of affirmative action in college. nbc news justice correspondent pete williams joins us live now from the supreme court. a lot to get to pete but let's start with these executions and this highly controversial cocktail use of drugs in a number of states. a highly debated issue and now we're hearing from the supreme court. >> reporter: the problem was the supplier of drugs that have traditionally been used have stopped giving them so they have to come up with other alternatives. this is the first drug oklahoma came up with. the challengers said it didn't knock the person out long enough. that when the second drug is given, it can cause the person to wake back up again, make them wright on writhe on the table. tom goldstein is with me supreme court expert. tom, what do you make of the overall views about the death penalty from this decision? >> we do have the 5-4 decision

in the supreme court with the five more conservative justices being much more forgiving and giving states a lot more flexibility. but then we saw the deep passionate divisions in the supreme court where there were two decisions read by the bench today, two of them saying they would not review the constitutionality at all, and two saying they would be willing to consider expanding it. >> and the court upheld this practice that's been spreading around the states to have independent commissions draw legislative and individual boundaries here. any surprise in this? >> it was a surprise, because we really did think after the oral argument the supreme court decision was going to hold and a way to fight back against partisan gerrymandering but they gave some momentum to lower the amount of gerrymandering in the states when it comes to

voting. >> the supreme court said it would look at the use in the university of texas at austin. they said it looked okay sent it back to a lower court to say whether it was just narrow enough to accomplish diversity. the challenger said no and after weeks, they said they will hear it next term. >> the supreme court majority has never -- none of those justices have upheld the race-conscious program, really. there is a new more conservative majority when they upheld the michigan program so the handwriting could be on the wall for these sort of efforts to incorporate race as a factor in school admissions. >> tamron there is impending use of growing use of abortion by having the doctors rights to admission in hospitals or surgical centers. we have a couple cases pending

out there. mississippi, texas. do you think we might hear about that tomorrow? >> we'll hear something tomorrow and it will be a big day. the justices could step into the mississippi case now or they could signal their willingness to step into the texas case by putting a lower court ruling upholding those restrictions on hold. >> and finally to wrap up the court dealt a bit of a setback to the epa and said it had to reds rejigger how they look at power plants, look at the dollar value of health cost to benefit analysis. >> they need to go back maybe limit the regulations and do a better job of figuring out how much it's going to cost. >> speaking of going on forever, that's it for me. >> this is great information, great for tv and obviously a huge impact on all of us. thank you, gentlemen, i greatly appreciate your reporting. meanwhile, the news

continues, though. two states say they are putting the supreme court's landmark ruling declaring same-sex marriage legal in all 50 states on hold. mississippi's attorney general claims his state is still caught up in a legal order for an ongoing same-sex marriage lawsuit. therefore, the supreme court ruling is not immediately effective. the mayor of louisiana attorney general's office said it found nothing, saying the supreme court's ruling must take effect immediately. the district attorney of texas said they can refuse to issue same-sex licenses on religious grounds, something ted cruz says he backs. >> what a crazy system to have the most important issues of our day decided by elected lawyers. we have 50 states. if states could decide this maybe new york and california would go one way and maybe texas and florida would go the other. that's the miracle of our constitution.

>> joining me live now, susan summer director of the constitutional litigation for land of the legal, the largest recognition for achieving lbgt rights. thank you so much, susan, for joining us. here we have this ongoing battle, at least three states now finding ways to if nothing else stall or hold what is now the law of the land. >> well the reality is that marriages are already starting in louisiana, they're actually starting in texas. throughout texas, county clerks are not listening to what are really pretty empty words coming from the state attorney general, which have been wishy-washy, saying, maybe you don't have to issue marriage licenses. i think on the ground county clerks understand that they do that that is their obligation under the law, and that the supreme court has made clear what the law is. >> but let's just go state-by-state. as i mentioned, the attorney general in texas said the county clerk can refuse to issue marriage licenses to same-sex

couples on religious grounds. you heard ted cruz there. if you are someone in denton county, for example, where one clerk said i am not giving out a license tieo a man and a man or a woman or a woman, what should people there know who are speaking to get married? >> first of all, they should give a phone call to land of the legal, because we'll have numerous lawyers to help out any clerk who wants to resist what the law is and they will need numerous lawyers, clerks who do that, will be exposing themselves to personal liability. justice kennedy's opinion made very very clear same-sex couples are entitled to equal dignity, to the same rights to marry. a clerk can't shutter the windows and say, we're not going to give licenses to same-sex couples. >> louisiana said it found nothing to object to the court's ruling it must take action

