"weekends with alex witt" starts now. a new picture emerging we're hearing more about the man behind the louisiana theater shooting, and the victims. i'll talk to a witness who was at the scene. history in the making. the president's trip to kenya. we'll take you there live as a welcoming event is set to get under way any time nouf. >> the hillary clinton e-mail saga. trying to separate fact from fiction when it comes to an account she used as secretary of state. recall, a u.s. automaker taking swift action after one of its cars was taken over by a hacker and crashed. good morning everyone.

welcome to "weekends with alex witt." new details emerging about the gunman in thursday's deadly shooting at louisiana movie theater. court documents say the shooter had a history of erratic behavior and hospitalizations for mental conditions. a prayer vigil for the victims was held last night on the university of louisiana campus two people were killed and nine wounded before the gunman took his own life. thursday's shooting was the third mass shooting in this country in just over four weeks. craig melvin is joining us from lafayette, louisiana for this morning. good morning to you. what has been the reaction there among the people of lafayette? >> reporter: so many people here alex wonder why. why here considering the shooter really does not have definitive tie to this community. we know that he lived in a motel 6 for about three or four weeks. beyond that no connection in lafayette. so that's one of the major questions that investigators are really trying to dig into.

also appears as if based on a news conference held 5 or 6:00 yesterday, appears as if he may have been essentially casing this theater. he showed up several times, and they are also looking at whether he was doing the same thing in lafayette. whether he came with the intention of carrying out the attack on thursday. the mood as you might imagine among folks, sad, angry. especially students. u of l a stone's throw from this theater, not even a mile. a lot of students came to this eat the ter, a lot of students said they would come to this theater on thursday nights. it was in walking distance to the campus. we spent time at a vigil last night. this is what some of the students had to say. >> really just to be here and to support everyone and to be part of the community that i love. i felt it was right, you know as a student here i felt it was right to come and pay my

respects and just be there to support everyone. >> definitely nerve-racking because i never would have expected to the happen here in lafayette. like i said before i think we can all help each other out and get through this. >> i'm going to -- that's one of my favorite movie theaters. it's close to my home. i've been going there for years. that's where i go. and i mean one act of senseless violence is not going to change my day-to-day attitude toward any business. >> reporter: so many folks said they are vowing to go back in this theater when it reopens. at this point no idea when that's going to happen. >> craig, the part that gets me you heard in the introthis man has a history of erratic behavior, some level of mental illness, about hospitalization for that. how in the world was he able to get a hold of that weapon used in the attack? >> reporter: that's the other big question. for a long time, yesterday

especially, the big question was did he get gun legally, illegally. we found out he did purchase the 40 caliber handgun legally, bought it at a pawn shop back in 2014. what is interesting about that, though, we heard from a sheriff -- he was denied a concealed permit in 2006 because of a previous criminal domestic violence complaint because of a previous arson charge as well. so how was he able to get that gun? again, he didpurchase the gun legally. history of mental illness you talked about. in the divorce filings we learned from his wife that at some point he was supposed to be taking medication to treat mental illness according to her, this medication every day. she says he was not doing that. at times would not eat meals like he should which exacerbated the condition according to her. that's part of. the mental illness is part of it. here is a guy you look at some

of the postings on social media, some of his previous run-ins with the law. there is this story back in early 2000 he owned a bar in georgia. the bar gets busted for underage alcohol possession five times, they take his liquor license. and he shows up at the hearing and he lets the board have it. and then really stick it to them he goes and drapes a huge swastika on the side of the bar, the size of a sheet you could see from the highway. that's the kind of guy we're talking about here. according to investigators. >> i tell you, craig. thank you very much for outlining all of that. lots of questions. let's turn to law enforcement analyst and special agent jim cavanaugh. there is a guy with the description that craig was offering and he does what he does in that theater. >> well you know this is sad because this guy, houser shouldn't have had the gun.

