"the ed show" is up next. \s. good even americans. live from new york we start tonight with very important breaking news. president obama will veto the keystone xl pipeline. if you voted for this president and you care about climate change you have to be proud tonight. we still have a lot of power, the progressives do. the president has just cemented his legacy as one of the pro-environment presidents in history. we hope so. starting last february we started talking about the pipeline and went to the middle of the country to get the real story. after six years of environment stud yes, sir, legislative wrangling and legal maneuver

president obama has taken a stand. earlier today, josh earnest said the president would use the veto pen. >> the president has been fairly downbeat on the keystone pipeline. republicans are moving ahead. have you taken a fresh rook at this? >> well not really the fact is this piece of legislation is not all that different from the piece of legislation introduced last congress. we put out a statement of administerrative position indicating that the president would veto if. i can confirm if this big passes with this congress the president wouldn't sign it either. >> republicans with probablily fuming matt but it shouldn't be a threat. it should be the way it's going to be. they spend sunday just a couple days ago all over the air waves pushing support for this controversial project. they made clear keystone would be the first order of business in this new congress. senate majority leader mitch

mcconnell released a statement after that press conference d. the president threatening to veto the first bipartisan infrastructure bill of the new congress must come as a shot to the american people who spoke lowly in november. it's interesting to note that the president declined a veto threat last month when a senator was trying to save her job over the exact same bill. once again the president is standing in the way of a shovel-ready jobs projects. even in the midst of the veto pen, here come the republicans trying to convince americans that 42 thousands temporary jobs is jurs the savior of the economy, but they failed to make a comment on how good things were last month when we aheaded over -- >> and replaced every job since the great recession. picking and choose been big time.

the hoe is experted to vote this friday. the committee was -- of course the hearings have been canceled. that's good. go do something else. a final vote is expected? the senate next week. i think president obama is getting out the boxes gloves as he heads to the fourth quarter of his presidency. he's not holding back. the president has power, and he has been talking about jobs and infrastructure for a long time and now he's going to push the republicans to a point where they have to do something about it. this is what he said about the pipeline back in december. >> it's very good for canadian oil companies and it's good for the canadian oil industry but it's not going to be a huge benefit to the u.s. consumers. it's not even going to be a nominal benefit to u.s. consumers. now, the construction of the pipeline itself will create probably a couple thousand jobs.

those are temporary jobs until the construction actually happens. there's probably some additional jobs that can be created in the refining process down in the gulf, but i've just trying to give this perspective. i think that there's been this tendency to really hype this thing as some magic formula, and to what ails the u.s. economy, and it's hard to see on paper where exactly where they're getting that information from. >> it is really heart to do a paper where they're getting their bullet points. why in the world are the republicans sticking to it like flypaper. what's happening here is the president of the united states is taking a stand on climate change. he goes over to china, does the deal on emissions, the republicans don't like that. well, they're not going to like this ever but we find ourselves in an interesting

bargaining position. there is almost a keystone 1 pipeline that goes down there. guess what? it leaks. here is the proposed pipeline that will come through south dakota that is not permitted properly yet, that's not properly permitted in the state of nebraska either abu they're going they eminent domain issues and the state supreme court is about really to render judgment on that so the of the heat of the permitting pros is say you bring me this and put it on my desk, i'm not going to sign it. what's happening here is this is not a major jobs project, but that's the how the republicans are selling it. so there's some interesting opportunities here on both sides. how many times have we covered on this program and talked to politicians politicians, elected officials about infrastructure in america? every show has done it. i remember president obama not long ago in ohio with a bridge behind him in john boehner's district in cincinnati in fact, talking about bridges in this

country and how they have to be fixed, and retrofitted el redone and rebuilt. this bridge actually goes over to kentucky. so isn't it ironic that this affects senate majority leader mitch mcconnell it also affects how speaker john boehner, who was reelected today. the president has already been in your backyard you want to do something on infrastructure? let's do it. the question is is the president really making a statement on climate change? or is he setting keystone xl pipeline to be a negotiating tool? to say show me some game republicans, don't give me this bill for 42,000 give me one that will do at least 200,000 in the first month like we did last month. 5 million jobs or the next year or two years, the way we have done since the recovery and most of you guys didn't support -- only three of you supported the stimulus package to start with.

