firefighters are battling a massive and fast growing fire with 12,000 people already forced from their homes will there be any more accusations today. and. and reports that vice president joe biden, will he run? good afternoon. we start with big news from the president today. it is being called the strongest u.s. action ever taken to combat climate change and the clean power unveiled is also a major part of his legacy. announcing new regulations to cut greenhouse gas emissions, the president said taking action is a moral obligation. >> as one of america's governors has said we're the first generation to feel the impact of climate change and the last

generation that can do something about it. and that is why i committed the united states to leading the world on this challenge. because i believe there is such a thing as being too late. today we're here to announce america's clean power plan a plan two years in the making and the single most important step america has ever taken in the fight against global climate change. >> now establishing the first ever national standards limiting carbon pollution, the white house says the guidelines would cut carbon dioxide emissions by 32% and provide second r secondary benefits. among those, cutting premature death, reducing energy costs and creating tens of thousands of new jobs. but the plan is also getting pushback from corporations and gop candidates. rear is republican presidential candidate jeb bush over the weekend. >> i think it is a disaster. it is taking -- it is typical of the obama administration taking

executive power he doesn't have and i believe it is unconstitutional. and i think in relatively short period of time the courts will determine that as well. >> msnbc's alex joining us from the white house. this is just the beginning of what the president said would be a big push on this plan. how big a deal is this in terms of both the climate and the president's own legacy on the issue. >> well it is one of the only things both critics and proponents agree on is the sweeping nature of it. the historic nature of it. the white house just to give you one statistic says this is the equivalent of removing 166 million cars from the road. for opponents they view are this as an attack on an industry. coal mine and coal production and potentially eliminating that entire way of life as the white house seeks to move to a more clean energy future. and even before the president rolled out this final rule attacks were in the making. 20 to 30 attorney generals from

states especially from coal producing states are gearing up for a fight in the courts. dozens of industry groups are gearing up to back that. republicans both on capitol hill and the republican presidential campaign trails are ganging up to fight it. they are going to fight it anyway they can. mitch mcconnell the senate majority leader advising governors to not obey this ruling. so this just shows how muchal opposition it is going to face. >> few for that update. and as president obama looks for his legacy vice president biden may be looking to his future as the 2016 candidate. there is speculation that biden is considering jumping in for the democratic nomination. according to the times report biden's son beau urged his father to make a bid just before

his death in may. he'll make a decision by the end of the summer biden says. peri perry, thanks for joining us. do people think the vice president is going to run. >> the vice president has left the door open. he's left the door open till september. i've heard in the last day and a half there is not a lot of enthusiasm for him to run at least so far. a lot of people in washington are already behind senator clinton. even people who used to work for vice president bide p. and a lot of people i've talked to who are not clinton supporters say they would rather have someone like a bernie sanders. so the idea of him running is out there but there is not a lot of support and he'll need financial support, donors staff and he's running, you know, basically seven months late. if he can't get a lot of support really quickly, he probably can't run even if he wants. >> and the biden spokeswoman is

dismissing that speculation about his possibly running and as said that as the biden family continues to go through this difficult time the vice president is focused on his family and immersed in his work. but how much would you say that beau's dying wish means to the vice president in making this decision? >> you know, i wouldn't want to speculate on that without having talked to the vice president about his son. that is a complex situation. what i would say is he's run for president twice before and he's left the door open now. so we know the vice president and i think over the few months we'll find out is there support for him to run or is the party really behind hillary clinton? you have seen so far the party, the senators and congressman have all endorsed clinton. now it seems to signal he wants to think about running. i'd be curious to see if other people in the party decide to get behind him. so far indications are no but that could change.

>> you talked about some of the challenges we would face. biden would have to face a lot of hurdles. including hillary clinton has already raised about $45 million. has a huge block already behind her. and sanders has consolidated much anti clinton vote in the party. could there be an opening. >> i think there is something to be said that clinton's numbers are not as strong as they were. she is running some commercials again to get them up. and you have seen bernie sanders get to 20 and 30% in the polls in iowa and new hampshire. biden is not known to be a progressive activist the way bernie sanders or elizabeth warren. is people on the left a say biden, obama, clinton are all pretty much the same place and there is to reason to abandon clinton for biden because they have the same policy views.

