was planned before the president delivered his proposal. now if approved the president's plan would limit the military operation to three years and prohibit quote, enduring offensive ground forces. now some democrats argue the proposal is too broad and could lead to another drawn-out military conflict. >> there is no limitation, no statute of limitations on the original 2001 ought sairks and i think that's a key problem. the other major issue is the language pertaining to ground troops very broad and ambiguous. none of us knows what enduring combat offensive operations mean and deliberately drafted i think to be ambiguous. >> and some republicans are skeptical the proposal does not go far enough. >> the first thing that i want to hear from president obama is i want to make sure he's committed to whatever he sets out as the goal. i know he said to degrade and

ultimately defeat isis. i'm not sure what he means by ultimately defeet. i want an authorization that won't hamstring either this president or future presidents, and i also want an authorization that sends a very clear signal to our enemies that we are going to defeat them. i don't want any ambiguity in there whatsoever. >> in his statement yesterday, president obama emphasized the legislation is not an authorization for a ground war. he also stressed combat troops would not be deployed. >> the resolution we've submitted today does not call for the deployment of u.s. ground combat forces to iraq or syria. it is not the authorization of another ground war, like afghanistan or iraq. >> this is the first time in over a decade congress has considered giving a president formal authority for a military operation. along with the president's proposal to consider this afternoon, the senate is expected to vote on a man who would be in charge of the man against isis defense secretary

nominee ash carter. a democratic senator joins us now. congressman, thank you so much for your time. >> great to be with us. >> i believe you agree with your colleague congressman adam schiff, the language of enduring ground offensive combat operations. as i understand that specifically stood out to you, and that's what you have an issue with as well. >> i do. there are actually two issues that adam schiff and i have both agreed on as problematic. one is what you just said. that language is very broad. it would allow significant u.s. ground combat operations. you know in the letter that accompanied the president's draft proposal he mentions two specific instances of what we would want combat operations. one to rescue downed pilots and, second, if we knew there were isil command-and-control folks and we wanted to send in special forces, we agree with that.

we think that that should be allowed, but if you look at the language in the proposed drafted it's much broader than that. it would allow significant u.s. ground combat operations. i know the president says he doesn't intend to do that. but if he doesn't we should narrow the scope of the authority and also this authority extends beyond this presidency, so we need to address that as well as this other issue about the 2001 aumf which would remain indefinitely on the books under the president's current proposal. >> when you say narrow the scope what, language would you be looking for here? >> would i look at language that would authorize the kind of specific actions that the president referred to in his letter without opening the door widely to much larger ground operations. look, the mistake in iraq was by thinking putting hundreds of thousands of american forces on the ground there we were going to somehow transform the

situation in the middle east and i'm very leery about anything that could open the door to the united states getting involved in another ground war in the middle east whether it's iraq or syria, so i support the current operations tamron, that are going on against isil in both iraq and syria, and we can craft a resolution tailored to do that but not at the same time open the door wide to more ground operations. >> to the operations u.s. ambassador samantha jones said there are people on the ground in training and advisory roles. ground troops are necessary but they won't be american ground troops and she says the president has been very clear on that. >> two things, and i support the current mission. we have troops on the ground to provide training and to equip the iraqi and kurdish forces.

we're also providing american air power to go after isil targets in iraq and syria and to support the iraqi and kurdish forces. i'm for all that but what i'm very leery of is opening up this pandora's box, both for the current two years and also beyond this president's term to putting ground forces in and finally, you know this -- the 2001 authorization to use military force which is a very broad writ of authority, like a blank check, that would remain on the books under the president's proposal even though the president himself said that just two years ago that he wanted to revise and ultimately repeal, it so we need to do that as part of this effort. >> but i also want some response regarding criticism from republicans believing that this proposal does not do enough. congressman michael mccall said his biggest concern is that the

