rivera in for tamara hall. and this is "news nation." in just three hours, congress will vote on a spending memo that will avoid a government shutdown. but the $1.1 trillion package is hitting snags. many problems, democrats are pushing back angry at a number of provisions they say was snuck into the 1600-page bill. and to roll back the legislation designed to aid risky trading with big banks. and elizabeth warren says it will leave taxpayers on the took for potential bailouts and she's now urging democrats to vote against the bill. >> i urge my colleagues in the house to withhold support from it until this risky giveaway is removed from the legislation. we all need to stand and fight this giveaway to the most

powerful banks in this country. >> and some democrats are also upset about another provision in the bill that rolls back campaign finance rules allowing big donors to give ten times more money than they currently can. house speaker john boehner will need some democrats and republicans to pass the bill that's because many republicans are expected to vote against it angry that the bill doesn't intend to defund president obama's action on immigration. speaker boehner is expected to speak in the next half hour. at that point, we may find out just how close the final vote it. joining me now nbc capitol hill correspondent kelly o'donnell. thank you for being with us. >> good to be with. this is a day when things are unfolding because it is deadline day. democrats feel strongly that these provisions are harmful are trying to rally fellow democrats

to bring this to a halt. thought to kill the bill overall, although that's a risk, but to try to take out that piece. the hard part, frances is if you take that one piece it's been negotiated by democrats over months. a lot of these things were only learned when the 1600 pages went public a couple nights ago. it has invited intense criticism from the liberal side of the party. some democrats at the bargaining party say they got other things in exchange for that. more money for consumer protection. and on the issue of campaign finance which is hotly contested republicans arguing that congress is decides no longer to pay for the national conventions. so you have to raise money privately and allowing donors to give more. it's some of that give and take. the real question is is it something that lawmakers can live with knowing that at midnight tonight the deadline hits for a government shutdown. now, they've got ways to protect against that but as we have seen

before in the final hours of a big important piece of legislation it does get very prickly, there are concerns. hard to know what will happen now, certainly, elizabeth warren and maxine waters in the house is saying hold on. >> and what about the option for the short-term measure? >> well what they can do that we've seen them do so many times and that's the passing of a band aid. keep the lights on and pass a short-term measure and keep talking. the hard part about this, this congress actually ends and a whole new group comes in in january. in that case, more republicans will be here. many of the ic negotiators say this is the best deal we can get. and at the same time if they're worried of a threat of a government shutdown that can be

scenes on the republicans' watch and harmful to them. so the negotiating goes on. we've only got a couple hours before it's time to show the votes. frances. >> we're talking about 1600 pages now. a lot to analyze. joining me now is "washington post" analyst eugene robinson. it allows banks to more easily trade like derivatives here. senator warren is furious saying this encourages the same risky business that led to 2008, and the crisis there. and they want to avoid the shutdown but does warren have enough clout to get the changes to the massive bill? >> frankly, i doubt that she does. you know, this san important provision because it does significantly weaken the dodd-frank. it lets banks use federally

insured deposits to use that money, which is federally insured to trade in derivatives which are inherently risky. but it takes the lid off and creating a potential. however, you know, number one, neither democrats nor republicans want to be blamed for a government shutdown. nobody wants to see that. and number two, very frankly, that didn't do very well in the recent elections. had the liberal side done better and if we were looking at a more liberal congress coming in in january, then there would be a better deal on the spending bill. but as things stand. i don't think democrats have a lot of leverage. i think don't think the democratic leadership in the house is particularly eager to fight at this 11th hour. >> well, let's talk about this year as far as republicans go.

a lot of them are proposing this package and say it doesn't do enough to stop the president's package on immigration. two prominent groups here club for growth and the heritage foundation are publicly urging them to oppose the bill hup how do you see that playing out in congress? >> well, exactly, the national review which is a conserve opinion journal said vote against the bill. a lot of the sort of true-blue and certainly the tea party conservatives in the house are going to vote against it. which means that it needs democratic votes to pass. it will pass with moderate republicans, the leadership. some conservatives, and democratic votes in the house. and if, you know, if those votes don't come, then we're going to have to shut down the government. or come up with some sort of last-ditch continuing resolution.

but i think in the final analysis, it's going to probably go through. >> a lot to analyze. especially given the fact when it comes to some of these provisions, everybody's going who inserted it? who inserted it? this person that person. that, too, as far as analyzing it. thank you so much. >> thank you. great to be here. another developing story we are following, what's been called the storm of a decade is moving in on california while snow continues to hover over the northeast. the nor'easter has dumped more than 20 inches of snow in parts of upstate new york, pennsylvania and new england. and forecasters say more is expected on the i-95 corridor even washington, d.c. could see a flurry there. but the big story out west, a live look at the golden gate bridge with a storm with driving winds in parts of northern california with bay area bridges closed and silicon valley companies telling their

employees, stay there, just work from hem. domenica davis brings us the latest. >> this is a blockbuster of a storm. we have winds, flooding and even blizzard conditions to contend with with this one. let's start with the peak wind gusts because they have been impressive. and this is what is so far. they are still expected to get higher. look at this in california, 96-mile-per-hour wind gusts. that's a hurricane-type wind. 60 miles per hour in mt. diablo, and san francisco, 39 miles per hour. but that will get stronger. eureka, 1.42 inches of rain so far. we have over 3 inches in some parts. redding coming in at over 2 inches. so here's a look at the expected rainfall. and this is why we're saying this would be the storm of the century because they haven't received rain like this in ten years.

