right here in washington. but the celebration is already under way from new zealand to australia, all the way to japan. millions are saying hello and enjoying big fireworks displays and big parties. it's happy new year in thailand. check it out. you are looking at live pictures from the indochina time zone. everyone celebrating there. it's all leading up to the festivities right here at home. stephanie gosk is live in times square. stephanie, no ordinary new year's eve in times square. governor cuomo has announced more security. obviously some tensions in the community there, the police department. what can you tell us? >> reporter: that's right, that announcement came earlier today about the national guard, increased presence around new york city. not necessarily right here in times square kristen, but in places including penn station and airports here laguardia and jfk. the presence on the ground here at nypd says it will be much

like it has been in years past. that is to say, quite a large show of force. there will be thousands of extra officers on the ground. those will include counterterrorism units, bomb squads as well as bomb-sniffing dogs. they'll have roof patrols on a number of buildings around times square. they're conducting regular sweeps at some of the storefronts and hotels. people that come here will see that presence on the streets. there will also be penned off by these barricades you see all around. they will not be able to leave. many of them will have to go through metal detectors just to get inside them. all of that to ensure that the party, the massive party here goes off smoothly and safely. kristen? >> stephanie, we know that protesters are planning to gather 9:00 pm tonight in union square and then they are going to walk over to times square. is new york prepared for that? is there any concern that those protests could escalate given the sheer volume of how many people will be out on the

streets of new york tonight? >> reporter: well nypd knows it's about to happen. they say they are prepared. they haven't taken any further security precautions as a result they say that protesters are welcomed on the streets of new york as they always are, as long as they don't break the law. what i would say is that those protesters are going to have a very difficult time with that increased police presence we spoke about earlier, the barricades, the streets cut off. that kind of freedom of movement that has allowed them in weeks past to shut off major streets and bridges in this city that's not going to be available to them. i would argue that it's going to be a lot harder for them to have a real presence on an event, on a night like this than it would be on an average night. >> security obviously very tight there. mailbox with a lock on it. they're taking that very seriously. it's going to be a cold one there as well. i see you all bundled up. >> reporter: yeah. you have to ask me in the warmth of your anchor chair. i really appreciate that. that's terrific.

protesters who will be out tonight? what's your level of confidence? >> kristen, the nypd is prepared for anything. the only question i would have are they going to be allowed to do what they have to do to keep the protesters from taking over? you know, during the demonstrations two weeks ago where they were allowed to take over the brooklyn bridge west side highway, main streets, that was not allowed in the past. so, if the police are allowed to stop them when they're interfering, yes. these cops can handle anything. they've been dealing for the last 13 years with all sorts of counterterrorism threats at new year's eve festivities. they can handle it. and i have tremendous confidence in commissioner bill bratton. >> how would you rate the level of tension right now? we know that mayor bill de blasio met with police union leaders last night. i've been reading a lot of reports that suggest that tensions remain. is that accurate? did anything tangible come from that meeting last night?

>> my understanding is that the tensions are still there. i know a lot of police officers -- my father was a cop in the city. i was at the wake and funeral last week of officer ramos. the tensions between the police and the mayor are the worst i've ever seen in all the years i've been in new york. i'm a life-long new yorker, born and raised in new york city. many of my constituents work in new york city. i do a lot of work with the nypd as far as counterterrorism. police officers feel that mayor de blasio turned against them early on. with the garner case the way he tried to portray it as a racial matter. african-american chief african-american sergeant on the scene, african-american businessman. what went wrong or didn't go wrong has nothing to do with race. they felt mayor de blasio jumped in to make it a racial issue. you're talking about the best police department in the country. they just don't feel that mayor de blasio has their back.