by the way just to through this in, they didn't like the it automobile loan either. what were the numbers go ask chrysler. the deniers are out and about on the climate change on everything, so reps this is your chance to get the project that you love. this is your chance to get that oil, because i think president obama might negotiate on it. i don't want him to. i think that this president might be making a statement to the world that the united states of america recognizes that the science is real its undeniable and we as a country have to lead as a superpower and do something about climate change. that's where i think the president is. but the republicans should make the play -- come to the table with the jobs bill and let's make this next session of congress real interesting. how big is the keystone project to the republicans? we'll find out. how big is keystone to the

to do everything we can to highlight the difference between the fossil fuel funded republican party is and where most average americans now are on climate change. this is kind of a turning point and i hope we can take full advantage. do you think the president is connecting this that could could this a benchmark moment that this could separate him from other presidents turning the tide and staying with the science and saying we have to show the world that we're serious about this? do you thin that's it or maybe it's about negotiating and getting a better deal somewhere else legislatively? >> i hope it's the former and not the latter. the increment of extra greenhouse gas, extra carbon that the tar sands create is the equivalent of nearly 6 million

cars on the roads for 50 years. it virtually wipes out the vast majority of the president's initiative to increase mileage. i would doubt he would wake to take a initiative that he worked so heart hard for and has been successful that would wipe oat 70% of this with the pipeline. if you damage from it it's about $128 billion in damage. that's a pretty big hammer over this country, and if we can turn that around that's a big thing to bargain away. this isn't just a little pipeline with 42,000 jobs and all that good stuff the republicans are saying. this is a very big hammer that a very responsible science 'tis who ran nasa's goddard institute says is game over for climate if we don't bring it to an end. what do you think the republican reaction will be? of course mitch mcconnell released that statement i just read a moment ago, but the legislative response what will

it be? i think they're in a bit of a bubble. they are funded by fossil fuel interests so much that i don't think they really see beyond the fossil fuel funding that surrounds them. so i think that they're going to be a little bit surprised by the discrepancy between where they think they are and where the american public already is on climate change. so i think they'll go ahead with it. i think they've got a point that they want to prove here but why on earth this new republican congress would want to introduce itself for the first time to the american people by doing something that blindly serves the interest of the fossil fuel industry, and has -- i mean 42,000 jobs, okay, temporary great, they killed shahin/portman, the clean energy bill that had 190,000 jobs. so this isn't about the jobs everybody can see that. >> senator, good to have you with us tonight. i appreciate you being the only senator who did the real

homework and went to nebraska to talk to the folks on the ground and get the story about what it means to run a pipeline over our aquifer. why should we take that risk and oh by the way, every pipeline leaks. why we would want to do that i don't know. the president making a big statement today. thank you, senator. >> thank you, ed. let me bring in tara sittenfeld with the league of conservation voters. i think this is a big victory. you should be smiling tonight. this is the strongers statement that the white house and president has made to this point. let's fly ahead of the aircraft a bit. let's say that the republicans put it out there. it gets vetoed and then it's over. what does it mean for 2016? >> well so as you said i am smiling, we are thrilled that the obama administration has made clear they would veto this

bill. we had been confident they would vite rho it but it's great to have it out there. but still going forward, to reject the permit obviously, as you pointed out so powerfully it's a dirty and dang are you pipeline. we think as we look to 2016 we'll be faced with presidential candidates who really have a choice. are they going to stand with polluters, or are they going to stand for a clean energy future? to keep building on the progress that president obama has made and we very much hope to see all the presidential candidates running in 16 really speaks to the important of efficiency renewable energy. >> well, now that the president has taken this position no matter what happens, how can the next democratic candidate, whoever that might be reverse what the president has said? i mean is there going to be a democratic candidate that's going to be able to garnish all of the sport of all the of the

facets of the left and reverse a decision that the president's made on keystone? i mean it really puts the next candidate in an untenable position when it comes to this doesn't it? >> it's hard to imagine, what we're seeing such leadership from president obama and others throughout his administration and fantastic staff working so hard to combat the cries, whether it's increasing fuel efficiency for cars or cutting carbon pollution from coal-burning power plants forging an important deal with china to cut emissions. >> but keystone in 2016 all those things you're saying is important, this ups the ante for whoever wants the nomination for the democrats. >> no question. it's hard to imagine that anyone would want to reverse the process that i was mentioning or when we wsh hope that all candidates running will agree with that, because it really is important. >> this should enight progressives. this should show that this is

of let's get to work. the nation's first bullet train starts construction today in fresno. it will take travelers between los angeles and san francisco in less than three hours. folks, that's booking. the 200-mile-per-hour train is a marvel of both engineering and politics. congressional republicans have vowed not to provide additional money for the project. the train route goes through house majority leader kevin mccarthy's district. he promises to do all that he can to ensure that not $1 of federal funding goes to boondoggles like high-speed rails. speaker boehner likes to ask, where are the jobs? the answer is project like this. bernie sanders wants to put $13 million american toss work with decent-paying job. the key infrastructure projects