authorization does not enhance the president's ability to defeat and destroy isis but restrict it. well. well, i don't see how you can read that in this way because it provides a very broad authority to go after isil and now unless, of course, people wanted to send american ground forces into combat. i don't think that that's a successful strategy. look, if we're going to have a resolution ultimately of the situation in the middle east and we're going to truly degrade and defeat isil we need a political strategy where the iraqi forces and kurdish forces some of the syrian forces like the syrian kurds have the military ability to move on the ground with our support, but the idea that american ground forces are going to go back and take these cities like mosul or other major cities, what do we do then? if the iraqi and kurdish forces are not capable of getting back in those cities they are not going to be capable of holding

those cities so we cannot have a permanent, you know war footing authorization on the books, and i hope every member you know will carefully review this. >> congressman chris van hollen we certainly appreciate it. new revelations this morning about kayla mueller, the 26-year-old american aid worker who was killed while being held hostage by isis. nbc news andrea mitchell confirms they asked the white house to free a convicted isil member but the white house did not negotiate the trade and the white house is disputing reports that kayla was married off to an isis commander saying that is just speculative at this time. the question in eastern ukraine is will the deal reached

overnight hold after a 16-hour meeting. germany warns the deal is not a comprehensive solution but merkel did call it a, quote, glimmer of hope. the cease-fire would not officially go into effect until midnight saturday but even as it was being worked out, ukrainian military officials reported about 50 tanks and dozens of missile systems and armored vehicles crossed into eastern ukraine from russia. nbc's jeff global correspondent bill neely joins us now. bill as i mentioned, merkel called this a glimmer of hope. what other reaction are we hearing at this point? >> yes, less more than a glimmer, 16 hours of what the germans called extremely difficult negotiations. there is a deal but there are doubts about it as well and as you say as that talking was going on ukraine games that 50 tanks, 40 armored personnel

carriers and 40 mile of systems were crossing from russia into ukraine. that has not been confirmed, but it gives you an idea of the combustible nature of this conflict and also of how the two sides are trying to grab ground before the cease-fire comes into effect. the deal and key points of it as you say, a cease-fire from sunday morning heavy weapons have to be pulled out from eastern ukraine won two weeks and a commitment no more than that, that all foreign troops should be withdrawn from eastern ukraine. there's been reaction this morning. david cameron, the british primes, was not at those negotiations, but he gave his reaction in brussels this morning. >> if this is a genuine cease-fire that would be welcome and what matters most of all is actions on the ground rather than just words on a piece of paper and i think we should be very clear that vladimir putin needs to know that unless his behavior changes the sanctions we have in place won't be open.

>> so deeds not words says mr. cameron and the germans are also sending a warning saying this is not a comprehensive solution. it's not a breakthrough. there's a lot of work still to be done. tamron? >> all right bill thank you very much. now to that investigation into the murders of three muslim students near the university of north carolina in chapel hill. in about two hours, funerals for the three young victims will be held in raleigh. there's still questions about whether the killings were motivated by hate or as police say by a parking dispute between neighbor. last night thousands of people gathered for a vigil at unc situation to mourn the three students who were killed tuesday at an apartment complex in what's kind as a quiet neighborhood near the university. the family of the victims maintain they were targeted by the suspect craig steven hicks because of their religion. the father of the two women spoke to msnbc's ronan farrow

just a short while ago. >> even though the murderer can say it was a parking dispute. whatever he was talking on he came to the apartment two or three times before the murder on different occasions. my daughter complained and she told us that she felt that man hated them for the way they looked and the muslim garb they wore. >> the suspect's wife said it was over a parking dispute. >> this incident had nothing to do with religion or the victims' faith. >> more now from raleigh where the funeral will take place in a few hours from now. let's talk about at least what we're hearing from police and authorities there. right now you have the u.s. attorney for that district saying based on all the information that their office has received at the time the events of yesterday are not part of a targeted campaign against muslims in north carolina but we're hearing information from

family members of these young victims now so where does this investigation stand? >> the investigation stands, there's a huge question of motive right now which both the family and authorities are disputing and just under two hours, funeral services for the three muslim americans will be held here at the islamic center in raleigh. behind me here is the mosque where the bodies are currently being prepared for burial and then if we go over here here's the alamin school where all three victims reportedly went as children. the school is closed for the day, and then if we go across the street here is the field where the funeral service and the prayers will take place around 1:30. the crowds are expected to be huge, anywhere from 2,000 to 3,000 people and most congregants here are expressing great sadness and just shock over how this could happen to three members in their community. we spoke to one of the brothers