immediately. what do you glean or take from that? >> at most i think it's saying we're going to wait until the last i to be dotted and t to be crossed, but the governor of louisiana announced as of this morning that the state wasn't going to resist any longer. >> and lastly mississippi's attorney general said in a statement, the office of the attorney general is certainly not standing in the way of the supreme court's decision. we simply want to inform our citizens of the procedures that take effect after this ruling. while it's clear they cannot stand in the way of the law, does it concern you at all that you will have individuals who -- i don't believe the right word is disenfranchise, but certainly delay or hold what is someone's right now? >> same-sex cupouples have waited way too long in this country to be able to marry and secure protections for their family. they should not have to wait another day longer but all we see is a matter of a very short time before states and counties in all of those states have

their forms in order and are ready to start marrying. >> susan, thank you so much for your time. we greatly appreciate it. >> thank you. >> later i'll talk live to a couple in their 80s who waited 54 years to get married. they finally tied the knot in dallas moments afr the supremeter the supreme court decision. we're also following the dramatic search for two convicted murderers on the run more than three weeks. david sweat now in custody. authorities are hoping he will provide some answers as to how he and richard matt were able to pull off that elaborate escape. this morning he remains in critical condition in an albany hospital guarded by police. he was captured just two days after co-conspirator richard matt was shot and killed by officers. appearing on msnbc's "morning joe," andrew cuomo said the case is far from over. >> we have a lot of work to do investigating both the cooperators and making the point that that cannot happen and if

that happens, that will be fully prosecuted. and number two the overall systems of the prison what went wrong, and are there systems we should change? >> nbc's miguel almaguer joins us. miguel, the system is wondering what if any, cooperation he will provide. >> he is still listed in critical condition. as you know he was shot in the torso, the upper body area. the hospital will only tell us he's still listed in critical condition. they won't go into any details about his injuries. and doctors won't even tell us if he's speaking to medical officials here. the district attorney's office has told us that sweat has not spoken to investigators, as you mentioned. of course a very key piece of information is determining not only how these two men were able to escape from prison but how

they were able to evade police and stay on the lam for three weeks' time. investigators have many questions for sweat, but right now we know he is listed in critical condition, that there is a team of doctors that are working with him, and as of right now, officials say there will be no press conference at the hospital here today, but that could change if there are any developments tamron. >> miguel obviously people are still mystified how these men got out, but also the incredible way this capture took place last night. just one officer noticing this guy walking across a field. >> yes, tamron it was a lone officer who was working on the side of a street. he said he saw david sweat jogging in his direction, asked him to stop sweat ignored him. asked him again to turn around. sweat asked him what he wanted and then ran toward the woods. the officer was not able to keep up with him. pulled out his pistol and shot him twice. that's where it all came to aend. one officer, one man as opposed to these tactical teams sweeping

the area. just one officer doing his job, tamron. >> miguel almaguer thank you for the report. around america, 29-year-old christopher antonio mcneal was captured last night. he was discovered missing from a prison about 48 miles east of charlotte. a prison food worker kimberly a annette miller is charged with harboring a fugitive and having sex with an inmate. she also gave mcneil a cell phone. he was accused of attempted murder and set to be released in 2018. david cameron is expecting a full terror attack in tunisia. at least 30 of the 49 people killed were from the u.k. they were at a popular beach for

tourists and over the weekend this video emerged of a gunman on the beach running with an assault rifle. he's been identified as a 24-year-old student. the attack comes amid heightened concern about a possible terror attack here in the u.s. over the upcoming fourth of july weekend. officials stress there is no specific or credible threat of an attack but authorities say what makes things different are key factors, including the timing of the holiday which comes during the muslim holy month of ramadan. thanks for joining me again. >> thanks for having me. >> let's talk about why this latest information is making headlines here in the united states. obviously the fourth of july we are always on heightened alert particular well this rash of attacks we saw in tunisia as well as the incident that happened in france. but what sticks out to you about this latest terror alert, if it's fair to even call it that at this point? >> well remember sort of what

you just said there is no credible specific information about a specific attack. it's understandable that federal officials and members of congress are interested and concerned that something might happen this weekend, but that's the thing about our major holidays and major events. you can't let these folks who chatter on the internet interfere with sort of the daily life of the way things go. so if you want to go to a fourth of july parade and if you want to enjoy your hot dogs and hamburgers and enjoy the fireworks, i think that's the best way to show that the united states is not really willing to put up with this kind of terrorist nonsense. >> i think people certainly want to go ahead and live their lives, however, we had these attacks in kuwait, as i mentioned. the video, and you've seen it multiple times, i'm sure, of the gunman walking along the beach with tourists in tunisia, points to the fact that people from the west are still on this target list and will remain. we're dealing, though with a

