veteran john mccain. it shows trump is still leading the pack. plus evacuations under way as a massive fire still burns in new jersey. we'll have the very latest from that scene. good morning, everyone. i'm tamron hall. we begin wretith the release of that dash cam video showing the moments leading up to sandra bland's arrest. the individual yoesvideo was released by the department of public safety yesterday evening. in the video bland is reportedly pulled over by the officer, he says, after she failed to make a lane change. >> how >>. >> i'm waiting on you. this is your job. >> i didn't know you were -- >> i was out of the way for

speeding up. >> are you done? >> you asked me what was wrong and i told you. >> okay. >> this morning after members of the media and others questioned whether the video was edited the texas dps is rejecting that claim, and the fbi has also examined the video. a spokesperson blames a, quote, technical issue on what some perceive as glitches in the footage. the agency is still investigating the encounter between bland and the trooper. in the video, the situation escalates when the trooper asks bland to step out of her car and eventually pointed his stun gun at her. >> get out of the car now or i'm going to remove you. >> and i'm calling my attorney. >> get out of here. >> let's do this. >> we're going to. >> yeah. don't touch me. don't touch me. >> get out of the car! >> don't touch me. i'm not under arrest. >> you are under arrest. >> i'm under arrest for what? >> get out of the car!

get out of the car! now! >> why am i being apprehended. you're trying to give me a ticket for failure -- why am i being apprehended? >> i'm going to drag you out of here. >> you're trying to drag me out of my own car. >> get out! now! >> once bland was out of the car, police say the two physically struggled which was not seen on camera. the trooper says bland became quote, uncooperative and combative and that she kicked his right leg. bland was taken into custody for assaulting a public servant. she was found dead in her cell three days later from what authorities say was an apparent suicide. her family disputes that claim. yesterday the district attorney announced her death would be investigated as a murder and both the fbi and texas rangers are continuing to investigate the circumstances surrounding

her death. trooper asynia is now on desk duty pending investigation into bland's death. i'm speaking to john burress as well as helen ginnings. helen, let me start with you. you were one of the lawmakers in that state pushing for the release of this video. why did you believe it was necessary for the public to see what happened that led up to that moment? >> there are a lot of questions, and we need to try answering some of those questions, particularly for this family. our hearts certainly bleed for them. but i think ultimately everybody wants to know what happened and how is it that a simple traffic violation, changing lanes without a signal, ends up with a young woman losing her life. >> and there are two separate investigations here. to your point, the arrest itself, that encounter we're able to see on that dash cam and

the investigation of what happened in that jail cell. so i want to break down here this arrest on its own. you and others have pointed out that you believe she should not have been arrested in the first place. you hear mrs. bland continually being asked, why should i be arrested? she even challenged the trooper who dragged her from her vehicle and never answered why she was being arrested. >> well the director of dps has indicated that she should not have been arrested. >> what are your other concerns about what we see on that video? >> well pardon me. the situation seemed to have escalated instead of de-escalated, and there were many opportunities for the officer to have given the warning ticket and allowed this young woman to go on her way. basically, i think everybody agrees that smoking in your car is not a violation of the law.

and based on that she should have been allowed to continue to smoke her cigarette, do what she was doing, without it becoming a more escalating as it did. >> you understand people are very suspicious after seeing that video and some of the details we've learned from watching with our own eyes. you have this morning atexas officials and the fbi saying there was a technical glitch in the video that makes it appear that it was edited. as you may know by now, the claim director tweeted out, i edit footage for a living but anyone can see this official video has been cut. are you satisfied with the explanation given as to why there is a glitch in that video? >> i haven't really looked at the glitch. the video i saw yesterday did not appear to have the problems that i've heard reported on the

news this morning. i need to go back and compare. but we looked at the video yesterday, and i do not believe that we saw the kinds of things that have been reported today with cars disappearing, and obviously some problems with the video. so i'm not in a position to speak to that. i have not spoken to the director of the dps just yet. >> john let me bring you in. as we all know you've handled a number of cases from california with rodney king asknd many others in between about police and use of force here. as i mentioned, you have this investigation now that is being treated as a possible murder here. but what we're watching in the video of this initial encounter, as the lawmaker pointed out, escalated here what concerned you or what do you believe is a valuable point of information for this investigation? >> first off, it's the officer himself who escalated this issue. this is really a very minor