and reparing crumbling infra infrastructure or where the jobs are the how will republicans relack joining me senator sanders of vermont. why are republicans imposing infrastructure modernization projects like high-speed rail. this is cost-effective. it's environmentally safe travel safe winners all across the board and it from creates jobs. everybody in this country that our infrastructure that once was the -- led the world, was once the pride of the world, is now crumbling. we have 600,000 bridges in disrepair in every state of this country. there are people in cars going over potholes. clearly we need a major effort to rebuild this crumbling

infrastructure. i'm going to introduce legislation to do that. part of infrastructure repair is creating a strong rail system that begins to catch up with europe japan, even china. so high-speed rail is part of the overall effort that we need to make in rebuilding our infrastructure. ed i will tell you this if we invest a trillion in infrastructure in the american society of civil engineers tell us we need to invest $3 try wrong, but $1 trillion will create 13 million decent-paying jobs and maintain other jobs as well. senator. >> how restrictive do you think that the republican letter is going to be in this session of congress? you're going to come up with a bill that's going to deal with infrastructure, do you think republicans will be ordered to not to get on board with stuff like there? >> they're going to have a

problem, because elf republicans automatic over this country whose still are telling them we're going to rebuilt the infrastructure. the chairman of the environment and public works committee here in the senate will be jim inhofe one of the most conservative members of the senate. you talk to senator inhofe he understands that we need to rebuilt our roads and our bridges. so i think there are republicans that understand that i look forward to working with them. you think it would put 13 million people to work. >> it will create and maintain that many jobs. >> i want to switch to the tpp, the transpacific partnership. you have recently written a her to froemming, asking for a full text of the agreement. how dangerous is this secrecy about the tpp, as you see it? you say in your letter to the trade representative that

welcome back for "the ed show." governor chris christie has received lots of attention for being a dollar cowboys fan. nothing wrong with a governor rooting for his childhood team. i live in minnesota. i love the green bay packers. i like it when they win. however, some think christie may have crossed the line with recent gifts from jerry jones. chris glor yosso has more. >> reporter: easy looked over in that skybox celebration is a simple question -- who paid for christie to have the best seat in the house? >> he should be rooting for the

giants or the jets but not the cowboys. i hay the cowboys. >> reporter: football 'liegeance aside new jersey citizens might like to know their governor's trip to a billionaire suite, including ticket and transportation was paid for by the billionaire jerry jones himself. it does raise ethics questions. according to new jersey's uniform ethics code there is a zero-tolerance policy for state officials accepting gifts, but christie's office justified this gift citing at code it says that gifts are okay if they come from relatives or personal frets. rutgers politics professor says ethics efforts have long struggled to define friendship. >> some decisions have been made by friendship is basically has to be reciprocal that it's fine if a friend takes you out to dinner and you have a receipt

from that as long as you take the friend out for dinner at some point for roughly equal dinners. >> reporter: if governor christie does thank jerry jones with an expensive dinner on his tab, one thing is for sure jets and giants fans will not approve. >> christie is rooting for the dallas cowboys? man, that's no good. he's a jersey guy. how can he be rooting for the cowboys? cowboys owner jerry jones says the governor brings the mojo. the story goes deeper. "wall street journal" reports that the dallas cowboys are part owners of the legends hospitality. they report jerry jones' family is a significant business owner in the company, legends hospitality will be the operator of the new one world trade center observatory owned by the port thofrt. governor christie and governor cuomo jointly control the port authority. the port authority said legends was selected after a public procurement process in 2013.

a board member told "wall street journal" the bidding process was fair and did not involve personal favors. he said cowboys owner jerry jones was not involved. meanwhile, no matter how you look at this it's bad news for governor christie who has been under heavy criticism for bridge-gate, has spurred calls for reform in the port authority. governors christie and cuomo recently vetoed legislative overhaul of the authority. instead they pushed for a set of changes written by a panel they appointed. one of the proposals could end overnight p.a.t.h. train service for new york and new jersey. this move would leave working-class people with no way to get home after work in the late hours. bartenders waitresses doormen, construction workers and other night shift workers would be in a pretty tough spot. their costs would go up. new jersey mayor told "new york times," if either governor actually rode the train during these hours, they would have