he has to work to restore that. >> there are still people throughout new york still upset by the garner case. what can you say to ease tensions on this new year's eve and heading into 2015? >> we have to put it in perspective. they made thousands of misdemeanor arrests alone and the person who died was eric garner. it had nothing to do with race. that was an aberration it had nothing to do with race. nypd is 44% white. clearly majority minority, 58 different languages spoken in the police department. the police department wants to reach out. it's going to take efforts on both sides. quite frankly -- i know i'm on msnbc. the less that al sharpton has to say about running the police department interfering with the police department, the better off everyone would be. the decent people in both communities, nypd

african-american minority communities want to find a way to work together. federal leadership is needed. certainly al sharpton should not be involved. >> of course al sharpton does have a show on msnbc. >> right. >> i will stay out of that discussion. >> yes. >> let me ask you about a controversy brewing the third ranking republican in the house, congressman steve scalise has apologized after revelations he spoke to a white supremacist group in 2002. he said he wasn't aware that the group was a white supremacist group but was headed by former kkk leader david duke. should he hold on to his leadership position, congressman, or is this something that he should say, maybe i should step down? >> based on what we know so far, he should stay on. the congressman of louisiana has stepped forward to defend steve scalise. i've never heard any hint at all of racism buy as or bigotry. that group is also anti-catholic and steve is catholic himself, a

very strong practicing catholic. if he said it was a mistake and didn't realize the full content of what they stood for, that the stage, we have to believe him. there's no other evidence out there. usually when there is something to it you have other incidents come forward. people say this happened that happened. so far as everyone who dealt with him, including governor bobby jindal congressman richmond, they say there's no buy as or bigotry. i've never seen it. i've always found him to be a man of his word and this looks like a scheduling error. >> the person who invited him to speak at that conference was the next door neighbor one of david duke's key strategists. do you buy that excuse that he didn't know who he was speaking to? >> again, i think we have to wait and see. steve scalise will have to explain if more details come out, what his relationship with his neighbor was, how active david duke was still with that

organization. this is 12 years ago in louisiana. i try to keep track of what's going on in new york. you're raising a valid point, kristen. i'm just saying, obviously, speaking to a group like this was wrong. steve scalise has admitted this. if there are other factors that are involved he has to address them. at this moment, no he has proven himself to be a hardworking member of congress reaches out, work with his everyone. there's always rumors about this person, that person in congress. i've never heard anything bad about steve scalise until the story broke the other day and he's giving us his explanation. i believe we owe him the benefit of the doubt on this unless more comes out. >> let me ask you quickly about the broader question here. you have this controversy with congressman scalise and then you also have congressman grim stepping down as he faces serious legal troubles. this is not exactly the way we would think that republicans want to begin the new year as they get set to take over congress in 2015. does this harm the republican

brand as they prepare to take over in congress? >> it's a short-term hit. michael grimm's district, we should elect a solid republican to that seat one we can be proud of. as far as steve scalise, if nothing else comes out, this will be behind us. it will be up to john boehner to lead us forward. obviously you always want things to go more smoothly. again, your life isn't easy. you have to overcome the tough ones. again, i have a lot of faith in john boehner to move us forward. >> congressman peter king thank you so much. again, have a very happy new year. we really appreciate it. >> happy new year kristen. good to talk to you. >> thanks. one place where the weather will be nice at midnight, honolulu honolulu, where president obama and the first family are spending another holiday in the sun. that is where we find nbc senior white house correspondent and my colleague and friend chris jansing, joining me now from the aloha state. happy new year's eve to you, my

friend. how is the president planning to spend new year's eve? >> kristen, you know as well as i do nothing on his public schedule. he never has exactly been one to do a big blowout on new year's eve. you also know there's a small group of journalists who travel with the president, they call them the pool when he leaves his vacation home. at some point we'll figure out what he's doing today. last year he went snorkeling with his family and got shave ice. in 2012, remember he had to go back to d.c. and give a speech on the fiscal cliff negotiations. it was a really exciting new year's eve in 2010. he played golf and went to the gym. this is kind of typical of the stuff that he does. he's actually been spending a lot of time with three of his friends that were actually friends of his from the time that he was in high school here. he was at one of their houses yesterday for more than five hours. they had a traditional luau. that's kind of what the theme has been since he has been here. and, of course there is also work to be done. i mean he has been obviously

