5:30 on the east coast, 2:30 out west. this is "way too early." the show that's always unpredictable, but in the end, it's right. ♪ i hope you have the time of your life ♪ i'm ready to join greenday if they need it. good morning. it's tuesday, august 11th. a state of emergency after a second day of protests marking the anniversary of michael brown's death. more than a dozen arrests were made after protestors blocked the avenue in ferguson. the police department tweeting quote, officers are hit with rocks and bottles. we continue to support free

speech but those ignore speech. protestors shut down the major interstate. it was closed in both directions as dozens of arrests were made there as well. let's bring in nbc's jay gray with the latest from ferguson. good morning to you. >> reporter: good morning. things have calmed down. there's frustration on both sides of the protest line after what was a difficult 24 hours in ferguson. there's a state of emergency in place now. more officers on the ground. officials in st. louis county saying they're not willing to take any chances when it comes to violence here. >> i think what is required in this situation is a proactive response. i think we need to get out ahead of this. last time you know around last year we saw a city burned.

we are not going to see that again. i'm taking every measure possible to avoid that scenario. >> reporter: police say there was no looting, no shots fired overnight, much different from monday night when 18-year-old harris fired on police officers. he's still in critical condition in a local hospital. he has been charged and faces four counts of aggravated assault on law b enforcement, five counts of armed criminal action and one count of shooting at a motor vehicle. >> now back to you. jay from ferguson thanks. here he is in handcuffs on the front rage of this morning's "u.s.a. today." reports of two journalists arrested last year in mcdonald's in the protest were charged by st. louis county prosecutors. they were both charged with

trespassing and interfering with a police officer. at the time, the police claim the two didn't leave the restaurant fast enough after being ordered to do so. now publications are coming to defense of their employees. "the washington post" statement said quote, charging a reporter with trespassing and interfering with a police officer when he was doing his job is outrageous. it appears donald trump has buried the hatchet with fox news for now. trump was under pressure to apologize to megyn kelly for remarks about her. yesterday trump said it was the other way around. >> she asked me an inappropriate question. she should be apologizing to me you want to know the truth. >> trump seemed ready to continue the feud. later yesterday morning, he tweeted this out. fox news producer just called. he's a great guy.

he assures me trump will be treated fairly on fox news. hours later, megyn kelly responded. >> mr. donald trump did interviewsing interviews over the weekend that attacked me personally. i will not apologize for doing good journalism. i'll continue doing my job without fear or favor. mr. trump will continue with a successful campaign thus far. this is a business. it's time to move forward. >> the feud between rand paul and trump seems to be growing. paul issued a statement blasting trump as quote a fake conservative conservative. >> all the you're stupid kind of language doesn't get us anywhere. it also makes you think that the impeerousness that he's going to

say i'm donald trump and therefore so my concern is he'll grab up that power and treat the country as his bully. that could be a real problem, particularly when we're not sure what is his philosophy. he said to "the wall street journal". i give politicians money so they do what the hell i tell them to do. that concerns me. that's what i don't like, politicians are bought and sold. many conservatives are upset with hillary clinton because she appears to sell access. my concern is a businessman like donald trump buying access. isn't that equal? and some say does the emperor have clothe or a brain, frankly? people are going to finally say, what is he saying when he says i must be smart because i'm rich? >> no surprise it didn't take
