this is "news nation." federal authorities have raided the indiana home of subway spokesperson james fogle. he was seen outside his home a short while ago with two investigators. authorities have been removing electronics from the home and loading them into a van in the driveway. state police will only say they are assisting the u.s. state attorney's office for the southern district of indiana. the fbi tells cnbc it's conducting an investigative activity in the area. they go on to say, we cannot disclose the nature of the activity at this time. now, this comes after the april arrest of the executive director of fogle's non-profit organization, the jared foundation, on charges related to child pornography. at the time, fogle said he was shocked at the charges and that his foundation was severing all ties to the director russell taylor. we'll bring you more as we get details in on this but right now this raid is taking place at

the home of the very popular spokesperson or pitch man for the subway restaurants, jared fogle, and we'll have more on what's happening on the ground there in indiana. turning to another developing story, we're following and waiting news statements from bill cosby's attorney on the stunning new revelations surrounding sexual allegations against cosby. new, unsealed court documents show cosby admitted under oath to buying qaaludes in the 1970s with the intent of giving them to women he wanted to sleep with. the document is from testimony from a civil suit brought by a woman accusing him of drugging her and sexually assaulting her. kate joins me with the very latest. dait kate, good morning. >> good morning to you. these are documents they fought to keep sealed for decades, but after a request from the associated press, a judge in philadelphia says because bill

cosby has been, quote, on a soapbox of moral issues he no longer has a right to keep all these records private. bill cosby, in his own words admitting he acquired seven prescriptions for qaaludes in the 1970s and gave them to other people. cosby was being sued by a woman who accused him of drugging and sexually assaulting her. cosby sat through a two-day deposition. when you got these qaaludes was it in your mind you were getting these for women you wanted to have sex with? cosby replied, yes. but he never said who he gave the drugs to or when or whether he ever coerced or forced them to take them. did you ever give them to these women without their knowledge? his attorney jumped in do not answer that question. cosby said she meets me

backstage. i give her qaaludes and then we have sex. >> i wouldn't necessarily call this the proverbial smoking gun but it is corroboration for the fact that he did use drugs in order to have sex for women. >> for barb bowman who was one of the 13 jane does in the case it's a victory. >> it's a lot of hope and i'm anxious for the next part of this journey because i think it's just the beginning. >> they are complaining to a judge that cosby's lawyer was turning the deposition into a carnival, a claim the judge later rejected. the plaintiff's attorney also at one point said to cosby, i think you're making light of a very serious situation. cosby replied, that may very well be. nbc news reached out to attorneys and representatives of bill cosby and did not hear back. cosby has never been charged with any crime in connection

with sexual or drug allegations which he and his representatives have continued to deny. a couple other things that come out in these court documents, cosby offered to pay for the education of the 2005 accuser if she got a 2.5 gpa or better. and also last fall bill cosby agreed to give an exclusive interview to "the national en enquirer" if they promised not to bring in that case. >> ari, let's talk about something i'm just intrigued by and your legal mind would know better than i. if this deposition is accurate and true and you have bill cosby admitting he used drugs to sedate women to have sex with them, that would be sexual assault, that would be rape why is it a part of the legal process that this could be sealed if someone is admitting to a crime like this? >> it's a great question. the fact is that most

depositions and sort of pre-trial materials like this can be sealed and remain sealed. there are privacy reasons and there are settlements that are often confidential in nature. in this one that wasn't judge-mandated, which is part of why the judge said in his opinion he could release it. but generally in a legal process, you have a lot of these skirmishes and proceedings that even when bad stuff comes to light, that is why individuals and organizations pay a lot of money to have a confidential settlement. >> let's talk about what one legal analyst there said that this is not the smoking gun, that perhaps you would need more if you were pursuing a civil case against bill cosby. why wouldn't this be the smoking gun? this was a deposition. this was taken with i imagine, with attorneys from both sides present, so how do you dispute what's on that paper? >> i would futput it a little differently than that analyst. i would say today we know that we didn't know yesterday, the

use of drugs to incapacitate women for the purpose of sex. that is not an individual smoking gun on par with dna evidence, right, or some physical evidence that would corroborate an individual encounter. that is the standard that any prosecutor has to look at not, did this person say that sometimes they do a bad thing or they are prone to violence but rather do you have specific individualized evidence for a particular case. i can also tell you that the prosecutor in the underlying case here from pennsylvania has said publicly that he thought bill cosby was lying when he did his criminal investigation, interviewed him separate from this case but he still didn't feel he had enough to go on for a charge. >> as i mentioned, we are awaiting a statement from bill cosby's attorney. we don't know what could be said here but is it a common defense for someone to say what i said in the deposition wasn't true or i was misquoted in the deposition? >> i mean that could be one of the things. we have to wait and hear it. >> i ask you that because it seems to me you either say, he

