the juror said they want to add their experience. jury selection kicking off in the trial of the boston bomber at the finish line at the boston marathon killing three, injuring hundreds. the attorneys twice asked for the trial to be moved out of boston saying it makes it impossible to seat an impartial jury. they called up an unusually large jury pool. they follow this outside of the courthouse. thanks. first of all, why such a big jury pool? and the reason they are starting with such a large number that's

because this is a high profile case involving allegations of terrorism. we know that two bombs went off near the finish line of the 2013 marathon and killed three people there and there was a police officer from mit who was killed execution style that led to the chase and the ultimate capture starting today. what jurors are going to do they got with the summons at home in the mail and today they are receiving another questionnaire that is more about the case itself. the previous questionnaire is just about administrative things about what they do for a living if they have hardships that they want to alert the court to.

strengthening the bonds that unite us. let us work to attain peace. >> he met with the leaders last week and hasn't done able to diffuse the tensions with the force. jim o brady is a reporter who happy covering every angle. this is near the city public advocate. i will start with you and what are we expecting it hear from the mayor? >> i'm not quite sure what we expect to hear. i do know that the city really needs to heal at this point in time. we really need to turn forward together. this is not a time that any of us should be turning our backs on the administration. i hope that all of us can work and i hope that members of the police department get a courteous and i hope that we can move the city forward. >> the commissioner bratton sent out a memo not mandating that

anyone not exercise the right to protest, but urging people and pleading not to turn their backs again. what does that say about the relationship? >> that memo the commissioner asked for grief the the funeral and not grievance. it just shows that there is a number of people who feel deeply that they are being disregarded by city hall. as i was saying to you, there is a built in tension between the police force and the civilian structure that guides it. it flairs up from time to time and that's what we are seeing. we wanted to see an officer who did not turn his back the head of the police union, pat lynch in the hours after the murders. he said some did with the mayor was different. they said the mayor had blood on his hands. now an apparent thaw in that relationship.

what do you make of his refusal? >> i attended the funerals for the detectives and i saw law enforcement from around the count rory and into the national police departments. there were some that turned their backs on the mayor and the city of new york but it's important to know that new york city police continue to be the international sim poll of the law enforcement and the good officers and detectives and lieutenant who is serve with dignity and bravery have always represented the mainstream of the department and that should be the message. some turn their backs, but they want to move the city forward and stand with them in doing that. >> you were in that room and felt the energy. what's the trajectory. do you think they are working? >> right now it was just words and speeches and what the department would like to see,

many would like to see action. they want to sit down with the leaders of the union. they discuss their concerns who are including and not limited to a contract. the vast majority are working without a contract and we need to resolve that and get that behind us and move the city forward and focus on community policing and how to reform the system. >> i spoke to members of the staff and he understands my position as well as the position of other elected officials. i think what we need to do is continue to focus on the agenda and more importantly again to say the down respectfully with the members of the pba and negotiate the contract. it's time we resolve and move the city forward and focus on policing and respect for the value of all lives.

were some saying you should not show respect to this mayor while others say it's a funeral and a solemn occasion and this is not the place to bring up the grievances and the unresolved contract is feeding some of this resentment. i don't know what to do to bring him back but it is a complicated situation and at some point, the police as an institution is going to have to come back to seeing city hall as a legitimate manager of them as a department. >> and you attribute their failure to city hall to deeper underlying differences in the rank and file officers. >> i don't know if i call it a failure. a quick history lesson. the city of london was growing rapidly in 1829. the constables were not

controlling the population and getting law and order. they created a police force. the people were very wary. they said we don't want an army in our streets taking away our civil liberties. they said no this is something different. they will wear blue uniforms and not red coats. it is designed to be like this first modern police force. a key part of that it has military structure, but it reports to city hall. it reports to his commissioner but ultimately the boss is the mayor. >> one of the big proposals you have been behind is more body cameras that are being tested out in realtime in the field. is that something that you see fitting into this cessation of tensions? >> yeah. body cameras have been embraced by the members of the nypd and retired officers and receiving a lot of good comments.

not only does it address issues to street encounters but provides security to police officers who are accused of false complaints. it's a win-win for everyone. i think the reality of the situation is that we would not be having this discussion regarding the garner decision in the absence of the body camera that demonstrated that in fact perhaps it was a use of force in that case. this is why this morning my legal team went to court to try to get the grand jury minutes unsealed and that case as you know until january 29th. >> that's important work as a new yorker. we all depend so much on the bravery of the force and need that relationship working. we will be watching that press conference closely. jim o'grady and public advocate i appreciate both of your time. keep it here. it's the awkward hug that is setting twitter a name.