offense. he should have told her that you're either going to get a warning or you're going to get a ticket and signed the ticket and that will be it. there was never any effort on his part to allow her to sign a ticket, and therefore she wasn't placed on notice as to what was going to happen. he then becomes argumentative and sort of demanding that once she puts out her cigarette and get out of the car. none of that was necessary in light of what had taken place. he was the one that physically ultimately started the use of force when it was not necessary. then to threaten her with the taser, you have to wonder whether this officer received any proper training on how to de-escalate a situation. it was his inappropriate conduct that caused this entire situation. if he had been more professional and talked to this woman in a more civilized way, we would not have this particular problem. it's really his conduct that escalated and caused the ultimate confrontation that took place later. >> john i want to show another clip in which the officer tells

her she has epilepsy. let's play that. >> i'm going to make you feel real good. you're a real man now. you're going to slam me slam my head into the ground. i have ep lepsilepsy. >> good. good. >> this officer is now on desk duty. does this explain what happened even the allegation that she kicked him? >> absolutely. the fact he claimed certain things and some of it is not seen but i think his conduct and his reaction to her when she said i have epilepsy and he says, good and sort of threatened her with more physical force raises questions about his credibility and whether you believe anything he had to say. what you have in that tape is him trying to cover his conduct when he suggests he had been kicked and had several bruises when the point is he is the one that caused all of this and was physically aggressive toward

her. he didn't have to do any of this. he would have taken the ticket and she would have moved on. it set up a scenario where this woman is physically assaulted by this officer and put in jail. and the false charges are saying she was resisting arrest and she was assaulting him when he was the one who initiated all the physical contact. she would have gladly taken this ticket if he had offered to give it to her. >> thank you for your time. helen, we appreciate you joining us as well. we'll continue to update the investigation there. we're following a developing story out of ferguson missouri. just this morning, ferguson announced his new interim police chief. he is andre anderson a police chief out of glendale arizona. he's been a police officer in glendale for 24 years. he's the second interim police chief after police chief tom jackson resigned in march. they criticized jackson's handling of a protest after

michael brown was shot nearly a year ago. there were civil violations in michael brown's death. developing developing now, jurors are set to decide whether colorado mu sheeovie theater shooter james holmes should get the death penalty or prison for life. the jury needs to weigh the extent of holmes' mental illness and the injury he caused. he was convicted last week of killing 12 people and injuring 70 others when he opened fire in that crowded movie theatre. scott cohen joins us live at the courthouse in centennial colorado with the latest. scott, i think a lot of people say this is almost the more difficult part for these jurors. >> reporter: it is. there is a lot they have to weigh and it's really going to be up to this jury of nine women

and three men whether james holmes lives or dies. remember that the defense initially offered to accept a guilty plea if the prosecution would take the death penalty off the table. the prosecution would not do this, so we had that three-month trial. and now we get into this really a three-pronged phase where first the jury will look at aggravating factors, the fact this was a heinous crime, a mass murder where a child was involved. then thil look at mitigating factors, mental illness and other issues with his past and decide whether the aggravating factors outweigh the mitigating factors. then if they see that is the case there will be the impact statement. so we'll hear more from families and survivors about the destruction and heartache that james holmes caused and then ultimately up to this jury to decide whether it's death or life in prison. >> all right scott. thank you very much for the latest from colorado. in less than an hour we are expecting new information about the attacks in chattanooga,

tennessee that killed five service men at two military recruitment centers. it's also being reported today that one of the marine victims may have been armed and returned fire. meanwhile, investigators have new information about the potential involvement of abdulazeez's uncle who was in custody in jordan. officials say he was radical and that the suspect stayed with his uncle in jordan during his trip there last year. let's go to nbc's sarah daloff. i was just handed new information that authorities are looking into four acquaintances of the suspect? >> reporter: that is true, tamron tamron. previously we were told it was two acquaintances they were looking into. they wanted to know if they had any indication what the shooter had planned. these were two acquaintances who had gone to buy ammunition with the gunman. now they say it's actually four acquaintances they are looking

at. this doesn't necessarily mean they knew of these plans, that they could have stopped him, but they want to know exactly what they knew. we saw the fbi go to an apartment about 20 minutes from here the day before yesterday. this is all part of piecing together this possible motive for the shooter. authorities also saying that they now know he downloaded recordings by anwar al-alaqi. he was that iraqi born cleric that was killed in yemen in 2011. not only did he have the recordings, he also had a cd of sermons. we also learned more about the gunman's uncle was detained in jordan, authorities describing him as a radical. they want to know if he had any influence over the gunman during his 7-month visit to jordan last year. a family representative is disputing that characterization saying he's a businessman, not a radical, and the uncle's attorney is speaking out saying that the gunman's visit to jordan was to spend time with family, he spent a lot of time

