8:00 am
good morning, everyone. i'm alex witt for tamron hall. this is "news nation "." developing now, there is an all-out battle on the deal in iran and republicans are blocking the historic agreement at every turn. we need a president who will terminate that bad deal with iran on day one. >> we have legitimized iran being a nuclear threshold country, and that in itself creates huge instability in the region. >> we know the iranians are going to cheat. >> this is a terrible deal. anyone could have done better and you have taken a can of gasoline and thrown it on a fire as far as i'm concerned. >> vice president biden arrived on capitol hill to brief
8:01 am
congress on the agreement. in an interview yesterday with the "new york times," the president explained why some of his critics are wrong. >> what's been striking to me is that increasingly, the critics are shifting off the nuclear issue and they're moving it to well, even if the nuclear issue is dealt with they're still going to be sponsoring terrorism so they better get this sanctions relief and they'll have money to engage in these bad activities. that is a possibility, and we are going to have to systemically guard against that and work with our allies the other countries, israel to stop the work they are doing outside the nuclear program. >> but in an interview in just this past hour with nbc's lester holt prime minister netanyahu again blasted the deal. >> i think this is a big
8:02 am
mistake, and i think iran has two hats in the bomb. one is if they keep the deal and one is if they cheat on the deal. they were given relief of sanctions, keeping their infrastructure and allowing it to expand within a few years. >> meantime the chief negotiator, zarif, returned home to a hero's welcome. on the streets of tehran the deal has been reached with celebration over the crippling of u.n. sanctions which has hurt the average citizen in iran. chris jansing is joining us from the white house. they are attempting to sell this deal in america, both parties in congress, that has got to be a full swing. >> reporter: it is indeed. all hands on deck alex and you can imagine the president already giving the interview to tom friedman. he's going to be out there to try to sell the deal to the american public. it started with his address
8:03 am
yesterday morning and it continues today where he'll take 45 minutes worth of questions. he's also going to have pretty much everybody out there who is involved in this deal. we've already seen as you said joe biden, hillary clinton was also on capitol hill. you'll see john kerry who basically has not slept in weeks and is still suffering from the after-effects of that broken leg. he's going to be lobbying so well the person a lot of people consider their secret weapon energy secretary moniz, because when you hear skeptical democrats, they'll say i really need to read this bill i really need to know the details, he's the one that can answer a lot of technical questions. and the final point i'll make millions of dollars will be poured into this campaign on both sides essentially trying to win over the hearts and minds of the american people. that could influence those in congress who haven't yet made up their mind. >> but chris, given their hold on the majority has the white house assumed democrats are passing resolution in approval of the deal? >> reporter: the whole pointer
8:04 am
of -- point of this full court press, alex is to make sure they have the number of democrats they need to sustain a veto. that's a 2-point threshold, they feel confident about it but the republicans know they have 60 days and a big chunk of that, they'll be home for recess so they are hoping they can start to win over more and more americans who then will put pressure on their members of congress. even if they don't get that veto proof majority they may succeed in helping to make the democratic party look more divided since most republicans have been vehemently against this deal. >> what about the president and the relationship with prime minister netanyahu? i know he's already called him as well as saudi arabia's king. how do you think those calls went? >> reporter: i don't think there's anything that surprises me. there is a strain there with russian president benjamin netanyahu. he said in public look it would be great if we were dealing with a democratic iran
8:05 am
if we were dealing with a progressive country. we're not. we had to look at this deal in the context of the cards that we have and that means that we had one singular priority and that was to prevent iran for at least ten years but beyond from obtaining a nuclear weapon. the white house believes this deal does that. they believe it increases the security of israel. he's not going to convince benjamin netanyahu of that nor is he going to convince skeptical republicans, but he does think he can convince many democrats and many americans. >> all right, chris jansing at the white house. thanks, chris, so much for that. jackie spear from california members of the armed services and intelligence committees. good to have you and i'd like to ask you first whether you like the deal, what's good and what don't you like about it. >> i think the most important message to convey is this deal is going to take two-thirds of the uranium that's enrichded and
8:06 am
get rid of it two-thirds of their sen tricentrifuges will be shut down. the alternative is that iran would be probably three months from having a nuclear weapon. we are now going to shut that down we're going to have inspectors on the ground to inspect and to monitor. i think this deal has lots to be very grateful for, and we had top-notch people negotiating for us both the secretary of energy and the secretary of state, real talents, and i'm very confident that the president has done the right thing here. >> how about strong enough verification provisions? are you comfortable with what's in there? >> i'm still reviewing it but there are very strong verification provisions in the agreement. within two hours of their request, the iaea would be allowed to do inspections on regular sites. on more questionable sites that issue is subject to more review.
