at this time of unimaginable suffering, the country shares in their grief. joining me live nbc news chief foreign correspondent richard engel, and ayman mohyeldin joins us in studio. richard, let me begin with you. we heard early on from isis after the barrage of strikes by jordan that kayla had been killed and now we have this confirmation. what more details do we know. >> reporter: we know something of the chronology. kayla mueller was based in turkey about a year and a half ago. she was a young humanitarian worker, 26 years old, decided she wanted to make it her life's work to help victims of the syrian civil war, she traveled into syria and then in august 2013 while volunteering at a hospital in aleppo province was captured by isis.

we hadn't heard much from isis about her captivity, there were no videos no public threats, no images of her with a knife held to her throat like we saw with other american hostages. the family was doing its best to keep this case under wraps, had requested from the media not to disclose her name the fact that her hometown prescott, arizona, really to try to give negotiators the maximum leeway they could have so they could potentially work out a deal. then things took a dramatic turn for the worse on friday last friday, when isis released several photographs which it claims were the buildings, destroyed buildings that kayla was in buildings that were attacked by jordanian aircraft, and according to isis it was in those jordanian air strikes that kayla was killed. u.s. officials and kayla's

family have now confirmed she did, in fact die, but u.s. officials don't know exactly when or how. so at this stage all they are saying is they received some sort of notification from isis that obviously nobody else would have access to that convinced them that she has in fact lost her life but they are not confirming isis' version of events, not saying she was killed in the air strikes, only that she lost her life. >> kayla's family also ayman, released a letter that was written by her, the family released this letter. it was from the spring of 2014 while she was in captivity, and part of the letter that i have here they requested that we show this letter when we refer to it says please know that i am in a safe location completely unharmed and healthy. i have been treated with the utmost respect and kindness. it went on the to say i have come to a place and experience

wherein every sense of the word i surrendered myself to the creator because there was no one else but god. by your prayers i felt tenderly cradled in free fall. this goes on to the family from kayla. the fact that her family had been in communication with some within isis they have now said that the report about a rescue that's not true had been reported they did not want a rescue, a team going in and trying to save her, but what are we to learn from the fact her family was able to communicate so directly with isis including this confirmation? >> i think without having the entire chain of facts presented, it is difficult. it is a telling and revealing exchange, more so about her captors and those that were taken hostage. why they wanted her to communicate with her family i think is very telling. were they at some point interested in using her as you know, they wanted proof of life

to use her for some kind of negotiation or to try to release somebody else that isis had wanted with the jordanians or anyone else, it reveals a compassionate side of kayla that she could use the language she used. in the coming days and hours there will be a lot of questions about the surrounding kayla, how much did the u.s. government know specifically where she is and more importantly, had they known, would they have allowed some of the air strikes taking place to continue as they have been. this is again isis' version of events, claiming she died as a result of jordanian air strikes. jordan throughout the course of this, in the past several days has stepped up its air campaign so there's going to be a lot of questions as to what they were specifically targeting. >> it was jordan that immediately said kayla was not being housed or kept in a building that they struck. one would believe they were

getting the intelligence from the united states and would have some idea at least on where they thought she was being held captive. >> yeah. i think for the most part targeting or strike packages are coming from the united states intelligence, jordanians are certainly carrying them out, but without a doubt, most intelligence gathering in the targeting is probably being provided by the united states which has a more robust in the skies type intelligence and surveillance. i think that going to the question you're asking earlier about the chain of events the letter and timing of when the letter came out is going to be critical and pivotal as they try to put together a time line of where she was when she was captured, when she was moved, was she being taken place to place. >> sounds logical, and we heard that from other accounts that people have been kept by isis are not in one location and that would make complete sense. >> right. and what emerged in the past several months as well is that

