good to have you with us tonight, folks. thanks for watching. hillary clinton's reputation or position as the 2016 front-runner might be fading a little bidt. a new poll out today in key swing states doesn't look good for hillary clinton. in iowa, rand paul has polled ahead of hillary clinton by one point. in virginia, she's in good shape. her lead has slipped to four points. in colorado, rand paul has a three-point lead on hillary clinton. if clinton wants to fix these numbers early on she needs to start talking about the issues when it comes to middle class americans and what they care about. hillary clinton, i think, has deliberately remained silent squeezing out the potential of the competition because of the money. but at this point we don't know where hillary clinton stands on the keystone xl pipeline. we don't know where she stands

on the trans-pacific partnership. many people think she's too friendly with wall street. would she really implement it again? we don't know if she would break up the big banks. we don't know if she wants to reinstate glass steagll, and we don't know where she stands on corporations sticking profits offshore so they don't have to pay tax. this is what americans are talking about. clinton also needs to speak out directly about iran. news today that if all the sanctions were not lifted at the same time there was not going to be any deal. pel low. nothing from hillary clinton on today's development. that's par for the course. being silent on the issue is starting to hurt clinton. earlier today, senator elizabeth warren, who seems to be the benchmark as of late as generals didn't sound too excited about a clinton run for the white house. >> hillary clinton could announce any day now that she is going to seek the presidential nomination and presidency in 2016.

do you think she's the future of the democratic party? >> well i think we have to see, first of all, if she declares. and what she says she wants to run on. >> what she wants to run on. that's right. if she declares -- i think she's going to declare. she's hiring people all over the country. senator warren is starting i guess the veting process. she's the first one in the senate to come out and say we don't really know where she stands on a number of different issues. at this point we have no idea wh sh se on a number of different issues. elizabeth warren expressed concerns about her position on trade. >> name me one thing that you would like to see hillary clinton do and say and commit to that she has not committed to. >> well i would like to see her address all of these issues. you know we have a big debate going on right now on trade. within the democratic party. i have real concerns about something called the investor

state dissput resolution that basically would permit multinational companies to sue other countries when they try to put regulations in place to protect their own workers, to protect their own citizens. i think this is a really dangerous provision in a trade deal. >> thank you. it is very dangerous. you know not to put too much pressure on hillary or come off as anti-hillary but the issues are far different from 2008 and 2007. and it's time for hillary clinton, at least when she does announce, and i guess it's going to be pretty soon. that she sets the record straight right away. democrats deserve to know exactly where she stands on the key issues of contemporary time. she needs to start talking about issues like trade. medicare medicaid. social security. minimum wage aren't those all easy lips for any democratic

candidate? eventually clinton is going to have answer the tough questions about the ones shoost been coy about. it's obviously clinton feels no pressure to step out and talk about these things because she's unopposed. she doesn't have to. until she feels the pressure to say something, she probably won't. so it's a run out the clock scenario. this is a late announcement, whenever it's going to be. but elizabeth warren is the person people are listening to. if she has questions on trade and the issues i listened to previously. that means there could be a slit in the democrat ig camp. now liberal groups are pressuring hillary to come out. they're saying we want you to sound like elizabeth warren. can we at least find out where she stands on the keystone xl pipeline. that will take us into a discussion about the environment. get your cell phones out. we'll ask the question in a few

moments. first i want to ask the questions to larry cohen. good to have yo we us tonight. you have spent an enormous amount of time on the tpp and fast track and yet the presumed democratic nominee, hillary clinton, has been ominously silent. can your union, and can you support hillary clinton if she supports tpp? >> i think it would be hard regardless of the party, to support a candidate who supports tpp, as we now know it. obviously still a secret. where just as importantly to support fast track, and we don't know what's in fast track. we need populous politics. we need candidates who say i care about jobs. net jobs. imports. killing jobs in america. not just a few export jobs. that we care about pay and how our pay gets held down.