in touch with his advisers a very small group with him here. the administration of course will be facing a republican-controlled congress in january. and so there are a lot of issues on the agenda there. in a state of the union address to write. among the issues he will be talking about, nuclear negotiations with iran to tax reform and immigration. and he also was one of the number of world leader whose got a new year message from russian president vladimir putin. this is vacation and there is a long tradition of presidents going home for the holidays kristen. >> chris jansing, i hope you and your team get a little bit of down time this holiday. >> happy new year. >> and to you. it will be a chilly one for many parts of the country, particularly out west. let's get a look at the national new year's eve forecast with nbc meteorologist bill karins. bill? >> good new year's eve to you, kristen. it's a cuddle day. temperatures are frigid across the country. tuesday was, by the way, the coldest day so far this winter

season going all the way back to last march, early last march, the only time that we were colder. winter has finally set in. we have winter weather in area that is typically don't have it. winter storm warnings outside of san diego, areas of arizona and also for west texas. that west texas thing will be more ice than snow. so this storm system which is kind of unusual, spinning down right over southern california, also bringing some of that moisture into the cold air of las vegas, northern portions of arizona. it will be snowing near the grand canyon. nice place to ring in the new year and elevations north of phoenix, up there on what they call the rim. high enough elevations they could even get some significant snow. our computers are saying the possibility of 6 to 12 inches ses from prescott northward. if you have ever been skiing at flagstaff, that's gorgeous. we'll also be dealing with a lot of cold. windchill values overnight, it was as low as negative 55 in

wyoming. that's like you get frost bite in five to ten minutes in temperatures like that. it's a little better out there right now. negative numbers still from oklahoma all the way up to the canadian border, back to chicago. it is very cold. as cold as it typically gets and even the coldest winter outbreaks as we go through each winter season. the new year's eve forecast, where it's really bitterly cold it's dry air no, snow to deal with. ohio valley right through the midwest, no problems with travel. the only travel trouble, again, west texas, with icy conditions in the southwest. how do we look as we ring in the new year at midnight tonight? temperatures, of course will still be very chilly. windchill down toward single digits zero windchill near denver. snow coming down in arizona. at times square we'll be at 25 cold degrees with a windchill in the teens. so even as far south as atlanta, kristen, we're still very chilly. if you want to ring in the new year with a nice little dress, short sleeve shirt you have to

more debris and more body frts water. they've got seven bodies as of now to a local hospital. that's, in fact where all the staging area will be moved to tomorrow, where all the families will be camped out. they've taken dna samples from 93 family members. they say they want to get the process of identification done as soon as possible to get these victims back to their families so that they can begin their own ceremonies their own religious practices, their own burials. as for the search itself there was -- the main fuselage the bulk of the wreckage. tony fernandez came out tonight and said no they do not have those images or official confirmation that they found the plane but everybody is working very hard to get that as soon as possible. weather was a factor today and they're worried about weather for the next couple of days. it is monsoon season here in southeast asia. it's raining right now and it's been pretty wet the entire day. kristen? >> katy tur, thank you for that report. now we go to nbc's tom costello. thanks for joining me.

do we know any more about why this plain went down? we know the weather conditions were treacherous but we also know other plains were able to maneuver through the storm. >> we don't really have any answers and we're not going to have any until we recover -- or they recover the black boxes, the flight data recorders and the cockpit voice recorder. the voice recorder records conversations between the pilots. we'll hear what they were talking about, what their concerns were. then we'll have about 1,000 data points off the telemetry, the pitch of the aircraft altitude heading, the speed. what the trim was like. what the wait was like what kind of alarm was going off, what kind of data. did they have bad sensor data how the engines were performing. all of that will be critical as they try to piece together what happened. it won't be one data recorder but both flight data recorders

coming together to paint this more thorough picture. they'll also be as i said inspecting the conditions of the engines once they recover the plane. is there any sign at all that the fans on the engines were damaged in any way by ice or hail? is that possible? they gauge the speed of the aircraft f they ice over they may have bad data. that can be confusing to pilots. we've seen that before in air france 447 where the pilots had bad information. it was feeding bad data to the computers. the pilots became confused. they grabbed the plane, trying to fly it manually and, in fact they stalled it and crashed it. we don't know if what happened with that plane crash, air france 447 is in any way similar to what happened on this crash. clearly something catastrophic happened as this plane was at 36,000 feet or so in very bad