there's clearly several groups within isis dealing with western hostages. some of them, executions we have seen, it is clear they're operating in a decentralized fashion. the question is who was responsible for her, where did they fit in in the larger isis framework and decision-making process. >> richard, i want to receive a statement from senator john mccain following the death of kayla mueller. he says i am heartbroken for the mueller family at the loss of their beautiful, beloved daughter kayla. thoughts and prayers of the people of arizona and america and civilized world are with the family at this terrible hour. of course she is from mr. mccain's home state of arizona, and his statement coming out just now. let's talk quickly, richard, about the air strikes from jordan. we know there was a new propaganda video released by isis where they used this journalist to convey their message of destruction, what they believe is an effort to win

over as many like to say hearts and minds, but we also know that jordan has used its own media and national media quite honestly, international media to convey that they are ready to i believe their words were destroy isis at this point. >> reporter: the group isis has been using hostages for very different purposes. they have used american hostages and british hostages for tools of terror. they have taken their americans out and their britains out, dressed them in orange jump suits and beheaded them on camera and then released horrific videos. european hostages french and italians in particular, they have been selling, raising hard cash. in the case of kayla mueller, it was unclear what their goal was with her. they were allowing her to communicate with her family to a degree. you showed a short while ago

that handwritten note that was carried out of captivity and delivered to the mueller family a very emotional note in which she talks about her spiritual connections with god and how she feels that her faith will bring her through, and she's apologizing to her family for having to put them through this very tremendous ordeal for her and for everyone associated with her. it is unclear what they wanted from kayla. did they want money? did they want to kill her? did they want to keep her? and then this mysterious death. we have now confirmed that she has been killed through her family, but no confirmation of why or when or how. so in terms of you look at the profile of what isis was doing with the different hostages she doesn't exactly fit with the other scenarios. in terms of the air strikes,

jordan is carrying out air strikes, the u.s. carrying out air strikes, uae carrying out air strikes. there's an intense air strike campaign which jordan believes is effective and which isis is saying is not effective. >> yes. let's talk about also quickly, i've got you here ayman, as well some of the development and that jordanian officials tell nbc news thousands of troops have moved to jordan's border with iraq also united arab emirates conducted new air strikes richard mentioned as well, and you have another detail that people have not talked a lot about today, but the syrian president assad saying he's been receiving information on air strikes against isis from iraqis and others. >> and i think the overall big picture is you ignore the syrian conflict at your own peril. there has been a shift away from it in the last several months and as a result of that the isis situation has now totally blown up so to speak. yes, you're absolutely right, in

the last 24 hours, confirmation from united arab emirates since they stopped and suspended flight operations in december they have now deployed a squadron of f-16 fighter jets to jordan who resumed fighting carrying out air strikes. jordanian government is sending troops, thousands of troops to the border to beef up some of that border security and perhaps concern there may be some retaliation or attempt by isis to infiltrate jordan to carry out would be attacks. i think as you mention president assad is watching this unfold and saying we are ready to be a partner, trying to use the situation as it unfolds to try to show that he is the only way forward to end isis that if the international community rallied behind him, they could try to take the fight to isis. this is a point he has been trying to make to his advantage, which is isis poses a threat but so many of these countries now fighting isis had for a long time supported isis or these type of groups and were behind this terrorism that has ravaged

syria. >> ayman, thank you very much. richard engel, thank you. the news of kayla mueller's death, comes with president obama about to formally ask congress for authority to use military force against isis. he relied on presidential authority given to president bush after 9/11. kris jansing joins us live. kris, i read a portion of the white house statement from president obama regarding kayla mueller's passing, but we well know this discussion over authority, planned today. what are we expecting next? >> reporter: i think you have to really look at what the impact of this is. certainly when we saw the death of the jordanian pilot it had exactly the opposite effect that isis hoped for. both the united states and folks at the white house and other authorities of countries in the coalition said it only strengthened their resolve. this comes obviously at a time as you say when they are looking to authorize what is essentially this war against isis.