i think it's essential that she speak out on these issues. >> essential that she speaks out. i'm hearing that in a lot of corners of the country from a number of different groups. so here comes senator elizabeth warren asking these questions. what kind of pressure do you think that puts on hillary clinton? >> i think what senator warren is doing is great for all of us. as she said in the clip you played, we now have 500 cases under the settlement. this is a reality. and cases like petroleum getting $2 billion from ecuador because they want to save the environment. ecuador doesn't have $2 billion. we know the record on isds stinks. it's what it does to the environment in every country. we have one world here. i think it's essential sh speak out on trade. it's one of the few things the president controls. much of the rest is up to the

congress. but the president controls the trade agenda. >> okay. so how important is it if she runs unopposed. i mean there's a real chance that workers this this country might no have total confidence that this is the best of the lot. >> yeah, i think workers in this country will number one, believe money and politics has taken over. few people can raise 1 billion to $2 billion. that's what this election will be. and as a result they don't get to the front end. there's other factors as well. working people are quite concerned it will be about who is worse instead of where is our vision for america? i think senator clinton -- or secretary clinton can rise to that occasion. she needs to do it quickly. we're beginning to believe that it's just about sitting it all out and getting the candidacy regardless. >> okay, larry, good to have you with us tonight. appreciate your time. a major headache could be

senator bernie sanders. the vermont senator has been thinking about a presidential run for some time. he's a much needed voice in the the national debate, as i see it. a new article gives analysis of his run. ted devine said sanders could win by bringing disillusioned tea partyers. that caught my attention. it's a real possibility, they want a lot of the same things that he has been talking about for a long time. . for more let's turn to the senator from vermont. good to have you with us tonight. >> good to be with you. >> you have been very clear on the issues that we have talked about. but now senator warren is questioning hillary clinton for not stepping out. does that change your schedule at all if there's going to be one? >> no it doesn't. look, the american people understand, ed. that something is profoundly wrong when 99% of all new income

generated in the country goes to the top 1%. when we have lost 60,000 factories since 2001 and millions of decent paying jobs. in my view every candidate, not just hillary, but everybody else has got to be clear about what we do to expand the middle class, to tell the wealthy and large corporations that they have got to begin paying their fair share of taxes. how do we create the millions of decent paying jobs we need? >> senator, you have been out and about around the country and all regions of the country. what are people asking you? when you go out to a town hall and they want to talk to bernie sanders, what are they asking? >> well i will tell you, ed. what people are talking about, is how we create the millions of jobs this country desperately

needs. and the reason for that is that real unemployment in america is not 5.5%. it's 11%. they want to know how we raise wages so people are earning $7.25 an hour. they want to know how we're dealing with climate change. and how we reverse climate change by moving to sustainable energy. and there's a lot of interest about trade policies and how we defeat fast track for the tpp. >> what is this analysis that you might get disaffected tea partyers? do you sigh a parallel in that? >> absolutely, ed. look. you have a lot of white working class guys out there. they can't afford to send their kids to college. they don't have any health care. go you think that they really believe in the the republican agenda giving tax breaks to

billionaires and cutting social security medicare and medicaid? they don't. but somebody has to reach out to them and say okay we may disagree on this or that issue. but are you concerned about your kid being able to go to college? are you concerned about having a de decent job. do you want to see your job go to china? we can bring forth a common agenda that brings a number of people into an approach that says enough is enough. the billionaire class can't have it all. >> senator, news today, the iranians are saying the sanctions are going to be have to be lifted across the board if there's going to be a deal. what is your perspective on this? if you were president, if you were making the deposition exhibit, where would you be right now? zbr well i got to say, ed. i think the president and secretary kerry have done a very good job in making it clear that, "a", we want to make sure

