i am tamron hall. this is "newsnation." developing now. the fbi opened a preliminary inquiry into the killings of three muslim students in north carolina focusing on whether any federal laws were violated in this case. the fbi says an inquiry is one step short of a full investigation. north carolina police say they do not believe tuesday's killings were a hate crime or motivated by anti-muslim sentiment. they maintain the dispute was over a parking space. today on "morning joe" a doctor whose brother was murdered on tuesday along with his wife and wife's younger sister expressed outrage at how the police investigation has been conducted. >> i have been here since the morning after the shooting and

police have still not reached out to my family. to call it a parking dispute when, in fact no one was parked in even that visitor's parking spot that does not belong to him is outrageous to me and insulting and trivializes their murders. >> yesterday more than 5,000 people attended funeral services for the three students many traveling for hours from other states. so many people showed up at the service that it had to be moved to a large soccer field to accommodate the crowd. joining me senior fellow at the southern poverty law center. thank you for your time. >> pleasure. thanks for having me. >> when you hear the doctor whose brother was murdered say the authorities have not contacted them not reached out to them since the morning after the shooting what concerns you about at least how authorities are investigating what so many are referring to as potential hate crime or should be investigated further. >> well it is hard to criticize

the police from afar you know i am not on the ground following the investigation piece by piece, but it does seem surprising that they have not spoken to the family yet, especially because it is apparently true that there was not an actual dispute that day over the parking space, at least that we know of at least not at the parking space, but you know -- go ahead, i'm sorry. >> i was saying it is often, and we know there's a legal bar and legal questions that need to be determined and asked before something can be designated a hate crime, but we have seen in the past where there's been some reluctance, maybe from the community or investigators, to call something or eventually charge someone with a hate crime. >> well the reality is that it is often very hard to disentangle the motives of a killer like this and in this case there does seem to be a kind of tangled mix of motives.

it seems clear that the man who confessed to the crime was a very angry man, in many disputes with others in the complex as well. but there are also suggestions like his strong atheist anti-religion comments on facebook page that would suggest that maybe a kind of animous, and one of the girls said the neighbor had in fact harassed was angry over their clothing. there's a lot there to look at. >> there's a heartbreaking interview released by north carolina public radio, an interview with one of the victims, yusor abu salha. want to play a little on her view of culture in america, what

she would experience from time to time. >> growing up in america has been such a blessing and, you know, although in some ways i do stand out, such as the hijab i wear, the head covering there are so many ways that i feel so embedded in the fabric that is our culture. that's the beautiful thing here is that it doesn't matter where you come from. there are so many different people, from different backgrounds and religions, but here we are all one. >> she has this feeling of we are all one, this measure of optimism. but we talked to you so many times about the worry from hate crime, whether it be for the color of someone's skin or the religious background and here when you hear this young woman say we're one, but there is concern. you have a #muslimlivesmatter on

social media because there's a fear this could be more. >> yes, i mean it is tragic really heart breaking to hear her speak about america. she sounds so american. look, i mean we are at a moment in which anti-muslim hate crimes are in a sense to be expected. we have had a raft of absolutely horrible news about islamist crimes, the "charlie hebdo" attacks, the murder of kayla mueller by the islamic state, the burning alive of the jordanian pilot in a cage on and on and on the shooting of ma alan a, the teenage activist in pakistan and this morning reports that an islamic center just about to open in houston burned to the ground this very morning. we don't know if it was arson or had anything to do with hatred but it seems likely. we have seen four or five other islamic centers attacked by

journalist austin tice say neither the u.s. government nor do they have any idea where their son is being held by isis. tice former marine was kidnapped two-and-a-half years ago. so far there have been no ransom demands from captors. in an interview with my colleague, andrea mitchell his parents say they're frustrated because they have no idea what, if any progress has been made in finding their son. >> what we really want our government to do is to engage in a dialogue with the syrian government. you know how can we have this fantastic state department and global diplomacy if we are not speaking. how does that work? >> there needs to be someone made accountable directly for the safe return of hostages. >> president obama has ordered review of the u.s. hostage policy, but reiterated earlier this week that the u.s. will not negotiate with terrorists.

