there's a lot of rain. so that is something that we have to look at more carefully because the weather is changing. >> katy tur is in singapore covering the reaction of the families of those aboard to this latest news. >> reporter: unfortunately today was the day most families were fearing, they found bodies and they con sfirmedfirmed the wreckage does belong to flight 8501. they were watching local tv live when the aimimages were shown and they had no warning. 162 people on the flight 17 were kid, one was a baby. they will resume the search effort tomorrow when it becomes light again, they will send typhooners down into the water to an area where they think the bulk of the wreckage is. it's relatively shallow. they will try to see if the divers can find the black boxes

so they can figure out exactly what went wrong with this plane, whether or not it was bad weather in the area or if it was something else that con contribute ultimate woulded to the crash. they want to talk to pilots who were flying planes in the area at the same time whond lad without any problem. they want to sfibd out if they have any insight. meanwhile family members will be given a charter flight tomorrow where they can fly around the islands, the last known location of the flight. they want to give the family members a chance to pray there for their loved ones. joy. >> katy tur in singapore. thank you. the search for wreckage and the black box may be complicated by predictions of bad weather in the area. for more tom costello joins us from our washington newsroom. so how might the ongoing weather problems complicate the efforts to continue the recovery? >> well, cloorearly it will kofrply indicate matters, but several

navys will be working through bad weather to pinpoint, isolate as best they can the fuselage of the down the aircraft. it vael areally is a forensics investigation, try to determine where on the bottom of the sea they can find the major pieces of the fusefuselage where might they find the cockpit, the main cabin section as they collect all of the evidence floating on the surface. but ultimately this tale will really be told through the flight data recorder and the cockpit voice recorder. the flight data reporter literally records hundreds and perhaps even thousands of pieces of data, parameters of data. everything from the air speed to whether they had any sort of a computer issue to what their headwind was, their tail wind

where were their flaps for example. the total flight configuration, what was it set up like. in addition to that what decisions and inputs did the pilots make. did they pull back on the yoke although on an airbus, you don't have a yoke. did they pull the nose up, did they push it forward, did they maintain a level of fright aslight. what types of winds were they facing. all of this will be what the investigators are being looking at and it should be recorded on the flight data recorder. separately the cockpit voice recorder will tell us what these two pilots were saying to each other. was there a struggle inside the cockpit to maintain control of the plane as they experienced what we think was a rather ferocious rain or wind event. so all of that will be in the tale of these -- will be told, rather, through the black boxes, these -- they're actually orange. we point out the contradiction. we talk about black boxes. the truth is they have been painted orange for the better part of 40 years.

but that should help investigators determine what brought the plane down and it looks at this point like it's the french will likely have the lead on this. this of course being an airbus plane, airbus is manufactured mostly in france and the french investigative crash unit will likely be the ones taking the lead. >> tom costello thank you very much. right now new york's mayor bill de blasio is attempting to thaw his icy relationship with the nypd. attending today's meeting, head wills of the five police unions including one of the mayor's most outspoken critics, patrick lynch, president of the patrolman's benevolent association. it was lynch who claimed the mayor's hands are with you literally dripping with the blood of police after two officers ramos and wenjian liu were exited by a edxcited by a disturbed gunman. andy, the meeting is closed to the press, but what do we know

about the agenda? >> the meeting is going on as we speak and we know that the mayor reached out himself over the weekend to set this up. it's an attempt to kind of turn an enemy potentially into a friend. this is a mayor who prides himself on keeping his own council, on keeping a circle of true believers that he makes decisions with who thinks it's a sichb strength that he doubles down on the promises he made during the cam pan thatkamcampaign that got him elected. this meeting is a chance when he to reach out to someone that his supporters think pat lynch speaks for a minority of his own union when he says things like the mayor's hands are covered in blood for these officers' deaths. this is rhetoric that bill de blasio and his supporters think most new yorkers find outrageous. >> is it likely then as a political matter that the mayor

would let's say apologize to these police unions in private because of course that would get out and what would that to to his political position in new york? >> i've read today that he's expected to apologize and i think he's hoping that it's a time for them to possibly turn down their rhetoric, as well, to back away from really outrage yus statements outrageous statements. it could be a chance for him to look like he's building a bigger umbrella as a mayor who is governing rather than campaigning. it's a city of 8 million people. i don't know what an apology would look like but finding a way to work with this pat lynch could be a real opportunity to look strong. >> what about also as a fiduciary matter to the taxpayers of new york having to turn around and negotiate with these unions over contracts.

