>> i get up and speak. i get the biggest crowds. we get standing ovations. and all we do is talk about how great our country could be. and i mean that. our country has such potential. but in it continues to go in this path it is going to be almost impossible to bring it back. it is really far down the line. >> so who will join the front runner on stage? at this hour, nbc's current best estimate is ohio and new jersey governors kasich and christie will squeeze into the top ten. although there is late talk of an 11th candidate being allowed on stage. for for casey hunt. tell us about what this eleventh candidate is all about? >> reporter: aman, good afternoon. well this has always been a possible. they didn't rule out the event of a tie. and at this point it is looking like rick perry would probably

be the one who would be the beneficiary of such decision. and at this point we don't know exactly which polls fox news is going to end up using to make this decision or how they are going to weight the numbers. as you said they are planning on using the cutoff of 5:00 p.m. tonight. so if you haven't released your poll before then or in the next hour that will not actually count as they look to tabulate this. but it could make the difference for perry, the texas governor, who of course infamously forgot the third government agency he would cut in that debate in 2012. and he of course has been looking for in some ways a little bit of a redemption tour here. so i think for perry in some ways this decision is a little personal. >> i now kasie you are in touch with these regularly. from what we're hearing, do you think there will be an eleventh candidate? is the margin that tight? >> well ayman at that point, the campaigns are -- talking to fox

news, the campaigns who are in the middle of this potential back and forth. but, you know, while they have their arguments for why this should potentially happen, it is really not clear at this stage. nor do the sources that i've been talking about have a really good handle at this point on what fox news is going to do. i this i they are just going to have to wait and see with the rest of us. >> we'll have that answer hopefully at some point today after 5:00. let me talk to you about donald trump. he's obviously within dominating the polls. now he's got to be front and center on the debate stage. is this the moment where he's finally forced to answer tough questions about real and serious policies? >> well it is certainly a possibility, ayman. and you are right, trump has yet to put serious policy bones on any statements he's been making. he has a list of issues he likes to focus on but i found when you do talk to him it is very difficult to press him on the specifics. so the fox news debate moderators have a chance to do that. megan kelly has made news already this election cycle

talking to people like jeb bush, for example. shes the one who pressed him on iraq. we'll have to wait and see but i think trump has gotten away from what's within the center of his, at least his announcement people and initial public statements. he was going a lot after our republican counterparts. particularly jeb bush. he's walked that back in recent days and there have been some private discussions whether or not trump has come under party from other establishment republicans to lay off a little bit. the republican party really doesn't want these debates to turn into what they feel like they turned into in 2012 where the eventually nominee was damage override and over again by fellow republicans. and seems there is a lot of pressure on trump and the candidates to focus on yourself, talk about your record and build the party up instead of tacking it down. and there are a lot of republicans who think it is a good thing trump is going to be on the stage. in part because he's going to

draw so many more eyeballs to the debate. probably a lot more people who would watch. if trump wasn't there fewer. so there is potentially upside for the gop. >> kasie, thank you very much. i want to talk about that point going after donald trump with two colleagues here. thank you very much both for joining us. let's start off with that point that kasie made. donald trump. he's going to be front and center. donald trump, do the other candidates go after him? is he going to attack the other candidates? what is going to happen tomorrow night -- thursday? >> who knows. as we learned in the bloomberg focus groups in new hampshire, the people who like donald trump think less of the people who attack him. so if jeb bush attacks donald trump, if ben carson, scott walker, any of the other folks attack donald trump they make themselves look worse to the

people who are supporting the front runner. and also if you attack donald trump, he has shown that he's not afraid to give actually better than he's gotten. so i mean that is sort of like tempting the lion there. >> i wouldn't expect jeb bush or any of the guys that have double digit support to go after donald trump. their best bet is to talk about what they would do and shine themselves. they don't want to get into a food fight with donald trump. but trump being there, all eyes are on him. and there is a much bigger viewing audience with donald trump in the debate than him not being there. if i'm donald trump i'm the same guy i've been in the so far. >> keep doing his thing. >> stay unfiltered. say what i think. be willing to say exactly what i think and hang on to that support. >> let's take a listen to a sound bite from donald trump talking about immigration. >> hey look i'm talking about illegal immigration. a lot of hispanics that are

