and pollster a brand new monmouth poll is just the latest head scratcher. donald trump and ben carson are now tied for the top spot in iowa. there is a new des moines register poll putting trump on top leading carson by five points but trump and carsn't reasonable the only beneficia beneficiaries of an electorate saying it is fed up with insiders. the poll finds bernie sanders surge to within 7 point offense the clinton in the hawk eye state. sanders rejected comparisons between his insurgent campaign and donald trump's. >> no i don't -- i don't accept that for one moment. we are not engaged in demagoguery. we're not engaged in racist attacks. outrageous attacks against mexicans. what we are trying to do is talk

about the reality facing the american people. and come up with real concrete solutions. >> for more on all of this, communications director for emily's list. political reporter for reuters and republican strategist, former aid to george h.w. bush. outsiders continue to surge in the polls. but in the last three cycle t leader in august did not go on to get the nomination. does that then mean that this is just the heat talking? >> i don't think that is quite the case because we are now going into september tomorrow. and as you may remember, tim polenti was out in 2011 naerl august. t caucuses are a month later this year. but look at these outsiders who are at the top of the polls. donald trump and ben carson and

carly fiorina. and they have much higher percentages in the polls than all of the other insiders who are clust eshd at the bottom. so it may be that these republican voters do really want to get behind an outsider. and if they can all coalesce around one that could be very dangerous to the republican establishment come early next year. >> donald trump keeps up the heat on jeb bush. he's targeting his line that undocumented immigrants come here out of an act of love. this is trump's instagram video from today. i want to talk to you about it on the other side. take a look. >> yeah they broke the law but it is not a felony. it is a -- it is an act of love. >> if and when donald trump does flame out as many expect he will, is he inflicting irreparable harm on jeb bush's campaign? >> i'll say this.

that donald trump has to be taken very seriously. he's a very smart candidate and he's not a flash in the pan. at this point now the campaign, all though it is august, you have to consider the fact that he's got lots of money. candidates usually end up running out of steam basithey can't continue to raise money to compete. donald has the money to raise. organization in place and t b s boots on the ground in iowa and new hampshire. so he's got people who will actually show up and vote for him. so it is going to be very very tough in these early prime ris in iowa and new hampshire. to you have to take him seriously. jeb bush is still very strong but donald trump is doing very very well and you can't take that away from him. >> joe it sounds like you think donald trump is the perceived nominee here. >> donald trump is the real deal. for anybody that would have written him off, as some people did some months ago, he's gotten real legs so far. he's got strong support.

he's managing to retain his basis of support. he's got money, he's got an organization. he understands how to keep in contact and dominate the news which he's doing. he's a very strong candidate. >> let's talk about ben carson a minute. here is a guy polling very well in iowa and he has not enjoyed the non stop coverage that the donald has. how much of a boon is this for ben carson. >> i want to go back and agree with bernie sanders. the comparison about political outsiders in both parties is a false one. sanders has been in politics for decades. i think democrats are having a completely separate debate. republicans constantly run on saying government doesn't work and people in government are the problem. so no wonder their electorate wants to go for people who have no experience in government. think that is why we're seeing donald trump and ben carson and

carly fiorina coming in where they are. i don't think we're having the same debate on the democratic side. we're talking about issues and agenda for middle class families. whereas republicans are talking about who can vilify government the most. who can be the strongest voice against politics? and i think that means they are stuck with a candidate like trump who i don't think anybody wanted to see as the standard bearer of their party. he just embarrasses them over and over again. >> let's talk about democrats for a second. tonight there is a huge new batch of clinton e-mails expected to be released by the state department. we'll have more on that a little later here in the show. but the des moines register poll, the one we've been talking about. it finds the democratic voters apparently do not care all that much about these e-mails. there are the numbers right there. 61% of those polled say that it is not important. is this something that's a big deal for those like you inside the beltway, folks like us that talk about it on television but

perhaps not so much for those dwhoent follow politics all that closely. >> craig, i don't think that the poll numbers you showed just there tell the whole story. and you have to look at all of the different numbers those polls are showing and that is that the favorability of hillary clinton has gone down over the last 5 or 6 months. many of her poll numbers have been shrinking and she's lost a lot of ground to bernie sanders. so i it may not be they care about the e-mails per se. but they certainly care about the perception and sure the media is doing a lot to drive that home. but they are certainly taking a big toll on her campaign. >> before we let you out of here we need to talk about another big political story on this monday afternoon. i'm sure joe watkins you were up last night watching the vmas, probablytweeting them. take a look at this surprise announcement from last night. here it is. >> yes, as you probably could