graham should send a thank you tweet or note to donald trump because they're getting more attention than they've been able to get on their own, because as trump pointed out, they are polling very very low, sometimes zero in the field. but the trump phenomenon tamron is a really real and troubling, from my point of view, phenomenon, because he is tapping into this feeling of anger in certain precincts of the republican party, and he is not going away any time soon. >> which you wrote about in your editorial on him. you pointed out that his prominence cannot be attributed to simply the celebrity and name recognition. and i was actually intrigued by you saying that because we've had a list of pundits and others come on and they say, oh this is just about name recognition. his name is on top of buildings throughout this country, he had a successful television show. but you were pointing out, and many others i think, now as

people feel when they hear talk. the problem with mr. trump's language is it's divisive it's angry, it's mean-spirited. we have to appeal to people's higher aspirations or we'll lose elections over and over and over again, and that's my problem with mr. trump. >> but you go back to that autopsy report after mitt romney lost, ruth and the whole party said they would take a look at opening their arms to mexican voters, hiss tanpanic voters people who matter in a great number of states, including, of course texas and arizona where trump recently visited here. but we also know in politics and quite honestly in many aspects of life the person with the loudest megaphone regardless of the divisive tone on getsften gets the followers. for many this is angry and hateful language, but there were many in the room applauding donald trump. >> indeed. in fact his message may be

resonating in certain parts of the republican party. obviously it is resonating in certain parts of the republican party. but i think governor bush is right, and our emcee chairman was right after the last election. this is not long term either good for the republican party or good for the country. it is not good for the republican party because it's guaranteed to turn off the fastest-growing demographic section of voters and it's turning off other people who are potentially willing to consider a republican candidate in the election campaign. they don't necessarily want to be associated with a party that is identifying itself or being -- some of its folks being identified as so ugly on this topic. >> and i get that but the question is will he force some of the gop candidates to move? and i want to point out what our first read said regarding romney and herman cain. they point out that trump has

co-opted the message from his rivals. they point out, remember the tax plan? romney has been forced to make his own tax plan. what will this do with the other candidates if fox decides to go by the recent numbers? what will he force them to do to get in the game? >> i think there is a fork in the road for candidates whose last name isn't trump. and it's really a character test for them. some of them like governor bush, can say they understand the frustration people have looking at illegal immigration, but they can talk about the divisiveness of his rhetoric and they can reassert what their position is about the importance of providing a path to legalization in some form for folks who are here illegally. so that's one character test as far as i'm concerned, is how quickly and how vociferously

this morning attorneys for bill cosby are fighting back over the release of unsealed court documents in which he admits to obtaining drugs to give to women he wanted to have sex with. koz cosby's attorneys are seeking to block further release of his deposition from the 2005 sexual lawsuit. in papers filed yesterday,

cosby's attorneys say the plaintiff has, quote, made a mockery of an agreement she signed in exchange for money. they also accuse her of violating terms of the settlement. nbc's stephanie goss has more on cosby's latest legal battle. >> reporter: at the center of the controversy is a deposition given by bill cosby in 2005 partially released by a judge earlier this month. in it cosby admits he obtained qaaludes in the 1970s to give to women he wanted to have sex with. but in court documents filed tuesday, his lawyers say the media immediately pounced and cavalierly misinterpreted their client's words, suggesting cosby admitted to rape. cosby has never been charged with any crime, and his attorneys vigorously deny accusations that he drugged and sexually assaulted more than two dozen women. over the weekend, the "new york times" obtained the entire deposition. cosby's attorneys say the

members on the deal. house secretary ernest moniz spurred the deal and treasury secretary jack lein will be spurring the deal on. joining me now, congressman adam schiff of california, a member of the house intelligence committee. congressman, thank you very much for your time. >> you bet. >> in recent comments you said whether i can support the agreement will hinge on information whether iran is complying and whether we have timely access to any site of iran's potential nuclear development activities, including control by the irani military. that's the sticking point, venues controlled by iran's military which are not part of that deal. >> this is a very key concern, and it's a concern not only because the broader provisions

of the agreement that pertain to the enrichment activities but actually the easier thing to hide in chief would be the military applications, so computer modelling of a nuclear explosion, some of the weapons research that is precluded by this agreement, would we really have eyes on that kind of research and development activities if it takes place at the military site? so that's a key question. i think the question really falls in three buckets the one you mentioned, which is how enforcible is this really what's detectible to iran cheating. the second is how do we push back against what iran is going to use some of this money for, which is support of hezbollah, support of hamas, interference of yemen, and most significantly at the moment what it's doing in iran to continue that civil war there. and finally, and perhaps most important of all, is there a plausible alternative? those are, i think, the three