the volkswagen golf family. motor trend's 2015 "cars" of the year. . it is the president's first official work day back after vacation. he comes back to a handful of big headaches. first up let's look at what happens in the mideast. israel lashing back because palestinian officials filed papers to join the criminal court back last friday over the weekend. they retaliated in a big way, freezing tax revenues asking congress to stop aid to palestinians. benjamin netanyahu said we won't let them drag the israel defense forces and soldiers to hang. they called the latest move illegal punishment and that amounted to a new war crime.

the editor at large steve clemens has been following this. does the u.s. have to get involved? >> they passed a provision that said if palestine takes and drags any israelis before the criminal court, the united states will no longer provide that $400 million in assistance. that is written into our law at the moment. there legal ways in which the president can get around it. we are in a train wreck course right now. >> it is a tough time for that. rarely is it not. we will watch to see how that comes to a head. pakistan is a suspected drone strike and killed nine militants right here. that's long been a stronghold of taliban activity and last month's school massacre brought a new level of focus on that area. that was an attack that killed 150 people most of them children. heart breaking. these u.s. air strikes were

accompanied by pakistani strikes here. does that suggest that there was a positive narrative and uneasy relationship? >> i think pakistan has been the frenemy and ally we have had across the world. i think that the deaths have changed dramatically the needle and the acceptance for a u.s. role inside pakistan and along that border between afghanistan and pakistan. drone attacks, any drone attack in pakistan could send the country on edge. u.s. popularity is about 8%. that has changed after the killing of all these young people. so i think we are now coordinating with pakistan in a way that we haven't in years. we are creating a vice for the both pakistan and the afghan taliban in that region and squeezing them and the death

rate right now is high. 1200 in the last week. >> ever does this put the border region back on the ra bar in a way that it is costly. >> it's back on the map of concern. it never left the map. it is heightened because we have cooperation with pakistan that we evaporate enjoyed for years. this is happening at the exact time that troops are being drawn down. we have with drawn for many parts of afghanistan. a lot of those forces have been part process of squeezing them and keeping the biggest problems contained. we will rely on air power and drones and have a distant hand. i suspect we will be increasing that and as long as they are not scream being the drone attacks,

i don't think it will be a big deal in the u.s. because it came along with a drawdown of u.s. military presence. >> one thing we have been hearing from officials is there a lot of tweaks being made to that withdrawal. what are you hearing? >> they have already assigned according to the "new york times," secret findings that the combat mission of the troops will continue. a series of programs on the mission ending but in fact it hasn't for all of the troops. they will continue to be a combat mission and an ongoing effort to rewrite the terms. the president right now wants to see a two-year drawdown to zero troops and the pentagon is pushing to maintain a longer endemic force for many years to come. >> appreciate it. >> thank you. >> one more really difficult challenge for the administration. north korea and pyongyang denouncinging the sanctions im

imposing the cyber attack on sony. pursued to stifle north korea and stirring up bad blood towards it would harden itself will and resolution from a nameless north korean official. let's bring in the legislation and policy for the obama administration. he is a truman national security project. what comes next in the administration's offensive against north korea. how do they contend with growing concerns that there is actually not so much of a link in terms of the evidence between north korea and the cyber attack. >> the administration seems confident that there is a link. now of course that seems to be coming from sensitive intelligence sources, but the people i have talked to i have shown a high degree of confidence and indeed in my personal experience, these issues are something that the president takes seriously. they would not be taking these

steps if they were not competent. >> that's the fbi's analysis and they can't reveal why. >> correct. correct. there skeptics out in the private sector in the community. much of that is because they don't have the same access to evidence that the community did. >> before we go on, i wanted to tell the viewers, the white house briefing is the first of 2015. questions about the congress and the keystone pipeline. we will keep an eye on that and bring you news. this is one issue that may welcome up. as we talked about these new sanctions, they are now going into effect and response from north korea. what kind of practical effect will that have? >> we have proven very ineffective at changing behavior over the last 62 years.

the broader experience. the sanctions are likely targeted with those who are contemplating similar use in the future. it seems to be inappropriate and should deescalate in cyberspace. >> it's the first time sanctions have been imposed in response to an attack on a private company. do you think that is precedent setting? >> certainly and the nature of this cyber action was precedent setting in that it was coupled with them. # this is very troubling and something that bears responding. this seems to me an appropriate response. >> the president is heading

and the transmovement talk to parents who can't or won't understand their child's transition? >> this is like i said earlier during the week. if you love someone unconditionally, there is no but after that. when they say who you they are, believe them. they lost their child and the other children lost a sibling. this points to the support that parents of transyouth need and the support created within the school system for the young people. >> i wish we could say this was a terrible one off and a typical thing. 40% of transgender youth have attempted suicide or say they have. what can change in schools since this does affect so many school age kids? >> actually that statistic is higher for transgender youth who experienced family rejection. it's around 57% that have attempted suicide. the best way for these things to