8:07 am
but on the sites that we know exist, the inspections will be able to take place within two hours. >> congresswoman, i know you were at that meeting this morning with vice president biden, with house democrats. what did he have to say and what was the reaction among your democratic colleagues and were they asking tough questions? >> well vice president biden was greeted with sustained ovations by all the members. he is truly beloved. he spoke off the cuff unscripted as we like to see him. and he told it like it was and like it is. and i think the result is he probably swayed a lot of members to support the proposal. he was well briefed on it very knowledgeable, and he was willing to come back willing to have secretary munoz come in willing to have secretary kerry come in. so we're going to have all the resources we need to ask the questions and get the answers. >> i want to play a little bit of what senate relations bob corbett said this morning on
8:08 am
"the morning show." here's that. >> i think every responsible person here in congress should begin with a skeptical outlook. i mean we're dealing with a country that is not trustworthy. let's face it the constraints come off, research and development will have been done their ballistic missile system will be much stronger their economy will be strong and so what happens at the end of this period? >> what's your reaction to that and do you think democrats are holding a healthy skepticism? >> i think it's important for us to always be skeptical and ask questions. i am prepared to respond to questions i'm asked by my constituents that i don't have the answers to and pose them before the administration. i believe that healthy skepticism is good but let's not -- let's recognize that in fact you could be throwing out the baby with the bathwater here.
8:09 am
and we've got to be clear about the fact that we now have a deal where we're on the ground. we're going to be able to inspect. we're going to be able to hold them accountable. and that they are no longer going to be able to act in a manner that is irresponsible relative to nuclear weapons. now, can we trust them? no. and that's why verification is so critical. we have no reason to trust iran. they have shown over and over again that they are not honest partners. but meanwhile, we have all the other countries in europe and we have russia and china on this deal agreeing to it. if we were to solely step aside from this and say, no we're going to retain our sanctions, what would happen with the rest of the world is that their sanctions would be lifted. and we're not a huge partner, trade partner, with iran. many of these other countries are. so the benefits that would accrue to iran and not have the benefit of inspections and
8:10 am
holding the line on building a nuclear weapon would be tragic. >> all right. california congresswoman jackie speer. thanks for your time. >> thank you. a reminder president obama will hold a news conference this afternoon at 1:00 eastern talking about the deal with iran. we'll bring you live coverage with that. jurors in the colorado movie theater massacre are about to deliberate for the first time. prosecution and defense ended their cases yesterday. the defense attorneys argue holmes was in the grip of a psychosis. >> this guy walked into that theater and tried to murder everyone in it. >> when mr. holmes stepped into that theater on july 20th 2012 he had lost touch with reality. >> msnbc's scott cohen is
8:11 am
joining me now from centennial colorado. scott, welcome to you. jurors questioning holmes' sanity,en whether he was the shooter. how clear is the definition of sanity as it's been presented to them. >> they do have alex a very specific definition they'll be looking at. we've just gotten official word na the jury nine women, three men, have started their deliberations. before that they got about 60 pages of jury instructions read to them yesterday. they have these in the jury room and they include this definition of insanity. if they find that james holmes was incapable of distinguishing right from wrong, and that's moral right from wrong, not criminal right from wrong, or if he suffered a mental disease or defect that prevented him from forming a culpable mental state, in other words the intent to commit a crime, then he's insane and they have to find him not guilty by reason of insanity. that's the debate not whether he was the shooter almost exactly three years ago.