it would have been illegal for everything we know to purchase a gun. he was involuntarily committed by a court for mental evaluation involuntarily committed to mental evaluation. that is specifically bars a person from purchasing a gun. what's happened is once again in america we don't learn lessons from the events that occur. we don't make the changes that we can legally make. look joe goes into virginia tech and commits this mass murder and he was barred from buying a gun because of his mental -- he was involuntary committed because he was a mental defective. it never was entered in the that was 2007. this happens to houser in 2008. a judge orders him involuntarily committed. yet, the state, the county the clerk, they don't enter this into the data base. that says he is involuntarily committed. so now, he's able to buy a gun

in 2014 and slaughter some of our best citizens. this could be fixed. >> how am -- barring human error there, not allowing -- not remembering to put something in a computer how in an open society can we keep better track of individuals who might be prone to acts of violence? >> here we have a guy who is barred, probably, from the record we see, from purchasing a gun in 2014. the dealer should have turned him away. the nick center the georgia authority should have turned him away. what we need do is have records entered. we have it on the books but we're not as leaders in the states in the county clerks offices, we're not having procedures, we're not going back and putting these people in the we failed to put them in. a governor could call in the county clerks of every county in the state and say i want this fixed. i want every involuntary commitment in the last 10 years entered and i want a process that it never happens again.

if everybody did that we'd all be safer today. and that doesn't need a new law. so this guy also alex hated society, he was a bigot, everything he says in his writings, and also you know he's in a film that really is you know a representative of modern society how modern society is today and people are in there laughing and enjoying the movie and he can't deal with that. he can't deal with that. he slaughters them. >> third mass shooting in the last four weeks. jim, thank you so much. other news now. a gunman was fatally shot by los angeles police in a busy shopping district. it happened in studio city on friday. witnesses say the gunman fired several shots in the air and reloaded his gun when police arrived. no bystanders were injured. police worried a bomb was attached to the body but the bomb squad cleared the area. so far no motive for that shooting. this morning we're getting a look at newly released photos

inside the white house on september 11 2001. they show former president george w. bush vice president dick cheney other members of the administration family there, reacting on the day of the terror attacks. some images show a very tense moment during the emergency meeting held six floors below the white house. the photos were released in response to a freedom of information act request taken by cheney's staff photographer. let's go now to the weather. strong winds in new mexico after a microburst hit near the border with texas friday. several homes were damaged and the winds also flipped over a tanker trailer. a slow-moving storm could result in high surf in hawaii. waves in the 6 to 10-foot range are expected and the weather channel's jen car tag no is here. good morning. >> good day to you. you know we're going to be watching for more thunderstorms in the sunshine state. right tloop the weekend. this front is the reason why and it's going to be one of the areas we focus on showers,

thunderstorms and you know how humid it is in florida. any time it rains it's going to pour here. we think some spots could get more than three to five inches of rain. that's going to be a concern through the weekend for plans. the other issue is that we could see severe storms and we've got a front, some jet stream energy everything coming together across portions of the northern plains and into the upper midwest so get ready for that and the red zone all the way from nebraska iowa into missouri, right into portions of ohio and michigan and that continues into the overnight hours. we're thinking damaging winds and hail the main threat. there is an isolated risk of a tornado. we talk about the heat, a lot of that going on with heat indices going up well above the century mark not above 110. we'll see that through tomorrow afternoon. and actually continuing on beyond that. another story we're following is believe it or not, from a storm that is 4500 miles away from hawaii kicking up the surf. we've got high surf advisories in the south facing beaches through the weekend into monday.

maybe 6 to 10 feet. that's a look at your top weather. alex, back to you. >> surf's up big time. thank you. now to president obama's historic visit to kenya. he will lay a wreath at the memorial park honoring the lives lost in the 1998 u.s. embassy bombing. earlier this morning he spoke at a business summit about the importance of entrepreneurship as a solution to inequality. >> it helps citizens stand up for their rights and push back against corruption. entrepreneurship offers a positive alternative to the ideology of violence and division one thing that entrepreneurs understand is that you don't have to look a certain way or be of a certain faith or have a certain last name in order to have a good idea. >> nbc's senior white house correspondent chris jansing joins us. i'm curious how the president's message was received and what else is on the agenda today.