legally in this country they agree with me. i'm getting letters and calls all the time. i think i'm going to -- this will surprise you. i think i'm going to win the hispanics and i think i am going win the african american vote. >> obviously a lot of confidence there from donald trump. he knows he's going to win the african american community and the hispanic vote. let's talk about the other candidates. the second tier debate, a lot of people are writing it off. is that something to be written off or? is there a possibility somebody breaks out of it? >> donald trump has sucked all the oxygen out of the second tier campaign. these are the folks that for the most part would engage with the right of center folks for the ca caucuses and early primaries and they can't make any headway here. >> i think their best way for the undercard folks is to say something that cracks through. and so if you are in the

undercard. say i'm carly fiorina whose a former fortune 500 businesswoman, ceo. let's say she says something that cracks through that puts donald trump on the spot, chris christie on the spot, that then forces the moderators of the main event to ask the question, carly fiorina said this about you, your policy, your past, your positions. what do you say about that? and i think that is something that could happen. i'm a big nerd. i will be in front of the tv watching the under card. and i think a lot of people will because i think just the dynamics because of trump. >> let me jump ship to the democratic side. hillary clinton is a big topic of conversation at the republican debate. our latest nbc poll finds her with chablgs though. hur unfavorable rating is about 48%. that is higher than ever recorded for president obama. how big of a challenge is this? >> i think it is just a temporary problem. the fact it's now makes it

easier than if it's later. but may be the reason why like vice president joe biden feels emboldened to get into the campaign still. and i think hillary clinton will ultimately be very strong and if she's ultimately the nominee it will be a very exciting day certainly for democratic women as well as ore democrats. i think she will be a credible candidate if she ends up being the nominee. >> if hillary clinton does succeed in becoming the democratic nominee for president she will pull a lot of republican women over to vote for her. i've been hearing, talking to republican women these last eight years since she ran the first time. and they are saying if she runs i'm going with her. those unfavorable numbers, i agree 100%. >> and let's talk about joe biden. you raised the point whether or not he's going to run. his sister today told the hometown newspaper she hasn't had any conversations about him running.

is it too late in the game for the vice president to make a -- >> not too late. a little but not too late. you have to have organization and you have to have real people to support you and come out to vote. you have to raise a lot of money to compete. secretary clinton has been smart to start her campaign ads early so she begins defining herself early. it is starting already. biden has to raise a lot of money if he wants to really compete. >> joe pieden is the sitting vice president of the united states. he's been this washington for many, many years. it is sort of strange that we haven't been talking about the sitting vice president as the potential successor to president oba obama. so let the vice president make the decision. and, you know, whichever decision he makes will be the best for him. >> thank you gentlemen for both joining us. coming up. new hampshire police addressed the deadly tent collapse last night. i'll speak with a father who was there next.

investigations are under way to determine the factors that played in a deadly tent collapse in lancaster new hampshire. dozens injured when a tent collapsed and a father and his 8-year-old daughter were killed. about 100 people were inside the circus tent when a storm came through bearing 60 miles per hour winds. >> about half a mile to a mile out you could see the definite path of the wind event that

approached the tent. it took out trees on a river bank and spread out across the field and ultimately took down the tent and there was no damage behind you on the other side of the road. >> brendan isham was in the tent when it collapsed and his son was injured. he joins us now by phone. thank you sir. i was wondering if you cannive us an update on your son. i understand he was injured as a result of that tent collapse. and tell us about your experience. what happens when that tent came down? >> caller: well, when the tent was coming down our biggest thing was to get down as fast as we could. his injures, he got a nice little cut -- gash i should say on the top of his left eye, on his forehead. and it was from a pipe that had fallen. and as a result he got a few stitches last night. and we were back home last

