a somber new year for indonesia. it's new year's eve this is "now." >> there's still a grim search going on in the jauf ava sea. >> seven bodies have been recovered recovered. >> they do not have confirmation that they found the wreck age. >> no sonar, nothing, some visual identification but nothing confirmed. >> the weather in the region is creating strong currents hindering the recovery effort.

>> the weather not looking good unfortunately for the next two or three days. >> good news is it should be a retrievable wreck and they should be able to find those black boxes. one day after wreckage airasia 8501 was first found bad weather held back already difficult search efforts as 18 ships recovered four bodies before calling off the effort. meanwhile heavy rain thick clouds kept held couldn'ters grounded and prevented divers from entering the search area. 7 bodies have been recovered. wreckage has now drifted over 30 miles from yesterday's location. according to one official we're expecting those bodies will end up on beaches. a number of indonesia cities toned their new year's eve sell brags in memory of the victims. the capital city held its annual

celebration marching the new year. marking the new year. what do you anticipate from the search efforts? >> i think it will depend on the weather. they are hoping to eventually get a break and do a better job of pinpointing where the wreckage might be from flight 8501. we're talking about depths in the sea of 100 to 160 feet so the hope is it would be easy to identify and retrieve the fusel lodge and the belongings and the critical black boflxes which were in the tail section. this could take time to identify where the different pieces of the wreckage might be. there is a chance you will find many if not most ever the passengers still seated in their seats in the main fusel lodge.

finding that will be critical and identifying the tail section and searching for the data voice recorders will be critical. we are likely not talking about using submersible robots in this operation because it is only 160 feet down. chances are this is something divers can do very well. they will squ be able to attach hooks and cables to the wreckage and lift it out of the water. >> can you tell us what theories investigators are working with in terms of a cause of the crash. >> i think everything is on the table. pilots are concerned about weather and a weather event is something they will focus on

early on. did they lose control. did their evenings go out because they kwr hit with hail or ice. did the pitot tubes iced over there's a wide spectrum of possibilities, it is difficult to identify any single one as a leading candidate other than weather may have been a factor. let's not discount weather. good pilots will do everything they can to get around a bad storm. they don't fry to fly through one of these. that's why he was asking to go up to 38,000 feet to get above it. clearly he was trying to deviate above around the storm. whatever happened here may have been very quick and very violent and that will only be known for sure when they get hold of the flight data recorder and the cockpit voice recorder and those

two black boxes, they are really orange, but those two pieces of information should help explain what happened to this plane. >> thank you. >> you bet. joining me now former ntsb investigator and form he pilot, thank you both for joining us. greg based on the latest debris found and condition of the bodies what have we learned about why this plane went down? >> i don't think we know enough from just the pieces of debris. i know that as the, in our experience you would examine it as an investigator to see if you could find evidence that could try to put together a story line as to what happened. as far as the victim that's have been recovered it will take an autopsy to determine the cause of death. how much traumatic injuries

those folks experienced, to try to help determine whether it hit the water or broke apart. right now we don't have enough to drive a focus for the investigation. >> yesterday the u.s.a. today editorial board wrote that technology has long existed to stream realtime data from black 3w0678 boxes, authorities would have position data where the plane hit the ocean, couldn't this plane have used the box to send out streaming data and would it have helped. >> it could have. but i don't know it would help to prevent the accident. we would have better information after the accident occurred but that won't do anything about an airplane trying to negotiate around bad weather, it will just give you information about how

bad it really was and it was awful awful. >> from 2007-09 european union banned all indonesia airlines can you tell us why indonesia's record is so bad. >> a lot of it started with gruda airlines years ago and the fact there were concerns with the way not only the airlines were managed but the training of the pilots and the level of equipment they were flying. every year the faa does an assessment of the carriers especially though flying into and out of the united states and they have to rate them because there is a safety requirement that faa looks at. so does europeans and there were a lot of deficiencies. they have been cleaned up because if those airlines can't fly to the united states or europe then it is a lot of loss

revenue so they had to put the expenditure of funds and resources coming up to level of standard that is required for international operation and they've done a pretty good job of that. >> is this also an economic story in terms of safety measures in indonesia keeping up with air traffic. we know they will need 216 thousand new pilots over the year more than any other. is this a story really about economics here. >> it is. just about every part of it is. when you talk about tracking aircraft. that's an economic situation as to how much money the airlines are able or willing to allocate for that. of course their governments are involved as wellful.