>> reporter: well, you are asking a key question how the message was received. i think the answer is it has yet to be seen. no doubt even as the kenyan economy is growing it has been racked by corruption one of the things the president was determined to focus on while here. but he's also in the past when he's come to the african continent and pushed for change and everything from economic issues to gay rights he's often gotten blow back from officials who say don't come here and try to tell us what to do. he's very popular obviously with the rank and file here a poll that was taken in the spring showed that 80% of kenyans trust him to do what is the right for their country and of course spending time here in the past as a senator and at the college student and he wrote so poignantly about it in his minimum woyr. it's a push and a challenge to

get that across to government officials. >> chris, i'm looking at great pictures of the president smiling, he had a visit with his extended family. what can you tell us about that? >> reporter: he landed they had a small ceremony at the airport, the formal ceremony is later today, alex. as soon as he got to his hotel he had folks waiting for him, about three dozen of his relatives, many of them had come from the village where his father was born and is now buried, a place he did visit when he was here in 2006. but for security reasons was not able to come this time. among the people there besides his half sister is his step-grandmother who is fondly known here as mama sarah. she told the media that she was going to try to convince him still to come back to what she considers to be his ancestral hometown. that's not in the cards for this visit but by all accounts they had a great time. and they will see each other again, he brought them to the

summit today so we saw some pictures of them listening as the various speakers were there. >> it's all good. chris, i want to switch gears to the wall street report that the obama administration will release convicted israeli spy jonathan pollard from prison at some point. what is the significance of this? what do you hear if anything from government officials? >> reporter: well, the significance is that "the wall street journal" says it has been told that the reason that this would happen is because they sort of want to appease israel who has been very upset about the u.s. push for this iran nuclear deal. but u.s. officials i talked to say that couldn't be further from the truth. in fact, i got a statement from the nfc saying mr. pollard's status will be determined by the parole position. there is zero linkage between mr. pollard's status and foreign policy considerations. he got a 30 year sentence that is over in november so should he be let out a few months

>> that's hillary clinton friday responding to new questions about her personal e-mail account while secretary of state. this came after two inspectors general asked the justice department to investigate whether any one mishandled sensitive government information related to her e-mail. joining me now is jonathan allen. also the co-author of hrc state secrets and the rebirth of hillary clinton. good to see you. >> good morning. >> so this new york times story, new york times broke it there has been initial characterization and then change in this-brief. where does it stand now? how do you suspect it's going to play out? >> there is a pattern here of partial leaks coming out in the media, and then a reversal on this e-mail story. over time. so i think it sort of fits into the broader context. what you've got going on here is basically a search through these e-mails to see if there is anything classified before they are released. and you have a turf war between

agencies. i think there is a belief that something that was classified or should have been classified is now out in the public due main and at least one inspector general, not both of them interested in seeing if the fbi wants to look through and see if anybody mishandled information. it was not as first suggested a specific inquiry into health care's handling but a search whether anybody put classified information in the public due main. >> you know that turf war extended to capitol hill because some of the gop like house speaker john boehner jumping on this story calling on mrs. clinton to turn over her server. she has said we heard her, welcomes an examination of all relevant e-mailings. do you think the clinton camp can characterize this as partisan politics and is it partly that? >> it is partly partisan politics i think a lot of what you see from the benghazi committee in the house and

existence is partisan politics. the one piece that is not partisan politics is the question of what's on all of those -- what was on her server that got wiped clean before she handed over the rest of the e-mails to the state department? but the republican message gets lost a little bit in focusing on the set of e-mails that were turned over to the state department and what is unlikely to yield anything mind blowing or illegal since she reviewed them before she gave them to the state department. >> let's get to pure politics the kuwaitest quinnipiac poll. three states represented here. and it shows mrs. clinton behind three gop rivals in a hypothetical head to head. colorado, virginia and iowa. give me conventional wisdom on this. too early to mean anything? or is there something to it? >> if this was 2016 you would have democratic operatives setting the phones on fire setting the offices on fire doing whatever they could to