different kind of organization in isis who has acted and behaved in a way far more disturbing according to officials, than anything we've seen. >> that's the thing about what's been going on in tunisia. tunisia is a company of about 10 or 11 million people and the lifeblood of their economy is really tourism, coming from holiday and vacations goers from europe. you've seen multiple attacks. the most famous one was really attacking the museum in tew neesh -- tunisia. now we've seen this terrible terrible attack. it's going to constrict in a great way. they have over 3,000 members of isis fighting in syria, iraq libya and elsewhere, which is actually quite out of scale for a relatively small westernized country. and so that's the thing about tunisia is you really have to make sure that the folks who are trying to undermine the tunisian

government, the tunisian economy are stopped, and whether the tunisian government can actually pull off this hat trick of forcing isis off the page and off their beaches remains to be seen. >> but back here in the states we've seen a number of lone wolf incidents, people who were inspired by isis to either attack police departments or plan attacks against everyday citizens here. we've talked a lot about this and in seeing that video of that one individual who was able to take 39 lives, again, 30 of those people from the u.k. with all of that said here do you believe that we believe see some significant change in policing over the next week or so entering this holiday? >> i'm sure that every single major metropolitan police department throughout the country is going to be on heightened alert. but you can't really protect everything and that's sort of the great difficulty and the great promise of the united states, is that you have lots and lots of people who can congregate and have a good time

without feeling something terrible. let me put this in perspective. i just came back from a week in israel which has significant security threat both from the north and the south, but yet you still have people going to the beaches, congregating in open air restaurants and so forth. and they just certainly -- they just had a huge gay pride parade, and they had -- in tel aviv they had something called the white parade where you have all kinds of regular people crowding the streets and having a good time. yet these people don't believe that living in fear is a justifiable way to live one's life, and i think the united states can take heart in the israeli example of living under certain risk but not allowing these terror organizations to rule your life. >> thank you, we greatly appreciate it. developing now, world markets are reacting to greece's historic decision to close banks for the next six days. atms went dry this morning, leaving the people of greece and even tourists scrambling for

react to the financial crisis playing out in greece which has come to a new head after festering for five years. it led to emergency shutdown for banks there until at least next monday to prevent a run on those banks. because of that there are long lines at atms which are functioning, but there is a severe limit on withdrawal. all of this also creating complications for a large number of tourists in greece, including many americans. nbc's kerry sanders joins us live now from athens and kerry, it truly is one of those situations where you wonder how you would react going to an atm machine and not being able to get any cash out. >> well and the reality is as you said the machines are functioning, but there is nothing in there. the machines are empty. now, the government had promised folks here that they would replenish the cash in those machines by noon today. that time has come and well long gone. the money is not there, so there is still the lines.

folks are going to be limited to how much money they can eventually take out, when and if the money makes it in there. it's going to be limited to 60 euros a day. that's about $66. for some people that's clearly not enough money to have cash on hand to live their day-to-day life. as they're looking about the fact that greece having the euro for so long now it looks like it's making people wonder if they'll be returning to the previous currency. after five years of dramatic and often painful cutbacks on government services attempts of paying their taxes, the country remains deeply indebted and cannot make an immediate loan payment of $180 million. those here on vacation are also caught up in this financial crisis. at the a crop lis, seniors in high school in california say

they're outraged and they still have little to spend here. >> i'm completely out of euros right now and i can't get anymore. i had someone pay for my breakfast and everything. >> reporter: some on vacation here say if they would have known about this they would have gone elsewhere. >> knowing what you know now, would you have gone somewhere else on vacation? >> i would have to say no to that. >> reporter: this is a case where folks are trying to figure out, this is complicated, it's monetary policy, do i really understand it? consider it this way. in the united states we had our own crisis with housing. think about greece as a homeowner who got a mortgage they really couldn't afford and eventually they went into foreclosure. even though they may have stayed in the house a little longer their house was foreclosed on. that's the condition greece is in right now.

you've got the euro basically saying, we're foreclosing on you, we're getting ready to kick you out. what are you going to do to try to stave off this foreclosure for a mortgage payment you haven't paid for some time? >> kerry, thanks so much. as i mentioned, the dow is down 200 points here. to dominic, we've seen the situation in greece turn volatile at points over this five years. we've seen obviously long lines here. what we're watching on the stock market today, at the stock market today, is this a result of instability in greece and with the euro? >> tamron there is no doubt that the market move today is certainly being caused by the greek fears and whatnot, but what a lot of traders are telling us right now is they're surprised that the market reaction hasn't been worse to the down side. you would expect if you have this greek fear the fear of the greek default of the euro you would think the market would be

