today. this news comes after the justice department announced it would not pursue federal civil rights charges against ferguson police officer darren wilson in the death of michael brown. in november a grand jury chose not to indict wilson. a second justice department report concluded the ferguson police department routinely engaged in racially based practices. let me bring in michael eric dyson and an msnbc national reporter. what is the latest here? how do we read this? my quick take on this is this. it forced the hand of the locals down in ferguson missouri. i don't think this would have ever happened had the justice department not gotten involved in this. and this is has changed, but not changed from within.

it is forces from the outside coming in and making this happen. what's the latest? >> that's right. i spoke to a number of people down on the ground including a number of elected officials who said the only reason this happened is because the department of justice exposed this last week. the fish rots from the head down. the police chief has now resigned. they're calling for the resignation of the mayor, a trifecta of the city's leadership. without the department of justice pulling the curtain back, we saw from the reporter how -- report how rotten things had been. until you really shake loose the culture that has infested this place for years, you won't have real change. >> if this doesn't happen i

don't know how you change anything else. what do you make of that? >> i have to agree. the department of justice's report was a damning won. it was systemic. you had racist e-mails and the ignoring of those e-mails by people at the top. you have the perpetuation of a culture of intimidation at the hands of african people. you have the inequality of the poor versus those who were better off. when you put all that together of course the police chief has to resign. of course the city manager has to resign. and quite frankly, it would be good if the mayor himself resigned and didn't see himself as outside of this system. he is responsible for what goes on in that city and he has

turned a deaf ear, so to speak, to this whole proceeding and he can't pretend he is somehow above the fray. i think that department of justice report is so necessary and so vital. ed, you said something that's very important. no, the change won't happen from within. it always has to be forced and encouraged. as a result of that those changes take applies.place. >> i think it is very profound. where's the governor of missouri? where's the state legislature? where are the state leaders? it's almost as if it didn't happen. had the justice department not done this we wouldn't be talking about this right now. when you say all politics is local, the politics in missouri would have stayed the same. >> that's right. >> had it not been for eric holder. >> it illuminates some of the issues here. in april, there are municipal

elections in ferguson. three city council seats are up including two areas of the city that have been bombarded with tear gas and where michael brown was killed. there are legislators introducing legislation clearly born from the unrest in ferguson. until we figure out what the department of justice is going to do as they hash out negotiations with the city will the city walk wholeheartedly and in full faith? we will see. the federal monitor, if that happens, if there are these benchmarks, we're going to see a massive shakeup of this culture. months ago there were rumors that there had been back room conversations about dismantleing the entire police department and handing over power to the county

police. locals say the county police are no better but at least they have to answer to the circuit court and not the municipal court like the local police have to. >> doesn't this start with some sort of social engineering project to get into the communities communities, to give them a voice, to break up the sections where every neighborhood feels some kind of representation and then to coordinate that with the police department and the communication has to be things are going to be different, this is how we're going to police your community -- from friends i have in law enforcement, this is the only formula that is going to work in a situation like this. what would you suggest? >> that's an excellent suggestion. there has to be a way in which the voices of the people are heard. what we have forgotten is the

police are to serve the people. there's been a mass occupation of ferguson by the police department. those people have been living under tieryranny and apartheid. we have to expose those police people who afterall don't grow up on mars. they grew up in the same cities and the same culture that inherits the bigtriotry of others. >> this would be the perfect time for the federal government to follow up with a massive jobs program in ferguson. i have heard a number of elected officials talk about how there is a high unemployment rate

among black youth in ferguson. if you occupy somebody's time and you give them a job and they have some money, their life can turn around. it would seem to me there has to be some kind of new model here if these changes are going to mean something other than just personnel changes. what do you make of it? >> that's right. you have to look at education. now of the two unaccredited school districts in the entire state, you're looking at you know, one that includes ferguson and also the kansas city school district. these kids out there, many who you would see out there late and night, who are disaffected if so many ways who don't have access to quality health care this is who you are dealing with. do these kids have a ladder out? do they have prospects at all?