reverse it. it is a little early. we're still in the middle of 2015. this is one poll that shows that. i think we need to see if this is a trend or potentially an outlier. if she were down in the states by those numbers to those republican candidates it would be bad news for democrats. you would assume with those states being where they are that she'd probably also lose ohio and maybe florida too. >> let's go to the floor of the senate and ted cruz yesterday. take a listen to this. >> the majority leader looked me in the eye and looked 54 republicans in the eye. i cannot believe he would tell a flat out lie. and i voted based on those assurances that he made to each and every one of us what we just saw today was an absolute demonstration that not only what he told everyone republican senator but what he told the press over the and over and over

again was a simple lie. >> so ted cruz called mitch mcconnell a liar. from his own party a liar. regardless of the issue at hand how unprecedented is this? >> i don't know if it's unprecedented. doing on the senate floor is sort of ver boaten. you are not supposed to insult people on the senate floor. usually members of the senate don't insult the party leader because they want to advance in the senate. that's not ted cruz's goal. his goal is promote ted cruz's image and think what is mitch mcconnell said to him produced a vote that won't be popular with his own constituency. >> well we couldn't goo do a political segment without donald trump in there. he is holding an event in iowa today, his campaign denying credentials to reporters from "the des moines register." what is behind that?

wire magazine had two hackers tap into remotely, not even in the vehicle, the console of in this case a jeep and take over the vehicle. so you see this pedometer starts to go crazy, this test driver ends up in a ditch. they are now saying they have a patch if you will. much like we talked about for years with computer operating systems or cell phones. this has prompted a dialogue around automated vehicles. they are increasingly high tech all brands. we have a list affected. they are recent models because that's -- vehicles are more automated than ever. this is a prelude to driverless vehicles everyone expects to happen. raising discussions about what happen when's you put that level of technology in a vehicle, it is susceptible to hacking. >> yikes. how about in price check. why are some airlines suspected of raising fares illegally? >> tracking back to the amtrak

train crash in the metro area of new york in may, now the transportation secretary is saying let's look at the correlating airfare prices in that time frame. you know so much business travel happens in that northeast corridor. and they are saying we want to investigate price gouging, did the airlines was there could ergs, did they know they weren't going to increase supply. interestingly, consumers don't always defend the airlines but i looked at hundreds of comments people saying look this is supply and demand. those flights are already crowded. what did you think would happen. we'll see where the investigation heads. people defending the airlines for a change. >> let's go to sneaker makeover. what shoe has taken a new step? >> the chuck taylor. i couldn't believe the math on this. hasn't been redesigned in 98 years. but nike purchased the converse brand in 2003 and they found through their market research people love the look but not

shark attacked and killed him. she sent out a flare for help but by the time rescuers raised him he was dead. competitive surfer mick fanning returned to the water for the first time since last sunday. he posted a picture of himself and said he surfed by himself. back in the states police in oklahoma say they are looking at social media postings for a motive in the family murders. 18-year-old robert bever accused of stabbing his parents and three siblings his 16-year-old brother is being held. authorities have not announced charges. incredible find in lake michigan. divers captured pictures of this ship wreck which sank in 1899. that is resting upright, 365 feet under water. it's still almost entirely intact. pretty cool pictures. developing news this morning, the department of justice is denying a "wall

street journal" report that u.s. officials are pushing for release of convicted spy jonathan pollard. he has been in prison nearly 30 years for leaking intelligence to israel. the israeli government has long sought his release. the potential now comes in the wake of the iran nuclear and time deal rather and a time near unprecedented lows in the u.s. israeli relationship. joining me is john yarmouth. nice to have you with us. >> thanks, alex. good to be with you. >> "the wall street journal" says some u.s. officials strongly deny this is a quid pro quo for the iran deal. if this is coincidental the timing would seem amazing. what is your reaction? >> well i suspect that the iran nuclear deal is a factor though probably a small one. pollard as you said has been in prison for 30 years, he obviously poses no risk to american citizens at this point

