this morning shows the moments that gyrocopter approached the west lawn. the pilot has been identified as 61-year-old doug hughes. he's due to make his first court appearance this afternoon. speaking to nbc news secretary johnson described his reaction to the breach. >> this individual apparently literally flew in under the radar. >> were you satisfied with the response? >> well, again, i want to see all of the facts and know all of the facts before i make any conclusions or draw judgments about yesterday's incident. >> nbc news peter alexander joins me with more on how hughes was available to avoid watchdogs and even the secret service. >> reporter: this episode gives new meaning to the idea of air mail. it happened less than 24 hours ago. right now on the marble mallnational mall we're in the middle of the gyrocopter's flight path before it landed in the grass shy of

the capitol building. if it had come any closer police have long guns to take it down. the pilot's desire was to spark a discussion about big money in politics but instead he began an entirely different conversation about the state of homeland security. following this unprecedented stunt, new questions about security in the nation's capital. how did the u.s. military capitol police and secret service all miss this? the stunning scene playing out wednesday. 61-year-old florida mailman doug hughes looking to deliver a message to washington carrying 535 letters, one for each member of congress protesting government corruption. >> this is not good people. >> reporter: ultimately landing on the capitol grounds where he was quickly arrested. the flight wasn't a surprise. hughes blogged about his plans in 2013 and shared details with tampa bay times last year. >> i don't believe the authorities will shoot down a

60-year-old mailman in a flying bicycle. >> reporter: after a heads-up about hughes' timing, ben montgomery drove to washington to watch but never alerted authorities. >> it's not my job to pull the plug on somebody doing something like this. >> reporter: the secret service interviewed hughes in 2013 but it's unclear if federal law enforcement was knew of his trip before he flew in. >> i'm not going to deny the fact it was kind of a stupid thing to do but it was also very brave and it was very patriotic. he is going to pay a very dear price. >> reporter: police believe that hughes took off from gettysburg regional airport in pennsylvania. that's about an hour away as the crow flies. he's landed himself in court. he'll be in u.s. district court this afternoon after 1:30. that's the latest from here. back to you. >> thanks to peter for that report. joining me now, msnbc law enforcement analyst jim cavanaugh, a retired atf special agent in charge. thanks, jim, for joining us here

again. so peter was able to get secretary johnson to comment here. part of what he said the commanders need to rethink possible ways that people can attack your protected areas. too many people are getting through. i think it's stunning to many to believe that our secret service, those who are supposed to protect our lawmakers and the president are in reactionary mode and not in pro-active mode. >> right. exactly. we shouldn't be saying what is a gyrocopter. we should be gaming these things out. i think they've got to regroup all of the law enforcement in the district, secret service, capitol police and aviation police that are all around the district. we have aviation pilots that fly police helicopters plus the military plus the faa, and get a strategy to stop this. this guy told everybody he was going to do it. there's other ways he probably could have been stopped as well. >> even though the secretary

said this man flew under the radar. the "times" report the secret service on wednesday night visited his home october 2013. they say that he had been interviewed about his plans to land a single manned aircraft on the ground of the u.s. capitol or the white house. so again this whole notion of regrouping and rethinking you knew at least one individual had planned out something like this let alone he was live streaming this. to say this is sloppy is that too harsh? >> you know here's the way it works. the secret service did some things right here. when they interviewed the guy they determined -- this is the main focus. he's not a threat to their protected persons or threat to harm people. they determined that. they didn't followthrough and say he has this contraption. he wants to penetrate protected airspace. how are we going to stop that? we need to stop that for him and others. the right way to do it would be to have a postal inspector -- he

works for the mail service. there's a great law enforcement agency that could have been watching. they have an office in tampa. they would have known when his days off were and if he was loading a gyrocopter on a trailer. he could have been interrupted at the gettysburg airport. >> they established this guy was not a "threat." given the drone that crashed near the white house and one person thought about landing a small aircraft the technology is available. i instantly googled this copter yesterday and saw one for $13,000. separate this guy with the technology who is manning what's available and assessable to people who may not be nonthreatening like this guy reportedly is. >> that's right. i mean they should always have these type of penetrations planned for and it should not

get anywhere close to the protected buildings of the capitol or the white house or the pentagon. they should game this out. if a gyrocopter takes off and they have limited range from 90 to 100 mile radius to the district, they should know about it from airport personnel, from radar, from assets and police helicopters should be escorting them. if they knew this guy was a mailman and didn't want to shoot him down which they did because tampa bay times alerted them in the last 30 minutes, they should have had police helicopters divert him to a safe place. >> thank you for your expertise. we appreciate it. another big story we're following, a stunning new report accusing tulsa county sheriff's office of falsifying training records for that volunteer reserve deputy who shot and killed a suspect with a handgun he says he thought was his taser. the tulsa world newspaper claims