the mayor looks like he's completely capitulating to the police unions going into negotiations. what position does that put the city in when it comes to renegotiating those contracts? >> one thing about this contract there is no contract right now with the police union and bill de blasio. but it's gone to binding arbitration which takes the mayor's role out of it. there has been talk about how this current tension is overcontract negotiations. but this will be sdwied -- it's gotten to a point where it's not mayor de blasio in the negotiating room anymore. >> and lastly, does the mayor the at all risk looking weak in the face of the police unions if they come out of this meetings victorious oi over the city's elected leader? >> that's tricky. i think he needs to come out of this looking -- i think everyone agrees it was right thing for him to do to reach out. this is an unsustainable

tension. it's not good for the city no 2k3w9 for him. it's overshadowing his first year in office. he needs this to go away. if he can kind of down play the tensions that are ripping the city in two, then i think i will look stronger. >> all right. amy carney thank you very much. out west it is beginning to feel a lot more like winter. but will this is not what winter usually looks like from nevada to texas. pea poly record-breaking temperatures and winter storm warnings in several states. gabe guttierez is live in las vegas. what are the odds of snow on the strip? >> reporter: we're still wondering whether the strip will get some snow. right now forecasters are saying 1 to 2 inches in the las vegas area. perhaps maybe a dusting here in the strip. we'll have to wait and see. this is the famous las vegas sign, more than 300,000 tourists

off the 114th congress. and neither is this. steve scalise speaking in 2002 before a group founded by this man, former ku klux klan grand wizard david duke. in a statement just released, scalise admits making the appearance and says it was a mistake i regret and i emphatically oppose views groups like these hold. what else is regrettable? that the incoming republican led congress might have a we e pr problem before it's even begun.e pr problem before it's even begun. what mar lamar, to your knowledge was this the only time mr. scalise has been in any kind of apassociation or had any dealings or conversations with

david duke? >> to my knowledge that may not be the only time no but i've not reported in anything other than this one event. >> so let's talk about that one event. what was the purpose of the event and based on your reporting what was the contents of the speech that steve scalise gave? >> i only know the kept of his speech that david duke gave the traps transcript from. scalise's speech is not out yet. apparently he was talking about a legislative slush fund and the tax plan that had not even been introduced yet. >> let me read a little bit from your article. and you talk about a commentateor and according to him representative scalise brought into sharp focus the dire circumstances pervasive in many important underfunded needs of the community at the expense of the housing and urban development fund.

attending well-known to be activists in the white see supremacist cause? >> there was a man there who scalise should have known who he was about. >> and david duke has made some statements now affirming would you say that steve scalise was there and that they have had some contact? >> david duke claims his campaign manager was in close contact with steve ask a shlaesskacaliseka ask a shlaes ask a shlaes and confirmed that etd be there early on. >> and so at that time, this was ten years ago, at the time was david duke who of course was a grand wizard of the klan was he active in getting involved in politics in louisiana? >> at that point he had sort of taken aback seat in louisiana.

speaker bay fleroehner to ten to allow this person to ascend ascend to the third highest position? >> if he's fit for the job. that's the question people like boehner have to figure out the answer to. if he's fit to it absolutely. but more so than john boehner's support, i'd like locally. i don't know congressman scalise, but i know how to figure out what is going on locally in louisiana. when you see representative richmond who is african-american, who is a democrat from the state of louisiana saying that he fully supports steve scalise and what he has done, and they have worked together on countless bills for the affairrican-american community, for the poor, for the rich when someone locally comes out and supports him who knows him best i have to submit to that intimate knowledge that he would have of congressman scalise as opposed to what the banging sim balances and main

>> i would imagine part of it is because david duke is a risist. but the real question is someone like congressman scalise. remember, i've worked for countless campaigns. these candidates walk into room they don't know who is there, they give speeches. and what their goal is try to get the people they're speaking with on their side on the issue. they're not the going there to hear pitches from the crowd to get on their side. they're trying to drive home a tax plan in this instance. so that's the question. once he gave the speech has he continued to be in cahoots with theme like this? and right now it appears the answer is no. he gave a speech. he was trying to get a tax plan passed or defeated i should say in the state of louisiana. and you now he's gone on to serve with distinction in congress. >> and yet your party trent lott arguably less than this.with distinction in congress. >> and yet your party trent lott arguably less than this. >> sure. >> so why would the party want to embrace -- and he was duly