that iran does not get a nuclear weapon. but "b", we have to do everything possible to prevent another war in the middle east. i can't not believe i have republican colleagues very nonchalant after the wars in iraq. after the war in afghanistan. yeah, well maybe we'll have a war with iran. disaster. so i applaud with the president is doing. the devil is in the details. i will study them. he and john kerry deserve credit for trying to goeshtd an agreement that prevents iran from getting the bomb and does it in a way without a war. >> from what you know of it would you lift the sanctions across the board to get a deal? >> i don't have all the details, but i think the president is moving in the right direction. as soon as i see the details, i'll be able to give you a better decision. >> thank you, senator bernie sands ers, good to have you with us. get your cell phones out no u. we want to know what you think. do you want bernie sanders to run for president? go to pulse.msnbc.com/ed to cast

we have breaking news at this hour. we have just gotten in the dash cam video from the walter scott case in south carolina. the video does not show any of the shooting. we see officer michael slager speak with walter scott at his car. out of the officer walks back. out it have camera's view walter scott takes off running. from there we can only hear audio. this is the officer in the stop. that was the dash cam. and we can't see anything beyond that once he exits the car and takes off. it's only audio. and there will be certainly no doubt that this is going to be central in the investigation. meantime, this case has broken into the political spectrum. hillary clinton called the incident heartbreaking and too familiar. she says we can do better to rebuild trust, reform the justice system and respect all lives. lindsey graham senator from south carolina called the video

horrific. rand paul, previously called the incident a tragedy. but today on a presidential campaign stop in south carolina he didn't mention walter scott at all. but he did have this critique of the media coverage. >> i do think that sometimes the way we report news we tend to report the news of crime, and so we see a lot of crime. we think it's representative of the whole. and when you look at police across the country, 98 99% of them are doing their job on a day-to-day basis and aren't doing things like this. >> there's no basis of that comment. he doesn't know what percent of police officers do their country and have excellent at it. not to say that most of them aren't. are we not supposed to show this tape? constantly the new media critic on the scene. the nation is still consumed by the cell phone video showing discrepancies between the recorder and the bystander who

got the video. feidin santana explains the shooting. >> there was just the three of us at that moment. like i say, i didn't -- i couldn't tell what was going to happen. >> sarah from nbc news has more. >> as investigators and the public continue to scrutinize cell phone video of the shooting, new details are emerging about the police officer charged with murder. michael slager joined the force six years ago. personnel records show a complaint against him two years ago for improper use of force with a taser. slager was exonerated, but the man who filed the complaint and his attorney spoke about what they call a systematic problem within the police department. >> we believe we're going to uncover other instances of where there have been aggressive behavior. >> investigators and the public scrutinize cell phone video of

the shooting. why does slager appear to retrieve an object near the ground where the shots were fired and drop it near the the body. they believe that object was the taser slager initially used to try to subdue scott. >> he then took that back to where mr. scott's body was and essentially planted the taser directly beside mr. scott's body. >> another troubling question why are no officers seen on video performing cpr when the initial report says they did? >> there are questions that i have in my mind that i can't answer right now. >> no quick or easy answers in a case that's reignited debate over deadly police force. >> joining me tonight, paul henderson, veteran prosecutor and legal analyst. also with us dr. james peterson, director of studies at lee high university and msnbc contributor. gentlemen, good to have you with us tonight. >> thanks for having us ed. >> mr. henderson, i assume you just saw the dash cam video. how do you think this plays into

the the case? >> well i think it shows us that but for the video tape that we received that came outside of official means and came from the community, we still would not have the hard evidence and the facts that show their lies and it goes beyond the lies into perjury where we have claim being made by the officer, that he was struggling that he was in fear, or that anyone else was in fear. so it's going to be helpful and corroborative corroborative. but it doesn't show as much as the first video tape that we all saw from the day before where we witnessed the entire incident playing out from the perspective of a thinker party. >> right now it looks like a routine traffic stop. there's nothing ordinary about it from what the video tape shows. i mean that's my first impression of this. there's been numerous reports about this officer's background mr. henderson.