sometime before the shooting before the shooting, supervisors were "ordered" to falsify robert bates' training records giving him credit for field training he never took and firearms certification he should not have received. now, that's according to multiple unnamed sources who also told the paper at least three of bates' supervisors were transferred after refusing to signoff on his state required training. nbc news has not independently confirmed the tulsa world's report and sheriff's office is pushing back against the story saying "the media outlet putting that information out is using unconfirmed sources and relying on anonymity. we don't respond to new mexico rumor and the undersheriff rejected the claim that training records were falsified or that supervisors were transferred." however, the tulsa sheriff's office says it's conducting an internal review of its deputy

reserve program. bob gates is charged with second-degree manslaughter in the april 2nd shootings of eric harris captured on body cam video. joining me now, one of the tulsa world reporters who broke this story. thank you for joining us. >> thank you for having me. >> you heard the response from the police department. they're not focused in on the report that's come out but an overall review of their reserve training system. this is stunning allegations from unnamed sources here. >> yes. this is something that is the sheriff's department we began hearing after the shooting and i heard several years ago in connection with the same individual, but several reporters heard this inside and outside the "tulsa world" repeat repeatedly repeatedly. we felt like we had enough sources four or five people saying the same thing and documents that corroborate this

information. so basically the information was that supervisors were told to sign off on training and he had not done the required number of hours and they refused and were transferred. not disciplined but transferred to less desirable assignments and then a handgun instructor was also transferred when he refused to sign off on the handgun scores. >> this falls in line with the allegations that bob bates paid his way into the sheriff's department and was given access great access based on donations he made and friendly friendships. >> i think that's something that -- i assume they'll look at that in their review. all of the reserves there are about 130 of them they give a lot of time they do a public service, they are unpaid and do things like traffic patrol and work the fair. it's unusual. i never heard of a reserve deputy working in an undercover

capacity like this. we obtained his statement made after the shooting in which he said he had been involved in 100 operations just like this that were undercover. >> also in your report it says that every year reserve deputies must complete 23 hours of special law enforcement training plus two hours of mental health training. a check of the records according to your report shows three years ago bates had just one hour of mental health training and not two. >> there is training records that they did release are basically a summary. there is no supervisor signatures on there. they're not the raw documents that were used to create the summary. when we asked for those documents from the sheriff's office, we have gotten a couple different responses. internal personnel records and the other is we've lost many of these documents. so we're still trying to find out where they are and there are a lot of questions about the training he has had. >> also again, the tulsa county undersheriff rejecting as we

pointed out claims that documents were falsified. he said training record speaks for itself. i have no knowledge of what you're talking about. they are not any secrets in law enforcement. zero. those type of issues would come up. he says there are not secrets in law enforcement. it sounds like from your reporting that at least some within the department took great issue with this whether they want to be identified or not. >> yes. there was some concern and fear on the part of the people that we spoke to inside and outside the department. it's a large law enforcement agency and we decided in this case it was worth granting anonymity. the public needs information. they do say this is not true. we'll just have see how it pans out. the documents will go a long way in helping to clear this out. >> thank you so much for joining us. greatly appreciate it. still ahead, three people now under arrest in a sexual

rubio and new jersey governor chris christie who just wrapped up his own two-day swing through that state. the governor told "today's" matt lauer he has not made a decision on whether or not to run. >> we're still going through the really personal part of this decision. with me and mary pat and the family. you don't rush that decision. if i decide to do this i'll do it honestly and go at it as hard as i can and try to win every day. i will never give up being who i am. that's the thing that stays with you forever. >> we go to manchester new hampshire. we should note that hillary clinton is expected to travel there next week. the people of new hampshire must feel really special these days. >> reporter: it's getting really busy in new hampshire. as you said the state is expected to be the next stop on hillary clinton's tour list and then tomorrow 18 potential or

official presidential republican candidates are going to gather for the first in the nation summit. over 600 gop activists are expected to be there and some of these potential candidates are trying to get a head start this week. rick perry in just under an hour will hold a business roundtable and then governor bush is going to be holding a pie and politics event in concord where he will eat pie but he'll also meet with many republican activists there as well and of course there's governor christie who has been here all of this week holding several meet and greets a town hall and pushing somewhat controversial entitlement reform plan to raise the retirement age to 69. last night at a town hall he was peppered with questions about foreign policy. governor christie really went after obama on his handling of isis and cuba and iran.