california will have a chill to the air for sure. for your new year's day we will see storm system heading into texas, even watching places like dallas. otherwise a lot of sunshine for new year's day across a good chunk of the country. for parts texas there may be a few pockets of wintry weather mixing in. but rain and potential for thunderstorm spreading southeast will continue through saturday. saturday's forecast is a wet one for the eastern half of the country. rain and thunderstorms through parts of the south and we will watch where cold air meets up with the moisture. chicago is one spot we may see sleet mixing in. eventually saturday into snow changing to snow in places like chicago and minneapolis will see snow as well.

republican leadership closed ranks around louisiana, steve scalise admitted yesterday that he spoke to a white supremacist group in 2002. very few democrats have called for his ouster. nancy pelosi argues what he plans to do today on issues related to race. >> actions speak louder than words. the republican party and its leadership still flirts with groups that are under mining voting rights around the country. i think he ought to lead a very affirmative effort to expand voting rights and civil rights and publicly disavow any of these activities that are under mining voting rights throughout the country.

>> many on the right accusing the needmedia of a double standard. bird's lead in kkk. went from civil rights act to stall ward defender. most prominent backer suggests this steve scalise most recent report card showed a f rating showing plenty of room for improvement. so far scalise's response is to create as much distance between himself and the white skpreem supremacist group he addressed

saying this. politics insider and former rnc chairman thank you for joining us. >> good to be with you. >> happy new year. >> michael, we know democrat congressman cedric said scalise has chance to write his own history. do you think he can be successful at that given his record. just a little context in 2004 when he was louisiana representative he was one of six members to vote against majoring martin luther king jr. day a state holiday versus 90 who were in favor. do you think he can rewrite his own history? >> sure he can. this is a real opportunity for him to carve out new ground and move himself and the party in a fresh direction. we'll see if he is able to do it.

i think there will be a lot of support in the leadership certainly at the caucus at large and give him space to do thatful look the voting rights act is sitting on the floor right now. members of the house can pick that bill up at the beginning of the year with scalise out front leading the charge to get it reauthorized to fix what needs to be fixed with it to make sure voting rights in the nation are protected. this is a real opportunity for him to do something like that. it is not exotic or sexy but it is very, very important work. >> let me ask you. we know many of these damaging stories often fit a pre-existing narrative. with that in mind how damaging is it for gop nationally especially when it is looking to reach out to latino and black voters. i will read this quote. so true? not true?

is this ultimately damaging for the national brand? >> i think is very telling that you have a democrat response where they are really happy not calling for his ouster. they want to make this a conversation about their message which is republican party doesn't stand up for minority voters and women. they would love to have steve scalise be the second coming offed to aikenche todd to be the second todd aiken. it needs to do better. >> yesterday it was said would release a list of names -- >> could this be a warning? could this warning be a factor in gop leadership to embrace

their number stlee three-pointthree. >> seriously don't threaten me you will release something just do it and then we'll deal with what you do. the reality is the party has to learn from these types of missteps. yes there's been association wz both sides of the oust that people like to distance themselves from. it's what you do now and going forward that matters the most. i disagree that this is going to be some black eye for the gop. if they take the right appropriate steps going forward to show that they are genuinely interested in making this party expansive and open to everyone who wants to be part of it. >> i was reading many of these articles wondering what african-american voters think of it. particularly 13% of the district is african-american.

jim crowe has been rereversed now. so i don't think it is so much a concern locally. but g.o.p. brand is really important. >> let me ask how african-americans in his district but also nationally see this incident but also the headline in the nation said steve scalise's problem is the republican party's problem do you see it that way? >> maybe in part. it has always been a struggle. going back to when i was county chairman to national chairman there is always a struggle to bring the party in to the current moment and make it relevant in the moment and having a conversation about the concerns we have whether in education, jobs, or whatever. the party tends to say they sound conservative or they go to church on sunday, it's so much more than that. and the party has to get away

from those stereo types of the black community and of itself and really drill down and recognize that within the party there are already people who can help you create that message and build that brand and make that relationship better and stronger with communities like african-americans, hispanics, gays, women, a whole host of folks. the sooner they get to that spot the easier this conversation becomes and easier it is for these parties to deal with these type of hiccups, who don't do anything on the surface that is outrageously racist it is just brad associations. bad occasions and they -- >> it is just bad associations. >> i think they ought to reach out to you on this. thank you both. >> happy new year.