this is what creates this perfect storm we saw explode after michael brown's death. >> if you don't do it in ferguson, where are you going to do it? if you're not going to try to rebuild this community, are you going to go? the country is focused on what has unfolded in ferguson. to start anew with everybody's attention i think is very important. i'll give you the last word. >> i absolutely agree with you, and this is where we have to see -- though the president said this is not made up but it is an aberration. it's much for systemic than people have been willing to acknowledge. it can't bring charges against darren wilson but it can bring a battalion of resources on that city to change its future. >> it's very clear the residents of ferguson in the minority community, they have gotten what they wanted. they got some intervention from the feds.

they got an investigation. they got a real calculation about the way things are and now there's some change, and now i think it is up to the community. those people who live on avenues and streets who care about their future to stand up for change and do something. this is a story to watch. >> until police stop killing unarmed black men -- they have to stop being murdered unfairly. >> i'll give you this one. what about disarming the police? what about just having them carry night sticks and the authority to arrest? it would take a brave person to do something like that but if you really want -- there are places on the face of this earth where there are police officers who don't carry firearms. >> absolutely. >> i know the right wing is going to think i'm crazy for

state department. they're attempting to force the release of e-mails and documents related to hillary clinton while she was secretary of state. the lawsuit comes after several requests filed under the freedom of information act. the news comes just one day after hillary clinton's press conference on her private e-mail server. republicans are still jumping all over hillary on this. i must be a clinton cheerleader all of a sudden. i thought she cleared the air yesterday. i thought she answered all the relevant questions that were pertinent to the issue of her personal e-mail. you might not think that as a liberal or conservative critic. that's just me. here is the chairman of the house select committee on benghazi earlier today. >> i'm not sure how setting up

your own private server is more convenient than an intern adding an e-mail account to your smart phone. she said we went through the documents. i have no idea who "we" is. >> so what do we have here? we have an issue of trust. do the american people want to trust hillary clinton? and i'm talking to democrats now and liberals. do you want to trust hillary clinton? you may or may not want to. do you want to trust trey gowdy? do you want to trust a right wing tea party zealot? bill clinton on the campaign trail is very effective. bill clinton, i think, showed a lot of people how to campaign for somebody else when he helped barack obama get re-elected in

2012. this is about across the board destroy the clintons. that's how i see it but trey gowdy. why should we trust him? do you think trey gowdy would do himself any political favors if he were to one to go down in history as the tea partier from the south who was willing to exonerate hillary clinton from absolutely any wrong doing? do you think he would have any good political standing with republicans if he did that? the answer to that is hell no. >> i think it is imminently reasonable to ask someone to turn it to a neutral third party. turn it over to a retired judge, an inspector general, so we can have some assurance that the "we" that separated the public from the private did a good job. >> who is going to select this person, mr. gowdy?

you? the right wing? a think tank? you mean to tell me the clintons are just average citizens. they don't have any global impact whatsoever. gowdy and the republicans would never be satisfied. can you imagine that gowdy would come out saying he looked over the server and nothing was found on it? the right wing would manufacture it. republicans are klooking for dirt wherever they can simply find it. we have rand paul trying to elevate his visibility also weighing in on hillary clinton's press conference today. >> i don't think convenience should trump national security. she has also admitted in other interviews she has an iphone an a blackberry so she does carry two devices. the fact she didn't obey the rules on putting her e-mails on

a government server i'm not sure that can be trusted since we can't trust her to do the right thing the first time. >> we just can't trust hillary to do anything right, can we? she's been the first lady. she's been a united states senator. she's been secretary of state. i know how she got those jobs, but we just can't trust her. but we can trust rand paul who has some civil rights issues reported previously. if there's no security breach and the country has not been hurt by this what's the mission? tell me what the law is that she broke. hillary clinton was very clear. her private server was secure and had not been breached. that's not good enough either, is it? i still think the biggest issue is security. hillary clinton has not broken any laws. there's a big difference between a rule and a law. this attack on the clintons has