of the victims, and he suggested that this is indeed a hate crime. this is what he had to say last night at the vigil. >> yusor was actually afraid of him. she didn't feel comfortable around him and felt threatened? >> why. >> he had come to the door several times before on certain things like her friends leaving the apartment. he said that they were too loud and woke up his wife and he came and opened up his jacket and showed that he had a gun. >> so as you can imagine, the family is just in terrible dis distress right now. authorities are saying that the preliminary investigation shows that this was a dispute over parking. the family thinks overwise. another vigil is expected tonight here at the state university so we will keep you posted. >> we're also learning at least according to the "new york times," a lot more about the

suspect's pc ground. apparently on his facebook page he had an extreme dislike of all religions at one point suggesting that praying is useless, narcissistic and lazy just like the imaginary god you pray to. according to the "new york times" that was on his facebook page, but it also seems to be just a dislike for hate for religions across the board, even christian conservatives. >> right. on his facebook page he expressed hatred towards a number of groups including christians and muslims alike. muslims weren't targeted specifically, but this is something that islamic groups want both federal and said authorities to look to as well. >> thanks very much for the live report from north carroll and developing now dnc chair debbie wasserman schultz announced democrats have selected philadelphia to host the 2016 democratic national convention. it will be held during the last week of july.

developing now, day two of the murder trial of the man accused of killing former navy s.e.a.l. chris kyle this. picture was tweeted out by our nbc affiliate in dallas. yesterday kyle's widow was the first witness on the stand testifying that when she called chris right before he died, quote, i could tell something was up. he was just quiet. part of her testimony was so emotional it brought some members of the jury to tears. during the opening arguments the defense attorney said kyle and chad littlefield texted each

other during the ride on the way to the gun range worried something was very wrong saying saying, this dude is straight up nuts and littlefield replied he's right behind me watch my six. military slang for watch my back. nbc's charles hadlock joins us how. the texas ranger first on the scene was the first on the stand. >> he's working the jury through the crime scene piece by piece and shell casing by shell casing describing exactly what he found at the shooting range here in erath county texas south of fort worth. the interesting thing is there were probably a dozen guns that the two men were using with eddie ray routh. they also had their own personal firearms on them. the firearms still had the safety on so they did not even use the weapons. they didn't know the danger that eddie ray routh post that had evening. tamron. >> also, as you pointed out,

hearing more from the wife. at least yesterday we heard from thea kyle regarding her sense and her feeling about the sense she got from her husband, that what she picked up from him that there was something awry. >> right. she made a phone call that afternoon to chris crime, and she said on the stand that she could tell something just wasn't right. he was more quiet. >> i think we've lost the audio to charles hadlock, we apologize for that. let me bring in legal analyst lisa green, author of "on your case." let's pick up a little bit what have this tranger is doing. as charles pointed out, he's setting the stage and explaining what he observed when he got there and some of the evidence that was recovered after the two men were killed. >> yeah, i don't know if you had the same reaction i did to the existence of these two guns on these two men who were killed

before they could even draw the weapons, their safeties were still on. i think that's helpful to the prosecution, paints the picture of two good samaritans. if we put aside all the publicity and fame that chris kyle has earned and just look at the good nature the human nature of these two men, it sort of brings in sharp relief the heinousness of the murder which is good for the defense. >> and for the prosecution, you have a veteran as well one who may have suffered from ptsd someone who gave both littlefield and chris kyle a bad feeling. they were supposed to be helping him but even their instincts, at least according to this text indicated something was wrong. they literally commented by text that something was wrong. we can agree he seemed crazy and in colloquial language that day

