citizenship for undocumented immigrants. going out the gaitte to the left side. overwhelming senate support is laying the ground work for congress to have the final say on president obama's nuclear deal with teheran. the senate allowed lawmakers to review and reject any final deal. republican senator tom cotton who drafted the warning letter to the iranian government voted against the measurement. he said in part congress should not accept this user pags nor allow the congress any grounds. i will work with republicans and democrats to stop a dangerous deal. president obama says he'll sign the legislation as long as the house doesn't alter it. the house is expected to vote on the measure next week. john boehner wants to get this

done. let's go to the nsa. a federal court has ruled the government's bulk collection of every day american's phone data exceeds itsz authority. the three-judge panel concluded the patriot act doesn't authorize the government to store the information but didn't say if the practice is unconstitutional. attorney general loretta lynch says the obama administration is deciding what to do next. the ruler brought praise from people on both sides of the aisles. rand paul and bernie sanders, all applauding the decision. we'll see what congress can do. let's go to texas where we are now learning the fbi alerted police about one of the gunmen involved in the cartoon contest shooting. should officials have acted soon sner that's a good question. pete williams has more. pete. >> good morning. the fbi says it sent information just hours before the attack

about one of the gunmen but the fbi director says it wasn't a warning because agents had no idea he had left phoenix. just three hours before sunday's shooting attack in garland, texas, the fbi says it sent police there a secure electronic message with the picture and car license number. the fbi says it acted as soon as it developed information that he was interested in going there but had no reason to believe he wanted to attack it or even that he left phoenix. there's no indication the fbi says, that the officer who ended up shooting simpson ever saw that bulletin. garland police declined to say what they did in response to the nchgs. they say the latest property shows how recruitment has changed. from a time when they had to seek out websites which the fbi could monitor to now when isis urges anyone who will listen to stage attacks whether every they

a report. let's turn to business. markets closed up across the board yesterday. the dow rising 82 points. nasdaq up. how will the markets react to the jobs report due out today. jeff, happy day after election to you and what are investors expecting today from that jobs report and everything else? >> hi luke. good morning to you. well, the economists have pence pencilled around 238,000 jobs added. that means we get a tick down in the unemployment rate which would be good news but this is the twisted logic markets at the moment. if we miss that number that might mean that the federal reserve pushes out its interest rate move. and the markets could actually be firmer on a bad number. if you follow the logic.

otherwise, the economists are looking for the 230 number. if we get that today, the markets may not like anything that's stronger than that figure because they might figure that the fed will have to move earlier, which means tighter money, which means less to put into the market. that's where we are on the jobs figure today. keep your eye on that. one other, and this is a real head scratcher to me. i've eaten kale to be honest yuck. and yet mcdonald's as part of this new revamp are talking about or testing, potentially, putting kale from the breakfast meal. this after they poo pooed, the idea of kale. it shows you how far they're going to try and head off this slow down in sales growth. back to you. >> yes. stick to the burgers and fries this. this kale and fish stuff for