or american security interests, i suspect there is no reason to continue to keep him in the prils. also find it hard to believe the administration would make a calculation this would in any way affect the official israeli position on the nuclear deal. they pretty -- become pretty intractable on that. i don't imagine that they really would think that this would change attitudes in israel. >> how about in congress sir. i'm curious where you see the chances of the iran deal going through. do you think this release could have effect on that? >> no i don't think the release could. this is a pretty emotional issue on the hill right now. i'm one who strongly supports the deal that will the administration negotiated. it basically prevents iran from ever getting a nuclear weapon under the deal they are never allowed to have one. forever. all of this talk about 10 years and 15 years is all relates to their civilian program, not nuclear weapons. i think there would be enough democratic votes on the hill to

sustain a presidential veto if it comes to that. but people are very, very engaged in analyzing the deal and i think some democrats obviously will hope it but i think by and large we have pretty strong support for going forward with this very, very important and historic diplomatic solution to a serious problem. >> how about this angle, though. the deal is expected to eventually open up iran's significant oil reserves. analysts expect lower prices and perhaps loosen opec's grip on the world market. is that a good thing if it's more influence and cash for iran? >> we'll see. i think, again, as president obama hasp stressed time and time again, this is not the answer to every situation, every problem involving iran. i think ultimately the combination of very, very significantly enhanced american oil production and possibly

iranian production is going to change the world oil market and certainly the leverage the opec countries have. remember iran's at some point is going to produce their oil and sell it. russia and china agreed pending a nuclear deal. now that we have one, russia and china and japan are going to buy iranian oil. there is nothing we can do. this deal is not a factor in that. the iranian oil will be sold. >> the latest about the controversy around hillary clinton's e-mails. new york times reporting that zres gers found on clinton's e-mail server. the inspectors general and the clinton team note these four e-mails in question were not marked classified at the time. is this going to be a problem for her? does this feed into the polling which shows a majority of voters in key swing states think clinton is not honest and truth

worthy? >> well, you know this is such a complicated situation with the e-mailings. i think the american people like myself having difficulty processing what's really a controversy about it. and clearly i think that this could have been handled more effectively from day one by the clinton team. but ultimately i don't think this latest bit of information changes in any way either the issue or the confusion that the american people are feeling over it. there's no question that this was not handled the best way possible, but i don't see where this recent revelation is going to change much of the calculation the people make over it. >> congressman, i wish i did not have to ask you about another mass shooting but it would appear these are now the times we're living. tler dead in louisiana, another in los angeles yesterday.

we know that there have been concerns in the lafayette shooting about the gunman's mental health. since 1989. how does this happen and what do you think can really be done? >> well obviously we have to make a major national commitment to keeping gun out of the hands of people who shouldn't have them. and obviously the data on this shooter was not adequately handled. did not filter through the system to the point at which he was denied the gun last year. this is again, a major commitment that state and local law enforcement i heard your guest earlier and i thil he was right on in terms of governors making sure all of this gets to the right places. we have to take further steps. i think that it's way past time when we change the law to have universal background checks, one of the guns used in the -- one of the prior murders recently was bought on line, not subject

to a background check. about 50 percent of all gun purchases are not subject to background checks. enforce the laws on the books to make sure people with mental problems and criminal records can get them but extentd to every purchase. >> on a lighter note here last sunday you played golf with the president. so what's on his mind now. how is his swing and what was the final score? just kidding. >> first of all, it was a fabulous day with the president. two others played. and the president was just a joy to play with. it was all golf. we didn't talk shop. he is very much into his game. he ask a pretty decent player. actually beat them in the match. because we made additional bets late and won the last three holes we won $3 from them.