now to the dangerously cold weather putting a deep freeze on a large part of this country. temperatures this weekend will be in the single digits from the midwest to the northeast, with wind chill temperatures as low as minus 35 degrees in some places. forecasters say this will be the coldest weather we have seen actually in decades. here is a live look from times square, where it feels like it is 7 degrees now, if that's not bad enough another snowstorm is expected in new england saturday. boston's mayor says crews are working around the clock to clear out snow piled high from three storms in three weeks. the city has gotten two ought mated snow melters from new york city and officials say as a last resort will dump snow into the harbor because they have nowhere else to put it. bill karins has the details, talking to dylan dreyer headed again to boston she said i don't know where they can put

all of this snow if another storm rolls through, and it appears that will be the case. >> yeah they're piling it higher and higher sooner or later can't pile it any higher. this is different from the big blizzard two weeks ago when they had 27" of snow. this one i am more concerned with the wind than the snowfall. i'll explain. to be a blizzard you have to get three straight hours of strong winds and quarter mile or less visibility. we are going to get the winds with this storm from maine to delaware. but the heavy snow will be along the coast, and definitely our friends in maine. that's why they have blizzard watches. as far as potential snow totals go, not talking blockbuster amounts in southern new england, central new england, nine to ten inches typically in the year is a big deal not this year. friends in maine, down east main could get two to three feet. some could end up with seven feet on the ground by the time it is said and done. when they get to the point where national guard is needed to get into some towns by the time we are done a lot of small towns

there in coastal maine. the winds. why are winds more an issue this time, they're more widespread over a large population center. could see 40 to 50 miles per hour gusts as far south as baelts and d.c. 60 to 70 around boston. and along the coast, 70 plus maybe a few hurricane force gusts on the immediate coastal areas. those winds alone, again, not a snow that's sticking to trees, don't have that weight but have dead and dying trees to worry about coming down in winds like this, and worry about pine trees coming down. we are not going to see hundreds of thousands without power when this is done hopefully, i think just scattered power outages, a couple 00 here and there. the wind chill will be so low. we are in an air mass that's cold. it will be worse sunday. wind chills, new york is down to three, we will be in negative territory like we are now on sunday. what do you do. you're with the family you lose power, it is zero degrees

outside, negative wind chill 20 i don't know if your fireplace if you have one can keep up with the temperatures in the house like that. if you do lose power, you have to be prepared to grab stuff and get out of the house. hopefully we won't, but that's a possibility. remember pictures after the last blizzard where the spray was freezing on homes? we are going to see a ton of that, too, large waves sunday areas north of boston and down on the cape we will see plenty of houses covered in ice again. >> awful. thank you very much. you'll keep track of that over the weekend. chilling video and testimony in the trial of eddie ray routh, the man accused of murdering former navy s.e.a.l. chris kyle. police dash cam video shows officers chasing routh in a pickup belonging to kyle the night he and friend chad littlefield were found dead two years ago at a texas gun range. he refused to get out of the vehicle and took off. at one point, a patrol car sped

into the truck, it went on nine minutes before routh stopped. he is seen in the video coming out with his hands up police take him down at that point. a police officer told the jury quote, he said he had taken a couple of souls and had more souls to take. the jury also saw body come ra footage in which routh mention the voodoo and the apocalypse. so what does this video bring to the table here? >> it brings to the table a gift for the defense but not a complete one. you have routh acting strangely, you have officers talking about his babbling yet the prosecution is trying to frame it as odd or possibly a man under the influence of drugs or alcohol. you see the advantage they get, bringing it up first. but of course the defense will turn back to the videotape, to a normal participant, he does seem nuts.

we wouldn't be the only ones to think that after all, the victims felt that way, too. >> some things could be heard because the body cam was recording, this brings up a lot of questions about his state of mind in which he says everything was just happening so fast i don't know if i'm going insane he can be heard telling the police officer in the driveway. the prosecutor acknowledged that routh made some kind of quote odd statements in that taped conversation. >> look of course, odd is a word that doesn't mean insane. on the other hand the defendant can't self diagnose as legally insane for purpose of his defense, all of the action focuses on the experts. we are going to hear a parade of experts talk about legal definition of insanity whether routh knew right from wrong. that's the key, much more powerful than what we heard on tape. >> the prosecution pointed out routh went to a fast food restaurant shortly after the shooting. if he was mentally unstable, why

capehart. you have been hard at work writing a column on this. what's your first take here? >> it was an incredible speech. i put it up there in terms of its power and its importance up there with president obama, then candidate obama's speech on race in philadelphia in 2008 with attorney general eric holder's speech february 2009 six years ago next week when he called us a nation of cowards. it was that powerful that strong, that nuanced. holding up the mirror to both law enforcement in unsparing ways, but also to us as a nation and the african-american community in particular. >> so there have been some people on social media who say you and others may see this as a powerful speech because he is white, that eric holder giving that speech or president obama the same words, people would see it as yes, very powerful the world's most powerful leader but both african-american men. >> well right. and i make that point in my

change can he facilitate? >> i think one, just by acknowledging that i think will be music to a lot of people's ears, to finally hear someone, a chief among law enforcement officers acknowledging the fact that law enforcement has a checkered past when it comes to dealing with as the director said unfavored groups. in his speech director comey calls for the police departments around the country to start collecting data on police shootings, and that he was surprised when he could not get any data whatsoever in the wake of the michael brown shooting on how many civilians have been shot and or killed by police. so he used a good chunk of his speech to talk about that and to bring that up. tamron there was another part of that speech that was also music to my others and i hope to other african americans, particularly african-american men, when he called on law

