was clear on it

and when he announced his orders, no one that entered into the united states after the first of january of this year could be considered to be able to stay under most conditions. so the fact is that there will always be people that in order to throw smoke screens on possible progress will say anything and everything. i think if we stick to what this is all about, to give five million people who have been here and many of them have children and grandchildren in the united states. those are the people who will be benefitted and not the people who are coming in this year or in the future. >> your opinion is valuable on this. for everybody at home, you can and should watch jose's show 9:00 to 11:00 a.m. here on msnbc. big news overseas. lebanese authorities detaining a woman and a child who could be the wife and son of the self

proclaimed ka live of isis, the islamic state. they stopped the woman and child more than a week ago as they tried to cross lebanon from syria. our foreign correspondent is following this. we appreciate you joining us. what do we know about how they were apprehended? >> we are learning that about days ago, she was apprehended by lebanese security officials on the border. we believe her identity to be that of an iraqi woman. that's important for another reason. we will get into that. we understand that according to lebanese officials, they believe they have one of the wives of the leader of isis. she is being interrogated at the ministry of defense in beirut. her interrogation will be very important for several reasons. she may be perhaps one of the most important pieces of intelligence about the leader and inner workings. if indeed she does turn out to

be the wife of the leader, it could prove to be an important piece of information into how he operates. was she carrying information and is she a courier as we have seen with the close inner circle members of these wanted individuals? >> if you for the upset. potentially significant development there. >> reaction pouring in and we were watching it. to the st. louis rams controversy. did they apologize for the hands up don't shoot gesture that five players made before sunday's game. the answer depens on who you ask. the police claims the vice president of football operations phoned him yesterday to apologize. they deny it happened saying in no statement did i apologize for the players's actions. the head coach said there is no plan to penalize them for exercising what he said was the first amendment right. >> as far as the choice that the

players made, no, they are exercising the right to free speech. they will not be disciplined by the club nor will they be disciplined by the national football league as it was released today. >> the players are not alone. members of congress making that same hands up, don't shoot gesture on the house floor yesterday. you can see them there. tre main lee has been covering this and joins us. some called this gesture a sign of respect to the late michael brown. why has it become so insendiary? is there a way to make that without it being so? >> there is not a reason without it being racially charged. when you look at the make up of the nfl and the five player who is put their hands up with the people of ferguson, many come from communities that had these daily interactions with the police that are often negative. i think though they called for an apology, they are standing up

with the community. there is no way to avoid it. they spread nationwide and it means solidarity with the communities of color. >> this is not the first time we have seen a gesture like this. members of the miami heat posted hoods in solidarity with trayvon martin. the difference is that it's going so national. what has changed in the years or why is this situation fundamentally different? >> i don't think much has changed. if you talk to folk who is have been anger and before that they ran a number of cases. it's another step in that same direction where people are mobilized. you look at st. louis. it's so racially segregated. people are now divided picking sides and i think that's why we see the nature. >> it's a tough setting not just there, but around the country. appreciate your up date on that. keep it here at home. we have a fascinating look at

million for 50,000 police body cameras to be dispursed t. that follows conflicting witness testimony the day michael brown was shot. their response to protests in the days of late august. there were similar calls in new york city after eric garner died. he was placed in a choke hold during a struggle with police officers. this call has gone national and one big voice, the person behind this addressed it. the new york city public advocate, always a pleasure to have you on. thank you for coming on. me about this move by the president. you have been lobbying for this latest news. is this what the country needed? >> the scenes we saw in ferguson and in the aftermath of a number of troubling shootings throughout the nation, not only ferguson, but eric garner as well as the case in brooklyn.

what we have proposing and i'm glad i have been a leader is proposing cameras. this simple device could provide an objective recording of street encounters with nypd and throughout the nation and the country. it's important to provide this objective recording. in addition getting an account of what happens on the street and exonerates police officers against false claims. >> you came on before with a camera and we looked at what that looks like. we have got some of that very set. there is the video of what it looks like to wear a camera and the scene playing out right now. what is the biggest stumbling block to police forces? >> the issue of access and privacy and it's an issue of our laws. they have not caught up with technology. a number of police departments

are concerned with respect to privacy issues and they are concerned with respect to access and with regards to storage. freedom of information request with our nation. what we are trying to do is review our laws in the state of new york. improving them and basically expanding them and revising them to keep up with the 21st century. >> the news is an update on the grand jury eric garner case. legal sources are telling us a vote could come as early as tomorrow. wednesday, december throwrd. i know you have been following this. >> yesterday as you know in the office of beby rose, we had a police commission with others. and so we came together and devised a strategy in response to the decision of the grand jury. it will be out wednesday or thursday. again, we are urging calm.