by some. the medical examiner's report released concluded that bland hanged herself using a plastic bag that was in her cell. relatives have disputed that her death could be a suicide. joy reed is in lisle, illinois. good morning. what recourse is open to the family at this point? >> reporter: good morning, alex. well at this point the family had their own autopsy done we're still waiting on the release of that informations as you suggested the family is reluctant to accept the finding of suicide. they talked about how full of life sandy was and their mind she was moving forward. she had a new job in texas having moved through from here in illinois where her home church is where she will be laid to rest today. listen to what her mother had to say how she wants her daughter to be remembered by those who have now followed the story of her tragic death. >> i want sandy to be remembered as an activist sassy, smart,

and she knew her rights. and so while everybody's in an uproar go do your research while this is all going on so you know your rights and it's not your daughter your son, your kid. that's what i want. the anger can be channelled into something that can be so much greater than the incident that happened to sandy. >> reporter: alex, you heard her emphasizing this issue of knowing your rights. a lot of people who have been following this story saying that the reason for the arrest was not something illegal or wrong that sandra did, but that she knew her rights and expressed them to the officer. the next step is what happens with that arresting officer, he is right now on desk duty. the question will be whether or not that arrest actually violated -- whether it's the statutes and the policies which we already know it did, whether it also violated the law. >> i can't believe that sound

bite you played from the mother. talk about composure and respect should be afforded to her and her time of grief. that was such a positive way to channel things. with regard to the investigation, though joy, what will be the next step in that? >> so there are two separate investigations that are proceeding. there is one by the texas department of public safety focused on the traffic stop and whether the officer involved as i said broke the law. if that were to be determined that he did, there is an assistant district attorney who has been designated to handle such a case. this case could still wind up going to a grand jury for them to look both at the death which as i said is a separate investigation, and the traffic stop itself. so while the finding is now final, that this is a suicide at least according to the district attorney they are still investigating all of the circumstances surrounding both the arrest of sandra brand and her death. >> thank you, joy reed in lisle,

joe biden. good to see you. >> good to see you. >> under clinton's proposal the wealthiest americans would see investing gains taxed on the sliding scale with the tax dropping the longer the investment is held. >> exactly. >> could this work? will this happen? >> i think it will help in the sense that secretary clinton just mentioned. right now if you sell an asset, whether that's a share of stock or that nice van go that your uncle left you and the appreciation on that asset, its increased value over time is taxed at something called a capital gains tax rate. that's a tax that about 40t about 40% if you seg sell it quickly, the same as ordinary income. if you hold it for a young or longer it's taxed at half that rate. what clinton is proposing is to have a sliding scale. the longer you hold it the lower the capital gains tax rate will be. the incentive is to incentivize people to hold their investments for longer that will bleed into

this kind of seed investment that in her model -- and i think she has a point -- helps the economy to grow faster on a longer term. >> i have to call my uncle because i haven't seen that van gogh yet. >> me either. >> talk about the op ed you wrote this week for "the new york times," the case for a tax on financial transactions. you say it could fund an erk pangs of pre-k programs also restore funding of college assistance for low-income students. we know bernie sanders has talked about this. how does this work? >> this is actually very much in the same theme. the idea is that as there's so much of this high frequency trading, now something like half the trades on some of our busiest exchanges are these automated high frequency trades. they really don't add anything in terms of kind of information or productive dispersion of capital to the economy, it's

this price, taking advantage of millisecond price differences. if you have a tiny little 1/100 percent, talking a dime on a thousand dollar trade literally, on these high frequency trades you can raise almost $190 billion over ten years. that helps finance, as you suggested, universal pre-k for 3 and 4-year-olds, some left over to replace cuts for college assistance. it's a nice way of shaving some of the excess trading off of our markets and taking advantage of the revenue that raises to help do something about the inequality, immobility problem at the low end. >> you're saying this could significantly reduce the amount of high frequency trading? >> correct. in order for all that trading to be profitable we're talking about these millisecond trades where the troft motive might be something like a penny or something on a lot of trades. if you have such a small -- even