actually said that and that is an accurate depiction and statement from mr. cosby, or it isn't. >> yeah. i think you're putting your finger on the problem for them. this is what we can say. the ap started this litigation over 10 years ago. that's how long it took to get this out. in those debates what they talked about was embarrassment for mr. cosby. his lawyers weren't saying don't release this because it's false or inaccurate they were saying don't release this because it private and he's entitled to some zone of privacy. >> another strategy from the cosby camp could be to focus on the judge here who wrote explaining his decision to release the documents at this time after the associated press requests that mr. cosby had donned the mantle of public moralist and mounted the proverbial electronic or print soap box to volunteer his views on, among other things child rearing, family life education and crime.

there are some who wonder why one judge can make this decision, and was the judge out of order of going this direction of bill cosby being a public moralist? i'm sure there are many depositions from the wealthy, celebrities and others who have been sealed who prop themselves up as a certain person but behind the scenes have done far worse. >> i think this judge's language was somewhat colorful and the logic there is somewhat novel, but it is based on a line of precedent that has to do with public figures, typically what we think of as public officials. if a sheriff or a senator says no no that's my private life the courts have said no you don't get the same privacy protection that regular citizens do. what this judge was doing, i think, and judges and lawyers do this a creative way to distinguish this case from others and a reason to basically say what was once a secret now isn't. and so he came up with a bit of this -- i would call it a twist on the public figure argument. it's public figure plus public hypocrisy in the judge's view.

>> thaur >> thank you, ari, i appreciate it. developing now, defense secretary ashton carter and general martin dempsey have been facing some pretty tough questions on the strategy to beat back isis. they are testifying before the senate armed services committee, chairman john mccain, who has been highly critical of the president's strategy including syria. >> isil is not 10 feet tall. it can be and must be defeated. but that will never happen if we continue to delude ourselves about our current campaign. we mentioned we are currently training about 60 fighters. i got to tell you, after four years, mr. secretary, that's not a very impressive number. we have no forward air controllers on the ground and that, i can tell you, is incredibly frustrating to the young pilots who are flying these 6-1/2-hour flights who

feel they aren't achieving anything. >> this comes yesterdaythis morning after president obama visited syria yesterday afternoon and said quote, they did not have a complete strategy. he said it would take time and require more than a military effort. >> this will not be quick. this is a long-term campaign. ultimately, in order for us to defeat terrorist groups like isil and al qaeda is going to also require us to discredit their idealogy the twisted thinking that draws vulnerable people into the ranks. this larger battle for hearts and minds is going to be a generational struggle. it's ultimately not going to be won or lost by the united states alone. it will be decided by the countries and the communities that terrorists like isil target. >> let me bring in msnbc news

colonel terry jacobs for the war against isis. thank you for coming on. what does the war against isis mean to you? >> just drone strikes. we have to have very good intelligence before we launch a strike. the white house has to approve the target and we have to have a very high degree of confidence they're not going to be any collateral damage or civilian casualties, which means we are just attacking a very small number of tactical targets, and there really is no overall grand strategy to accomplish our objective. >> you have members of congress asking at this point how is it we don't have an overall strategy when you have isis gaining territory and certainly continuing their bloodthirsty quest to just terrorize the country, the nation the world. let me play a part of the exchange that took place between the secretary of defense as well as republican senator jeff sessions just a short time ago.

let's listen in. >> the strategy is to -- for defeating isil on the ground in syria and iraq is to train and then enable local forces. that takes some time. i know it's difficult -- >> general dempsey was training the iraqi forces eight years ago. i visited him in iraq. that was his primary responsibility. we've been training them for nearly a decade. and that's not the problem right now. i think the problem is confidence within the iraqi government and the iraqi soldiers that they're going to be supported and that they're going to be victorious and if they had that confidence, you would get more recruits. >> let me get your reaction to that. to the point of senator sessions here you have all this training that's been taking place. more trainers went in i believe it was just last month, some 400. how much training can you continue to do as isis continues to grow in its power structure?