the scuttlebutt in the hallway? are they satisfied with what they heard from hillary clinton yesterday? >> we're not talking about that because we all know this is politics. we're talking about why it is we can't get anything done many the senate and why 47 republicans did the unthinkable and embolden the right wing hard liners by sending that letter. we know what's happening here. you said it in the best way possible, but you left one thing out. the republicans are obsessed with our president. they are out to get him and make sure he doesn't have a legacy. as we see this economy really booming and the fight against isil going better all they want to do is hurt him and they are now turning their attention to the person they fear the most in 2016 hillary clinton. she has and is no doubt about it

followed the rules, followed the law. i find it interesting the republican party is turning into the e-mail police. at some point the american people are going to get scared of that. i want to know rand paul -- he's a friend of mine. he's a colleague of mine. we sit on the foreign relations committee. chairman gowdy, he's the head of a very important committee. he, rand paul, myself, we all sat in highly classified meetings. did they ever write a classified e-mail to someone? why don't they turn over their personal service? this whole thing is unbelievable. they're going after hillary clinton because they know she's exciting the public and we have just got to get past this because you could talk all day. i'm not interested to know as much as i love to know about hillary's grandchild how many times the grandchild ate in a

day and all the rest of the things i know she must have been communicating with chelsea. this is ridiculous. >> i take it you think she should not turn over her server in any circumstances. >> i would not support any candidate running for public office to turn over their personal e-mails because they have to protect privacy and their families. i just can't even believe that this is -- if she did it i would be so unhappy. the fact of the matter is chairman gowdy is not turning over his personal e-mails. i don't care what he writes his family. i don't know what rand paul writes on his personal e-mail or ted cruz or jeb bush. jeb bush handled his e-mails the exact same way as hillary clinton. where is one press person questioning the fact that jeb bush destroyed e-mails that had

got this server? >> that would have a political field day. the odds of them getting it are very slim. hillary clinton has already turned over thousands and thousands of pages of documents that might relate to benghazi. it is a house select committee on benghazi. he wants anything to do with that. he's already gotten all these documents. he knew months ago there were also these other e-mails. it is highly unlikely a judge will force her to turn over these e-mails to the press. this is the point that keeps getting missed. this these e-mails of what goes on inside of government aren't released for decades until people's government service is over. what is the compelling need to have them released right now?

as the press would i like to see them? of course. but the public need to turn it over doesn't exist. >> the hurdle for her right now seems to be the national media. >> when you compare it to the economy, immigration, isis education, and all that i don't think it is going to sway voters one way or the other. ed i usually agree with you. i usually agree with my friend john alter. i do think this is a serious matter. i do think hillary clinton did something that wasn't right. i agree with that. >> good. >> she took e-mails that were really the property in theory of the public of the federal government, and she decided which ones to give back. i'm not saying she hid anything destroyed anything deleted anything, but i understand why

people on the right wing conspiratorial side of the coin will keep saying -- and they have the basis to keep saying how do we know? how do we know? how do we know? because hillary clinton tainted the chain of custody here. no matter what she says whether barbara boxer trusts her or not, there will always be an element of doubt because the e-mails on the server were not handled appropriately. >> what are the big issues here? for me security. that is the big issue here. confidentiality is also big. i don't think it is against the law to delete e-mails. >> i'm not saying it is against the law to delete e-mails. as a journalist and historian, records have to be preserved.

it has to be preserved in a way that's independent. >> you are not convinced they are? >> they were on a server that is monitored by people outside of government. >> i agree with david. i agree she made a mistake in not having separate e-mail accounts for personal business. >> she admitted that. >> her judgment has been called into question in this. i don't believe in a way that would violate the law or even violate any conscious or anything like that. this being a long-term political issue is ridiculous. it will become a republican talking point. by next week we'll be on to something else. what david is indicating and where i would agree is there are issues here -- it is a warning sign that hillary clinton believes she doesn't have to play by the same rules as other people. that's troublesome, but not disqualifying for her.