but the stand legalese for a defense victory here of insanity was always tough and has been toughened up in texas considerably. >> why is it tougher in texas? >> after andrea yates, remember the mother who drowned her children back in a heinous case so the standard is that the person needs to know that what he did was wrong, very tough standard, and what you're going to see in the defense's case is the attempt to bring in all of his life show he's been a troubled man throughout while the prosecution says look at what happened immediately after this murder. he actually confessed and tried to flee and those are both not actions of someone who is insane. >> so the defense will depend on military records and hospital records. in the opening statements we heard the defense attorney say this was a man in the grips of psychosis, a psychosis so severe at point in time that he did not know what he was doing was wrong, but we do know from testimony he did admit to doing something wrong. >> that's right, and i think

appeals court has ordered a hearing on whether there will be a change of venue in the trial of dzhokhar tsarnaev accused boston marathon bomber. let's go to nbc news justice correspondent pete williams for details. we know the jury selection is going on right now. what else can you tell us? >> it is going on and it's going to continue to go on based on this order from the appeals court. three times the lawyers for dzhokhar tsarnaev have tried to get the trial moved. the trial judge has three times said no. a federal appeals court has said no runs but today the first circuit court of appeals said it will not stop jury selection but will hold a hearing on venue issue next nurse. i think it's fair to say tamron, after reading this order over, the chances of getting a venue change are pretty slim. what the appeals court says here is that you can schedule a hearing on a motion at the request of a single judge and the court is 3-1 on whether jury selection should be stopped so

it's probably fair to say it's also 2-1 on whether to change -- 2-1 against changing venue so there's going to be a hearing but it would not appear based on just the four corners of this two-page order, that it's very likely one will be granted. >> in another hearing, i know you're keeping an eye on out of alabama where a federal hearing will be held sometime this afternoon, couples who want the probate court judges to issue same-sex marriage licenses in the state. >> they have gone to the same judge who a couple weeks ago ordered the state to begin granting same-sex marriage licenses and found the state ban unconstitutional and lawyers for some same-sex couples have said to this judge we want you to order one of these -- they are called probate judges in alabama who issues marriage licenses. we want you to issue an order ordering one of these probate judges in mobile count toe start issuing licenses. if the judge grants that request, and would i think the odds of that are pretty high then it's likely that other

russian president vladimir putin announced the deal overnight after a 16-hour meeting with european leadersch the cease-fire would not officially go into effect until midnight saturday, but even as deal was being worked out, ukrainian military officials reported 50 tanks and dozens of missile systems and armored vehicles crossing into eastern ukraine from russia but, again, a new statement now from the white house on this developing news and wisconsin governor scott walker was in london yesterday, part of an effort to bolster his foreign policy credentials ahead of an expected presidential run but speaking at a foreign policy think tank walker declined to offer an opinion regarding the fight against isis or the debate over arming the ukrainian rebels and he also dodged a question on whether he believes in evolution. >> are you comfortable with the idea of evolution? do you believe in it? do you accept it? >> for me i'm going to punt on that one as well. >> no. >> that does you -- >> really? >> that's a question a politician shouldn't be involved in one way or the other. it's one of those where i'm here

to talk about trade, not to pontificate on other issues. i lost evolution of trade in wisconsin. >> well, walker later clarified in a series of tweets riding quote science and faith dictate my belief that we've created by god and i believe faith and science go hand in hand and he said it was unfortunate that they politicized this trade mission. joining me now is political senior editor scott murray. learning over chris christie's mistake, picking up on christie's visit to london as well. seems like all the potential presidential candidates are going to london but when he got caught up regarding vaccines. >> all of a sudden you hear the adage politics stops at the water's edge and that usual will you means when you're a president call candidate or go overseas you shouldn't be criticizing the president of the united states or engaging in that kind of back and forth

politics. i'm not necessarily sure that this means you shouldn't be able to answer any type of political questions either on social policy or things like evolution or even on foreign policy and that's where it did seem scott walker almost overlearned chris christie's lessons. chris christie got in trouble on his own trip to london. got stuck on a question about vaccines and pretty much just kind of put his entire trip on a bad footing. almost like scott walker went on his thing to say i'm going to talk about trade and talk about wisconsin and i'm not going to talk about anything else and, of course, people when they are going to be running for the presidency and someone like scott walker where you're a sitting governor not somebody with a lot of foreign policy experience, people want to know how you would react to foreign situations particularly when the congress is going to be debating on a war authorization against isis. >> an individual running for president and wants to bolster his or her foreign policy credentials. >> it's a very tricky situation and, of course you know