night. but he's doing a little bit better today. >> brendan, i can tell from your voice that you are visibly shaken still by that traumatic experience. did you have a sense from the weather that this event that you are going to could have potentially been a high risk situation? do you believe that local officials should have made it known to the public or to those that were going that perhaps this event should have been been called off? >> from what i could tell, i didn't think that the weather was going to be that much of an issue. it all happened, you know, just like that. it started with a little bit of rain. about halfway into the first act. and it went into the second act and the rain picked up. and next thing you know the wind started blowing. >> one of the things that we've learned today is that this circus, the walker brothers, did not have a place of assembly permit that should have been issued to them. what are your thoughts on the

developing news out of mississippi at this hour. local authorities say they have found a truck matching the description of a vehicle driven by two males accuse offend shooting at the camp shelby military facility earlier today. according to police this afternoon two men fired gunshots at soldiers during a training exercise. the suspects then allegedly fled in the vehicle, a red ford ranger truck. about 4600 soldiers at the base for an annual training exercise. no injury were reported. out west, air force reserves are being called to help in the fires raging in california. more than 10,000 fiergters are working overtime trying to help get the blaze under control. the rocky fire, the largest blaze has already burned 75,000

acres and only 12% contained. >> reporter: from the air and on the ground it is ab all out assault on raging wild fires in california california. >> steep rugged terrain making it very difficult. >> more than 1240us firefighters battling some 23 active fires burping across the state. the largest the so called rocky fire north of san francisco. over the weekend it tripled in size and already burned some 65,000 acres, a little larger than the city of sacramento. >> we had a ten mile fire front that made that run in five hours. the computer told us it would take seven days for that to happen. >> the fire is still only 12% contained. but the fire has grown so that 12% is just a little bit bigger. so that is progress but one containment line they were hoping would hold was highway

20. firefighters were surprised when the fire jumped right over. >> it is all because of the drought and how dry the conditions are. the fire is doing things that is unpredicted. >> the fire threatens more than 6,000 homes and has forced nearly 13,000 people to evacuate. >> it's finally smoking us out and we got to get out of here. >> two air force c-130 hercules planes have been added to the aerial assault joining more than a dozen other air tankers and helicopters already flying around the clock. and firefighters on the ground all working to save homes and lives from these raging infer knows. live from california. authorities have been talking about the drought and how it's been a factor. but how is the drought specifically affecting the fire's behavior in how fast it is spreading? >> that is the best question. you nailed the problem they are

having. this drought has caused the fuel s to be so unpredictable, fire behaviorists really don't know what it is going to do. it is fuel driven and the fuels are so dry they are just crackling and going up like bombs. a lot of o times you will see fire going across roads like it did across the 20 yesterday. and what they are describing is not just embers flying and lighting on grass and then burns. it is like a rocket launcher. it is like a flame thrower. they are talking about huge boules of fire just exploding into grass. sometimes hundreds of yards away. so yeah it is a very, very difficult fire fight. and that is the question they want the answer to is how this drought is making all of this happen. >> and obviously one of the changes as we understand, there are now at least 20 different fires. we're going to put up a map. they are really all over the state when you look at it.

how are authorities on a state level able to get the resources deployed over such a wide spread area? >> you know and it is actually worse than it looks. because you will see one big ball of fire. one plop of flames and that could actually be six or seven smaller fires they have classified as one just to keep things straight. humboldt is actually 75 lightning strikes that are all in the same general area that con fla grated into that huge infer know there. and that fire alone i think was burning -- gosh, i don't remember the acreage on that but i think it was around 2,000 acres just from those lightning strikes. so it is really, really hard to keep track of. and the resources are stretched to the limit. but as you mentioned, the air national guard and air farce fo coming in to help. the governor declared a state of emergence on friday and that is

welcome back to msnbc live i'm ayman mohyeldin. donald trump is holding on to his commanding lead at the top of the polls. it comes as we are less than 30 minutes in fox news' deadline to determine who will be on the debate stage thursdays night. now the number of homes threatened in northern california has now risen to 6900. crews are sending in more resources to contain the blaze which has now grown more than 100 square miles or roughly the size of the city of orlando. and fall out from a deadly circus tent collapse in new hampshire. the fire marshal says the events operator should have been monitoring weather before the show. two were killed and more than 20 injured. a kentucky sheriff's office is facing a federal lawsuit this week for allegedly handcuffing