suspicious of an administration that is so intent on keeping the elected representatives of the american people out of this deal. there's only one conclusion you could reach, which is the intends to make a bad deal. >> welcome back to "the ed show." we have seen this movie before haven't we? a fringe group of republicans has a self-inflicted disaster. former florida governor jeb bush in 2016 gop frontrunner followed the script to a "t." he claimed the 47 senators were just reacting to reports of a bad deal. bush said they would not have been put in this position in the administration consulted with them regularly rather than ignoring them input. republicans have been called traitors for undercutting the

president. it is bad for the gop brand, so they're coming out of the wood work big time to deflect the became. even senator jeff flay one of the few responsible republicans who did not sign the letter managed to slip the president some of the blame. >> i just didn't think it was productive during this time when there are very tough negotiations going on. they are tough enough without introducing this element. when the president says i'm going to veto everything you do he doesn't foster much cooperation. >> joining me now is senator coons of delaware. what do you make of the republicans playing the blame game on the president, trying to reverse this after taking so much criticism? >> shifting the blame isn't a constructive path forward. the 47 republican senators who sent a letter directly to the ie

ya government of iran were not acting in america's best interests. secretary carter and chairman of the joint chiefs joined secretary kerry as we had a very somber conversation about the costs of war in front of us. as you said just a few minutes ago, we're mourning the loss of 11 members of our armed forces who were killed in a training accident. it is a reminder of the very real human cost of conflict. it is not an appropriate time for us to be turning this into a partisan bickering fight. it is an unfortunate distraction from the very real and important issues in front of us. whether we should be authorizing the president to continue the war against isis and whether we should be preparing for a strong

deal if these nuclear negotiations resolve appropriately. >> hillary clinton tweeted out the letter undermines american leadership and nobody running for commander and chief should sign on. >> what secretary of state hillary clinton said today re reflected what biden said today. they both said that the president relies on the power to reach executive agreements hundreds every year to protect our troops to engage in commerce. as secretary clinton is pointing out, anyone who hopes to be commander and chief shouldn't be signing on to a letter like this shouldn't be that undermines the president of

the united states. it is just not responsible. >> if you listen to the republicans and the guy that started all this senator cotton, he thinks he's saving the country from such a horrific deal. that may be unprecedented in the way they have done this but it is so bad and so dangerous they just had to do it. what about that? >> well look there are many of us who have real concerns about iran, who don't trust iran who think their efforts to get a nuclear weapon pose a real threat to the region to israel to the united states but if you have policy disagreements with our president, as senator cotton and others do the place for that is the well of the senate. you should write op-eds give speeches, but to write directly to the head of state of a foreign government in a way that was constitutional inaccurate and somewhat condescending is not constructive in this

environment. we really need to focus on the issues right in front of us. one thing i raised in the hear today, in addition to the human costs of war is the fiscal costs of war. we can't be barrelling forward towards expanding the conflict with isis with no plan of how to pay for it. i'm going to introduce an amendment to calls on congress to have a clear plan of how we would pay for this war on isis. >> senator, give us a number if you can, quickly. >> it is proposed to be billions of dollars a year. like the afghanistan conflict i don't think we know at the outset how long it may go and how much it may cost and we should be prepared to pay for it. >> accuracy in numbers in war has never gone together. joining me now is rabbi, who is the founder of this world the values network. great to have you with us

this letter is completely unorthodox. who is the evil party here? is it congress? is it the republicans? is it benjamin netanyahu? or the iranian government? he tweeted that israel will be wiped off the face of the earth. he is identifying america has a great satan. these are distractions. how else are you supposed to be heard when it comes to an administration who threatens a veto? they're going to leave iran with a significant nuclear infrastructure. this is a country we would not buy a used car from. >> you think the letter was necessary? i don't want to put words in your mouth, but was it necessary? >> i think that president obama has to get the message somehow that a large number of educated and informed people believe this