there are three things that we are looking for critically in this authorization. first of all, does it mean boots on the ground. a lot of debate about that. nancy pelosi says it is a nonstarter. others believe given the terror that has been bringing destruction and the spread of it, it needs to be broader, they're going to look at the length of time for the authorization, where it would be used, will it just be in iraq and syria or could it extend to other places as john mccain has said wherever isis goes places like north africa but in the statement released by the white house today, one of the things that was written is no matter how long it takes the united states will find and bring to justice the terrorists who are responsible for kayla's captivity and death. in a couple statements i have seen already from leading members of congress in addition to expressing their sincere condolences and horror they

made statements to that effect as well. this will help inform that debate as it moves forward. could be as early as tomorrow that that authorization goes to the hill. >> thank you very much kris. let me bring in democratic senator ben carter of maryland member of the senate foreign relations committee, standing by. senator, thank you so much for your time. >> pleasure to be with you. thank you. >> i will give you an opportunity if you would like to express your condolences to the mueller family. senator mccain and the white house also expressed their thoughts and prayers to that family. >> kayla's death was tragic our condolences go out to the family. it is another casualty from this barbaric organization isis and our hearts go out to the family. i think it just strengthens our resolve, hope it strengthens international resolve to degrade and destroy isis. >> i know that you believe congress needs to authorize use of force to fight isis. explain more on your stance there, given the air strikes

with jordan the rally to have more arab nations take a harder look, more forceful approach to defeating isis but also knowing that this terror organization has gained power, territory, and traction. >> our objective is to degrade and destroy isis. we want to work with the international community, we need to very much work with our international partners particularly countries in the region that joined us in the fight against this barbaric organization. the president has stated that it will not be boots on the ground. i think most members of congress strongly agree with that that the mission on the ground needs to be carried out by the iraqis who we can train in syria, that's fine but it shouldn't be american troops on the ground. we are providing air support, that's what we need to do and an authorization should specify that authority. congress and the president should be on the same page on authority. also should be limited in time

to give the next administration an opportunity if you need authority to get what authority it needs. >> in a statement released december 9th you said i do not agree with the contingent that either the 2001 or 2002 authorization for use of military force provide a full authorization for the current u.s. military action occurring in iraq and syria. you also went on to say i believe that the solemn task of declaring war rests with congress. it is up to congress to draft the pending correctly, keeping in mind the president has article 2 powers to deal with the unexpected. are we looking at the unexpected here with isis? >> we know the risks and we have a game plan to degrade and destroy. we should provide specific authority to deal with that risk that the president asked for. i think it is a stretch to use a 2001 and 2002 authorization that was for a different circumstance to say that we are authorizing use of force. we should have a use of force resolution passed by congress

that speaks to the current threat. that's what i hope we will do. i think we also need to review that as time goes on so we are not faced a decade from now with an authorization that was passed now that's used by a future administration to justify american troop presence somewhere else in the world. >> you are making the argument and many others while a particular party may have trust in the current president in office the authorization to use military force, the argument may change depending who is in the white house next. >> i think president obama has made a strong case for the u.s. involvement to degrade and destroy isis i think he has the support of congress and support of the american people and we should go on record supporting that but don't want to give an open ended authorization to be used somewhere else for a different circumstance by a different president. >> thank you so much for your time. greatly appreciate it. thank you. we follow breaking news about the death of american kayla mueller confirmed by her family. also following breaking news out of virginia.

died. nbc's keir simmons joins us from jordan's capital of amman. jordan originally after isis claimed kayla was killed in one of the air strikes replied by saying she was not in the building any of the buildings they targeted, now the family says it has confirmation otherwise. >> reporter: well, the family is saying they have confirmation that kayla has died but we wait to hear what they believe, what they think has happened in relation to how she died. i was told by a jordanian air force commander that some days ago where isis said kayla was being held was not where they were bombing, and he described unconfirmed isis claims she had been killed as a result of jordanian air strikes as lies. now, it is also an argument

being made with the jordanians a number of days since the allegation was made by isis they say how can you trust isis that organization, and how could isis know what air force was bombing them in the nature of bombing. you don't necessarily know. it could, for example, have been a syrian air raid so all those things are true there will be a lot of people who will be saying in hours and days to come that whatever the means that kayla died by it is isis that bears responsibility. they were holding her hostage, that organization is responsible for that. and certainly ever since isis made that claim, jordan has continued to launch air strikes. now united arab emirates today launched its own air strikes against isis and so they have continued to put on the pressure. there will be though tamron a sense of shared pain because