>> well the problem is not as senator sessions says iraqi confidence and our ability to support them it's a lack of confidence among iraqis in their own government. you saw in romani for example, a very small number of isis soldiers, isis whatever they are, terrorists run off a very large number of iraqis. it's not going to change until there is some semblance of support inside iraq. and we're not going to be able to change that. certainly we're part of the problem and not part of the solution, but at the end of the day, it's going to take a regional force on the ground to take advantage of the attacks that we are conducting on their behalf, and you can't just do it with airstrikes. anybody who spent any time in the military knows that. >> colonel jacobs thank you for your time. we appreciate it sir. >> you're welcome. talks on the iran nuclear

program is going past the deadline. they said it is taking steps to extend the agreement currently in place with iran after july 10. a spokesman says they are more concerned about the quality of the deal than they are the clock. secretary of state john kerry will remain in vienna to continue these critical discussions. now to developing news in south carolina where the state senate has just given final approval to a bill to remove the confederate flag from capitol grounds. it's now on its way to the house, where it is expected to face a much tougher road. many house republicans have spoken out in favor of keeping the flag and in a news conference just this morning a short time ago, house democrats say they are concerned about potentially controversial plans being formulated by house republicans. >> we see movement in the house, amendments that have over 50 co-sponsors to not remove the flag but to substitute it with another confederate flag or substitute it even with the american flag. significant support we see

that for whatever reason want to keep some sort of a confederate battle flag on that flagpole and, you know i came out early on. i was one of the first two republicans in the house to actually state that we need to remove the flag and put it in the state museum. but there are several amendments to do various things and now that the senate has overwhelmingly, the last two days approved this bill to remove the flag from the state house grounds and send it to the confederate rally down the street here in columbia i think that sends a very strong message to all of us in the house, and i'm looking forward to getting that bill over a little bit later today. i'm sure it will be read across the desk today, and there are some procedural moves that will be made to try to get it on the house floor as quickly as possible. and hopefully we can move this bill forward by the end of the

week. >> what is your take on representative mike pitts, a republican, your colleague, saying that he wants to replace the battle flag with another one, leaving the flagpole standing on the state house grounds near the confederate soldier monument? do you see that as something that will gain traction, and is that a compromise in any way that you would even slightly consider? >> well it's not something that i would consider tamron. i think i've stated that in my position and made that very clear. representative pitts is a good friend of mine and i certainly respect his right to put up any amendment that he has, but i think that this is something that is not going to move us forward. this is going to keep the status quo. and i believe that we've reached a point in south carolina where we truly want to be in the 21st century. we need to remove the flag and that pole because we got a

a florida state university star quarterback is facing charges this morning afr videos surface of him punching a woman at a bar. i want to warn you, this video is certainly disturbing. the video shows deandre johnson walking behind the woman at the bottom of the screen brushing into her. she turns around and it looks as

though they argue. the woman appears to have her fist up. johnson grabs her arm and they struggle for a few seconds. the woman is seen swinging at johnson and he then punches her in the face. the nfl suspended johnson from the team last week and the person who released the video charged him with assault and battery. a witness said he bumped into her, she then shouted a racial ep thet at him. >> he grabbed her hand with which she had a closed fist. she then kneed him in the groin area, took another swing at him before he retaliated. he is very regret fullregretful that he did not turn around and walk away immediately. >> with melet's first start with what do we know about deandre johnson's background? has he been in trouble in the

past? what do we know about him? >> as far as we know i don't think he has any kind of reputation that would lead anybody to believe that this was something he was capable of or something that he necessarily had a long history of doing. and i definitely think that you know, a lot of people probably see quarterback, probably a star, and they add the other elements to it but this was not somebody who was expected to be a starting quarterback this season at florida state. he was not the replacement for jameis winston who we all know just left. >> he's a third string freshman right? >> he's a third string freshman who was expected to maybe contribute but certainly no one that i think would be considered maybe in a situation like this as a, quote, target because of his status. >> his playing on the field, his character, his background has he been someone who has gotten in trouble?

i ask this because all day long since this video popped up you see a series of videos from jameis winston who was never charged but certainly accused of assaulting another student there under heavy krutscrutiny and heavy behavior of stealing food from a grocery store and other incidents from showing ray rice on the elevator of beating his wife and ultimately claiming responsibility for it. now you have this group of what people see as this violent rash of nfl players or college players. >> that is why i think this has all of a sudden become a huge topic. of course the element of a video has always and will always change a situation, much like it did with ray rice. because of the presence of video in ray rice's situation, certainly, but this one, people in general are just much morae more aware and have a much lower tolerance than they ever had