and finally tonight, this is the story for the folks who take a shower after work. one of my next guests thinks he's found a way to finally get congress to invest in america's infrastructure. put the ttp on hold until they take action. they sent a letter urging them to use the trans pacific bill. the highway trust fund is set to expire on may 31st. america's roads, bridges and highways, as we all know are crumbling. the letter points out, india and china spend 7 to 9% of their gdp on infrastructure. the united states only spent about 2%. the ttp is controversial. i think it's a bad deal.

investing in our infrastructure should be a no-brainer. is there any way to mix the two or should they be separate? joining me is larry cohen, also with us tonight, congressman tim ryan of ohio. congressman, you first. a for effort trying to come up with a solution to get things done in america. but if we connect these two, what does it mean for the long haul? >> i'm not saying you have to connect them. i'm saying put the trade deal on hold because you're going to lose any leverage you possibly have. the corporate interests want the trade deals but they also want a transportation bill. tell the republicans, tell the corporate guys who want this trade deal you're not even going to touch it until there is a fully funded robust long-term transportation bill that is going to put people back to work. and i'm not saying i'm going to vote for the trade deal either because more than likely i am not. but i want to communicate directly to the president and

say, you're going to use any leverage to get any other piece of legislation for the rest of your term once you pass the trade deal make them fund the transportation bill, get our building trade folks back to work our laborers construction people get them back to work. the other thing they are talking about is a trade adjustment assistance. those people can qualify for trade adjustment assistance. let's get people back to work before we lose any leverage to have that happen. >> mr. cohen, what do you think of this proposal this tactic? what about it? >> i think it's exactly right. i think if there's any possibility for working with the republican majority in the house and senate this is it. this does create jobs. it creates high-paying jobs so it has a multiplier effect and includes mass transit support which is key for those of us caring about the environment. it's surface transit.

it's exactly the right play and we applaud the four members of congress for doing it. >> but it sounds like okay if you do infrastructure then we'll rubber stamp the ttp. that's where it gets dangerous. or am i misreading it? >> i think you're slightly misreading it ed. that's not my intention at all. you get a certain amount of democrats and most republicans that vote for it and it normally passes. all i'm saying is if we're going to fight as hard as we can to stop it i'm whipping votes against it. right now currently with rosa delora and others the president is ush approximating forward and saying, i'm not going to do it bring me a transportation bill and when you do that i'll talk to you about the ttp. >> there's a lot of noise being circulated around all of the unions on board with the ttp. on tuesday, the afl-cio

president richard trumpket said if they vote for ttp it will be used against them in the election. what does that mean and does it have teeth? >> it does have teeth. as a vice president, this is the first time that every union, all of the fast track and, secondly there will be no fundraising done until fast track is defeated. i think it does have teeth. i think we have to keep sounding that theme to make sure the teeth is real and i applaud rich trumka and all of us for uniting in this way in which would be a devastating blow to america's union or not union. >> and mr. ryan how does that receive you? how do you receive that as a member of congress? now it seems to me that the unions are making a very strong

statement here. i think it's very clear you can draw a line between winning and losing when it comes to their support. >> yeah, no doubt about it. i feel okay about it because i'm 99.9% sure i'm going to be with them. i haven't seen many trade deals i like many in yourp where they have high-standard working standards and regulations that would even the playing field up. but the unions do a pretty good job of making sure they communicate to us what they want and fortunately i'm with them on these issues so i'm not going to be too concerned about it myself but i think it's showing that working families and the unions in this country are tired of getting slapped around and tired of being, you know for somehow all of the economic problems in our country are the union's fault, whether it's the teachers union or private sector we blame the working-class people trying to earn a wage for them and their family and i think