he also took a shot at hillary clinton. he mentioned a report that he had seen that clinton was going to spend about $2.5 billion on her campaign but trying to get corrupt money out of politics. he said that was hypocrisy. >> all right. interesting things going on and being said. thank you. now let me bring in huffington post senior reporter and politico chief political columnist. robert, let's pick up regarding this "bold" move from governor christie regarding entitlement and how he started the week off discussing that. "the l.a. times" puts it this way. if there's a rule in politics it should be beware of candidates who try to be bold merely for the sake of looking bold. chris christie trying desperately to keep his presidential hopes alive and wants to look bold and he's not above throwing thousands of elderly americans under his campaign bus to do so. michael wrote that.

>> i think the key word in that is desperate. chris christie has to give a rationale for why out of all of the republican potential candidates there is still room for him. seizing on a bill that has no chance of passing in congress we're not going to raise the retirement age for social security. we're not going to means test social security. even though doing both of those would raise billions of dollars. the american people think that congress can find more fat in the budget than what is spent on old people. >> amanda let me bring you in. in that interview with matt lauer regarding chris christie's criticism of jeb bush but matt asked him if his time had passed given the bridge gate scandal and other things. 69% of new jersey voters say he

would not make a good president. in that question whether his moment has passed he said i don't know. >> when you look at a potential run, is he your biggest rival? >> i don't know. you would have thought when he announced in december that he would be. but it seems to me that train has slowed down pretty significantly from what i've seen out and around the country. >> do you think it wilel speed up when he jumps into the race? >> i don't know. >> that's related to jeb bush. a separate don't know when he was asked whether his time had passed. >> those are honest answers by chris christie. that's part of why he's in new hampshire now trying out these town halls. this is what chris christie is good at. town halls where you stay with voters for a long time. take any random questions and engage in this unscripted back and forth. and sometimes it blows up a bit for him where he yells at

someone and is called a bully. those are the moments that get chris christie noticed. right now lately he hasn't been noticed very much. he needs to get back out there. figure out if there is a place for him and like chris christie i don't really know if there is right now. he's going to have to answer questions about bridge gate and just really is the country and the republican party really craving chris christie? i don't really think so at this moment. >> it's interesting, roger. our first read team points out in the mix of where is waldo chipotle coverage of hillary clinton, she did bring up seven issues and positions while not in great detail. she talked about campaign finance, free community college, expanding pre k, paid family leave, immigration reform and making equal pay more enforceable. not in great detail but hitting on issues but whereas when you look at chris christie he's not

getting much attention but to roll out with entitlement reform and jabs here and there at jeb bush, is that effective? >> nobody is going to get the attention that hillary clinton is going to get. we know what kind of burrito she likes. it is accurate to say that in all of the massive attention of scooby van and all the rest she is laying out the skeleton of a campaign that she will add flesh to as time goes by. this is her first campaign trip to iowa. last time she ran, she ran as the candidate of experience and intelligence. this time it's a much softer image. she wants to be america's champion and she understands ordinary people. it's a big shift in what she's doing but at the same time she wants to be candidate of substance. she wants to be everything at once and we'll see if she can do

that. >> we'll see. martin o'malley posted a new campaign style video on same-sex marriage being seen as a shot at hillary clinton from a democrat who may very well jump into the race. let's play it. >> history celebrates profiles and courage. not profiles and convenience. the dignity of every person tells us that the right to marry is not a state right, it's a human right. >> amanda yesterday clinton's campaign said that she hopes the supreme court will come down on the side of same-sex couples being guaranteed the constitutional right. that's a different version of what we heard from her last year. >> i think -- i mean governor o'malley has been out in front on issues of lgbt equality. i don't think hillary clinton will have a tough time getting lgbt to her side. it's smart coming out little by

little with these positions. she recognizes where she's been criticized and that npr interview where she didn't really lay out sort of as an expansive view of lgbt equality she's addressed that now. she's focusing on economic inequality which has traditionally been something where she's been criticized and not going big. you don't see the helicopter flying around iowa this time. she's doing smaller stops. so she's really absorbing the lessons of 2008 and where she's been criticized in the past addressing them this time around. >> before we let you go i'm curious how you think in the end the week went for hillary clinton? >> it was a good week. through a careful attempt to shape her image, she also tried to appear to be the spontaneous candidate who would just leap in