there is a tragic story out of idaho to tell you about now where family members are reeling after the death of veronica rutledge. on tuesday, she was accidentally shot and killed by her 2-year-old son while shopping at a local walmart. nbc's john yang joins me now. what is the latest on this incredibly tragic story? >> well kristen, her family is rallying saying that this is not a case of afn irresponsible gun owner. her father-in-law said she is a responsible gun owner, took gun safety courses. she says this is simply the accidental result of a toddler's curiosity. the police say there is unreleased security video showing her 2-year-old son in the shopping cart her purse nearby. he reaches into the purse, gets the concealed weapon the gun

that she was carrying there. it discharges. the bullet strikes her, killing her. now she had a concealed weapons permit. her father-in-law said she carried this gun in a bag that was specially designed -- is specially designed to keep it secure. she got it just for christmas last week. but the police in hayden do say that all of the precautionary measures weren't taken to ensure the safety of that weapon. we're not sure exactly what that means. they are not explaining themselves. they say that this was an accidental death and that they are continuing their investigation. veronica rutledge was a scientist. she worked at the idaho national laboratory in idaho falls. she was with her at this time of the shopping trip were three young nieces, who were with her at the shopping trip witnessed the entire incident.

now to the continuing fallout for the top republican houseleader, steve scalise, who admitted he appeared at a conference when he was a state legislator a dozen years ago. he still has the backing of house leaders, here is andrea mitchell with more. >> reporter: one of the party's rising stars house republican whip steve scalise at home during the holiday break, acknowledging he did speak at a meeting organized by white supremacists in 2002 while a state official. a mistake, he wrote in a

statement, adding i emphatically oppose the divisive racial opinions groups like these hold. how could he not know? the group was founded by former ku klux klan leader david duke. >> how do you not know who david duke is, what his associations are? >> by then he had famously tangled with tim russert. >> my people, my heritage. >> white people? >> european heritage, the people that built this country. >> reporter: duke's organization held conferences like this one from 2005. >> we are the white race. we have the ingenuity and the creativity to overcome anything that they can put up against us. >> reporter: civil rights call duke's organization a leading hate group. >> david duke was the world's most infamous white supremacist, a man especially known in louisiana. >> reporter: the question now, does the controversy set back

john boehner's efforts to broaden the appeal of the gop? >> it can be particularly damaging to the party and to the party's efforts to show that it is truly more inclusive and truly reaching out. >> joining me now to talk scalise fallout and much more political correspondent at the washington post ann garen and msnbc's benji starlin. let's start with that question how could he not know? a louisiana representative for the american unit everybody there knew euro was putting it on and david duke was the national president of euro. you don't go to a james brown concert and not know it's james brown. it is what it is. has scalise done a good enough job of explaining how he wound up at this meeting? >> he certainly left a lot of holes. he has apologized which is probably the most important thing he needed to do. he said it was a mistake and disavowed any connection to the beliefs espoused by this group

and its founder. but the nut of the question you asked, how could he have shown up at this thing with the name it had in louisiana? i mean david duke was not there in person but he spoke to the group remotely. certainly it must have been a topic of conversation at the event itself. it does stretch the imagination that he had no idea that duke was involved. that said duke was a prominent figure who represented a prominent and politically powerful part of louisiana's state party and scalise had to do some political courting of that constituency. the question is how -- what's the difference between addressing a political constituency, while disavowing its beliefs and buying in. and that's the part that he has left a little bit vague here. >> that context incredibly important. benny benji, republicans set to take

over congress and we have 2016 right around the corner. i know you tried to get reaction from some of the 2016 candidates. did you get any? what do you think the broader implications are for the gop? >> at the moment john boehner has said yes, i stand by steve scalise. no other leader wants to touch this with a ten-foot pole. so many facts are murky. no one knows if something else is going to come out. they don't want to touch it. i reached out personally to representatives from ted cruz rand paul marco rubio, chris christie. none of them commented. none of them have commented publicly in any way. the only possible presidential prospect who said anything is bobby jindal but is also the governor of louisiana and supports scalise. he has a different interest than the rest of the field. i think it's going to stay this way until they absolutely have to talk about it. >> i think you're right. jeb bush continues to ramp up -- he stepped down from another position, board of directors