resolution of which the president says he has the authority to act now, that that does not sunset. we would like a provision within the request by the president to sunset in three years, that everything sunsets, and look at everything and make determination based on what's happening on the ground and not give the future president a blank check. we want to make sure whoever the president is has to come to congress debate the information. also we want to make sure there's more clarity on the fact that there will not be sustained ground troops on the ground that the president should have i think the utilization of special operators and special forces. that's important. but we don't want sustained ground troop where you send hundreds of thousands of troops and engage in the kind of war we

were in over the last 10 15 years in afghanistan and iraq. >> when you look at the language, the president said it makes it clear as well as some key advisers u.n. ambassador samantha power was on yesterday morning saying it is clear language that there was not be mass number of u.s. boots on the ground, that boots on the ground are needed but they do not expect them nor do they intend for them to be u.s. troops. so why is it that the language in this proposal and the clear language the president says he is presenting is not enough for you and some of your colleagues. >> there's some words. i think one of the things some of the benefit of the doubt, a number of us will sit down with his legal counsel to see it is in the language happy to be a lawyer, every word means something. there are certain words that mean something to me, may mean something to someone else differently. so we have to talk that out.

the hardest vote for a member of congress is when you go to vote and you may have someone's son or daughter on the line where they could lose their lives. to me i have to dot every i and cross every t. i understand this to me is a very different resolution than what took place in 2001. clearly in 2001 saddam hussein, weapons of mass destruction, i was not convinced there was anything there. here there is a threat by isil to the united states. we have to know what we are doing, i think dotting is, crossing ts. >> quickly, we have a new nbc news marist poll says 54% of americans want their representative to vote in favor of the president's request. it included majority of democrats, republicans, and independents in this split on whether or not they have confidence in the strategy. 45% say they have a great deal or good amount of confidence 48% have little to no confidence. again, this is just a snapshot

welcome back. the u.s. army agreed to pay for hormone therapy for chelsea manning. manning formerly known as bradley is a soldier serving 35 years for leaking classified documents to wikileaks website, after sentencing in 2013 manning revealed she's a transgender female was later clinically diagnosed last year. she sued the federal government claiming she was denied medically necessary treatment. the last week the commandant of fort leavenworth where manning is serving time approved the treatment. this is a first for the u.s. army. demonstrators in pasco, washington vowing to hit the streets every night to protest an officer involved shooting. and getting ready for a big protest outside city hall tomorrow afternoon.

tuesday three officers shot and killed a 35-year-old after he allegedly threw rocks at them and passing cars. witnesses caught the shooting on camera. nbc's halle jackson has the latest from pasco. >> reporter: we learned the fbi is monitoring the situation in pasco where overnight a few more signs were placed at the memorial at the site of the shooting. all of this sparked angry protests already with more on the way. first, gunshots then the chase, caught on camera by a witness who posted the video online. you can see pasco police running after a man who raises his arms above his head, then turns around. that's when three officers opened fire a second time killing antonio montez. >> anybody down loads it on youtube, they'll see it. that it wasn't justified. >> reporter: police point to moments before the video begins when they say montez was throwing rocks at cars hitting

two officers and ignoring commands to surrender, even after being tasered. the chief promises a full investigation. >> we are not here trying to cover anything up we are trying to get the right information out. the public deserves that. >> reporter: they are meeting with protesters to prepare for hundreds expected to be here saturday. the second demonstration since tuesday's shooting which the state aclu calls very disturbing. >> we have a situation here out west in this little town that doesn't justify a scene like that. you don't have to go as far as they did. >> reporter: it is the fourth deadly officer involved shooting in six months in this small farming town where montez was arrested last year for trying to grab a policeman's gun. experts warn even with the video, investigation into the use of force may not be easy. >> when i look at a flat one dimensional picture, i am acutely aware that reality may

>> yes. >> the pressure? >> yes. the nervousness. i think i was more nervous for rethrough on wednesday more than the show itself. >> why? >> i knew by saturday i knew the material i knew we would have cue cards while they would be there, and so the lines were there. it was no way to mess up. but on wednesday for read through was the first time your sketch would be read in front of people, and so for me that was the most nervous i would be i was hoping -- it was the first time people would see what i had be writing the night before. so yeah that was more -- i was more nerve racked then. >> we love you. >> and would i drink to get through it. >> courvoisier. >> of course. >> you smell so good. somebody gave him hand sanitizer, every time you waft your hands, i am distracted by what you're saying i smell flowers and whatever else. >> i have to get some of this. >> he said i didn't want my