>> wow. >> so this is say major storm that they certainly do need to help with the drought. expect the rainfall in the next 24 hours. in some cases look at redding, 8.7 inches. that's a lot of rain in a short amount of time. it's not just northern california that's going to see that. also through southern california they're going to get in the much needed rain. 2.02 expected rainfall in santa barbara. over close to 2 inches in los angeles. -those burn areas they could be looking at flooding. mudslides continue to be a risk. the storm does, though, push out by friday. and starts to move into the plains for the weekend. wet, wild weather for the west, much needed but certainly very dangerous over the next couple of days. >> hopefully, the aftermath and power outages won't be too much. nbc's miguel almaguer joins me now from san francisco. miguel, how are things looking

so far? >> reporter: well, we've been seeing the steady heavy rain for the last couple hours or so. it's the leading edge of the weather system moving in. we could see upwards of 8 inches in the san francisco bay area in the next 24 to 48 hour. that's a lot of rain for a drought-stricken region that hasn't had a lot of water. it's not just the rain but pounding winds, 75 miles an hour right into the bay area. you go farther north up into the mountains, we'll also find blizzard warnings in effect for the i-80 commuter route that transports many goods. so it's a sloppy and wet day, not just here in the low area, but the mountain area where they're expecting steady know as well. >> talk about the drought situation there. is there really going to make an impact? >> well, we've been in extreme drought in california for the last three years and this rain is going to have a slight impact on that. but the good news about this

storm system, it's setting this up to enjoy a fourth year of consecutive drought. that's really what this system is doing. packing reservoirs, filling the snow pack area to protect us from another year of drought. even a steady rain in the next 24 or 48 hours isn't going to do to impact the drought. >> kind of an investment down the road for the down the road situation. developing now the cia strikes back. in just a couple hours, the agency's current director john brennan will publicly address the findings from the conversation tr controversial torture report. up next, i'll talk with adam ship. and angelina jolie and others caught up on the hack on sony. plus, this -- >> well, we've changed the policy. we've strengthened it. we've toughened it.

intelligence that helped thwart attack plans, capture terrorists and save lives. and brennan's statement also -- and former vice president dick cheney. >> it's deeply flawed. they didn't bother to interview key people involved in the program we asked the agency to go take steps an put in place programs that were designed to catch the bastards that killed 3,000 on 9/11. khalid sheikh mohammed the mastermind of 9/11, what are we supposed to do, kiss him on both cheeks and said, please, please, tell us what you know. of course not. we did what we had to do for those to catch who were guilty -- >> this report says -- >> that report is full of crap.

>> joining me adam shipp of california. we appreciate you being with us this morning. >> you bet. >> let's start right there. what is your reaction to vice president cheney's comments you heard it? >> no surprise, but still shocking. yes, we tortured and denied it worked and yes, we'll do it again. that is not what america is about. what i'd like to emphasize here, a lot of debate since the report came out is whether the torture was successful. that's the least important conclusion of the report. the most important conclusion is we did something that amounted to torture. and efficacious or not, it's immoral and destructive of our values and diminishes our democracies and helps our at versus saers in the war of ideas. that i think is the most

fundamental conclusion of the report. >> one who will be watching as brennan speaks. and mark udall made that emotional speech on the floor yesterday where he basically told president obama to fire cia director brennan. let me play what he said. >> director bren and the cia continue to with any provide information and misrepresent the efficacy of torture. in other words, the cia is lying. this is not a problem in the past, madam president, but a problem that needs to be dealt with today. >> okay. the white house standing behind brennan, but when brennan speaks in a couple hours if he continues to dispute the report in the face of what president obama said that constitutes

torture that that's not who we are, should brennan be fired? >> well, i'd tell you what i'd like to hear brennan say. it will be up to the president to say whether he has confidence in the director. i'd like the director to acknowledge those techniques amounted to torture. and that was wrong and a mistake that will likely not be repeated. and whether it worked, it doesn't matter. what matters that america not engage in this kind of conduct. that's what i'd like to hear the director say. that would help instill greater confidence for me and the director. >> coming out of the shadows. t the architects, james mitchell, one of the two architects who designed the commission after 9/11. >> i don't think it's the right thing to do, i don't think it's the wrong thing to do. i think you can do it in a way

that constitutes torture. i think you can do it in a way that it constitutes training. i think you can do it in a way that helps a person shift their priorities so they experience less abuse later on. it's like every tool in the tool bag. you can underuse it, you can overuse it. >> we learned his firm was paid $8 million despite having no experience in counterterrorism interrogation. was that one of the more shocking revelations to you? >> it is shocking, the amount of money that knew nothing about al qaeda or negotiations really. what you just played is ridiculous, anyone who's been water boarded, described by him as sometimes, it's helpful, sometimes, it's not helpful. sometimes, it's a useful tool, helps them break down whatever reluctance they have, that doesn't change the fact it's