from a publicly traded company. how close do you think he is to making a decision anne? >> he could well take another step. >> are you surprised by that? you've been covering clinton, obviously, for quite a while. >> i am. we all thought she was -- he her in inevitableity alone would carry her to be the first big name to make it official. she looks now as if she's going to wait on into the spring. i wouldn't be at all surprised if late february or even march before she makes it official. she can afford to wait. her democratic primary opposition is -- you know exists but isn't any kind of a real threat to her at this point. and the bigger threat comes, frankly, from jeb bush. >> senator jim webb was the first to launch an exploratory committee. we haven't seen or heard a whole lot from him since he made that

announcement. does he have any real following within the democratic party at this point? >> well he did once. at this point is the question. there was a time when jim webb was thought of as a vice presidential nominee even for barack obama. he seemed to voluntarily take himself out of the fray. he chose, without any clear reason, to not run for re-election of the senate mostly because apparently he hates politics. not a good description for running for president. if he didn't like shaking hands all over virginia his native state, he's not going to like it in the freezing cold in iowa for a year. lot of question about whether he has the fire in his belly, let alone the constituency to actually go forward with this. >> do you think he has the fire in the belly? >> you know he's a quirky guy. he was a quirky figure in virginia, very well respected one for a long time. and senate. but as benji said he has said himself he doesn't like politics. he does however, have a strong connection to a part of the

breaking news out of boston. a judge has denied a motion by dzhokhar tsarnaev to move his trial out of the city. he faces the death penalty if found guilty. cyber attack against sony the state department is standing by the fbi's conclusion that north korea was behind the recent cyber attack on sony pictures but did not des missismiss reports that outside groups may have played a role. new year surprise with the associated press reporting a south korean activist will launch balloons carrying dvds of "the interview" toward its northern neighbor as early as late january. joining me now for more on this cyber security expert. thank you for joining me. appreciate it. >> hi kristen.

>> there is word it was a possible disgruntled employee but the fbi says no that's not the case. what do you make of this back and forth? >> i would put it in the category of it's an ongoing investigation. it's somewhat unfortunate how things have developed with norris blaming it on a an internal employee or group of ex-employees. after that meeting with the fbi and putting them in essence, on the spot. and one thing that has to be remembered by all of us here watching right now is that the fbi is actually working with counter intelligence agencies which norris cannot do. they may have other evidence that they cannot publicly talk about that comes through, for example, spy networks that they work with. this is something that's definitely still developing

today. sony executives are saying that an internal employee was compromised and that was connected to it. there are all sorts of moving parts. i think we just have to look at it, as of now, as an ongoing criminal investigation and see what happens, frankly, tomorrow. >> that is the crux of the fbi's argument that, they have more information and intelligence that they're not sharing at this point. let's move on to what all of this means. let's take a look back at some of the cyber attacks over the past year. >> how many cyber attacks we've seen the past year and what needs to happen to crack down and make some of these larger companies secure. >> i have to tell you, 2014 can easily be described as the year of the hackers.

sony playstation x box and sony. i can list them off and keep going. what we're seeing is number one, hacking has become mainstream in the media, which is good because it raises a ton of awareness about what we need to do to care about our own systems, whether we're a company or an individual. and i think in 2015 it's only going to increase with hackers getting more bold more brazen more organized and, in fact even organized crime coming in because there's financial value in attacking. >> and hemu one of the scarier things, one of the more disturbing things were individuals being affected by this. celebrities. jennifer lawrence among the celebrities who was hacked this past year. she, of course spoke out about it. she called it a sex crime.

is there something that individuals can be doing to protect themselves? >> yes, absolutely. and i will first say to all those celebrities, i really feel for that. because they may be public in part of their life but their private life should not be disclosed. it's just unfortunate. it's illegal and it never should happen. as private individuals who are watching celebrities, we should know that we could also be at risk. the way to prevent it is number one, use anti-virus anti-phishing software. number two, change passwords when you hear something is happening. be careful what you're clicking on. most important than anything else is update your systems. when you get that security message that says update now, what do we all -- we always do it. i know you do it. >> update now, yep. >> we remind ourselves later, right? we click that remind me later. they should ban that button from the internet and update update update. >> hemu nigam, thank you.
