reading several cases, i don't understand how this can happen. you must believe me it can happen to anyone. >> bates also responded to the tulsa world report claiming he was given credit for field training he never took and firearms certifications he should not have received. according to the report based on anonymous sources and unconfirmed by nbc news supervisors who refused to falsity his records were transferred to other positions. >> that is not correct. i have a written piece of paper that a mr. warren krimdon, now in jail for first-degree murder 40 miles east of here signed off to say i'd done a good job. you know the law firm has been most interesting, they seem to represent all the people that have been terminated by the sheriff's office -- >> without getting off on a

tangent, you did the training and you can prove that you were certified? >> that is absolutely the truth. i have it in writing. >> acting as a back-up involving eric harris was working as a volunteer capacity as a reserve. during the interview he apologized to the harris family. a state lawmaker is now calling for an independent investigation into the sheriff's reserve deputy program, and the tulsa county sheriff's department is conducting its own review. joining me by phone, one of the reporters behind the report who broke the story about bates' training record along with ryan keisel executive director of the aclu. thank you both for joining us. i'd like to start off with you with this report you heard mr. bates in his interview on the "today" show he can prove his record was not falsified and also linking the individuals in the report to lawsuits against

the sheriff's department. let's quickly play what his attorney said dismissing the credibility of the sources in the tulsa world report. let's play that. >> the so-called evidence of falsified training records comes from a person that was terminated by the sheriff's office seven years ago. he signed an affidavit. mr. bates would have been with the department as a reserve just about a half a year or a year at that time so seven years ago, that is their evidence and he is a person represented by the firm that's representing the family and he has a year ago been charged with first-degree murder. so the credibility of the witnesses should have been -- or that particular witness, should have been waived before running that story. >> what was the paper's response to that? >> we firmly stand behind our story. the deputy who was fired and charged in that homicide was absolutely not one of the five sources that we relied upon in

our reporting. the affidavit he signed does partially corroborate with our sources because he talked about the three supervisors who were transferred after they refused to sign off on deputy bates' training. i think it's interesting this deputy jailed in a murder case signed off on deputy bates' training before he was fired. that says a lot about their system at the sheriff's office. >> what about the claim the harris family is represented by the same attorney representing some of the sources in your article, in your report? >> that's not true either. some of our sources still work in the sheriff's office today, and are afraid for their job, so it's not true. they don't know who our sources are, i think they are making a lot of guesses, blame the messenger type attack when we would prefer to have the documents so we can, you know show whether he was trained or

not, if he has these documents, provide them to the sheriff's office. >> the aclu is calling for an immediate independent investigation of the sheriff. you've been quoted saying you have zero confidence they have the capacity or trust between the office and the people of that county and of that town here. what is the critical question you have right now regarding the independent investigation? >> you know i think that we need to see these documents. i think one of the critical questions, even aside from the investigation, is where has the sheriff been? where have the leadership and the tulsa county sheriff's department been in saying that the way these deputies even leaving aside the reserve officer program, the way these deputies dehumanize and the callous language they used as mr. harris lay dying on the pavement. the fact there has been zero condemnation of that treatment and zero questioning of the fact why was a taser used against a

subdued man to begin with. all of that in combination with the new allegations that have been documented by the tulsa world that you know these records of the deputy's service and training may have been falsified and i think some new evidence this morning saying they have given him an exemption. this is all deeply troubling and the public trust has been eroded to a point resignation is the only thing to get us to a point we can begin to restore that trust. >> mr. bates was also asked about the donations he made to the tulsa county police department. let me play a part of that answer he gave to matt this morning. >> that is unbelievably unfair. i have donated equipment as i saw fit. when the need happened to arise to allow the task force and other areas of the sheriff's

office to better do their jobs on the streets of tulsa. tulsa has a drug problem. there is no question. nobody argues that. i am willing to put up equipment to assist them to better educate the public. >> what has your paper uncovered regarding others who may have had a similar relationship with the police department like mr. bates, where donations were made and they acted in the same capacity as he did with the department? >> first i'd like to point out the reserve deputy bates was the sheriff's campaign manager for his most recent re-election, he also donated to his campaign. when we asked for the records of all donations by all reserve deputies, there are about 130 in this program, the vast majority are not wealthy people. his donations, five automobiles and surveillance equipment were the only things on the record

