redia lynch start he new job. but first rob durst appeared before a judge one day after a stunning new development. it is monday march 16th. this is "now." "killed them all" that's what he said in the bombshell season finale of hbo's "the jinx." durst, who has been linked to two murders and one disappearance over the past few decades was arrested on murder charges for one of those cases, the death of his longtime friend susan berman 15 years ago. his lawyers today made a brief statement. >> bob durst didn't kill season berman he's ready to end all the rumor and speculation and have a fry. >> following the mistieries disappearance of his wife he's been estranged from his family

traveled across the country, at one time posing as a mute woman and has been arrested for a number of crimes. he was later acquitted of murder in that texas trial. in the final episodes of "the jinx" was revealed. in one of the most disturbing few minutes of television history, this was what mr. durst is caught saying on tape as he went to the bathroom after being confronted with that new evidence.

joining me now from new orleans is hannah raply. what was he like in court? >> most of the time he just sort of had a blank expression on his face. he was held apart in a separate holding room that was protected by glass. he would stare off into face and blink, occasionally look around at the small courtroom, which was packed with media. but at one point as he was waiting to face the judge, he suddenly broke out into a grin a very quick grin full teeth. he looked very frail. at one point he defense attorney said that he had recently undergone neurosurgery and was denied his pain medication in jail. he seemed frail, shackled in a

plat and orange jumpsuit. >> is he going to be extradited to los angeles? we know there was some back-and-forth, maybe new orleans wanted to charge him with something at some point. what is the latest on that? >> reporter: right. we are -- law enforcement sources have told nbc news that it's very unlikely durst will leave new orleans today. it's likely he will be charged with something in new orleans, but we don't know what the charges will be. >> hannah thanks for the update. joining me is host of msnbc's "all in" chris hayes. >> the media circus and also the incredibly chilling details, right, chris? i was watching this. my jaw was on the floor after that recording plays and it was the end of the series. >> honestly one of the most remarkable moments of television i have ever seen.

battle over admiskt. these are very good lawyers, as we learned in texas. still no forensic evidence linking robert durst to susan berman. >> well not yet. >> right, they may have collected dna and other types of crime scene evidence that will now be retested. >> on that note the last trial was in early 200. has the technology around dna evidence and -- how much of that has advanced in the last 14 years? >> i think quite a bit, because before back in 200 or 2003 maybe we could only say a certain amount could be connected to one person or exclude one of person but now we can say it's a mixture or not enough to test a certain item or amount of bodily fluid. >> i want to talk about the other piece of evidence. the handwriting samples, this is

a moment in the documentary when robert durst is confronted with two pieces of writing that look to be identical, and could be both his. >> say -- so beverly spelled the same way? >> same misspelling. >> what does that say to you? >> the writing looked similar and the spelling is the same about you i can see the conclusion that the cops went for. the writing exemplar would prove they were both written by the same person. >> he talks about the fact whatever that bathroom confessional, he purposes in the middle of this the purposing, almost self-punishing, right? >> it's almost like -- i was thinking i have watched that scene a dozen times.

if you were scripting a series and you had the person making this motion like if you had the actor sitting at the table doing the scene and the way he played it was to go like that, as they were saying the thing, you could say tone it down bring it down. >> in court, he's smiling and he goes back. that's all formulaic. >> does that piece of tape get played in court? >> there's a huge question now that we're going to see play out. we had the film makers booked for our show tonight. we had booked that three, four days ago, i was excited about it. they canceled. they canceled "the tonight show" they canceled every bit of press after some media this morning, and they're saying because they may be called to testify. everything around this series will be legally contested by

some of the best-paid, most aggressive lawyers in the world, right? everybody around the means by which they acquired the evidence, the chain of custody, all of that will be -- >> just to be clear, my producers for the docket the online show they got a press release from hbo that they wanted to do press and they were reaching out to everything to come on the show. same thing happened they just stopped sporchd ingresponding. >> they knew in the documentary that -- is going to come out in legal procedures is what -- when did they know what they knew? when did they talk to authorities? and what was the timeline of the investigation being reopened and the production of this and the choices. >> i think both investigations in los angeles and westchester have been reopened since this all started coming about.

>> the lapds "the jinx" had nothing to do with the timing of the arrest this weekend. >> everybody thought he was a flight risk when episode 5 came out, after he was looking very guilty in the eyes of the public. >> and using an alias and driving in a toyota to new orleans. >> which is par for the course for robert durst. i want to talk a bit about the family. douglas durst released a statement this weekend saying -- we are relieved and also grateful to everyone who has assisted in the arrest of robert durst. we hope he will finally be held accountable for all he has done. it was also revealed that doug durst had sought a protective order. we were concerned he was floating around we knew bob had been upset about episode 5.