change is not only for us to have transpolicies, but to make sure the leadership within these institutions also reflects this transexclusion. >> the hardest is high school going into college. this is still hard. one aspect i wanted to zero in on some colleges are coming into scrutiny. me about the transformation going on in that respect. >> we are starting to have more conversations around women's colleges and what it looks like for the students to be included at the schools. what we have to do is have a larger conversation around gender. that is not something imposed, it's self-determined. a transgender woman is a woman. she needs spaces to learn. these schools are starting to adopt the policies but where we get caught up is it could be difficult for transfolks to get

their identification changed if are a number of reasons. these are saying that these details need in place before they can get into schools. there is this caveat that people have to work through. we need a larger conversation and start making sure that these policies are actually going in. we need to see the changes not only in the all women's schools, but starting to see in school districts across the country in high schools and middle schools are adopting the policies. >> we are about to head over to the hill and what's on the docket as this republican leadership goes to work. what should be considered by leadership to change the stakes for vulnerable transyouth? >> absolutely we need the policies in all of our institutions, not just the schools. in the workplaces and take a hard look at therapy that has

boehner and two saying they'll challenge boehner for the title. congressman gohmert of texas are on that list. should boehner be shaking in his boehner britches? a spokesman tells "the washington post," quote, he expects to be elected by the whole house this week. that's what most prognosticators are saying but it reveals interesting fault lines in. caucus. kelly o'donnell covering all of this. thank you so much. what will it take for this message from these conservative opposition leaders to get through the mainstreamers, or is that even possible? >> for the last few years, the sort of irritation factor that's been going on between the most conservative members and john boehner has been a running story we've been covering. this is another one of those moments where those who believe he has not done enough to answer their concerns are going to you know make their objections known. this is not a real surprise. these couple members characters in that story, frequent

agitators of the speakers. what helps john boehner this time, he has an even larger republican majority in the new congress so he has some room to be re-elected. this is some way they can make some noise. they're all sworn in then again electing electing. democrats in the house will likely vote for nancy pelosi but there will be enough republicans that the kind of fate of john boehner as the next speaker is not in doubt. this with-s one of those issues where it allows conservatives to challenge him and to give him some sort of aggravation right before he takes the gavel again. >> speaking of the kind of aggravation he's receive, take a look to what congressman gohmert said specifically this morning on fox news. >> we have got to show the american people that they don't need to abandon the republican

party. there are people in the party that are willing to stand up and fight for the very things we promise we would do. >> so interesting focus there. essentially he's receiving that grief, boehner is, for being too moderate. >> and boehner has been up against this challenge all along. i mean people like gohmert have wanted the speaker to fight harder, to defund measures related to the health care law or to take the president to task related to immigration and the executive actions. boehner has said publicly he wants to do both of those things. but at the point of the most recent debate between these two sides, had to do with sort of the one of the last stories of the year gone by that cromnibus that funds the government but keeps the question of immigration open until next month. that's one of the things where goe better and ted yoho were against the position boehner took. they said it's about looking into a new republican congress

and other potential accomplishments they could make. you have most conservative members stepping out this way. not unexpected but part of what comes with the territory. >> of course, boehner is not the only republican. we're still dealing with this fallout for scalise. he came under fire for speaking to a white nationalist conference a decade ago. there are questions about whether he should be re-elected. the white house just addressed this. here is josh earnest a few minutes ago. take a listen. >> there's no arguing that who republicans decide to elevate into a leadership position says a lot about who -- what the conference's priorities and values are. and, i mean ultimately mr. scalise reportedly described himself as david duke without the baggage, so it will be up to

republicans. >> some barbs there but relatively gentle ones. seems the furor is dying down at this point. will there be any repercussions for scalise? >> this is a reset opportunity for democrats who want to bring this issue up when members are in town after the post-holiday time, people are in front of cameras again. there's a chance to have that kind of briefing where that criticism can play out. we heard from debbie wasserman schultz on paper today also raising these questions and steve scalise will be back in town later today. he'll be a part of the events of the new congress and will surely be questioned on camera about this. he's not making any new comments today but he'll have to address it. still the leadership in the republican party supports him. even some new members are supporting him as well. but this is a chance for democrats to bring it up again and to shine a light on it. ronan? >> a new year new year of political in-fighting. kelly o'donnell, thank you. we have sad breaking news right now. two pros speblgts from the u.s. ski team were killed today in an