that the county kept and so people can draw their own conclusions. you've got one reserve deputy that's 73 years old donating five cars he's the only one that got to work undercover and carry a taser. the others are working largely traffic patrol and those kinds of duties. it's a great program, but i think the training is an issue, obviously, in this case. >> ryan what would you describe or how would you describe what you believe was going on in the sheriff's department given the information as ziva just revealed of the role mr. bates played in the campaign of the sheriff? >> i think it creates a huge conflict of interest and one that creates in its wake a really big public safety risk and jeopardy to the people of tulsa county. the disclosure of these gifts and his service on the campaign all of these things come together to create this idea that he was given special access. and, you know whether he was

given special access because of his gifts or for some other reason, because of his friendship with the sheriff, in no instance should a reserve deputy be on a violent crimes task force. these reserve programs are valuable, many legitimate reasons individuals should be contributing to the communities in ways they can do it but serving on a violent crimes task force and apparently getting there because of your gifts and relationship with the sheriff is simply unacceptable and reckless. >> i most note a statement yesterday said the media outlet putting the information out is using unconfirmed sources, they do not respond to rumor, and yesterday the under-sheriff says the training record for mr. bates speaks for itself. thank you both for joining us. thank you for your time. >> thank you. >> thanks. joining me now, developing news in the 2016 race. within the next hour, former texas governor rick perry will take the stage at a republican

leadership summit a gop cattle call kicking off today in nashua new hampshire. perry will be the first of several presidential hopefuls appearing today, chris christie, jeb bush marco rubio will speak later today. this will be the first time rubio and bush will cross paths. former governor bush arrived in the state yesterday and met with potential primary voters at a number of events. this morning he spoke at a politics and eggs breakfast in manchester. >> i'm excited about this part of my life where i'm sounding out the views of people around the country. i've been traveling around. i'm seriously considering the possibility of running over the next few months i'll make a decision about that. this may come as a shock to you, but you have brothers and sisters, so you may appreciate this, we're not all alike. >> in new hampshire, benjy, i was surprised governor bush said in the next few months as if he's still pondering whether or

not he's going to jump in or not. >> reporter: well, he's starting to get some questions about that. he had some yesterday from the press about whether it's fair to call him a real candidate at this point which comes with legal implications about how you fundraise and whether you can associate with a super pac which can take unlimited funds, but indications are he's taking his time he's waiting, we haven't seen any signs of a campaign announcement. so we will see how this plays out, if the pressure rises now that more candidates are starting to get involved. >> i want to play a couple of the exchanges he had with our own kasie hunt where she asked about minimum wage and about marco rubio, who as we mentioned, will cross paths with him while in new hampshire. let's play both of those. >> not against the minimum wage i'm against raising the minimum wage, because it will create a reduction in jobs. if states want to do it fine but there are better ways. expanding the earned income tax credit is one simple way of doing it. making sure people have skilled

to be able to get a job way above the minimum wage is another. there's a lot of ways to do this. this is all focus group, poll driven. this is not economic policy. >> should marco rubio have waited his term? >> i love marco. he's a great guy. >> that was a short answer to that question. nevertheless, if you had to measure the energy who does it seem are the people around there most excited about right now? >> reporter: well it is truly anybody's field right now. i talked to senator kelly ayotte one of the most popular republicans in the state, she said it's the most wide open field she's ever seen. i've talked to ted cruz supporters there's a draft ben carson committee here people around here interested in jeb, some people said they were impressed with chris christie yesterday when he talked about reform in the state, so you really are seeing republicans of every stripe here. this is definitely a representative mix of the gop in the state. >> thank you, benjy.