8:12 am
before they got that instruction -- or i should say after they got that instruction, they heard those closing arguments, four hours' worth of sometimes impassioned closing arguments. george brockelman never once referring to james holmes by his name. that's a comfort to the family never wanting to give him attention that he's looking for. >> the prosecution has proved beyond a reasonable doubt that that monster was sane at the time of the shooting. >> we're all getting more anxious because we don't know what the verdict is going to be and we don't know what that will lead us to next. >> reporter: again the jury nine women, three men now officially deliberating. the only time we expect to hear from them is if there are any questions about the evidence
8:13 am
they heard over nearly three months, and then when we finally get a verdict, we will see when that happens. when we hear there is a verdict, we're supposed to give three hours' notice before the verdict is read. joining me now is michael greco, former assistant attorney now defense attorney. michael, on the issue of what constitutes insanity how tough is it going to be on this story? you have prosecutors saying he was sane to the defense saying he was legally insane. >> it's something that's a rare situation when a jury comes back with a not guilty by reason of insanity. it's not unheard of but it's rare. an example would be john hinckley who shot ronald reagan back in the '80s who was found
8:14 am
guilty by reason of-- not guilty by reason of insanity. it's a very fine line but it's a very rare verdict for a jury to come back with. >> there is so much for this jury to consider as you know michael. there's 1500 pieces of evidence introduced in the trial. how does a jury try to make sense of all this? >> what's good is that you don't have a whodunit. this is simply about what the thought process was. the prosecutors laid out methodically all the planning that went into it. he spent two months planning this. what they made a serious point of is he went to those movies nine times during the two-month planning process and he went through a plan when it came to actually setting up a booby trap in his apartment. they are trying to show that he was cool he was calculated he chose clothing in the right way to show that he is sane. the flip side of that is the defense are going to talk about
8:15 am
his actions are so crazy that he must crazy. that's the defense, and that's a lot for the jury to chew on. i don't think deliberations will be over in just a couple hours. >> this is also a lot coming up here because the jurors heard heartbreaking testimony from the victims, the families also first responders. let's hear some of that. >> i told him that i loved him and that i would take care of our baby if he didn't make it. >> by the time we pulled into the hospital she stopped talking and she lost consciousness. >> the judge told the jurors don't let your sympathies influence your verdict. is that possible? >> well it has to be. unfortunately, jurors are going to have emotions. you don't ask the jurors to walk in and become robots but they really have to turn it off. every jury instruction in all 50 states includes a line that says you need to leave your sympathies at the door and you need to assess the facts, you need to assess the law, and you
8:16 am
need to do that without emotion. it's a very difficult thing to ask, especially when you have folks coming in who have lost loved ones who are injured themselves, who see photographs. it's a difficult thing to ask but they go through an extensive voir dire process, and they try to select jurors that can come up with a fair verdict and separate emotions. coming up surveillance video inside "el chapo's" cell showing the exact moment he vanished. plus we'll take you inside the elaborate tunnel where he escaped. a new poll shows donald trump surging to the top of the presidential field but where does he stand in a match-up with hillary clinton? it's part of this morning's first read. plus the courage controversy. the special honor being awarded to caitlyn jenner and why some say its undeserved. join our conversation on line. you can find me on twitter

developing now, mexican authorities have released new video of what appears to be the very moment notorious drug kingpin "el chapo" guzman escaped from his prison cell yesterday. we're looking at the tunnel he used to make his daring escape. mark potter was one of the a handful of journalists allowed in that cell. >> the prison connects to a house about a mile away and we got a chance to go into that tunnel last night and it was amazing to see how well constructed it was. this was done by professionals, done by engineers, people who really knew what they were doing, they took a lot of time to do this and it allowed "el

era of exploration. >> people landing on pluto, that's impossible, right, because of its distance and also the makeup we believe the surface is? >> it's impossible today, but who knows what tomorrow holds, and one of the things we're considering is sending humans out of our solar system and to a star system that's very distant from us. as we go out, we're going to need resources and the asteroids and the objects may serve as resources for us so who knows. >> all right. there's been a lot of debate and this has reinvigorated it whether pluto is a satellite or not circling neptune. >> it revolves around the same sun, but while it does that it actually crosses the or pit ofbit for 20 years out of its 214-year orbit. no planet does that. that's embarrassing. if you're a planet you should not be crossing another's orbit.

>> should pluto be embarrassed it's crossing neptune's orbit? >> it should not be embarrassed. there is a whole slew of objects that come across and cross neptune's orbit. what we now understand is we don't think of the solar system being the sun and nine planets, we think of it as the sun and different families of objects. the asteroids, the kuiper belt which pluto is a member of constitute these main families so some of those families are primarily dwarfs. pluto is large enough to be a sphere. some people think if it's large enough to be a sphere we should call it a planet. weave made we've made a compromise and it's called a dwarf planet. >> new horizons what do you think is next for the frontier of space exploration? >> right now it's been an era of

>> it's very interesting. amazon prime costs $99 per year. with that you get free two-day shipping on many many items as well as some other perks that come with content from music and video and photos and the like. prime day is for those prime members. we don't know how many prime members amazon has because it's never disclosed it. experts guess that probably there's somewhere around 44 million to date. that's from consumer intelligence research partners at the very least. so it is geared more towards them. what's also interesting, alex is that prime members probably spend more than nonprime members. again, that consumer intelligence research partners estimate they spend $1200 per year versus $700 per year so they're already spending more money. maybe they don't need the deals as much. some folks are speculating that amazon did this to liquidate some of its inventory and perhaps that's where you're getting some of the people upset about what they're actually seeing. we didn't know until today what amazon was putting on sale how much the sale prices would be