collected, but as its third highest member. some very high profile and face of the republican party given the party's support among nonwhite americans. >> look, foolishness does that erate to racism. harry reid said barack obama was arrestcticticulate negro. and robert bird was a recruiter for the kkk. when he left, everyone gave him a ticker tape parade leaving the is that the saying how great he was. so there has been a long line of people who said foolish things. doesn't equate to racism. and in this particular instance, the party itself of republican, we do have an issue of african americans going on nationally, but you how do we fix that. as we move forward, you'll see like for instance the 2016rd shal stage presidential stage, you'll see a complete diverse crowd.

follows on the crash of airasia flight. search efforts will soon resume in the java sea. searchers are battling conditions of bad weather for much of the week as they hunt for and he canwreckage and the black box. the ceo has made promises of compensation to the 162 families who were first alerted to the recovery of bodies by live images of the recovery on local tv. joining me how, bob hager, who spent decades covering aviation for nbc news. and that is bon of the changes in the way these things operate. there was so much media swarming at that site that you really can't blame the airliner for families finding out that way, but it is tragic. >> yeah, that's a shame. and there was a period about 20 years ago where the national transportation safety board which supervises all these investigations in the u.s. realized that they got to start

paying more attention to the families. and it was passed as a new law at that point and ever since then, the ntsb has made that a prime part of the business taking care of the families besides doing the important work of the investigation. >> let's listen to agreeing fif fifth talking and come back. >> officially the fact that we do have bodies and material from interior of the aircraft suggests that the fuselage broke up on impact with water. we know the debris has been floating for at least three days. but where did it originate from. we know what we have on the sur far, but that doesn't necessarily translate into a debris field on the sea floor. >> how complicated is to figure out where the rest of the debris would be? obviously there is no pattern to the way planes break up. is it a hopeful sign that they

found debris on the surface, that they can find what they really need down below? >> yes. and it's interesting where they found today the brie on the surface is not that far from where they logsst contact with the plane. so the important thing is that they are saying they have seen signs from the air of shadows underneath the surface of the water. it's quite easy to see things when you're looking directly down as opposed to looking across water. so from the air, you can see a lot of things under water. water isn't very deep there. so by seeing some shadows now, they may have happened on what will eventually turn out to be the scene of the main body of the wreckage. and enough they're confident enough that they're putting those divers down in the morning asia time. if they can find the main body of the wreckage without having to use sonar or underwater radar radar, that will speed things up so much and get you toward the real prize which as you mentioned is finding those black

box recorders. >> and obviously the weather is a factor in trying to make sure that they find all of these parts of the plane. what about the tracking technology that is being used, satellite technology being used? we saw nothing was helpful in finding mh 370, but in this case, do we have the tech knowledge to make sure enough of this plane is found so that investigators can figure out what happened? >> well, i think by the fact that we found the surface wreckage, that's not going to be a real question in the case of this wreckage. certainly a question for the possibility of accidents in the future. that's a huge public policy question. your ability to track planes more exactly in the air or find out what is handling aboard them mechanically in real time. but now that they think they're in the area where they can find the main body of the wreckage, tracking no longer becomes an issue. but this is not far from the

shot happened at very close range. last night several dozen protesters took to the streets in l.a. shutting down traffic briefly after the report was released. los angeles police chief charlie beck told reporters the officers involved in the shooting say they shot ford when he reached for one of the officer's guns. chief beck said the investigation is still ongoing and pleaded for the public's help asking for any eyewitnesss to come forward. >> we want to find out what happened that night because if officers need support, they need support. if the officers need discipline or criminal prosecution, then they need that. we want to find out the truth. >> joining me now john burris, criminal defense attorney. thank you so much for being here. start with the timing of the release of the report. the los angeles police have said according to the "los angeles times" that they placed a hold

on ezell forward'sd's autopsy report designed to ensure that any witness statements about the fatal encounter between ford and two veteran gang officers were not influenced by information released publicly about the shoot ppg. >> i think the issue he raised is a legitimate one. the question of how long should that have taken place, i think four months is a very long time not to release a coroner's report because it creates confusion and uncertainty for the family. certainly the actual report itself in terms of what is complete within a day or two generally takes six weeks just because you want the toxicology reports and everything. so within a six week period after that report should have been released and any report any investigation does not take place in terms of the witnesses clearly could have been done within that six weeks. so four months is an