developing right now, an ohio man plotting to commit terrorism in the u.s. is in court, where he's expected to plead not guilty. the man is accused of not only receiving terrorist training abroad, but also coming back to the u.s. with plans to carry out an attack. prosecutors say he spent two months in syria getting training in weapons, explosives and hand-to-hand combat. nbc justice correspondent pete williams joins us now from washington. pete, court documents also show

who this man plans to target. >> reporter: he's 23 years old, he's from columbus and prosecutors say he bought a one-way ticket to greece a year ago, but got off the plane in the connecting city of istanbul and made his way into syria. and they say he went to the same place, syria, where his brother had gone in 2013 to join the al qaeda affiliate in syria. his brother was killed in a battle last year. prosecutors claim that when mohamud came back home to columbus he told people he wanted to target anybody in uniform and wanted to quote, kill two or three american soldiers execution style. the pictures you're seeing now is when he was arrested on state charges in february. he'd been under surveillance several months and authorities say his pro-jihadi postings on facebook helped attract the attention of the fbi. >> thank you very much. and the florida mailman who

today has something to say about this. >> it's incredible how quickly this has captured the attention of people. the story is actually the focus, of course, of a lot of attention today. what has people talking is the reaction of this reporter especially after she knows she's on camera. >> i'm in the news sweetheart, i will [ bleep ] sue this place. >> reporter: it's the viral rant caught on camera. even a warning that the incident was being filmed. >> okay that's fine and i'll play your video, so be careful. >> reporter: that's britt mchenry a reporter for espn who acknowledges the camera's presence while picking up her car after it was reportedly towed while she was out to dinner last week. >> i wouldn't wash at a [ bleep ] like this place. makes my skin crawl even being here. why, cause i have a brain and you don't? maybe if i was missing some teeth they would hire me, huh? oh, like yours? stunning.

cause i'm on television and you're in a [ bleep ] trailer, honey. >> reporter: after the video was released on thursday mchenry apologized on twitter. in an intense and stressful moment i said some insulting and regrettable things. as frustrated as i was, i should always choose to be respectful and take the high road. i am so sorry for my actions and will learn from this mistake. espn announced they have suspended mchenry one week effective immediately. overnight, nbc news spoke with someone in mchenry's camp who contends the tape has been edited, but also admitted either way, it does not justify her actions. social media exploded in response to the tape. wow, everyone has intense moments. the difference is most adults know not to berate someone for doing their job. and a whole week? wow, that's showing her that she will never be a disrespectful person again because of that severe punishment.

and some support. why is she being suspended for a tantrum having nothing at all to do with work. we have reached out several times to advanced towing which is the company. i called them again this morning, they are only answering questions via e-mail. there is a question in terms of what was the conversation in this video. if it was edited and it does appear to be edited why was it edited this way, so we are looking for those answers. we reached out to msnbc, too, they have not gotten back to us this morning. but as you and i were talking during the break, one of the issues is not the editing, it's the reaction. >> absolutely. for the person who said on twitter what does this have to do with her job, you know there are others who say she brought her job into it by saying i'm on tv. she may not have said who she worked for espn but she used that as a leveraging tool to try to get back at this worker. >> and someone who works in

of control. why would i say it if it wasn't true? i mean there's no political upside to this right? >> campaigns need to be about the future not the past. >> joining me live now, nbc news senior political editor mark murray. happy friday mark. good to see you. >> happy friday tamron. >> let's start in with this political fight over trade that could put clinton in a tough spot here. explain what's going on. >> yeah tamron this is a fascinating development. it's a really strange bedfellows fight, in one side in pretrade authority you have president obama, john boehner, paul ryan on one side and the opponents are organized labor, progressives, and even some other republicans, and hillary clinton faces a choice. does she decide to say, yes, i'm in the same position as president obama? that has the potential of alienating her with progressives, organized labor, just at the time she's trying to get right on so many issues with progressives and the democratic

left or does she say i oppose this and alienate president obama and big business. so a really fascinating thing and i think we'll get a position from hillary clinton in the next few days particularly when she's in new hampshire. >> absolutely, we know she's headed to new hampshire monday and tuesday. meanwhile, harry reid talking with our own rachel maddow last night says he could force a vote on loretta lynch's nomination that's been delayed longer than any attorney general combined. >> that's right. there is one little hitch, though, as our senate producer puts it for reid to get this he needs 51 votes. that means all the democrats in the senate plus five or six republicans, and it's unclear, even though you end up having five or six republicans who support loretta lynch's nomination, whether they back harry reid on this. there does seem to be some movement in getting loretta lynch scheduled next week one of the top communications aides for senate majority leader mitch mcconnell says there would be a