questions that most members are asking. >> and you have critics who say will we be back at this same point in about 10 years, and their belief is the united states felt pressure to our european allies who need iran who are focused on their energy issues, and obviously iran in a desperate situation because of sanctions but still having some leverage here over europe thus co-opting in a sense the deal that the united states really should have pursued? >> and this is something that i think most of us are grappling with which is we have to try to separate the questions about what kind of deal could we have gotten, what if we had done this differently or negotiated this differently or had a credible military threat. the reality is we have the agreement we have before us. the what-ifs at this point don't add a lot of value to the discussion and debate. is this agreement worth entering into or is it not? ultimately that's the decision we have to make. >> and quickly, 59 days left

here to review the deal congress expected to vote to reject the deal. the president vetoed the resolution here. what are you seeing from your democratic colleagues? as we know there is a heavy lobby going on on both sides, specifically yours. >> i think there is a big number of our members who are prepared to support the president and support the agreement. there is also a block of members who may be decisive here that still have yet to make a decision that want to continue to go through, and there are a lot of documents here. there's the classified the unclassified documents, all the annexes, as well as have the filter of the experts out there to talk about what does this provision really mean? is it something that we can implement? i think members are working painstakingly through this. we're undoubtedly going to be barraged at home in our districts, i am already, and that just comes with the territory. but this is probably one of the most significant decisions we're going to make. it really is a decision potentially of a war of thieves,

political editor mark murray. mark, i've seen a lot of research numbers on the amount of tv coverage trump has received, and looking at the first read this morning, and just about every story on the front page, it's about trump. it's not really the celebrity, it really is about his supporters and the people who are rallying behind him. >> it is, tamron, and you end up getting a lot of publicity when you are starting to lead in the polls, but to me what does it really mean that donald trump is at 24 or 25% in the latest "washington post" abc poll? in some ways the best way to look back at it is look at the 2012 race when there was always a differential alternative to mitt romney. you had a michelle bachmann surge at one point, then rick perry, then herman cain then newt gingrich and finally rick santorum and it was rick santorum who was the final person that matched up against mitt romney but it was always about who those voters were their support, what mitt romney

have a little bit more civil discussion going on? >> that is a good point. last topic says this would be the lead if we were not talking so much about donald trump, and it's this new poll in three swing states one by president obama who shows hillary clinton struggling. >> it does show vulnerabilities, and these are key battleground states tamron. it is important to note that it is very, very early. also hillary clinton ends up leading in most national polls against her republican rivals and the national polls often reflect what is in these battleground states because these battleground states, after all, kind of reflect the middle of the polling in the country. >> we should name the states though. colorado iowa virginia. >> correct. those are three very big presidential battleground states tamron. but we need to kind of wait until the nominees are in place before we start to really zero in on who is up and who is down in these key individual battling grounds. >> absolutely. thanks so much mark.

getting their information and talking to their friends, making their decisions. so he knows he has to be there. and he's very relaxed. he's very comfortable with popular culture, with media. and he's thrived as a result on this program. >> what's interesting, one of the headlines i saw prior to the taping was would jon stewart be friend or foe to president obama. we know that to your point it's an entertainment program, but it's also an intellectual program where he is willing to challenge any of his guests including president obama. and i actually -- there was a part of me that saw this as cosell and ali. you knew he was a fan but was still willing to stick it to him if needed. >> jon stewart is a comedian. he always says that he's a comedian. but he takes things like hypocrisy and government dysfunction and cynicism in

communicator and someone who really understands these settings. by the way, he said as much. on one of the things that he talked about on the show was proliferation of media and how you have to deal with that today. with so many news outlets and so many of them not necessarily agreeing with you, can shape your message. he kind of sort of envied those days where there were just three networks and if the government thought something was important and one of the networks did a documentary on it it got the attention of a lot of the nation. not so easy to do now. he understands that. and he knows that part of his job today is to be able to navigate this new media landscape, understand things like social media, and really get that message out in all different ways. >> we'll see if the next man or woman in office appreciates that as well. and the next host of -- everything is changing. >> a lot is changing. >> thank you steven. it's always great to have you on. that does it for this edition of "news nation." by the way, tomorrow on the show i will talk live with ballerina