days after sheriff's deputy in texas was gunned down and killed execution style at a gas station, the suspect 30-year-old shannon miles appeared in court for the first time today. shackled, miles shuffled his way through a courtroom packed with staring uniformed officers. is suspect was arraigned on a capital murder charge that could bring the death penalty. prosecutors say surveillance cameras at the gas station show a black male driving up in a red pickup truck, walking behind officer darren goforth and shooting him 15 times in the head and the back.

here is the district attorney today describing what officers saw leading up to that shooting. >> they saw a male sitting in the driver side of the red ford pick up parked right in front of the store. they saw deputy goforth come out of store. had evidently pumped gas, went inside and then was walking back to his patrol car. and as you see the video you see the male duget out of car. and he runs up behind deputy goforth and puts a gun to the back of his head and shoots. deputy goforth hits the ground and then he continues to unload his gun, shooting repeatedly into the back of deputy goforth. >> lawyers for the suspected gunman say their client intends to plead not guilty. let's just start with the

question that everyone in this question has been asking for the past few days. motive. any idea at this point why he might have done that? >> none, craig. and that is the big missing piece in this case. police have said as much. they have said in a press conference over the weekend that they haven't been able to determine why it is that shannon miles, the suspect, shot execution style the sheriff's deputy on friday night at that chevron in northwest houston. though authorities openly speculated he targeted goforth because goforth is a law enforcement officer. and today the district attorney said although he would like to know the motive, motive is not required for the prosecution. >> what do we know tablabout th? >> shannon miles is a 30 years old. he has a criminal record. the criminal record was read

today in court to establish probable cause for the county to continue to hold miles. he's had trespassing, disorderly conduct with a gun, resisting arrest. he also know he was a student at the university of houston. took classes briefly in 2011 or 2012. aside from that police are not saying much more and again motive remains on open question, craig. >> how has the community there in houston responded to all of this? >> well there's really been an outpouring of grief here. fair to say that the community has been shocked by this. and the shock was really worn on the da's face and evident in her words during this emotional press conference that followed the court hearing today. i'd likeo play you a bit from that press conference. >> i want to accentuate the positive here. that saturday night and sunday night, the harris county community came out for law enforcement in a huge way.

saturday night was a prayer vigil for deputy goforth and sunday was a prayer walk. and people from all races, from all around the county came. over a thousand both nights came to support law enforcement. that is what houston's harris county is about. this crime is not going to divide us. this crime is going to unite us. >> that is the district attorney talking about two events over the weekend that drew people in large number around a thousand people on saturday night at the gas station where the shooting occurred. and more than a thousand last night who marched in a local church to that gas station. in the meantime funds have been set up. fundraising drives have sprung up to support the family of the fallen deputy. he left behind a wife and two children. an online account has raised about $75,000 and organizers of a separate cash drive tell me this afternoon they have been able to raise around $76,000. and funeral services are planned

for friday at the local church. that church can hold about 5,000 people, craig. >> and we imagine it will be packed. jamie, thank you. at this hour mourners are also gathering in the salem, virginia virginia for a memorial for adam ward. ward the wdbj cameraman gunned down during a live broadcast last week along with alison parker, a friend and coworker. show some virginia pride wearing the colors of the virginia tech. ed that virginia tech announcing they will be wearing stickers honoring ward and parker on opening day. also this morning, wdbj tweeted out this photo of their news team including ward and parker saying "we love our morning family. we'll get through this together." outside of that memorial in

salem is adam. what's the scene like there? >> very somber. lots of hugs and tears as hundreds come out to pay their respects to this truly heartbroken family. he touched so many lives. not only here at the high school in salem but at virginia tech and wdbj. but here at the high school where he grew up. teachers say he was a popular student. he was athletic. he was on the football team that made it to the state championship and won. she was a smart kid. someone with a joke or a prank. but most importantly he had met the love of his life, melissa ott. to control room producer who had to watch on live tv. they had a bright future together. they wanted to be parents and. none of that happened. and they pay their respects to the ward family here in salem.