how does this play into the scenario? >> it's absolutely going to play a significant role on three levels. both in the criminal case, it's going to come in in terms of the bad behavior that's been done by the officer. it's going to come in any civil case and for the same thing to say that the department should have had notice about his bad behavior, and at a third level, it's going to be brought in as part of the analysis if a third party or federal government comes in to review a pattern and practice of behavior from the police department where they will be evaluating how other officers and this officer specifically was land led when there were allegations made against him. so you will see this evidence being useded over and over and over again as we analyze just this incident that took place. and the subsequent accountability. >> you're going to see scott run from the vehicle here in just a moment as the officer has gone back to the police vehicle. we can only assume that he's

running a license plate of the vehicle. mr. henderson, does this video, the video that was recorded there you see scott opening the door. it's not like he's taking off right away. >> right. >> and now he's going back into the car. >> right. >> and this is -- that's important because that shows intent, doesn't it? >> it shows intent. and the thing to focus on is when are you allowed to use justifiable deadly force? and so what you're analyzing is when, if ever do you see the officer in the zone of danger for either himself or of others, which would justify the use of deadly force? that's why i said this video tape will be used corroboratively to show that there is no evidence of that flash point taking place. there's no evidence anywhere of something showing that that officer was either in danger for the -- to justify the use of deadly force, either for himself

or for the public. >> okay. i'm just going to put it in street terms here for just a moment. just folks talking on the street. how in the hell could this police officer not know what has happened over the last year in ferguson, missouri with michael brown, with trayvon martin with the gentleman choked to death in new york city, eric garner. and i mean this looked like a normal traffic stop. what elevated this guy, as you see it dr. peterson, to bring it to the point where he would think that he should unload his pistol on an unarmed man running away from him? i mean don't these -- it would seem to be that every police officer in this country would get the message, don't shoot unarmed people? >> you would think, ed that that would be the case. but at the top of the case you mentioned a routine stop. just from the ways in which

we've had to cover the cases, it seems more and more routine that law enforcement are engaged in the shootings of unarmed civilians. they have a particular script about scuffles and going for the gun or taser and then fearing for their lives. and this story shows us the limitation of dash cams. this is why i'm not a huge fan. the same type of law enforcement who will use deadly force on an unarmeded civilian on the way this officer did is the same kind of officer who might manipulate the cameras or the urn the cameras off. the routine nature that you're talking about, ed i think filters into this entire discussion. law enforcement folk are looking at cases like trayvon martin ta mir rice eric garner and they're siding with law enforcement. they're saying it's tough out there. it's dangerous out there. they have to protect themselves. and this is the narrative that they use every time in these shootings. we were fortunate and this family was blessed to get access so we could have the truth in this particular case, and it explodes the previous narratives. your common sense question is going to continue to go

unanswered. i don't think that law enforcement has gotten wake-up call just jet. i really don't. if you think about these as sit-ins and die-ins and some of the organized ways in which the dream defenders are trying to raise awareness. if you look at their assistance in michael brown's funeral. their attitude their positionalty, they're still defensive. we haven't had the kind of conversations to lead to resolution and rebuilding the public trust with law enforcement. >> and finally, mr. henderson, the discrepancy between the police report and the video tape your thoughts? >> i think it's a real problem. as i said before it goes beyond mere lies. it drifts into an area of perjury, which is real accountability in terms of what this officer was willing to say, and then beyond that what that report shows in terms of how cpr was administered to this individual, to walter scott, who had died. there was no cpr, and we saw that on the video tape. and that's going to speak directly to the analysis and the overview of the pattern and

anna revis logan joins us tonight. former florida state representative. good to have you with us, anna. >> good to be here. the pulse of this in florida what does this mean that the house is sending a letter to the president. do you think that reflects the mood of the people? >> absolutely not. we've seen what the president is doing. when the president first announced his relations issue with cuba in december 41% of south floridians approved of it. today it's 51%. so people are accepting this we're not talking about the rest of the nation. we know the cuban relations support the president's move on cuba. >> is there much conversation about the state sponsor or testify richl lift. if he takes the recommendation to remove cuba what do you think the reaction will be?