two young children with disabilities at school. one of those incidents was caught on video. nbc's john yang has the story and a warning to viewers that the video may be disturbing. >> don't get to swing at me like that. >> the alcu says the video was taken by school personnel in kovgten, kentucky. kevin sumner can be seen handcuffing a boy's arms above him behind his elbows. he was an eight-year-old third grader diagnosed with posttraumatic stress disorder and attention deficit hyperactive disorder. according to the lawsuit he was sent to the violence principal' office last november after disability related difficulties relating to his teacher. the boy has swung his arm and

attempted to strike him with his elbow. >> we don't think handcuffs at the biceps are the way to treat an eight-year-old child even if the child is emotionally disstraut the lawsuit alleges he also handcuffed a nine-year-old girl. >> children with disabilities should not be handcuffed, especially when their behavior is related to their disability. the. >> reporter: the sheriff's office declined to comment because the litigation is pending. civil rights advocates question why police are dealing with young students, even those without disabilities. >> instead of treating things like garden variety discipline they treat them like law enforcement problems and it leads to the response we saw here. >> the school district which is not named declined to comment on these incidents, as a federal court is now being asked whether it violated his constitutional rights. >> that was nbc's john yang

reporting. joining me now is matt coles. thank you for joining us. i want to read part of a statement made available today. the police department is standing by the officer saying all facts and circumstances have not been presented. what is your response to that, sir? >> my response is it is never appropriate to handcuff a child behind their back with adult handcuffs like that. never. and it is almost never appropriate to fill physically restrain a child like that. every parent and teacher worth their salts knows the way you deal with this situation knows you deescalate it. you don't use force. >> a lawyer told the newspaper the children were put in handcuffs because, quote, they were placing themselves and other people in danger of harm. and that is what the book says to do. what do you think of that

defense, that the officer was just simply carrying out his orders based on what the law says he should do? >> well the claim they were placing themselves in danger is brand new. and this happened some time ago. many months after the incident the deputy wrote up a the report. none of the reports make that claim. in many ways the best answer is look at the videotape. look at the officer, look at the boy and you tell me that boy was a threat to the officer. >> this video has also come to light. i'm sure a lot of people are going to find it disturbing. we've warned our viewers. but how common is it for school officers to handcuff children in school? do you think this is a one-off? >> i only wish. it is a one-off incident already involving two children. but what the department of education tells us is that in a system that way underreports, tens of thousands of children got restrained physically in school last year and thousands

of those were handcuffed like this. it is a big problem. what's more, 75% of the kids who were restrained were children with disabilities. it is inexcusable. and it is a big problem. >> deputy and national legal director for the aclu, thank you for joining us. >> thank you. joining me now is defense attorney john burress. the officer's lawyer says these children and others were placing themselves in danger. it is what the book says to do. from what we know and can see on that small bit of video was he acting lawfully or not. >> i don't care what the book really says. at the end of the day the question is did you use more force than reasonable under the circumstances. what we see here is a young boy placed in handcuffs behind his back creating real harm. it seems to me that if that is a policy in effect that policy is fundamentally wrong and it should in fact be replaced. there should not be a situation

at all where a an officer feels free to handcuff a kid with adult handcuffs. policy right and wrong it may be there is some protection for the officer for doing what he thought was right at the time. there is question about qualified immunity. but on its face, given what we see, that the officer should have known better. that any reasonable officer how much is known you don't handcuff an eight-year-old in the manner he did and recognizing the real harm that can result from it. either you have been properly trained as the teacher or not as the law enforcement. seems to me the law enforcement training overtook his teacher training because behavior modification does not mean that you handcuff a child because the child is acting out. particularly when a child is acting out in a way that is expected given the nature of the disability. from my point of view that officer was fundamentally wrong. the lawsuit itself should go forward and the district and the law enforcement agency should really revamp and reconsider the policies they have in effect and