democrats dao sense a vulnerable there. the language that's so controversial was in the bill. they didn't pick it up when it was passed. it should have been picked up in real time. republicans could be far less sneaky about it but it's not that democrats have handled it as completely purely as well. >> i want to talk about that. anna marie, what the republicans are trying to do is attach a stricter longer-lasting version of the hyde amendment to this victims fund. it doesn't allow for any taxpayers money to go towards abortion or other similar reproductive service. this is about fees and fines collected from people who engage in sex trafficking, and maybe using some of that money to fund reproductive health for victims. it seems more craven in theory

and in practice it's only subject to renewal every five years and would be longer lasting with much less debate than the normal hyde amendment. >> not only is this not about, it isn't taxpayer funds. presumably some conscientious it is those fees you were talking about, and the people who have stud yesterday the hyde amendment, that doesn't get used very often. the federal government is not going to be performing lots and lots of abortions if this happens. it's a pretty rare case. these are the people we might want to consider having fuzz action over the control of the reproductive systems. how -- at what point do they get control over their bodies again? apparently not ever according to this. >> you can imagine women who have been forced into

prostitution and sex slavery might want to have something to say whether they carry a termto term a pregnancy that was visited upon them, if you will, during sex slavery slavery. >> and i do think it's true, as sam pointed out, the democrats should have caught this in the language of the bill but i don't know about you guys but i don't want my federal government to be playing a game of red light/green light. like, you didn't catch it so you have to live it. it speaks to the juvenile nature of congress right now that that's how they're playing this. >> let's talk about that a bit. democrats are saying they basically asked republicans for a list of changes, and this wasn't on that? is that basically what happened? >> yeah there's something like seven changes. i think seven changes roughly. this is a pretty substantial one, and it wasn't among the seven, so they felt duped

obviously by not getting briefed on the changes to the law. still it's incumbent upon them to read the bill. we expect our lawmakers to read the bills they vote upon but at the same time the fact that they were you know negligence gen in reading the bill up until now doesn't necessarily mean they exactly have to pass the bill once they find out what's in it they can have the problems with the text that they find out and still vote against it. i don't see that that's a problem at all. >> it also gives context, ana marie, to about how this language around exchanges got this badgering which took the whole law down. this happens because members of congress do not read carefully the bills they are signing especially if it's 900-page looks bike the affordable care act. >> i tend not to agree with the false aisle comparisons with the -- like the whole you have

clinton. >> that's true and he did win the popular vote. he technically has won the presidency already, so he could be president again. how the democrats have a wholesale ownership including income and equality but maybe it sort of neutralizes it do you think that climbed change is something that a candidate could run on. >> no i think you have two problems first, he wasn't a good candidate. he came out of the clinton administration aft the biggest economic boom since world war ii and he could barely get 50% of the popular vote. so i'm really skeptical, in a more difficult time i think for democrats, that he would even be able to get the presidency

especially if he ran on climate change. i think climate change is a big problem, i would love to see us talk seriously about having a carbon tax, so forth, but realistically when you talk about raising the price of fossil fuels, which is ultimately how we'll have to address climb changes, the people outside of urban areas -- i drive about 1,000 miles a year but for ordinary people for whom gas prices -- >> an indicator of -- >> yes. part of their daily budget campaigning on hey, vote for me i'm going to make it more expensive for you to drive your car? >> i think it will be more like hey, i'm going to do something about an existential possibly species issue. >> i'm with you. >> i think people kind of know they're the same thing, which is why it's hard to get traction. >> i think it's a good idea to toss his name out there. he does own the climate change

issue. i think the democratic platform will be set for whoever the nominee is around income equality, and trying to figure out and adjust a sustainable economy. i would add to that ticket and i've said this here before on this show only michelle obama as his running mate. >> it will never happen. >> a gore/obama ticket? >> what about john kerry? >> that was done. eyen a worse candidate than al goir. income equality is such an important issue, and climate change not sexy for most voters. >> it's a problem, though. >> people don't -- here's my other thing. al gore was an original dlcer one of the cofounders of the democratic leadership council. he is not the more liberate candidate that the base has been yearning for. >> ogdlc.

two weeks into the battle to retake the iraqi city of tikrit from isis iraqi forces today say they are putting their offensive on pause to allow civilians to leave the city and call for air support from the u.s.-led coalition. this pause comes one day after heavy fighting in tikrit resulted in extensive damage to the tomb of saddam hussein. the fight for tikrit takes place as nuclear talks between the united states and iran have resumed. secretary of state john kerry arrived in switzerland today for talks with his iranian counterpart ahead of the march 31st deadline. these talks come just one week

region i think is tough here to have a huge shift. iran is a bad ocor it supports a lot of the negative terrorist groups like hezbollah, and the groups we are against with the assad regime in syria. even if we can get to an agreement with the nuclear talks, which i think are largely focused almost exclusively on those issues it's going to be hard to get to a consensus, as you saw general dempsey was critical of the iranian role in some of these operations inside of iraq just a few weeks ago. >> i want to get your thoughts on what secretary kerry said this weekend that we would negotiate with assad. this is someone who the administration has said has to be deposed. what do you make of the idea that we need to be talking with assad and his regime to end this war. >> as i understand it the state

department qualified what secretary kerry said because there's been some blow back from it. he supposedly was saying we wouldn't talk to assad himself, but people around him in the center of power. actually i think that's been the case for years. >> isn't that just diplo-speak? in the same way we're not coordinating with the iranians in iraq but effective will i we're talking to them? >> i think that's right, but in the case of syria with assad, if we really want to see him go we have to have a more robust discussion with those people around him and those supporting him. i think what secretary kerry was saying was that what the administration has said for year now, which is there needs to be a absolute. the problem with the parol is we don't have the strategy or sets of policies to support that. if you look at just a couple weeks ago, president obama, when
