be very afraid. what your new high-tech tv could be doing while you're hanging out in the privacity of your own home. this is "way too early." mom is always right. hi, everybody. i'm thomas roberts. it is tuesday, february 10th. welcome to "way too early." the show that thinks the tv has ears. wait until you hear this story about samsung. we may think the toaster has ears. that's us being paranoid. jen, you have one of the samsung tvs? >> yeah. >> the tv is listening. we're going to begin with the winter weather. it won't give boston a break. the storm dumping two feet of snow on parts of new england. it's winding down. but forecasters say more could be on the way. the drastic times are calling for drastic measures as some massachusetts towns are dumping snow on the local waterways. waivers were granted because

there's no place to put it. the mayor, not ruling it out. ron mott has a quick look at how it came to this point. >> reporter: in the past 30 days, there's been multiple major snow events. january 27th, upwards of 22 inches. another 16 inches less than a week later. then nearly 7 1/2 followed by about a foot of snow. in total, a record 60-plus inches and counting paralyzing parts of the region. so much snow has been removed across the state, 10,000 dump trucks in boston alone would fill the home of the super bowl champion new england patriots gillette stadium 90 times says governor charlie baker. >> we're on our last run. >> ron sent back pictures of boston commuters walking along the tracks to get to work yesterday morning. about 50 of them forced to trek it after their train lost power. we're going to bring in msnbc reporter amanda sakuma live in boston. we know that schools are closed for another day.

what else are you hearing? and what are you hearing about if boston inside the city will go ahead and start dumping snow on waterways? that's big. >> good morning, thomas. you know, the snow may have stopped falling. but the conditions are getting worse. and it doesn't seem like things will be getting back to normal for residents here anytime soon. officials shut down the metro system here around 7:00 p.m. causing a number of headaches for commuters who were stranded or waiting hours on to get home in our commute. it's only getting worse today. those making the drive will see stretch treacherous conditions. officials have been plowing nonstop. it's putting up a pileup of snow around the streets. look here. we had some major pileups of snow here around boston. here, this isn't just a pileup of snow. this is an actual car. you can see the side mirror here is buried completely in snow. even if someone does want to get

out and about the streets, and into the city there's virtually no way to dig themselves out of here. >> you're lucky a car alarm didn't go off. i was a little worried when you pulled on the rear-view mirror there. it's amazing. have you heard about whether or not they're going to dump snow in waterways in boston? >> it's a major concern. they're running out of space of where to store all of the snow. this has been a record breaking couple of weeks. they've been putting the snow in snow farms. and have been melting it around the clock. that's about 400 tons of snow that's melting with these industrial machines. they're running out of options. that's on the table. but there are many options that they're trying to figure out what to do with all of the massive amounts of snow. >> great to see you. thanks for your reporting. amanda sakuma. and bill karins will be joining us later with the forecast on what to expect for new england and the weather concerns around the country. want to get back to the top story for you. in alabama, several counties

began issuing marriage licenses to gay and lesbian couples, making it the 37th state to do so. but it wasn't without a fight from a well-known judge. >> reporter: gay marriage came to the heart of the deep south. same-sex couples began getting licenses in alabama, after a federal judge two weeks ago struck down a state ban on gay marriage there. scalia and thomas says the supreme court should have put that on hold until the court rules on gay marriage nationwide. the failure to grant alabama's request, thomas said may well be seen as a signal of the court's intended resolution of that question of gay marriage nationwide. two-thirds of alabama counties refused to grant the marriage licenses. >> we're not handing out same-sex marriages. >> reporter: after roy moore, chief justice of the supreme

court urged justices to avoid the ruling. he was removed from office but was re-elected three years ago. >> that was pete williams reporting for us. it's unlikely that the supreme court would allow alabama to grant the marriage licenses. the high court taking up the issue this spring. and we'll have a ruling by june. turning overseas to a rift between the u.s. and germany on how to end the ongoing conflict between russia and ukraine. leaders must quote, try again and again to end the fighting through diplomacy. just hours earlier, angela merkel stood side-by-side with president obama. both leaders are holding out hope that peace talks will be successful. but president obama says he is open to sending arms to ukraine, putting him at odds with chancellor merkel. >> if diplomacy fails, i asked

my team to look at all options. what other means can we put in place to change mr. putin's calculus. and the possibility of lethal defensive weapons is one of those options that's being examined. i have not made a decision about that. >> and bloomberg reports that secretary kerry said he is in favor of sending arms to ukrainian forces. president obama and israeli prime minister benjamin netanyahu. there were reports that he was going to downplay his address to congress on his trip to the u.s. next months. john boehner invited the prime minister without consulting the white house. nbc news has learned as of now, he plans to go ahead with his address in front of the full chamber. at a campaign event yesterday, netanyahu didn't hesitate to tweak the u.s. while some are busy with

protocol or politics, a bad deal with iran is taking shape. president obama will not back down on his decision not to meet with netanyahu on the march trip. he cited netanyahu's political election in israel, during the event with the german chancellor. >> as much as i love angela if she was two weeks away from an election she wouldn't have received an invitation to the white house. and i suspect she wouldn't have asked for one. so, you know -- >> kind of looked like maybe i would have. i might have. i don't know. we'll never know if i'll ask for that. president obama has had a change of heart on the use of filibusters in the senate. he says lawmakers should eliminate routine use of it this that requires a 60-vote threshold to move forward. >> in an era where the parties