may require retraining of officers in the future. >> so you honed in on a point i'd like to pick up on which was the issue of policy here. and even if it was the policy that he was just, you know, executing the law, who should be held accountable here? is it the officer applying the law? is it the district for having that law? and more importantly you talk about the officer exercising common sense. should the officer lose his job over this. >> the fact it is a policy doesn't make it the law. you can write a policy within the school district or department. that doesn't mean it is a law and it does not override the law. the law in terms of civil rights is one of excessive force. you cannot override that. you may have a situation in a department where you think you can write a particular policy that. may in fact go to the officer's state of mind. on the other hand an officer engaged in the conduct using physical force in effect is hurting a child and causing emotional distress that cannot

be over ridden by an existing policy in effect and the law itself would dictate you cannot engage in that type of conduct. frankly if an officer doesn't have enough common sense to do this she should not be a police officer in this type of environment. it is clear he should be reassign order terminaer or ter. >> thank you for joining us. developing news out of mechs memphis where a tennessee man who was the focus of an intense nationwide man hunt is now behind bars. tramaine wilbourn will be arraigned tomorrow. he's being held on $9 million bond after turning himself in late last night. the first-degree murder charge is the for fatal shooting of sean bolton on saturday.

and i think this is the correct position -- that we're in a post deal phase here. and the assessment is only do we want this deal or no deal? and it is really clear to me that a deal is much better. and i think a arms race president netanyahu will be more likely without it. >> in a senate hearing today nicholas burns said it was inevitable that iran would cheat. take a listen. >> i think it is inevitable the iranians will test the restrictions and try to cheat. no question in my mind they will cut and cheat on the margins. that is why we have to watch them. >> do you think that is true? do you think there are enough protections in this deal that we will know if they are in fact cheating without a deal? >> i think -- i believe energy secretary moniz. and i think he is right that

will be a signature. we'll be able to know if they are cheating. the administration claims that the snap back provisions, those are the ones that let us unilaterally go to the u.n. and get the sanctions reimposed, could work well. and i also think -- and i think this is very important -- that we should mistrust and verify. and if the iranians are the cheating and the snap back provisions don't work i think we have a better argument and much more world sympathy for using the military option then. and i don't think president obama would hesitate to do it at that point. i think he's resolved to prevent iran from getting a nuclear weapon. and i think that is the goal we all share. >> jane harmon, good to speak to you again. moments ago presidential candidate jeb bush gave his take on the controversy surrounded planned parenthood funding. take a listen. >> the next president should defund planned parenthood. abortion should not be funded by the government, any government in my mind.

>> the comments come hours after the antiabortion group t center for medical progress released a fifth heavily edited undercover video showing officials discussing the transfer of fetal tissue in this case in tact fetuses. planned parenthood has maintained the group does not profit from the transfer of fetal tissue and said that today's footage doesn't show planned parenthood staff engaging in wrong doing or agreeing to violate any legal or medical standards. on monday the senate failed to pass a bill to defund the health services group. leaders joined 44 democrats in voting against the bill. one reason the senate may be having trouble defunding the group that is planned parenthood is the group is pretty popular. an nbc wall street journal poll conducted found that planned parenthood was rated positively by 45% of those surveyed.

post. sam stein. what is your sense of whose going to make the final cut, and who is not? >> right now you are looking at i think rick perry really on the fence. we know for a fact lindsey graham will not be in. carly fiorina will not be. santorum doesn't appear to be in. you have the only woman in the field whose not going to be in the main event. the second place winner of the last cycle t guy who won the iowa caucus will not be there. we have notable people who won't be there. but it looks like rick perry is vying for the last spot. >> who do you think stands to gain the most from thursday's debate? >> it was tough to say but i think last night's forum gives us an indication who really needs to have a good event. i would guess at this juncture jeb bush has a lot of pressure on him. if you watched last night he was a little bit awkward. his speaking mannerisms weren't exactly up to snuff.