the effort to empty gitmo continues. overnight the pentagon flew five prisoners out for resettlement

bringing those released to 28. they spent over a decade at the prison without charge. they were first flown out monday but because of mechanical problems the pilot circled back 90 miepts later. population is now at 127 inmates 59 who have been cleared for transfer. joining me now senior analyst who recently returned from reportings at gitmo bay. she's spent roughly 1,000 nights at the facility since it opened in 2002. thank you for joining us. can you tell us who these men are and what their lives will look like now that they are released. one of the men has a 13-year-old daughter who wasn't dornborn when he was captured.

>> that's correct. he was able to talk to her in recent years. s of as you said three yemeneerksyemen, and two others, one told in 2004 he was considered a low risk and has a heart condition and would be eligible to leave. he had a health condition and would eligible to leave. it took him ten years. they are going to a country that decided to offer sangt san tu airy a chance to start a new life there. we don't know much more about that. we assume they will get language lessons. >> kazikstan, why, there, what

happens once they are there now. will they be monitored will they be allowed to go free? what happens? >> first you have to address why not tunesia and why not yemen. one option is to send them home. yemen is a front line country being attacked steadily by al qaeda and the arabian peninsula. tunesia has chaos next door in libya so neither country could provide security guarantees provided as part of this process. you look at other country that's want to help the united states and want to help reduce and ultimately close the prison kaz kauz stan is a country that can provide resources and over sight for these detainees and it has

to worry less about public opinion than perhaps other countries. >> we know president ob is trying to empty out of prison first for those already transferred and then moving the remaining detainees to the u.s. >> he can't empty the prison unless he moves them to the united states which means congress will have to relent or he will have to decide to ignore congress. back to kauz stan this illustrates how far flung america has done to settle these men. in the absence of congress allowing them to come to states the diplomats have been skouring the earth for safe countries, maybe a police state, that can

keep an eye on them where they can stay out of trouble but also they have gone to such extremes like places like palau and cape verde. in their effort to close it they are going around the world to try to send the people who can be sent away but the only way to close that prison is to bring the ones who can't be stoent third countries to u.s. soil. >> let me ask you about the point carol just made. we know cliff stone who is responsible for negotiating the transfer stepped down and chuck hagel announced his resignation.

>> 2015 will bring republican control of the senate in addition to the house. and there is deep skepticism about closing gitmo. president wants to do it. a lot of americans want to do it but there is also concern about closing it. we will find deep resistance for that. we believe there will be 20 or 30 hard core detainees who can't be tries or can't be released. we know the solution is bringing them to the united states but that may well take years before the political conditions to exist for that step to occur. >> it cost $2.7 million a year

and now for some much-needed good news tomorrow minimum wage will rise in 20 states nearly half the union, including gop-strong holds like montana, first time states will have higher minimum wage than the federally required amount. today the empire state's minimum wage up to $8.75, up from $7.25 last year this coming after rallies demanding fair pay. in january president obama called for a 10-$10.10 federal minimum wage. all told will pump over a

argument. >> let me ask you about how this came aboutful i want to point to the fast food protests we have seen not just this year but the last two how much increases was driven by the fast food workers. >> a lot of it. i think it was a direct reaction to the federal inaction on being able to raise the minimum wage to $10.10. so i think the more we see the federal government not being able to raise that the more protest and demonstrations we will see, especially going into next year. >> so tomorrow 21 states. i want to turn to cities. some of the biggest increases are at the municipal level. seattle and san francisco raising theirs, chicago also saw increases. did act itchistsivists help with that.

>> i think local legislatures were convinced because they were in the field hearing from constituents every day unlike senators in d.c. i think it has had a big effect and i think we will see more cities going into next year rallying for change. >> last but not least, do you see any potential for these campaigns to build up to an increase at the federal level. >> i think there will be talk about it, whether or not there's any action done is yet to be seen. in april democrats weren't able to rally enough to move the minimum wage talk to get to $10.10 so and mcconnell said back then that if that didn't pass, which it didn't he was unlikely to bring it up going