as the scandal of the e-mails grows more maybe people will change but i've seen very little every day of that so far. >> perry, thank you for your time. for more i want to bring in the panel now. chris, it is hard to even imagine saying this. we're more than a year away but is there any speculation that joe biden would get in this late in the process? it is hard to say it is already late when we have more than a year away. >> i would say that for most people the way to think about a presidential race is like an iceberg. the part that you most average people see is very small. the part under the water that nobody ever pays attention to except people like us is vast. we're in the vast underwater stage right now. i do think it is probably a little too late. i think perry hit the nail on the head. which is i don't know that justification for a biden bid.

what is different? where does he draw a very clear distinction from hillary clinton? where is he better positioned on issues than hillary clinton? you point out some of the numbers in the quinnipiac poll that suggest there is weakness in a general election for her and there is. but the some polls suggest she remains very very popular national among democrats and among democrats in iowa and new hampshire. there is no real evidence right now that she's deeply endangered or waiting for someone to come along and be able to beat her in a primary. >> and there is another side to this race. and trump is leading it. trump leads the gop field in both our poll and a brand new monomount university poll. he's very much the front runner in command. how long is the summer of trump going to last. >> certainly the media coverage of him, specially media attacks

and not taking him seriously is really contributing to his poll numbers rising. especially in places like new hampshire and iowa. only when he starts coming into trouble and being asked serious policy questions and not being able to answer them which could of course happen at this thursday's debate will he begin to go down. the washington post actually had a great story this weekend about all of his policy proposals and that it would cost a ton of money. but he didn't really have any answers to how he would pay for the proposals. and as the moderators begin to pin him down on that. i think that is when you could start seeing him slide. but also the press has do due diligence here and really start covering him like the front runner. do the opposition research and see how he holds up under the pressure. >> and one demographic trump hasn't won over even though he said publicly he would win the latino vote is hispanic community. three out of four say they have an unfavorable view. 55% found his comments about

mexico to be offensive and racist. how much does it hurt the gop to have a front run we are those kind of numbers with such an important demographic. >> i wrote a month ago where i didn't think this would ever happen and it would be a nightmare for republicans to have donald trump on a debate stage, much less front and center for at least this reason which is on immigration. while his views have won him some support in the party they contribute to a major problem they have had in recent elections. mitt romney during the 2012 debate season said his immigration policy would be self deportation deportation. it is not beneficial for the republican party to have someone voicing the opinions on immigration that donald trump has. and i don't think it is any surprise. he always cites oh i'm going to win the hispanic vote. there was never evidence that was a case.

he was using a teeny sample of a nevada poll with single digit number fs of hispanic numbers in it to prove that point. this sample has many more hispanicis in it. >> 14 candidates attending tonight's c-span forum. why do you think donald trump declined to attend tonight's event? >> we said it is because the new hampshire union leader had a very negative on ed about him a couple of weeks ago. and donald trump is not taking this media coverage anymore. and he's protesting the forum and kind of protesting the state in so doing. in terms of really building an organization there and starting to do better in new hampshire. but this is really just a reaction to the press in new hampshire. >> thank you for joining us. coming up a colorado jury rules

in centennial colorado is scott oh cowen. when does the sentencing for the third phase begin. >> the third phase beginning tomorrow morning ayman. and in this phase the focus returns to the victims, which is where the families say it blongd all the time. but the jurors really resoundingly throwing out the defense's argument that james holmes should not receive the death penalty. that he should only receive life the prison because of his illness and age and the fact he had no prior record. the jury took about an hour and a half all told -- or two and a half hours i should say, to decide that was something not that outweighed the aggravating factors that is the heinous nature of the crime. so the next phase we're likely to hear gripping testimony from survivors, from family members about the impact of the crime.

>> thank you scott. we're also following developing news out of california where raging wild fires have forced approximately 12,000 to evacuate their homes. the massive wild fires continue to sweep across the northern part of the state. already destroyed two dozen homes and threatening approximately 6,000 others. here's the latest. >> reporter: a nasty fire. erratic. unpredictable. tripling in size and reaching for more. the rocky fire north of san francisco ravaged more than 80 square miles. officials say this one generated its own winds and spread faster than they had ever seen destroying 24 homes and 26 other buildings like sheds and barns. thousands evacuated. >> this is alarming. a little surreal and just keeps you on your toes. >> reporter: crews are shooting fires into the brush, burning breaks before the fire can get

to it. catastrophically dry conditions have turned california to kindling. three thousand firefighters on the lines. one killed in the modock national forest las week. four others seriously burned. crews on the lines have to keep going in spite of it. >> definitely it is hard. the fire community is definitely bigger than any ore job i think out there. think that is what makes this job great. but that is one of the natures of the beast. that is part of the job. >> many of the fires are touched off by lightning, striking in remote areas, bringing ligament or no rain. water parch'd trees and brush succumbing succumbing. now i want to bring in a