never considered this. it's easy for christie to push for reforming like this while flying on a private jet to see the cowboys. christie's office has justified gifts from jones by citing new jersey's executive order 77. it says the governor may accept gifts, favors, services gra attitudeities, meals, lodging or travel expenses from relatives or personal friends that are paid for with personal funds. well jerry jones has plenty of money, no doubt about that. the governor's office did not mention christie updated the code back in 2010. christie himself sinds an executive order 24 that says all public officials must avoid conduct that violates the public trust or creates an appian of xwro prity. we reached out to jerry jones and governor cris yik to come on the program today. fat chance of that governor christie decline, and of course we have yet to hear back from the cowboys, because they better

be getting ready for the packers, and they better take their long underwear to green bay. it will be cold. for more brad woodhouse, president of the american bridge 21st century. and also with us assemblyman gordon johnson. i appreciate you both joining us. i think it goes much deeper than being a football fan. mr. johnson what kind of problems do you see? >> i see a conflict here. these not just two guys or two friends getting together. this is an individual who has gotten a contract from an authority that the governor controls, and then two months later is flying on this guy's private jet, not just himself, the family the four kids and a security force, all fly out to dallas. they're all lodged in a hotel. they had to pay for lodging, they had to pay for the transportation there, and the meals, and it's just two friends

getting together. i'm not buying that. this doesn't make sense to me at all. >> are you calling for it to stop? there's a game this weekend, on the road in grind bay. >> i'm going to call for an investigation. i'm going to ask assemblyman wisniewski wisniewski, the chair of the committee to expand their investigation to include this latest incident. >> brad woodhouse, i was reading in the american bridge 21st century your playbook for the upcoming election. in it you've got a section in there about travel issues with chris christie. this isn't the first time he's had some issues is it? >> no not at all. one of the things we are trying to get to the bottom of is about chris christie and his travel outside of the state of new jersey and who pays for it. we know one things is he was gone a ton from the state of new jersey as rga chair. i think he was gone about a third of the time but the issue here, ed and another

organization i'm involved with has already filed a complaint with the state ethics economy calling for an investigation. what you are seeing here with taking gifts from jerry jones, taking gifts from the cowboys, while also jerry jones and the cowboys doing business with the state of new jersey is not a far cry from what the type of activity that bob mcdonald was sentenced for. not a far cry from what we saw with abramoff and tom delay. that was all about favorites, tickets, golf outings, plane rides. i think chris christie really crossed the line here and we're calling for an investigation to get to the bottom of it. >> mr. johnson, is the investigation, should it go into the deal for the observatory, to find out the devil in the details in how all of that unfolded? >> i think we need full disclosures on everything. we should bring in the governor mr. jerry jones, legends, and also the port thought in new

york/new jersey. we want to know how this contract was let, what was the process they used to select legends. the whole thing, the whole comprehensive package should be investigated. >> is it possible gentlemen, that the governor of new jersey has just gotten wrapped up in the moment and he's kind of a regular guy and said jumping on somebody's jet and going to the nfl game is pretty cool. i am the governor i guess he wants me down there. what about that? >> look all power to him. everyone would like to sit in the owner's box at an nfl game but the question is whether or not he violated either ethics or criminal laws. i just say a political question ed, i get it. i'm with you. i don't think anyone should judge public officials on what their rooting interests are or candidates for office but chris christie takes it a step further. he criticizes eagles fans. he really gets in the face of people who find it

displeasurable that he is rooting for the cowboys. i don't think he's acting ed either on the ethics front or just smart politics like someone who really wants to run for president. >> mr. johnson, i would be curious to know if jerry jones and chris christie ever knew each other before the bidding took place for the observe story. >> that's a good question. so that's a very good question. we need like i said before we need disclosure. we want to find out why this contract, would you say legends got this contract and then two months later, the governor is flying on private jets with his family and security force to dallas. the lodging costs, and the meals and the transportation to and from the hotel. i'd like to know how much all this came to. >> well it's quite a bit. >> i guess it would be. a private jet from new york down

to dallas and back is about ten grand. i mean i just think that -- you know i understand people getting wrapped up in the moment. i get all that but if there is a deal here there's a real problem, okay? and the governor doesn't seem to have a problem with it at all. the k578 ra is on him, he's hugging everybody, right in there with the family. are they that close of friends? >> there's a perception here of unethical behavior all right? and the public needs to know -- this needs to be cleared up and the governor needs to clear it up along with the port authority and mr. jerry jones with legends. >> ed, i don't think the personal friendship passes the laugh test. there's no history that they were personal friends or friends of any kind before christie became governor. of course a governor all of a sudden acquires all kind of

and finally tonight, repeal happy republicans are not the only ones working to unravel obamacare. this week, some democrats are sounding more like this guy. >> there will be a vote on repeal.