for the latest i'm joined by nbc's christen dahlgren outside of the courthouse for us. the ruling could come 24, 48 hours, christen. what else did we learn today. >> we learned these two sides cannot reach a settlement agreement. neither side willing to budge. before today's short hearing they had about a half hour meeting in the judge's chambers. and they had -- tom brady's camp was there. players association. and also john mar ra from new york giants who was brought into to try and broker some type of deal. the judge had been pushing the sides to reach a settlement agreement. in the end they weren't able to. the judge said in open court that he thought both sides had tried. so it does come down to the judge's ruling. he said that is likely to come by tomorrow, wednesday,

definitely by the end of the week. but even after that judge's ruling this could still go to appeal. so it is likely that we haven't seen the end of it. that with the patriots playing their first game on september 10th. so there has to be some type of, you know, decision at that point whether or not tom brady can play. whether there is a stay while this is all figured out or whether a ruling in favor of him or whether that decision is upheld and he's not able to play in that game. that is a game he'll never get back. so this will continue into the appeals process very likely. >> steelers fans watching with bated breath. christen, thank you. as the conclusion of today's hearing the nfl players union reacted. >> we tried our best to reach a settlement, which we did not reach. we understand tom's position. and i think the process will work itself out. >> all right. there is the players union rep there. for more on what today's ruling could mean for tom brady and his

legacy. i'm joined by jason paige. again not so much a ruling today but in the coming days. >> we're all guessing at this point. all playing armchair attorney or judge trying to figure which way richard berman is going to go. but i think the key point is the fact that this doesn't end here. this is nlt binding. we're probably talking about an appeal either way, whether it is tom brady and his side and the players association or roger goodell and his side. both sides have so much to lose in losing this case that it is hard for me to believe there won't been appeal. with that said i have always leaned towards the side that while judge richard berman has been hard on the nfl for their way of going about this investigation, i've always believed that he has done that with the idea in mind of trying to get a settlement. at the end of the day he still does not want to over rule this

arbitrato arbitrator's decision. i still have a sense he could go in favor of the nfl in this. and i know a lot of people fall on the other side but i got the sense he was trying to force a settlement. >> is that because the collective bargaining agreement really does give the commissioner a fair amount of leeway when it comes to matters like this? and at the end of the day the judge really has to decide not whether this was fair to tom brady or fair to the patriots but whether goodell has the authority to rule the way that he does. >> the thing is there are five or six instances in which a judge can throw out an arbitrator's decision. now we have to get to the bottom of, did the nfl players association for tom brady make the case that they should throw out this decision by roger goodell based on potentially one of those factors coming into play. and that is what we're going to find out soon enough is whether the judge felt that way or not. either way we're look at an appeal here but if tom brady

e-mail will be made public. in just a few hours. that is more than the three previous releases combined. nbc justice correspondent pete williams joins us live. pete, what can we expect to see in this particular batch tonight? >> lots of e-mails. from 2009 and 2010 the state department says. they are all being release d. a website vice who asked for state department e-mails on a number of subjects. benghazi, enhanced interrogation and lots of other subjects. and after the case went to court a judge took the case over and has set the schedule. and now at the end of every month and if it's not done shortly, it will be by the end of january. the state department has to produce an additional number of e-mails. and they say they are going to meet the judge's requirement that at least a quarter of them be released by the end of this

month, today. they do say that 150 in the 7,000 pages that are coming out tonight, that 150 now will have some redaxs, some parts crossed out because they have now been deemed classified although the state department says as the time the e-mails were created they were not marked as classified. and we can't say now whether we'll be able to tell. you could tell at least what the general subject in some. and some you can't. >> pete williams for us down in d.c. on the big e-mail dump tonight. thank you sir. >> okay. >> meanwhile president obama heading to alaska, marking the first trip to the state's arctic region by a sitting president ever. at that state department conference tonight the president will try to rally for his

climate change agenda hofd his summit in paris. then he plans to tour the state's wildlife highlighting the immediate threat of global warming. ahead of the visit the president used executive power to rename mount mcenkinley as denali. more now from anchorage alaska. >> good afternoon. well the way president obama puts it is that alaska is on the front lines of climate change. and part of the reason he's going to spend three days here is frankly for the visuals to show exactly the impact of climate change. for example, he will be going out to a glacier. he's going to be taping a segment with bear grills about the effects of climate change on the glaciers. on the permafrost which is the frozen ground that so much of alaska sits on. on national resources. meeting with fishermen salmon