down. european markets did take a big hit, but there is a sense that whatever we've seen has been orderly, not as panic drifrven as we would have expected to see here. what's interesting about the move so far is whether or not this could have a bigger effect on the u.s. stock market overall. the sense right now is that it won't have as big of an effect on the u.s. market because as much exposure as we have as a country in business to europe, it makes up only about 10% by some estimates of s&p 500 revenues for sales. so large companies in the u.s. they do have exposure to europe but it's not like it's a huge huge amount of it so that's the sense that a lot of traders are telling us, at least, that you won't see that big kind of a move here. what will be key, tamron in the next couple days next couple weeks, is whether or not you see any pronounced effects. around the world, economists tell us they're not seeing signs of panic yet, but that could

lift-off from cape canavaral. this was the third time in eight months that a cargo ship carrying food and water exploded raising new concerns about supplies at the station. nbc's tom costello has more for us from cape canavaral. >> reporter: hi tamron good day to you. a beautiful day here in florida and authorities are asking people who live along the atlantic coast here to be looking for any sort of rocket debris they might spot and if they do spot something, contact authorities. in the meantime, space x says it still doesn't know why this rocket came apart just 290 second into flight. this morning the investigation into how this seemingly picture perfect rocket launch suddenly went so wrong. a massive explosion as the unmanned space x falcon 9 seemed to vaporize over the atlantic coast. it's the third time in eight months a cargo ship destined from the space station has been

lost. last october another private company's rocket blew up in lift-off. then in april, a russian progress ship where two tons of supplies were lost in orbit. scott kelly tweeted, watched dragon suddenly fail. he called his twin former astronaut mark kelly, now a space x and nbc news consultant. >> these cargo ships have a lot of stuff, not only personal stuff, clothing and food but also supplies for some of the experiments and upgrading the space station. >> also lost water supplies parts of space suits. but nasa insists the space crew has enough water and food to last until fall. >> they've done a wonderful job of balancing all the consumables on orbit. >> for these high school students, their science experiment was gone again after first being lost in the october blast. >> this is to be expected

we are back with our first read on politics this morning. was last week president obama's best week in his presidency? speaking of gop candidates starting with chris christie the last three major republican announcements are set over the next month, and they are all sitting governors. joining me live now, nbc news senior political editor mark murray. mark, good to see you. >> good morning, tamron. >> is there have been a lot of editorials this morning, people asking was this president obama's best week? the "washington post" saying obama did everything he could to avoid spiking the football in a statement following the court's decision, but whether he came

out and said the court's ruling on obamacare validated what is without question, the defining policy accomplishment of obama's presidency. >> he had his whole convention late week leading into the 2012 reelection which was seen as a very, very good week but what was extraordinary about last week tamron was one thing after another. first his trade agenda is back on track. then the health care law and the subsidies get upheld. then gay marriage is ruled to be constitutional and legal across the country. then it's all capped off by the very big speech he gave in charleston, which many are regarding as maybe his finest speech as president. >> let's move on to some of the reaction we saw over the weekend from members of the republican party, both those running for office and those who are in leadership position. this is actually being described as a big divide within the party on how to react to same-sex marriage in this country now. >> tamron some of the

republican presidential candidates are very defiant, particularly after the gay marriage ruling. on that defiant side you have folks like mike huckabee ted cruz and even scott walker. on the other hand, there is kind of the acceptance where they weren't happy with the rulings, but they're moving on. jeb bush is in that category. you could also add marco rubio and lindsey graham to that so a little divide. but just to show you where the juice is in the republican party, our washington journal poll found a sizeable amount of republicans are against gay marriage, and when those are the people you'll have to win over in iowa and new hampshire, you can kind of tell where the debate is probably going to be and if you're somebody who thinks, well let's just accept this and move on you might have another thing coming. >> but let's talk about what you see as how this will impact the debate stage. i know we're going to talk about some of the big announcements coming from chris christie john casey and others here before the end of summer but let's picture the debate stage and same-sex

marriage comes up. what do you anticipate? >> well you anticipate in the republican presidential primary, tamron the person who usually has the most conservative answer is the one who can be trusted. sometimes you don't want to be seen as the moderate squish yes, anthony kennedy ruled this way on the gay marriage and it's time to just kind of move on. the person who stands up on the debate stage and says this is wrong and this is what i'm doing to try to fix it will get the bigger applause and will get more plaudit from conservative voters. so i do think the gravity seems to go to the right on this thing, including gay marriage. >> let's talk about, as i mentioned, casey, christie scott walker big launches but of course the question is do they have the numbers to get nem on that debate stage? >> if all three get in it means we'll have the sweet 16 and of