christie and we saw mitt romney in 2012 where sometimes you end up getting into trouble. scott walker almost didn't want to talk about anything how you end up having that balance, that's a very tricky situation and it does show if we are going to be talking about foreign policy, national security issues tamron this presidential election in 2016 of course, you and i don't have a crystal ball on what the issue matrix will end up being, you look at panoply of candidates out there, more of them have a more domestic message than foreign policy or national security-wise. >> and what also stood out to people who heard the dodging of the question and that's what it was regarding evolution, series of tweets that followed. i think it also caught some eyebrows raise some eyebrows. >> for a lot of people, a basically the scientific community. they say evolution or global warming or things like that those are simple answers -- questions to answer. now, of course there are a lot of people both republicans and developments who end up supporting, you know my faith and science go hand in hand

welcome back. the captain of the ""costa concordia"" cruise ship that capsized three years ago killing 32 people was sentenced to 16 years in prison. a three-judge panel found him guilty of manslaughter causing a shipwreck and abandoning passengers on board. nbc's katy tur has more from italy. >> reporter: schettino received 16 years and this was held at a local movie theater instead of a courtroom and the trial theatrics inside matching the venu. standing on stage of a local theater the panel of three judges literally held the high ground as they delivered the captain's fate.

16 years in prison 10 for multiple counts of manslaughter and 5 for causing a shipwreck and 1 for abandoning ship. in the plush red develop set seats below, the prosecution and defense but no schentno. the captain who broke down during a hastily thrown together final plea to the court. was a no show for sentencing. "the concordia" went aground and capsized in italy in 2012 killing 32 people. it took two years for salvagers to upright and haul away the ghostly cruise liner and two-thirds of that time for the trial of the man at its helm. >> i remember moments of it. they come to me in flashes. >> survivors were not satisfied. and others tried to get their own apology.

working with authorities to manage the situation and ensure public health. a high speed police chase came to a dramatic end in dallas on wednesday. a robbery suspect tried to squeeze between two cars as he was running from police but instead of rear ending them both to escalate matters the driver and passenger of one of those cars got out and confronted the suspect which resulted in a brawl in the middle of the intersection. one of those people is a mother of a teenage passenger. >> i was angry you know. i just lost my 4-year-old child on the second day of school and to think that something else would happen to another one of my kids i just can't imagine. >> unbelievable. police quickly arrived to break up the altercation and arrest the suspect. no serious injuries were reported in the accident. an explosion at a chemical plant created a huge toxic cloud

for his game? >> well you know yes, obviously there's a lot of physical things to do. he does need to practice. he does need to work on his swing. he does need to heal up a little bit. on top of it all, he needs to center himself and that's one thing we saw after the scandal a few years ago, that once he lost his focus, he was unable to perform on the course. and so now he needs to get that focus back so he needs to work on himself mentally as well as physically. >> that is the question which is the larger issue, his mental health meaning that spirit that competitive thing that's almost indescribable that he needs to be as fierce as he has or problems with his back and other problems physically zbh. >> exactly. it's half and half. obviously he is turning 40 this year. he's not 28 like he used to be. there's good to be some issue

there. more than that you know there was a point where he -- the momentum was carrying him to win after win after win. and he doesn't have that anymore. so he does need to mentally get in the right place. some of that will be spending time with his mom, with lindsey vonn, whoever he needs to spend time with. >> i'm sure that will help but when you look as i pointed out, you wrote the book tiger, the real story, when you look at his storied career and how competitive he is, what do you think this is doing to him really inside with his confidence? >> well you know the thing about tiger is that a lot of the confidence that we always thought tiger had back in the '90s and in the first few years of his career it was a little bit put on. he came out saying that he had more confidence than he did. so once he lost that a few years ago after the scandal, it's taking him time to get that back. once -- the other thing is that