fishing. a huge part of the economy. not all the environmental groups are happy because just last week the president approved a drilling permit off the northwest coast for shell. something in the works since the bush administration. but they say it is hypocritical for him to come here and say he's going to be the president that addresses climate change and to do something which they say promotes fossil fuels which contribute to the global warming. and that is not the only controversy he's facing here. just yesterday the president announcing mount mcen kinly is going to be renamed denali which in fact alaskans have always known it as such. it was a point of contention for native americans who said it was just another example of imperialistic americans who decided to tell them what it was

going to be called. it was tall gold prospector who heard mckinley was running for president, he wasn't even president yet named it that. and it stuck. already the park programs are in the process of changing the names from mckinley to denali. >> a little history lesson for us from anchorage. thank you. and flood watches meanwhile in effect across much of florida and the southeast today thanks to remnants of the hurricane erika. you are looking at the foot frj charleston south carolina. the city of charleston saw its second wettest water day ever. water rescues, road closures. this is charleston, south carolina. all of this coming after erika wreaked havoc in the caribbean last week. killing at least 20 on the tiny island of dominica. kerry, what's the scene like

there in clearwater. >> i've moved little further south now. down in desoto in arcadia. and that guy on a paddle board is not uncommon sights in florida except he's on a street. the real problem is erika brought all the tropical moisture and the ground is really saturated in this area. from tampa bay south they have had record, record rains in the last two months. 27.5 inches of rain. you have to back to 1890 for more than that. the ground is already saturated and now you have to tropical moisture coming through. and some roads are flooding. the real concern is that it is going to rain some more. and if it rains more, the rain will not soak into the earth and we could see more flooding and maybe wider spread flooding. further north in pasco county the authorities have set up pumps where they are trying to pump out the rising water levels. and a lot of residents along the west coast have made sandbags

in the nas face of a national crisis officials have scheduled talks for lather this month. as thousands of refugee syria and of cour africa and other countries are rushing into the europe before hungary finishes their fence stretching across the border. richard engel had more now from the hungarian boarder. >> the mess exodus continues. thousands of desperate migrates from syria, iraq and afghanistan are seeking refuge in europe. in serbia we met that man from a syrian city devastated by the war. >> all killing. war. >> a pharmacist, his shop was destroyed in an air strike.

he left home two weeks ago and is now trying to get into hungary, a member of the european union. but it could be his biggest challenge yet. europe's borders have largely been reduced to reminders of a different era. the migration crisis is changing that. >> hungary was the first country to start to tear down the iran curtain. now a quarter century later, it is taking the most extreme measures in europe to put up raiser wire border fences again. >> hungary is building a fence along its entire border. when finished it will be 12 feet high and a hundred miles long. so the migrants are in a hurry to cross while they can. for now hungarian police seem happy to pick up those who are willing to cooperate, load them on to buses and encourage them to move onto the next country. the locals are watching all of this with great concern.

is it us? is it the media. >> where he have a lot of people in underwater cameras and devices and phones and that allows us to see these activities where we never used to. >> so it is the proliferation of camera that is given us the impression that sharks are everywhere. >> well i think that we are also seeing some amazing things. obviously the attack, although very sad were early this year in north carolina and south carolina. this is probably because the ocean temperature was a little bit warmer from a mild winter. and we're also seeing the return of great white sharks up in new england which is catching everybody's attention certainly. >> what effect is el nino having on this? >> well el nino is primarily looking in the west coast. so you can see in different weather events a change in the way the bait fish behave. bait fish can use waters closer to shore which also brings the predators closer at the same time. >> i want to show footage here of -- this has been making the

rounds for the past week or so on the internet. this is that great white leaping out of water to catch a seal off of the coast of cape cod. amazing video there. >> it really is. one of the first times this has been documented in new england. and we can credit that to saving the seals in the area has brought back the predators. >> is it reasonable to expect that forever now we're going to be treating every shark attack like it is a big deal? >> i think we need to put it all in perspective. around the globe, maybe five or six shark bites per year are fatal. and typically only about 80 to 85 bites a year globally. compare that to the 73 million sharks we kill every year and it is clear to see who should be afraid of who. >> and good to know that the woman out in california is expected to be okay. andy, thank you sir. >> thank you. >> that is going to do it for the 4:00 hour.