developing now a live look at the golden gate bridge in san francisco. the area is getting pounded with heavy rains and gusty wins. pacific gas and electric reporting 90,000 customers without power in the san francisco bay area. the storm is being called, quote, the storm of the decade" after 9 inches could fall in parts of the region. players head back to a new personal conduct policy with the nfl. the players union is raising strong objections. the union claims it's goodness their collective bargaining unit. the new policy was put in by the nfl yesterday. it comes after a string of domestic violence incidents involving players this year but remains to be seen how much will really change. nbc's peter alexander sat down

with roger goodell saying we got this right. >> that's what they are saying right now. the new policy establishes a disciplinary process that puts players and teams on notice. in addition to studying the upcoming games and plays, nfl players have to follow a rule book for off the field behavior. particularly, roger goodell in the nfl he's the one that's taken the heat over the last few months. and he's confident the new policy will create a new change. admitting he dropped the ball in the past, nfl commissioner roger goodell said the league is ready to tackle its problems head on. why should we be confident that this time you got it right? >> well, we've strengthened it. >> reporter: any player charged with a violent crime will be suspended with pay. the nfl will also conduct its own investigations independent of law enforcement. >> we'll collect information? >> reporter: you'll independently investigate?

>> yes, we will. we'll make a determination if it's a violation of the personal conduct policy. >> reporter: maybe the biggest change, the league will hire a special counsel to oversee punishment. formerly the commissioner's role. goodell will still have the final word on appeal. >> the special counsel has the appearance of being more independent, but in fact will be an nfl employees employed by 32 owners and the league office. >> reporter: these changes come in the wake of cases including that infamous elevator attack caught on surveillance tape. last week, an arbitrator reinstated ray rice. during an exclusive interview, matt asked rice about his future. >> what do you think it would take for another group of owners or fans to put that image behind them and say we'll take a second chance. >> only thing i can hope for is a second chance. >> your reaction to the

reinstatement of ray rice. >> we don't agree with the arbitrator's ruling. >> should a team pick him up? >> that's up to them. >> the new policy is like the old. they call it window dressing. beyond that, the union, they're upset as well. they wanted this to be collectively bargained. they wanted a better say in this project. roger goodell is the ultimate arbitrator in this policy. >> peter alexander, thank you for being with us. bringing domestic violence writer leslie morgansteiner. they wrote the book "crazy love" about her own experience. thank you for being with us. peter laid down the piece, any player about used of a violent crime will automatically be placed on paid leave pending an

investigation by the nfl independent of law enforcement. and it's a discipline laid down by goodell based in the new policy. that person will be, quote, a member of the league staff who will be a highly qualified individual with a criminal justice background and will be appointed by commissioner goodell. and also a committee comprised of nfl owners to review the changes. and it calls for additional funding and counseling and services for victims' families and violators. i have to ask as a domestic violence survivor, do you think the issue goes farther enough in dealing with domestic violence saying, you know what, this time, we are confident, we got it right this time? >> well, the policy looks good on paper. but as someone who working with media and a domestic violence survivor myself i'm overwhelmed and frankly skeptical for two

important reasons. one is commissioner roger goodell still has the final say on everything including the special investigative counsel's punishment so he still has complete control. and also the fact that you can be an nfl player who is charged or convicted with violence against a woman or child and you can still play with the nfl. there's nothing about expulsion here. it's just a six-game suspension. so this is really troubling to me. i think it's still a big call to action for the media, for nfl sponsors and for fans to focus on the nfl's enforcement. not just a policy but do we really trust the nfl to end violence against women and children and nfl families and also to set an example for the rest of society about how men treat women in our culture. >> well, clearly, you believe that the baseline punishment doesn't go far enough in this

sense. but are you getting an impression here that the league at least, you know, they're getting the message like, okay, maybe we messed up before. maybe we ought to try and tweak it this time around but do you think they're actually getting it as far as the protests they got -- >> yes, absolutely. >> for roger goodell to step down or does more need to be done here? >> this is a watershed moment in the history of ending domestic violence in our country. the nfl that stand of masculinity in our country that for so long completely ignored women's concerns, it's finally paying attention. but i would say the battle has really just begun because there are so many loopholes in the policy. there's a disturbing line about mitigating or aggravating circumstances. as a survivor myself in violence against women and kids i'd say they're never mitigating or aggravating circumstances. what we have seen not just in the nfl but the bill cosby

allegations and in the uva/"rolling stone" rape case, we as a culture have a difficult time with victims. i have a hard time thinking that the nfl will enforce this policy by giving victims as much respect and support as they have historically given players. since goodell has been some charge, there's been 56 cases of domestic violence arrests in the nfl and only ten players released from teams. so the nfl doesn't really have a good track record. i think we can be cautiously optimistic that they're going to be different in the future. but we have to keep a very, very bright spot lite on the nfl's code going forward. >> not to forget the victims who were impacted the most and families. leslie morgan-steiner, we appreciate it. developing now as the house prepares to vote on the spending bill this afternoon, democrats are facing a dilemma.