we will get on his desk for signature bipartisan support, eliminating the tax on -- the employer mandate, the 40-hour workweek. we have bipartisan support for that. >> the medical device tax has been in effect since january 1st of 2013 as part of the affordable care act. now this revenue, folks, is one of the financial pillars of this law. this is how we're paying for it in a big way. getting rid of the tax would blow a $30 billion hole in obamacare's finances over the next ten years. some democrats with medical device manufacturers in their states are siding with republicans. senator amy klobuchar told chuck todd why she wants it repealed. >> this issue was not part of the agreement originally. a major tax was packed on the

mel device manufacturers. people like al franken and elizabeth warren are supporting this and the hope is that we will find a way to pay for this and get this tax off -- >> but you haven't figured out a way to pay for it? >> we are working on that as we speak. >> they're working on it. the industry has spent nearly $200 million lobbying congress to get rid of this tax. if the medical device tax goes away this will create a big hole in the funding of obamacare and how this country's going to pay for it. but the republicans chip away, chip away, chip away all they can to destroy this health care bill. i'm joined by dr. corey herbert. also wendel potter author of obamacare, what's in it for me. mr. potter we're talking about a 2.3% tax on an industry that makes billions of dollars.

can this tax be repealed and obamacare survive? >> obamacare would survive but it would be weakened. this money helps to pay for the subsidies to millions and millions of americans are now getting to help them afford insurance coverage. so what we're talking about here are companies in my view that are really quite greedy. they are getting new customers. people are finally able to get the care that they need because of obamacare. they're able to get medical devices that they need but these companies don't want to share a penny of any revenue. they're getting billions of dollars in new revenue, and this would do some significant damage to the law and to the ability of americans to be able to afford coverage. >> what i find interesting is some democrats are on record saying they're willing to repeal this tax, but they don't know how they'll raise the revenue to make the law work. this is a big hole in the funding of it. dr. hebert who gets taxed,

every device in the medical industry? >> well, no let's be very clear. and as a physician, i want everybody to understand this. it's a 2.3% tax, but really it's 1.4% because the companies can write off the tax as a business expense. so let's talk about that. it's really 1.4. with that being said what is taxed? everything from tongue depressors to artificial knees and hips so that's everything that's going to be taxed, but the reality is that we know that these companies make so much money that they can afford it. we have to talk about the fact that the billions of dollars that they make they actually are funding their boards of directors. they're funding all of their constituents and it's just really not fair. we know it's going to punch a real hole in obamacare. we got to do something about this and not let it be repealed.

>> they're saying it's shipping jobs overseas. they're saying this tax is just making it so hard to manufacture these devices they have to go, ironically to countries that have universal health care to get it done? >> it's completely bogus. congress's own researchers determined that. they did some research they said that does not hold any water. keep in mind they're going to sell more stuff. they're going to sell more devices. so i don't think that is going to be costing jobs at all. the congressional research services says that's not going to happen. industries use the job card all the time when they're fighting something like this. and it usually has no merit whatsoever. and in this case i don't think it does either. >> so what industries get hurt here? i mean have they slowed down production because of this tax? have they raised prices because of this tax? has there just been an upheaval

financially in the medical device industry since obamacare started in 2013? this story kind of comes from all of a sudden the republicans say, holy smokes, we got to get rid of this tax. where's the outcry been on this mr. potter? >> i don't think there has been sufficient outcry because it's been largely under the radar for most people except those politicians who are getting pressured by the lobbyists for these companies. the two biggest, johnson & johnson and general electric. two of the larger corporations in the world, that have enormous revenues. they can well afford this. they will pass along, in fact they'll probably not absorb any of this they'll pass the cost to consumers. it's just greed. >> dr. hebert your thoughts on that? >> i totally agree. first of all we know the large corporations are not going to lose any jobs. as mr. potter correctly pointed out, the congressional research service did the study and they did the study in november, which

is very recent. so no jobs will be lost. we also have to remember that it will force hospitals and insurance companies to come up with money that they don't have trying to get the insurance that people need in the urban communities in the rural communities where people don't have health care. so make no mistake. this is pure greed. and the reason why there's been no outcry is because there's been nothing out there in the medical industry to show that people are going to have any problems with this tax. it's been there. it's not going to change anything. the companies want money and that's the bottom line. >> and where would we make up the revenue in this? would we just cover fewer people? >> you know that's the thing. congress is supposed to come up with the revenue if they do something like this but i don't think they're serious about this. i don't know what would happen. i would hope the president would veto it if it gets to his desk. great to have you with us tonight. that's "the ed show."