this country has been grieving over the horrific death of their air force pilot, burned to death by isis. they will be really heartbroken to see another person killed by that organization. >> "the washington post" is reporting that the united states confirmed kayla's death and that according to the information they have that a picture of her body was sent to her family. the u.s. officials are still unsure how she died as we just discussed, jordanian officials express their skepticism she was killed in an air strike. the u.s. official saying they cannot confirm cause of death or when she died but the family did receive that message from her captors with additional information that the u.s. was able to authenticate. >> reporter: that's right. just remember too, that if you think back to what happened with

the jordanian pilot, isis were negotiate white gold the jordanians to try to get a jihadist failed suicide bomber released from a prison here in exchange for the jordanian pilot, even jordan says those negotiations were happening by isis, even after that pilot had been killed. in other words isis was pretending that the pilot was still alive. the question that you raise there about when did came a die, that will be a very important question because it will be for those officials, those u.s. officials to try to figure that out. they just aren't going to be able to rely on what isis says. >> thank you so much keir simmons in amman, jordan. appreciate it. another developing story we are following escalating same-sex marriage show down. new signals that the supreme court may allow same-sex marriage in all states. this morning, majority of

alabama probate judges are still refusing to issue marriage licenses to gay and lesbian couples. as "the new york times" points out, it is unclear how many are acting in overt defiance how many are reacting to the order from the state's conservative chief justice not to issue licenses. the clash between state and federal government intensified after the supreme court decision yesterday morning cleared the way for same sex couples to begin tying the knot writing his opinion, thomas criticized the court, argued that ruling may well be seen as signal of the court's intended resolution. nbc news justice correspondent pete williams joins us now. pete, let's first talk about what's happening on the ground in alabama where you have the majority of probate judges refusing to give the licenses. >> right most judges that are refusing are in less populated parts of rural alabama. in big cities probate judges responsible for issuing marriage

licenses in alabama are issuing them. lawyers for some same sex couples are going to the same federal judge who originally struck down the state's ban, and asking the judge to hold one of the probate judges in mobile county in contempt or find he is violating the order, order him to issue licenses. if the judge grants that then i think other judges will start to fall in line to realize that they do have to obey the federal court rulings. on the u.s. supreme court question, it was interesting to see this from justice thomas. he thought given the u.s. supreme court decided to hear this case in april, deciding in june, as matter of respect for the states he and justice psychological ee a thought they should put marriages in alabama on hold until the whole thing is decided in june, but the fact that the court would decide to

against the suspect in the death of university of virginia student hannah graham. he was previously charged with abduction with attempt to defile in connection with the death. investigators say matthew is seen on surveillance video with her just before she was abducted last september. in a press conference moments ago, the district attorney wouldn't elaborate on specifics of the investigation, including why capital murder charge was taken off the table, only adding on top of murder matthew faces countless counts of reckless driving. >> these indictments signal the beginning of the next phase in what has been an incredibly difficult process for the family of hannah graham for our community, and for the men and women of the many departments and agencies who have worked on this matter since september of last year. >> last november he pled not guilty to attempted murder and two other felony charges in

unrelated sexual assault case in fair fax county virginia. authorities say he may have to stand trial in the case before he can be tried in graham's murder. also developing now, the city of boston is still at a near stand still as it tries to dig out from the latest snowstorm. mass transit shut down to allow workers to clear out snow and ice from the tracks. the boston mayor, marty walsh, urging residents to stay off the streets so they can plow. the paper reports on growing frustration of the record break snowfall, more than six feet in the last month. frozen reads the boston herald. transit failure, clogged streets push us to the limit. things so desperate, the mayor is considering dumping snow into the harbor only done in absolute emergencies. msnbc's amanda secuma is in