vote on this as well as the antitrafficking legislation that's held all of this up. so it does look as of now that there might be a vote next week. >> and our last topic we're taking a look at this is a developing story right now, the court taking a look at the president's executive action on immigration. >> this is the next step in the process. we ended up seeing the federal district judge rule against president obama's executive actions, now goes to the 5th circuit, three panel judges some liberals are worried because there appears to be two of the three are republican appointed judges. then, of course tamron it would next go to the supreme court after that. i don't think this fight is over with at all. >> i think most would agree with you on that. thank you very much, mark. have a wonderful weekend. we'll see you back on monday. >> you, too. still ahead -- "star wars" fans emotional and overjoyed with the release of the trailer for "the force awakened." >> the force is strong in my family. >> every time i see this, it's

highlighting the resilience of survivors. the photographer's mission features dramatic images of dozens of people who have gone through life changing experiences but are emboldened dozens who have gone through life changing experiences but are em boldened to live. a teacher was inspired by her students who would memorialize their friends killed by gun violence making them what she called folk heroes. she thought about those that survived what's their status? they thought about their story photographing in the location they were shot. she wants to show how the physical wounds may heal but scars on the inside last forever. she also wants to spark a realistic conversation about gun violence across this country. cathy joining us now in studio. also from new orleans is sarah, one of the survivors featured in the project. thank you both laydyies for your

time. >> thank you. >> thank you. >> congratulations. it takes bravery given you were a teacher. you saw something i think a lot of people understand but don't get. how people -- you see memorials of people who have died in gun violence, and it does not promote the larger conversation of what we need to do in our society about it. >> very true. our society is totally polarized. everything has turned to black and white issues. nothing is gray. gun violence is a very gray issue. this project is there to create a dialogue to talk about what's happening. we can't ignore this is happening to all kinds of people across the country, all ways life, all lifestyles. it's a problem we have to address and address by talking to each other as opposed to

about each other. >> that's a wonderful point. i said coming in many images are graphic. many are. you want to turn your eye. that's an important part of what you're doing. you want to make us look. >> deaffinitely. there's nothing sad about this project. this is an uplifting and moving project. when you look at images of survivors, strength of them comes out in this project. no one should feel i don't want to see that, that's horrible i can't deal with it. it's about strength perseverance and survival. all people i photographed so far, the 61st will be this afternoon. the goal is 100 people nationwide. all of the people are amazing and powerful and people we should look to for solutions. >> absolutely. sarah you are one of the people featured. you were 13 years old, shot at

point blank range by a man that stole your mother's car while you were sitting and waiting in that car. what also happened after that something that none of us can imagine. you were faced with a gun and the man counting down to your death there. >> yes. >> what made you decide to participate in cathy's project? >> it was the right timing. you know, my 20 year anniversary of my survival recently passed. i was at a place in my life i felt people needed to hear more of the survivor's side of the story in regards to gun violence. we just connected. it was just the right time. i think it is an incredible project to be a part of. it's very personable hits close to home. i was thrilled. i'm thankful to cathy for doing this and being able to have survivors have a voice in the conversation. >> what was it like to go back to this scene? this happened in louisiana in

1994. >> yes. it's a little difficult. thankfully 20 years has ss ss has made the environment change. it doesn't look exactly the same. it wasn't as hard as i was anticipating. it still brings back a lot of memories. survivors struggle with ptsd a lot. being put in the situation having to relive the experience is hard to deal with. that's part of our reality. for 20 years i've struggled and learned to live with. thankfully i had friends with me. cathy is a very supportive individual and asked me repeatedly if i was okay and needed anything. it turned out to be an okay experience. to be honest it was a healing experience to know i had the strength to go back there and face it and still be okay. >> cathy, your goal is

photograph 100 survivors. you're hoping to raise $12,000. you have over $1,000 raise sod far. one of the pictures we showed one was one of the victims shot at the batman movie in aurora. we have one man shot on three occasions. you have domestic violence survivors as well. how hard is it to convince people to walk back down the road as sarah did? >> to go back to the spot they were shot? >> to relive it. >> it's aning feeling actually. you may feel scared like i did to come on television. you go back to the space that's yours. you rise above what happened to you. i think the end result is very positive. it takes courage to do it. all of the survivors are incredibly courageous.
