where a new report is adding to the uncertainty about what led to freddie gray's death. today's washington post story not confirmed by nbc news. a prisoner in the police van says he heard gray banging against the walls and trying to injure himself. that prisoner could in the see gray because they were separate bid a partition, but jane miller the investigative reporter for our baltimore affiliate reported even before gray's death that there is no evidence to back up that specific claim. she says an autopsy only showed a spinal cord injury for gray and that there would have been additional injuries if he banged his own head. in addition, she says the police commissioner recently stated the prisoner arrival was calm and quiet and gray was unresponsive when the second prisoner was picked up.

in the baltimore the second night of a city wide cur few ended minutes ago. things were calm with police reporting 16 arrests during peaceful protests. 101 people were arrested on monday. they're now free because they were not charged in time because of the paperwork bag log. police also announced they will not release all the findings on their investigation into gray's death to the possible. >> we have an obligation to be accountable to the people of baltimore in this investigation. we know that there are a lot of people who want answers who have concerns they want to have addressed and we have an obligation to do our best to be accountable. we cannot release all of the information to the public because if there is a decision to charge in any event by the state's attorneys office the integrity of the investigation has to be protected. so by turning these documents, our findings over to the state's attorney's office as quickly as

of freddie gray's death and setting back the cause of justice, so the violence has to stop. but more broadly, let's remember that everyone in every community benefits when there is respect for the law and when everyone in every community is respected by the law. there is something profoundly wrong when african american men are still far more likely to be stopped and searched by police charged with crimes and sentenced to longer prison terms than are meted out to their white counter parts. it's time to change our approach. it's time to end the era of mass incarceration. we need a true national debate about how to reduce our prison population while keeping our communities safe.

welcome back to "way too early." let's turn to the nation of nepal where the search for survivors continues five days after a deadly earthquake. images are just now surfacing including video showing the base camp on mt. everest as the earthquake hit. that triggered a massive avalanche. richard engel is one of the first journalists is reach everest and has our report. >> through the window of a rescue helicopter we finally saw it. that is ef let's. >> the tallest mountain in the world, and the site of last weekend's deadly avalanche. most died here. >> reporter: this is the base camp. the avalanche came down from here. the snow and rock came crashing down destroying all of this part of the base camp and they are still looking for bodies.