spokesperson for cal fire which is leading the efforts to fight the fires in california. lynn, thank you for joining us. if you can give us a situational report on how fast the fire is spreading, when do you hope to have it under control? how much is contained at this point. >> today we're looking at 60,000 acres so far. only 12% containment. this fire has been quite a monster. overnight it doubled in size up to 48,000 acres and just continues to grow from there. >> can you tell us about how much has been contained so far? >> only 12%. a very small number unfortunately. but firefighters are working hard. the weather is continu cooperating a little today. >> we flow a u.s. forest service firefighters named david rule died on friday. how dangerous are these conditions right now for the firefighters out there.

>> for california being in four years of a severe drought all the fuels are tinder dry and burning very well. most of the firefighters in california are aware of this. they are paying attention to the conditions surrounding them. but sometimes, you know, like in david's case you get overrun by fire. and sometimes it is just something you unfortunately don't necessarily see. >> lynn thank you very much. and best of luck to all of those fighting the fires. thank you. i want to bring in dr. greg forbes from the weather channel who's been following the extreme weather patterns in california for us. what can tell us. what is it looking like out there. >> the humidity is a little lower -- sorry the humidity is a little higher. that means the fuels don't dry out as much. the winds are a little lighter so the fires don't spread as much. but the lacking of rain. it is not going to have any rain to put the fires out. so that fire it might be a

progress. willburn jumps out, struggles with him. shoots him a number of times. willburn and the driver leave the scene. multiple people tried to call 911. finally someone comes over and uses his two-way radio to call for hope. officials are incredulous that someone would kill a police officer over less than two grams of pot. >> how is the community reacting? you could see the police chief was visibly emotional and angry when he referred to the suspect as the coward. but how is the community there dealing with this news? >> this is the third officer killed in less than four years and the city has experienced its share of crime in the last four years. it is possible they are not surprised but just a real tragedy for the city.

street journal" poll 35% of americans support the deal. 33% oppose it. another 33% don't know enough to have an opinion. this comes as key democrats have come out in support of the deal. however according to political one key democratic chuck schumer is said to be leaning no. congress has until november 17th to approve or reject the deal. joining me is former u.s. ambassador and former policy adviser. thank you for joining us. given the divided polling and divided congress will president obama get the approval he needs or not? >> it is a little early to tell because congress is going home on its summer recess. it will be the first time congressmen and senators are going to be facing voters and whether these voters are going to hear objectively from members or constituent groups that are lobby these members is hard to

tell. suffice to say they are certainly going to get an ear full. members of the congress already know there are massive lobby campaigns going on by opponents of the deal to have them vote against the deal as well as override the president's veto should it come to that. >> let me play this sound bite from congressman adam schiff who today backed the deal. he framed it essentially as a necessary evil. take a listen. >> it is a hard decision. if it were a clear choice it would be one thing. it is not. and frankly, when you are in a negotiation with an implaquable foe you are going to get a deal with parts you like and parts that you don't zblo. >> a necessary evil. do you think other members of congress will get on board with this logic. >> seems the constituenciry the president needs are jewish members of the house and senate.

there are members of the congress who clearly are feeling a great deal of concern over the deals consequences. because the deal itself can be defended on the merits. but it really has a much harder sell to those who are concerned about the regional implications. and so in some respects i grew with my good friend adam schiff that this may be a necessary evil. but the president has a much harder time i believe convincing members of congress that the deal's consequences can be adequately defended by the united states should iran cheat. and that is where i think the president has the more selling job. he's going to give a speech on wednesday as members leave as, you know ayman for their recess. so this selling job continues. >> and it is obviously not the sell internally the members of the congress that matter. there is also the allies of the united states. secretary of state john kerry is

in a qatar. and tomorrow the president will meet with leaders of jewish american groups. when you take a step back how would you rate the selling of the deal thus far. >> i would say there is a great deal of credit. the president has immersed himself in the details. i've never seen anything like it in the seven years of the administration. the president has literally been willing to get on the phone and call members once twice three times. i think the secretary of state has a much harder job. he's seen as the less than partial advocate of this deal. so his impartiality is questioned by both israelis and by arabs because he was so involved in the actual negotiation. and he's stumbled here and there in explaining how the deal is going to be carried out and has faced a torrent of criticism. i think the president and white

house staff have done a much better job than the secretary has actually. coming up the battle over funding for planned parenthood reaches a fever pitch. they will hold the vote to defund planned parenthood tonight. plus a big night for republicans. 14 out of 17 candidates will take part in a new hampshire forum tonight but why won't donald trump be there? and the city of brotherly love is showing no love for the hitchhiking robot. you had some blocks and you had major thoroughfares and corridors that were just totally pitch black. those things had to change. we wanted to restore our lighting system in the city. you can have the greatest dreams in the world, but unless you can finance those dreams, it doesn't happen. at the time that the bankruptcy filing was done, the public lighting authority had a hard time of finding a bank. citi did not run away from the table like some other bankers did.