before in terms of domestic violence. so now it's on everybody's radar. where before this might have been an incident that went largely unnoticed, it's just not that kind of climate anymore. >> when you hear his attorney claim that this woman raised her fist, that she shouted a racial epithet. you can't hear that because there is no audio on the video. we see there is this heated back and forth between the two of them. she appears to pull her fist back. whether she hits him or not, there seems to be aggression there. and then what is absolutely difficult to watch is this crushing hit from her. is this fair to put this in our domestic violence conversation or could this be something else -- violent nevertheless but not in the same vein as ray rice and some of the other cases we've talked about? >> i think this is in the same category as ray rice and jameis winston and other, you know

infamous cases. because it's violence against women, period. >> again, jameis winston was never charged. >> yes, but i think that says -- that doesn't mean that he is innocent. >> and it doesn't mean ben roethlisberger and the other people, the laundry list. i'm just trying to keep it to people who were actually charged. this young man has been charged. >> we have video and we can see what actually happened. i think people should watch it and decide for themselves. i think it's a very common accusation for a woman that she provoked him, she hit him first, she spit in his face. that is a normal thing for a victim of aggression, a normal way to react. it doesn't mean thait rightt it's right that he did this. she hit him with her left hand, a very glancing blow. but that's irrelevant. if this is the way an athlete is treating a woman in public i can only imagine what goes on in the locker room and what goes on in private.

i want to note that deandre johnson is 19 years old. it was illegal for him to even be in that bar. he has been dismissed from the team. there are consequences. he is being prosecuted by the state's attorney unlike jameis winston. the victim is willing to come forward. she's courageous and feels safe enough to be able to testify against him. and the media is doing a great job in shining a spotlight on violence against women. that is all good and i think that's the positive legacy of ray rice and other cases. >> i've spoken with young boys part of the organization from day one in new york. we've talked to young boys about violence and some of them have said they've been hit, what do we do. and we tell them walk away from any incident. violence of any kind is not acceptable.

to the people who are saying whether it was a left hand or a glancing blow or not, if someone actually takes a swing, hits someone, should they also be charged? if this were two men and two women, would both those individuals be charged? is violence unacceptable from both genders? >> those are great points and in many ways it's a legal issue. from my perspective as an advocate, i think we have to understand how complicated interpersonal violence is in every way. it's never okay to hit somebody. so in some ways she was wrong, but if there is such a thing, he was far more wrong, because he's a football player he hit her really hard. and i think that the only solution, the only option is to walk away. and he should have and clearly he's saying all the right things. but i don't think that makes this understandable in any regard. and it just goes to show our

reactions to seeing this show how deeply embedded in our society violence against women is and how difficult it is to prosecute it and to unpack it and hold somebody responsible for their actions. >> well it's an interesting conversation that people are having on line. we'll see if this 19-year-old man, deandre johnson, if his attorney speaks out more and if he presents more. right now i understand he is volunteering at a facility to help women who are victims of domestic violence. his people have put that in place right now. that could be heartfelt, that could be pr we don't know. thank you both we appreciate it. coming up banks that were supposed to be reopened today remain closed. this as an emergency meeting is set to begin in less than an hour to deal with the country's debt crisis. a live report is next. plus, why democrats are

we are watching washington's reaction ahead of a critical meeting on greece's financial status. at noontime greece's financial minister will face the leaders of the eurozone's 13 countries in brussels belgium. the same leaders have accused of making absurd demands for a new deal. greek voters chose overwhelmingly not to accept the tough terms the country's creditors were offering. it also comes with greek banks, who remain closed while their atms remain open expected to run out of cash within days. keir simmons joins us from

greece live. keir, you have these meetings in place, but it was expected the banks would now be open. >> reporter: if they expected them to be open, they expected too much. tamron, i think we should talk about the stunning news that is just emerging from that meeting before the meeting, if you like and this may explain some of the reasons why the dow is down. because what we are hearing is that the greeks turned off at the initial meeting without any written plan. now, let's just keep in mind what we're talking about is the biggest crisis in europe since 2007, a crisis that has the potential to shape the unity of europe and has financial and political implications that are difficult to predict. and yet, just to say again, we're being told the greeks arrived without any written plan. now the leaders of europe have to gather and try to talk about a plan that they haven't seen. and tomorrow we're hearing that the greeks will ask for emergency funding. it looks like the greeks are

donald trump is standing firm on his description of mexican immigrants as criminals and making illegal immigration a keystone issue in his campaign. in a statement the presidential candidate said the killing of a young woman in san francisco proves his initial remarks about undocumented immigrants were correct. trump also added even more incendiary accusation saying that infectious diseases are, quote, pouring across the border. nbc's peter alexander joins us with the very latest on trump and the continued opposition by some republicans to his words and his actions. >> yes, opposition and some people sort of supporting what he said, ted cruz among them this morning. trump is dismissing the latest company to break ties with him. that's espn.