>> well it shouldn't be there. it shouldn't have been there for a while. it was placed on there many many moons ago. it's time they come off. >> so as time goes by momentum seems to be swinging in favor of everything the president is doing with cuba or trying to accomplish. i think the gop members of the florida house haven't gotten the memo. >> so how does this play in the next election? is this going to be a political calculation by say, the rubio crowd? >> well, of course there's always going to be the cuban hard liners that are not going to move on the issue. and they do represent a big part of the primary voters in the gop base. and so there will be a lot of rhetoric of that. i imagine with rubio and several gop primary, you know in the primary. so they're going to be playing to the far right. which is the republican primary. but they're against everything

and we are back. florida isn't the only state staking its head in the sand when it comes to climate change. now they have joined the ranks of the withfully ignorant. meet matt. he advocated for eliminating his own roll. he also hates environmental people. he's on record. which is bad for the folks in wisconsin. on tuesday adamczyk success pli passed a ban to prevent the board of commissioners of public lands from doing any work involving climate change or discussing climate change or

e-mailing about climate change don't talk about it. well, this will make the board's job of protecting a lot harder no doubt. don't expect governor scott walker to step in hean make this right at all. he's a poster child for r the war on science. in fact, walker has the lead. he's been leading the charge against the the efforts to reduce carbon emissions. walker signed the koch brother's no tax pledge. he tried to slash millions from state subsy died recycling programs. congratulations, wisconsin. a pioneer of anti-worker policies and now going backwards on climate change. joining me now on the rapid response panel, ruth editor in chief of the progressive magazine wisconsin state senator, chris lars on. what is the motivation here?

what is this about? what is the the root of this? >> it's a petty vendetta by the tea party state treasurer who is really pretty out there against the daughter of the great environmentalist. founder of earth day. senator nelson from wisconsin. basically he tried to fire her. he was overruled by the other members of the state land board who defended her. she is an environmentalist. and he's attacking her for serving on a task force that she was appointed to by the former governor, a democrat on climate change and then talking to the timber industry that is concerned about climate change and invited them to speak about how it affects the industry. and so then he's gone further and said she shouldn't be allowed to speak of climate change, to do any work on climate change which she hasn't done since she was asked to do work in her capacity. it's about this petty vendetta. this other piece is just across the country, we see the folks

like the state treasurer, tea party folk who is are really worked up about the idea that there is such a thing as climate change, like making it very expensive to use solar energy. we know he's friends with the koch brothers. he has pushed to make wisconsin a less environmentally friendly state. this mostly originates with one peculiar individual our state treasurer. >> senator larson you just can't raise any money admitting that there's climate change. so walker is not going to be an ally here at all. so this is pretty obviously. so how much is this going to hurt the state? as you see it? >> well in wisconsin, we have timber agriculture and tourism. and they depend on us having a reliable climate. they will be hurt if climate change is not addressed on a

wide scale. so this is going to hurt. and he's trying to bury his head in the sand. walker is trying to do that. other republicans are trying to do. and this is not your grandfather's republican party. this is the regressive era republicans who are denying inging climate change. and not just that. they don't want people talking about this. as hay demand silence, it's important for us to speak up baa it's not just a matter of saving trees or something environmental. it's the future of the history in this state. >> isn't this a form of intimidation of employees, though? telling them they can't think of talk or e-mail or mention climate change at all? what about that, senator? >> absolutely. #. >> absolutely. yeah, and this is -- it's not just -- ruth mentioned how he is trying to fire her since he came in.

and he issued edd dozens of open records request. this may be his close-up on national spotlight. but we know him here. he worked for senator who is in line to be the next president of alec who denied turning over documents to find out what bills they were trying to move forward. he's using the same process to try to silence somebody in our state. it's important fortous speak up on it. there's great foot a 7-year-old calls governor walker to the mat and asks him to questions about climate change. i encourage people to speak up on this. and we need to speak up. >> and what was the response ruth? >> i posted the video on twitter. basically he ignored the 7-year-old. the 7-year-old was bold enough to ask a follow-up question that said do you care about climate change. and walker ignored him and walked away. >> all right. now he says this isn't part of