extraordinarily long time. >> and we have another case here where the police are saying that the person who was shot went for the officer's gun this has become a very familiar story to people. >> absolutely. >> is that just my read with it this seems to be the story in many of these cases? >> i've been involved in many police shooting cases as a plaintiff's lawyer and it is common narrative now that the person went for their gun. and that's just kind of ridiculous to me. like someone putting their happened in the waistband when they have nothing and the police have guns on them like in the michael brown case. so it's a common thing that is often said. this case, though strikes me in a way that is fundamentally racial profiling. this is a young man who was walking down the street minding his own business. the police tried to stop him. he said no. he was not under arrest. he was not unlegally detained. key have continued on. which he did. but it's the police who pursued

him. so police were creating conflict and then shoot their way out of it and claim it was justifiable. but the real request why did you have to use force to detain this person when you shouldn't have been binding him in the first place. >> and in the lawsuit the family has filed against the police department departmented a and the officer tsz ands and the city they said the two gang officers knew ezell ford from the neighborhood and were aware that he had mental problems which raises the question you just did why they would fold himlow him in the first place. >> that's even worse if you knew he had mental problems. you're supposed to keydeescalate, talk them down bring someone else in. here they knew him, they knew he was mentally impaired they

should have not been creating a confrontation at all. so that only adds further for the whole question of how you treat mentally impaired people. a traffic stop like this orshould not have resulted in this man being killed and shot in the back and these claims that he was going to the gun and all those kind ever things are side stories when you compare the fact they shouldn't have stopped him in the first place. >> despite the fact that it shows a close range shot, isn't it a likelihood that these cases will end the way most of these other cases end which is with no indictment, with the family not being able to achieve satisfaction through the criminal justice system? >> rarely do they end in prosecution. particularly if the narrative have a narrative that he went for his gun, i find it interesting that the abrasions

on the young man's body are there. the question is what abrasions if any do the police offices have to support the notion that there was the kind of struggle that would justify the use of deadly force. but unless you can offset the story of the police officers that he went for his gun, there was a struggle it is unlikely the district attorney's office will file charges against him. there doesn't mean there isn't a viable civil case that is there. it might be the only option that they have available unless there are witnesses who are out there. dy notice we saw in the mikechael brown case the district attorney's office will go at great lengths to discredit witnesses who are not in support of the police. so that could very well happy here, as well. >> and even in the case of eric garner garner. do you think we have a viable system in this country for dealing with officer-involved shootings of civilians when the district attorney who works with the police is involved? >> no i do not.

i don't think a citizen who has been the shot family has been shot and killed by the police has a viable recourse against the district attorney's office or weren't judicial system at all because there is an in-herent desire to protect the police. so no i don't think the criminal justice system is a reasonable alternative. you did have it in the oscar grant case but the video was so profoundly outrageous. but generally it's very very difficult and i wouldn't suspect it will happen either here. >> john burris, thank you very much.

the stat came by an independent journalist entitled operation ghetto storm. an annual report on the extra judicial killings of 313 black people by police security guards and vinlgmg vinlggilantes. it highlights the deaths of young black men killed by police officers including eric garner tamir rice and eezell forward. now the every 28 hours is being scrutinized claiming protesters will do better to citing the fbi statistics. but here's the thing. there are very few statistics to cite. a st. louis public radio reporter wrote this month police

2012 were missing from the national tally. or in a few dozen cases, not attributed to the agency involved. the journal tallied at least 1800 police killings. in those 105 departments. that's 47% more than the fbi statistics showed for those districts. we know more thanks to the officers' memorial fund. that data finds that the number of law enforcement officers killed by firearms jumped by 56% this year and included 15 ambush deaths. like the murder of two police officers in their police cruiser in brooklyn last week. but gun related deaths among police officers remain historically low. the nonprofits annual report found that of the 126 officers killed in the line of duty in 2014, 50 were killed by firearms, but nearly as many 49 died as a result of traffic

accidents. in other words, the incidents of police being shot to death on duty is thankfully rare. what is clear is the critical need to keep more data and to compel police agencies and, yes that could mean defying police unions to fully account for the number of civilians killed by police. just as we count the number of officers killed. the public has a compelling public policy interest in that data. hashtags aside. i'll see you back here tomorrow at 2:00 p.m. eastern. and be sure to visit us online at the reid report.