times. we join senior political editor mark murray. our chuck todd has a very interesting analysis how it could potentially be risky for republican candidates to go after trump, it could be seen as punching down. and when he's got nothing to lose drags you down into some of the muck that it seems he's in with regards to the language he's chosen to use with immigration. but michael steele the former chairman of the rnc, was on yesterday and he said the delay with republican candidates and really speaking out against this seems as if some were looking at polls and gauging the base rather than saying this is what i believe. this is my authentic self as a candidate and this is wrong. >> tamron when you take a step back from this entire debate the biggest result is that it really exposes the fault lines of the immigration topic for republicans. as we've seen in the past, immigration hasn't been a very good issue for republicans, particularly when it's through the primaries, during the primary season of course in

2012, it was mitt romney who talked about self-deportation words that came back to haunt him. what was fascinating about donald trump was all the back and forth over his comments about mexican immigrants. when jeb bush responded to him, forcefully, i would end up adding, donald trump's response back was reminding everyone of the active love comments that jeb bush had given about illegal immigration, calling it sometimes an act of love. just seeing that dynamic play out, you can see how in debates this will be a big topic. it just really exposes all the fissures and divides on the topic of immigration. >> it certainly does. let's transfer to bernie sanders. 135,000 people showing up to see him in maine. how is he able to get these huge crowds? is this a grassroots effort something happening behind the scenes? you keep hearing the language how much of a threat is he to hillary clinton when you see

this kind of enthusiasm around him. >> tamron this has really been the summer for bernie sanders and those crowds are for real. but i'm also reminded of the summer of howard dean back in 2003 where he was also able to get some very big crowds particularly on liberal college campuses and liberal areas. it shouldn't be a surprise that where bernie sanders is doing this in places like portland maine, in places like madison, wisconsin are really hotbeds of progressives and liberals and he's doing this very very well. but tamron it is worth noting that hillary clinton is your big democratic front-runner. what bernie sanders has essentially done is consolidated on a wing of the democratic party which i would say is down around 37% or so. if we see bernie sanders getting into the 40s, that will be a sign there's something more than that. right now the story about bernie sanders is he's consolidated the oppressives in response.

. update now on a deadly collapse at the popular ice caves near seattle. the area is closed until further notice while search and rescue teams figure out how to recover the person who was killed when the ice and rock came crashing down. five others. >> reporter: seriously injured. jacob has the latest from the hospital in seattle where the three victims are being treated. >> reporter: this morning one person is dead and five others are injured after a section of the popular big four ice caves in northern washington suddenly collapsed monday. >> being advised for a possible partial collapse of the ice caves. it's nine subjects possible injuries, some subjects unconscious unconscious. >> reporter: more than 100 rescuers raised to the remote area about 70 miles northeast of seattle. >> frozen avalanche chutes below a giant rock chute.

>> reporter: three of the injured hikers two men and a woman who all suffered from crushing type injuries and broken bones, were airlifted to harbor medical center in seat approximately a fourth victim juvenile not seriously injured, was transported by ground. it was the second day in a row that part of the ice caves collapsed. on sunday one woman was recording when a portion of the i'm is a cave gave way near a group of hikers. officials warned the public in may to stay away from the unstable and dangerous caves. warmer than normal temperatures were melting the ice and snow months ahead of schedule. sadly this cave-in was deadly with one person buried inside. that cave area is closed until further notice. rescue personnel recover the body of that deceased individual. it is meticulous work. the rescue personnel also have to make sure that they are being safe as well. tamron? >> thank you, jacob.

welcome back. we're following breaking news out of south carolina. defense officials are telling nbc news reports of a midair collision between an air force f-16 and a cessna private plane. this is some of the debris believed to be from that f-16. we're told that may be a portion or part of the engine of that aircraft. this happened about 11 miles north of charleston. the reports indicate the military pilot safely ejected from that f-16 before it crashed. no word on the passenger and pilot or just pilot, the people inside the cessna itself. we'll update you on this. again, this midair collision being reported details coming from defense officials saying the midair collision between the air force f-16 and the cessna private plane happened about 11 miles north of charleston south carolina. we'll continue to follow this breaking news and update you in the next hour. this does it for this edition of "newsnation."