in just a few hours 14 of the 17 republican presidential candidates will share the stage at the voters first forum in new hampshire. while they will be on the same stage the candidates will not debate each other. instead each will have about five minutes to answer questions in what is being seen as the warm up to thursday night's first republican debate. for more we're joined by mark murray. what should we be looking for tonight? do we expect any of the

candidates to come out swinging? >> i don't think so. and i think the way you put it there as a warm up is a really good description ayman. there is a really big difference between tonight's forum and thursday night's debate. and that is that you are just not going to see any big sparring. you are not going to see moderators trying to have other questions that are at other candidates and asking them to respond and interject as well as having follow-ups. another really big difference that you are going to end up seeing 14 different republicans participating, some via satellite. others on stage. whereas thursday's debate by fox news is going to be limited to just 10 republicans based on the national polls. so those are the differences between the warm up event tonight and the big event on thursday. >> the front runner donald trump is not going to be there tonight. despite the fact that a new monmouth university poll that came out today finds him in first place with 26% of the

vote. how will this effect tonight's proceedings? >> i don't think that the poll and even donald trump will really effect the proceedings. in fact i think it is going to be even more build up for thursday because trump is not going to be there. it is said that he is not showing up because he kind a picked a fight with one of the newspapers with new hampshire or he believes that newspaper picked a fight with him. but he's really kind of saving all of his fire for thursday night. >> and finally let me get your opinions on joe biden reportedly thinking about jumping into the race. what are you hearing in terms of the probability of that happening? >> well the probability, most people still don't believe that he gets in. just because the process of having to raise the money, put together a staff, it is really hard to do that at this stage. we are now in august to be able to have that kind of mechanism in place would take place in september or october and to build a winning campaign that is

well-being the the senate is expected to vote to defund planned parenthood, the bill is not expected to get the votes it needs to move forward. this effort after a series f videos released by an antiabortion group attacked the organization for sale of fetal tissue. joining me is kelly o'donnell. good afternoon. let's talk about the vote and what is going to happen in the senate later today. >> well the vote will come at 5:30 p.m. eastern. and what this is about is taking a look at the response to those videos that you have alluded to. senate republicans are saying that the senate needs to act to send a message that this is in their words a disregard of human life by having those persons who work for planned parenthood caught on the video talking about selling fetal tissue. what it would not do is change a lot about what is happening in washington. the passions are deeply divided by party. you heard elizabeth warren republicans have been coming to the floor talking about their belief that this needs to be

done. it would shift money from the integral government to planned parenthood to different community health centers. they make the argument that women would not be taken out of the loop of getting those services. democrats say that is not the case. and this is about 500 million dollars. and what we're talking b about also is the fact that the federal government for about 40 years now has forbidden the use of federal tax dollars to pay for dorgsabortions so it doesn't change that equation. it is an attempt to send a very strong political message to planned parenthood. now, the numbers are such that republicans, although they have the majority they don't have enough to move this through quickly. they would need democrats. so far west virginia democrat joe manchin is saying he will vote to defund planned parenthood siding with republicans but they will be short. so this is expected to be a an important moral test vote with the arguments on both sides. but it doesn't look like republicans could pull this off.

>> certainly there are -- over a dozen republicans have already there is threatened to shut down the federal government. how realist ache threat is this? and how do you think the house speaker is going to respond? >> the most conservative republicans are saying this is an issue to fight during the hot month of august. house members are already home in their districts testimony senate finishes up later this week and they will be talking to their observe constituents and town hall meetings and local events and conservatives are saying they want their voters their supporters or people who have strong feelings about this to dial capitol hill to put the pressure on. it will be a political debate and strong fight in the congressional races but it will also play into the presidential race. republicans are saying this is a stand worth taking. democrats who have fought this kind of thing before are saying it is a subterfuge for going after women's health. expect this to be echoed again