are more polarized, it almost ensures greater gridlock and less clarity in terms of the positions of the parties. there's nothing in the constitution that requires it. the framers were pretty good at designing a house, a senate to assure that a majority didn't just run rampant. the filibuster in this modern age probably just torques it too far in the direction of a majority party not being able to govern effectively and move forward its platform. >> okay. interesting there, especially the visuals. but in 2005 then-senator obama had a different view. the republicans considered the so-called nuclear option to get around the democrats' use of the filibuster. >> the american people want less partisanship in this town. but if the majority chooses to end the filibuster if hay choose to change the rule and put an end to democratic debate the fighting and the bitterness and the gridlock will only get

worse. if the right of free and open debate is taken away from the minority party, the millions of americans that ask us to be their voice, i feel the partisan hat atmosphere will be poisoned to the point that no one will agree on anything. that doesn't serve anyone's best interest. and it's not what the patriots who founded this democracy had in mind. >> last week democrats used the filibuster to block legislation that would reverse president obama's executive actions on immigration reform. a new staffer for jeb bush's political action committee is facing criticism for a series of offensive tweets made several years ago. the co-founder of hipster.com was hired as the chief tech officer for the right to rise pac. he deleted two dozen tweets that included insults about women and gays. one tweet said quote, new study confirms old belief college

female art majors are shuts. science majors are also shuts but uglier. another said quote, most people don't know what halloween is. german for night that girls with low self-esteem dress like shuts. and another deleted tweet said when i burp in the gym, i feel like it's my way of saying, sorry, guys but i'm not gay. he said i deleted old jokes that i no longer find funny for appropriate. he didn't include i never want to work ever. bush appearing to be standing by the new hire. in a statement, a spokesperson says, governor bush believes the comments were inappropriate. they've been deleted at our request. and we're excited to have him onboard. the right to rise pac. several candidates are fanning across the globe. we have scott walker in london opening for better headlines than what chris christie received there. christie back in iowa for the

second time in two weeks. this time he openly dangled talk of a presidential run, selling himself as a washington alternative and conservative who knows how to work with the legislature. rand paul was back in iowa. and the arms race for political operatives, mark rubio was making a big play for new hampshire, hiring a strategist that delivered the state for mitt romney four years ago. there was action yesterday surrounding hillary clinton's unannounced presidential campaign. there was word a top operative for a super pac backing clinton had resigned from the board. he was reportedly upset over a tactic used against other pacs. and politico obtained a letter where he blamed a hit jb on other pro-clinton groups which he supports. last week, the "new york times" pulls back the curtain on those groups and their practices.

among the findings, the fund-raiser received a commission of 12.5% of the money she was bringing in. the priorities usa supplied the information for that piece. now, brock has written another letter. this one saying he's open to returning to priorities usa. there's been an effort to smooth things over. and it brings back echoes of 2008 when the clinton machine was expected to be a cash juggernaut. but fighting among cliques got in the way of that. shifting our attention to business news. and news of a possible privacy infringement by samsung. this is really fascinating, jeff, about the smart tvs. the samsung product. and whether or not they have the capability to listen in on your private conversation and what that means for the owners of these tvs. >> absolutely. it's a privacy infringement if you allow it to happen. but it's all part and parcel of the new technology in samsung televisions that allow them to

be voice-activated. and the microphone will be in the handset. and the point here is this is double-edged toward of new technology. on the one hand, great. you don't have to get up from the sofa. you can use your voice-activated system on your tv to get it to search for what you want it to find. but samsung pointing out in the privacy statement, that it will also be listening to other conversations. you remember the phrase not in front of the children. i suspect with this audio facility that will be recording whatever goes on in your living room you might want to be careful about what you say or what you're doing. some of the future tvs could have the ability to look into your room. the problem here, as well samsung says this information could go to third parties. they haven't specified who. that has to do with marketing purposes. they're going to know a lot about you if you allow this facility to operate.

rankings yesterday. that's the lowest in 20 years. the former number one is missing the cut after shooting an 82 at the phoenix open two weeks ago. let's get a check on your weather. bill karins is joining us now. this is a big concern. the storm system that's coming through a second punch. and then the cold forecast that comes with it. >> yeah. this is going to be a brutal stretch here for at least the next week, week and a half. and boston area, you're finally done with the snow. these stats are just -- i can't really equate. what does this equate to? i lived in florida in 2004 when we had four hurricanes in six weeks. that's similar. boston will deal with four major winter storms in a two-week to three-week period. they're inching closer to some historic records. yesterday, in that snowstorm it will all total from sunday and monday 323 inches of snow. it wasn't widespread. eastern mass was hit much worse.

albany hartford and providence ended up with 17 inches. we have the rest of february and march to do. and 107.6 inches in '95 was the one. for everyone likes the numbers and trends. look at all of the big storms that we've had. snowiest winters. and then this winter. you kind of see the trend here. looks like boston is snowier than ever over the last couple decades. talking about a little snow. watch how careful out there. a lot of black ice from d.c. down to richmond and through the delmarva region. we had a little sleet and freezing rain. in other words, tom, the next snowstorm from boston. it looks like it would be possibly thursday. as we know now, a glancing blow. just a little bit of snow. now, a little bit of snow is six inches. >> right. it's not that big of a deal. >> just six inches. a bigger chance on sunday. that has a better chance of