it's important to understand that staten island is not ferguson and it's important that individuals have a right to protest and they don't have a right to destroy property. we will stand up and i will stand up with the residents against anyone who violates the law. >> thank you for that call and just coming in over the wires, we are hearing there could be a vote tomorrow in that eric garner case. we will keep track of that. what we are hearing is a similar call that they are surging patience and calm. stick around too. i want to you weigh in on the next story. it has a close tie. we will turn to one of the trends that is spurring accountability everywhere in the country. open carry laws getting more pervasive. laws allow gun owners to carry publicly their guns. they vary from state to state. we took a deep dive on this in detroit. they met with a group that is advocating for more expansive

joining me now, she know this is issue well. she is the wife of wally williams and she faced domestic abuse and has spoken out about her experiences with the league. it's a pleasure to see you. you saw that interview. how did you feel watching that? >> it was kind of uncomfortable actually. knowing all the pressure that they have, ray is trying to find a team so they have to present themselves as a united front. we will never know what is going on behind closed doors. i know that when my husband and i had our situation, i was his biggest defender as well. i was trying to protect our home, his job, and the nfl. >> this is a woman with everything at stake. >> everything. and walking away and losing it,

vote a resolution or bill with disapprove of president obama's executive action regarding immigration reform. this allows more conservative elements of the party to get out there and give speeches on the floor saying how bad it was and overstepping the executive powers, etc. next time they fund through cent 30th, with the exception of next year and the exception of homeland security which they only fund and trying to hold back the funds come march pertaining to the enforcement of the immigration policy. the homeland security secretary testified that we don't want him until march. that would be detrimental. a lot of republicans feel that's a better way to go because they don't have to worry about a shut down prior to christmas. the rest of the government gets fund and they focus more on the

immigration element when they come back when the majorities are stronger. that's the pervailing wisdom. you never know whether people on the right and he said he is not totally on board with this so far and you never know what they will say too. >> we are hearing reports that ashton carter is maybe the leading choice to be the next staff. what support do you see him fighting on the hill? is this a smart choice? >> as this story floated on the hill at one point, we had the ranking number of armed services say yes, it's going to happen, great. they have to walk back a little bit. no official announcement. from democrats and republicans, they think carter would have an easy confirmation. in. >> mickey:'s report, he is the general manager and he knows where the money is and what the budgets are like. he worked well in the eyes of both republicans and democrats. if he is to be put up for

about who they can be helping and who they can be giving monitarily to at this time of year when a lot of money is changing hands. it's a reminder that and and certainly regardless of your ang, we have all time we can give to different causes, charities and efforts. and people give in other ways. we have the largest military force on the face of the planet. it's an all-voluntary military. those people at this time of year are giving -- giving up time away from their family and loved ones so we can all be home with ours. it's not just about money. it's about time. it's about thinking about the world and our communities and how we can be trying to make the place a little bit better at a time of holidays when sometimes it focuses more on ourselves. >> congressman, you had an interesting generational emphasis that struck me when you announced this, you noted that 73% of millenials gave to charity last year. why frame this in such generationally specific terms? >> well, part of it was my co-chair of the future caucus

and co-sponsor of this bill is tulsi gabbert, who wanted to be with us but couldn't. she's 34 years old. i'm 33 years old. a part of it is young people today, right or wrong, have -- you know, people have focused somehow on the fact that maybe young people aren't as involved politically, aren't as involved in their communities, aren't as involved in fiphilanthropic causes. people our generation are involved more than ever. and so, i think, the numbers speak for themselves. 74% of millenials and young people have given to charity in the last year. and that's an impressive number. so, it's not only a benchmark, but it's also a motivational factor that i think we need to rally around. >> congressman, as you mentioned, tulsi gabbert tried to join us for this segment. she was unable to due to her votes. the fact remains, this is a push across the aisle. personally, i'm very inspired by

that. it's an anecdote to the cynicism and partisan we normally see. you are both trying to broad that, significantly a very significant development if it catches on. what do you think others on the hill can learn from the show of bipartisanship the two of you have launched? >> well, we get more done working together. at the end of the day, regardless of what happens on the continuing resolution, on the omnibus, on the funding bill, it needs to be bipartisan. at the end of the day, you know, i can assure you votes taken on both houses will get both on both sides of the aisle. the fact of the matter is having us sit in our respective corners really doesn't do much for our respective constituents. the more we reach across the aisle -- doesn't mean have you to compromise your principles or compromise what you believe, but it's a recognition that even in your personal relationships, your business relationships or

your political relationships, you don't get everything that you want. and people who live in these worlds where they believe that they should get everything that they want, just aren't living in reality. so, i think what tulsi and i and the future caucus are showing is that, particularly among younger members of congress who have come to d.c. at an early age, we're results-oriented. we don't want to think three or six months of funding, but what are we doing for america to be more strategic in the next five to ten years? the last time i checked those aren't republican/democrat issues. it's about how do we invest in education? how do we make america smarter so we compete on a global economy? >> how do you translate to partisanship into some of these tougher, more divisive issues?

>> if we're going to pass a truly comprehensive immigration bill and addresses all the areas it needs to be, it will be finding that common ground. and i think certainly bringing the members of congress together, there were -- when i came to congress six years ago, there were four of us under the age of 40. two years ago there were 40 members under the age of 40. and now we've got about another 20 members that were just elected under the age of 40. so, the point is, is that we have a growing number of people who are result-oriented and finding that common ground on tax policy, on trade policy, on immigration policy, if we can bring bills to the floor with 40 or 60 members as co-sponsors, that allows our leadership to actually be leaders and move on these issues. >> well, this is a rare show of bipartisanship. it's certainly a start toward those very important goals you outline. i so respect that. of course, there are tons of specific policy issues i would love to drill down on. i know you're here to talk about giving tuesday. i'm grateful you came to talk about that. thanks for your day on a busy day.