the measles outbreak that originated in california may be considered over if no new cases are reported. it ignited a debate on immunization. a state senator introduced a bill requiring parents to immunize children. when those parents choose not to vaccinate and don't have a medical exemption, would be forced to homeschool their kids. the debate is so heated shs the senator who wrote the bill says he's been receiving threats and now he's been assigned extra security. his bill was up for a senate education committee vote yesterday but hundreds of parents as you see there who

oppose the bill came out in force and helped stall the vote by a week. a pediatrician from university hospital center in cleveland joins us now. some of the criticism and concerns posed to the committee, some of the parents continue to say there's a lack of evidence of a health risk to justify taking away parental choice requiring many children to be homeschooled when some parents cannot afford or are not qualified to do so. they are saying what do i do with my child? the child is being punished when they believe that the science does not prove that the immunizations do not cause things later, health issues with kids. >> these parents unfortunately or fortunately really have never lived through measles. they don't know what measles is like. so for children who get measles, one out of ten are going to have

contact with parents and you hear from them on a regular basis. are you saying that kind of anger that we saw for example in california to the point that a lawmaker says he's received threats. why is this a topic that has turned in some ways now allegedly violent for some parents? >> well maybe they need more mental health dollars in california. this is not something that you should want to kill somebody about. i don't understand that. what we do know is in west virginia and in mississippi, they haven't had measles cases in years. so it works. the number one thing for children and childhood well-being in the 20th century were vaccinations and number two was clean water. so there are a lot of things that children used to die of and be disabled from that people haven't seen so they don't understand the severity of it. i get very upset when i read quotations from people who it looks like they're educated but

welcome back. now to new developments in an alleged spring break sexual assault caught on cell phone video in florida. a third man has been charged and is held without bond. george kennedy was arrested tuesday night a student at middle tennessee state university. two students from troy university in alabama were arrested and charged last week. all three are accused in participating in the alleged 60s sexual assault of an incapacitated woman while a crowd watched on in panama city last month. the popular spring break destination sunday pressure to make major changes to deal with the drastic rise in spring break crimes. >> reporter: this morning many here are asking is spring break broken? >> there's some bad things happeninging on panama city

beach. >> reporter: after this video surfaced showing several men sexual assaulting a woman on a beach in broad daylight while bystanders do nothing. >> within ten feet of this happening, there's hundreds of people standing there watching looking, seeing hearing what's going on. >> reporter: three men have now been arrested. >> heartbreaking. >> reporter: this community there's been a dramatic increase in violent crime. a gunman shot seven people at a house party last month. in bay county which includes panama city beach, arrests have more than tripled compared to last year. police nabbed twice as many suspects for weapons related charges and set up so-called spring break jails or mobile booking cages. >> we have a cancer in this area right now. >> reporter: wes pittman has lived here almost 40 years.

he works with an anti-bullying group and an advocate for hiring artists with disability. good to see you, good morning. >> thank you for having me. >> could you have ever imagined the popularity of this show? >> no we couldn't. it's like any show, you can't imagine that it's beginning to have the impact that it can have. a lot of people didn't get into "breaking bad" until it was almost over. so we have had an amazing afterlife. i have been lucky to take that in so many different avenues of my life u and career. >> it's provided you a platform to talk about life with cerebral palsy. tell me the audition process. here you were going in to play this role and, as i said you were diagnosed when you were 3 years old. >> at the end of the day an audition is an audition. it doesn't change for a disabled doctor r or able bodied actor. they are the same thing.

the only difference is a lot of people can't see past a disability. they see it first and the actor second which is really important to change and changing that mind set. and i went in five times and auditioned in laings, once in new mexico and apparently they liked me because they hired me. >> they love you. now you're in dixieland and play a drug dealer. . >> i wouldn't say it like that. >> is there a theme that's following your life here? >> i'm a manager of an establishment. very distinguished. >> that's a great way to put it. >> it was amazing, we shot in mississippi. i have a decent part in it but small. the lead actors were amazing. i worked two days, i flew down to mississippi and there for three and the only regret i have u is i couldn't be there longer

because we had so much fun. i just got back into town yesterday and saw chris and saw everyone. >> you bonded there. here you are landing these great roles, even as you said in this film it's not a huge role, it's a milestone for you and an inspiration for kids who have disabilities. adults who have disabilities. >> my character doesn't have a disability in "dixieland." this is the first time i was just me playing this character. i'm lucky that i get to do this job because not a lot of people -- people try to do our jobs, they try to get in this industry and people don't make it. it's not an easy industry to break into. >> which is why it's even more inspiring to see what you have been able to do. on a side note, you're also a d.j. he had his first gig here in new york. we were talking play lists.