most seniors, house leader nancy pelosi saying look as we strengthen our resolve to bring justice to a brutal regime, we should proudly celebrate kayla jean's generosity of spirit. what i'm interested in tamron we saw the impact that the death of the journalist james foley, had in 2014. it really put the barbaric nature of isis in people's living rooms. you have here a beautiful 26-year-old humanitarian worker doing so much. you're going to get all these members of congress praising her work talking about how important the work she was doing was over there in syria, the humanitarian health work. what type of impact will that have. you saw the death of james foley had impact how isis was viewed in the public. what type of impact will the death of kayla mueller have on this on-going debate which will start in congress about organization of use of military

force against isis. president obama and the white house are planning to send forward that authorization for military force as early as today. many people don't think today, later tomorrow. you see her image and think about that i suspect it will have impact in the sense people realize according to nancy pelosi as we strengthen our resolve to bring justice to a brutal regime, they have to figure out what exactly that means. i believe she will have an impact that goes into this congressional debate. >> we had senator ben car son on earlier, and expressed concern that the democrats may trust the judgment of this administration but not that of the next administration or down the line, and his concern is what doors are opened now that may certainly be decisions regretted later, depending who is calling shots for lack of better description. >> that's going to be the fascinating aspect of this debate is republicans will say hey, president obama we want to

give you all of the authority you think you should have i think majority of republicans, libertarians are against it. democrats want a timetable. we want to know are there boots on the ground, how long would military presence be against isis when exactly would this be over what's the scope of geography. you're going to see fascinating bed fellows in this between libertarian conservatives and progressive liberals. on top of that hawkish democrats and hawkish republicans, and you're getting to the key of it tamron how long would the authorization of military force go forward. is it two or three years or would that be problematic because mitch mcconnell, john boehner said we don't want to show the enemy what we are willing to do so early on we want to have all options on the table. this is the fight that's going to play out. but this plays out after the deaths of james foley, after the death of kayla mueller, after these horrific deaths of the japanese hostages of the jordanian pilot, that's in the forefront of the members' psyche.

how those translate into legislative action, we don't know, but it is going to be fascinating to see over the springtime. >> thank you very much, luke russert, appreciate that update. we have an update on the measles outbreak that continues to spread across the country. the cdc reports the outbreak spread to three more states delaware and new jersey and washington, d.c. that brings the total to at least 121 cases across 17 states, and district of columbia. the vast majority of cases are linked to the outbreak that began at the disneyland in late december. today on capitol hill a senate committee is holding a hearing on the reemergence of measles and other vaccine preventable diseases. joining me from cleveland, pediatrician and child advocate at the rainbow babies and children's hospital. doctor, thank you again for your time. >> good morning. >> what are the critical questions you would like to see from capitol hill today? >> well i don't think that this is a political discussion this

is a public health discussion and what we know is that in 2000 when we said measles was over in the united states we did not see the three to four million cases a year didn't see the 48,000 people hospitalized we did not see the 4 to 500 deaths a year we did not see the 4,000 people with measles encephalitis. we know the vaccine works. the vaccine we are using is the same one since 1968. what's interesting is you have two states that don't allow parents to opt out, west virginia and mississippi. in mississippi, they have 99% immunization rate. they have not had a case of measles since 1992. what else do you need to know? >> you know you say it should not be political, but maybe perhaps on a federal level, you talk state to state laws and requirements, it does make it political. to your point, there are states that allow parents to opt out.

things and what was the background there? >> well i've always had a retail back ground went to school and have a four-year degree and worked in the business for seven years before i got married and had kids and stopped working. so retail has always been a part of my life. fashion has always been a part of my life. one day i just started trying on jeans and couldn't find jeans to fit my body type. i have curves and i'm not like huge and i'm not super skinny. but there was nothing out there in the premium denim world that could fit my body type. it made me depressed. it was hard to find -- >> really? >> it was hard to go in a store and start trying on jeans because it was -- i would walk out with my head down and i work out hard and eat right. now, i've lost another five pounds, i can do it. well what i figured out, it's not necessarily the weight as much as body shape. and these premium denim are for women with really very straight up and down stick bodies.
