calling the blos inexcusable but urging the jury to keep an open mind saying his older brother was the master mind of the attack. he pulled zo car into his passion and plan. >> this is his relationship with his brother. >> they said he believed he was a soldier in a holly war against americans and telling the jury as he planted a homemade bomb he pretended to be a spectator but he has murder in his heart. of the first six witnesses called four were bombing survivors including an amputee who said i thought that was the day i would die, then cried as she remembered her friend who did. >> tsarnaev stared straight ahead. his legal team chose not to kroex any of the survivors that took the stand.

>> it would seem the defense is more focussed on the penalty phase and historically it would seem the numbers are in their favor. only 3 federal defendants have been put to death. >> thank you to much for that report. hillary clinton is breaking her silence about the explosive report on her use of prooifrt e-mail accounts when she was secretary of state. last night she tweeted i want the public to see my e-mail. i asked state to release them. they said they will review them for release as soon as possible. her tweet comes hours after the house foreign affairs committee subpoenaed her e-mails related to benghazi and two days since the report came out. "the washington post" editorial board says she made a deliberate decision to shield her messages from scrutiny and it reflects the control and secrecy that she has exhibited before.

i imagine there's millions of teachers and students that get the day off today across the countries. temperatures tell the story. it's 76 in atlanta. 40 degrees colder in nashville as the air moves in and collides with what was rain and now has changed to freezing rain and sleet in many areas. the worst of it is going to be in areas of arkansas. the 3 inches of snow in dallas the most snow in five years. history snow. as far as arkansas goes you have the snow up to memphis and now we're watching areas of kentucky starting to improve a

little bit. northern kentucky all night long. shifting to the south now. still watching the snow start to pick up outside of philadelphia. there's one big city in the east with big snow. they could end up with 6-10 inches by the time it's all said and done. a lot of this has already fallen. now a couple additional inches in memphis and nashville. in the east getting away with some of the morning commute without too much snoech. new york city still increasing during the morning rush hour but midday into the early afternoon is when the heaviest snows will fall in here and it looks like a good 3-6 inches. isolated spots a little more than that. >> the last round, right? >> the forecast next week looks quiet and warmer. >> in california a dramatic fire rescue caught on tape. come on. there you go.

brewing scandal? >> well first of all, their normal reaction to just any of the controversies that have come up over the decades. we're talking about the clintons is to basically just sort of circle the wagons and then decide after, very legally parsen a response to come up with a response and this is typical. she's saying the state department has 50,000 plus of her e-mails but these are e-mails she had kept on her secret account and she was the one and her aids who decided which state department e-mails would be turned over to the state department in the first place, so now she's saying the ones they've already done can be released but the question is what is it they decided not to turn over to the state department and their aids aren't talking about the criteria they used. >> yesterday they subpoenaed her e-mails. is this a hunt into benghazi.