the board's mission, which is to make money for our beneficiaries. what is your response to that, ruth? >> well part of the board's mission, it's the oldest state agency, is to manage these public forest lands, and the money from their sale. more were sold off 100 years ago. they have about a billion dollars in their trust. not taxpayer funds. but this is publicly owned wealth. they use a loot of it to support public libraries. they also mansioned the lands. and to talk about what is happening to forestland. as the senator points out, the timber industry itself wants to know what to do about climate change. so this is completely within a reasonable per view. to say they should be silenced is preposterous. even the tea party is catching up with that. >> say that again? >> even the tea party is catching up with us. a bunch of people who don't like having it made more expense i have for them to generate their own power is growing across the

finally tonight, the story unfolding in the central valley area of california should have the attention of the country. this historic drought in california is now in its third year and it's devastating farms and the economy. house majority leader kevin mccarthy's district is taking a hit. >> there are some cities that have more than 30% unemployment. the number one factor -- water. >> in an exclusive interview with "the hill" congressman mccarthy said it's no longer a

political issue, but has been become a life or death issue. i think he's using the drought as a plasm form to to show he's still in touch. how about some disaster relief? is that what he wants? interesting here is that every time a democrat has a proposal for disaster relief whether it be for a hurricane or a flood, republicans always want to talk about budget offsets, what are we going to cut to make this possible? so the question tonight is how does mccarthy feel about offsets now? is there going to be a big political fight in washington while the people in california suffered? i've spoken to friends out there who are telling me that people are economically suffering right now, and there's no end in sight. congressman john garamendi joins me tonight. good to have you with us. >> hello, ed. >> now that it's hitting the leadership in the house, would the philosophy change somewhat for the role of the federal

government? because if people are losing their farms and their ranches, what is the role of the federal government and our commitment to american citizens? >> certainly the federal government has a major role to play in dealing with this drought. it's not just a california drought, but it's stretching across the entire southern united states all the way to florida. this is a national issue. the federal government has a specific set of opportunities to deal with it. in california without new money, we could focus the existing federal government programs to really augment, to coordinate and to really cause the california bond act, which passed by a 60% majority just last november to actually get up and going earlier. we talked about the communities that are losing their water system the department of agriculture has existing programs, but they need to be focused. we have aquifers that are depleted. we need conservation programs

both urban and agriculture. all those programs are in effect, so what we really need to do is stop fighting in washington and focus our attention that are in place in federal law with money already available. if they want to bring new money in they're more than happy to spend money on their favorite projects without an offset but for the things they don't care about, they demand an offset. in this case let's solve the problems of the drought all across the southern part of the united states, put the money there to help the communities, to help with conservation recycling, all of those things need to be done now. >> the experts are predicting that the economic loss is going to be roughly $3 billion in this year alone, 2015 for the state of california. that means job loss. >> exactly. >> that means folks losing farms, generations, you know some of these farms are like three, four generations. that's hard on people. >> absolutely.

>> what do you do to avert that? >> well first of all, don't steal somebody's water. for the last four years mccarthy and the folks from the southern san joaquin valley have put forth legislation in congress actually passed that would steal waters from farmers and the environment from the north, the fishermen, the salmon fishermen. don't do that don't engage in a pointless water battle but focus on the things that can be done to assis people. some communities in my direct for example, do have 30% unemployment. we need to employ those people putting in place the conservation measures and it's everything from toilets to agricultural conservation, drip irrigation, better management of the canal systems. all those things are jobshat we need now and we need toss conservation programs. we know we need to take care of the aquifers and replenish them.

"politics nation" with reverend al sharpton starts right now. good evening, rev. \s. >> good evening, ed. breaking news the new dash-cam video connected to the deadly shooting in north charleston. it was just released by south carolina state's law enforcement division. it shows the traffic stop before officer michael slager shot and killed walter scott. you can see the broken taillight is there. there's also a second person in the car in the passenger seat and the video shows officer slager approaching the car. the audio isn't clean, but you can hear him asking walter scott for his license and registration.
